		<section id="H85BA49536A184F65A3047C48BE7713F7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small-Scale Hydropower Enhancement Act
			 of 2011</short-title></quote>.</text>
		</section><section id="HE6595DB3504A4F0389CF8729F03A2F65"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HF6E2FB0D76FB42CD9588BDBDD9B345B6"><enum>(1)</enum><header>Conduit</header><text>The
			 term <term>conduit</term> means any tunnel, canal, pipeline, aqueduct, flume,
			 ditch, or similar manmade water conveyance that is operated for the
			 distribution of water for agricultural, municipal, or industrial consumption
			 and not primarily for the generation of electricity.</text>
			</paragraph><paragraph id="HCD2BCAC560694DF9A9AE43DA621AADAE"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="H37F1F11D704549628A0352266A772687"><enum>3.</enum><header><editorial></editorial>Applicability
			 of law</header><text display-inline="no-display-inline">Notwithstanding any
			 other provision of law, a hydroelectric project that uses only a non-federally
			 owned conduit to generate electric power that does not exceed 1.5 megawatts and
			 that, on or before the date of enactment of this Act, is not licensed under, or
			 exempted from the license requirements contained in, part I of the Federal
			 Power Act (16 U.S.C. 792 et seq.) shall not be required to be licensed under
			 part I of such Act.</text>
		</section><section id="H9B0AAED447674811ABD839FF25BED3B0"><enum>4.</enum><header>Inclusion of
			 certain facilities in report and study</header><text display-inline="no-display-inline">The Secretary shall—</text>
			<paragraph id="H91732749ECB7477ABDDAC7E63344A5B8"><enum>(1)</enum><text>not later than 6
			 months after the date of enactment of this Act, revise and update the study and
			 report required under section 1834 of the Energy Policy Act of 2005 (Public Law
			 109–58) to include facilities that would result in less than 1 megawatt of
			 capacity;</text>
			</paragraph><paragraph id="HF7CD2DE0333D4CCAAF4BBC96D1C34B52"><enum>(2)</enum><text>to the maximum
			 extent practicable, consult with non-Federal and noncontracting interests in
			 implementing this section; and</text>
			</paragraph><paragraph id="H9E4636F2DE764C2EB284BF708D450EAC"><enum>(3)</enum><text>implement this
			 section on a nonreimbursable basis.</text>
