<subsection commented="no" display-inline="no-display-inline" id="HA4055A1DEDD648A2A81051E8AB07B153"><enum>(a)</enum><header display-inline="yes-display-inline">Specifications of amounts and personnel levels</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated under section 101 and the authorized personnel levels (expressed as full-time equivalent positions) as of September 30, 2011, for the conduct of the intelligence activities of the elements listed in paragraphs (1) through (16) of section 101, are those specified in the classified Schedule of Authorizations prepared to accompany the bill H.R. 754 of the One Hundred Twelfth Congress.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H2061494F377E4A0A8B68F73F0ECD3011"><enum>(b)</enum><header display-inline="yes-display-inline">Availability of classified Schedule of Authorizations</header><text display-inline="yes-display-inline">The classified Schedule of Authorizations referred to in subsection (a) shall be made available to the Committee on Appropriations of the Senate, the Committee on Appropriations of the House of Representatives, and to the President. The President shall provide for suitable distribution of the Schedule, or of appropriate portions of the Schedule, within the executive branch.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H6F433E6BED0445A9A1147AAD023B23A3" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Intelligence Community Management Account</header> 
<subsection commented="no" display-inline="no-display-inline" id="H7D8F566435AF4F999ACCAF8156F24036"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Intelligence Community Management Account of the Director of National Intelligence for fiscal year 2011 the sum of $660,732,000. Within such amount, funds identified in the classified Schedule of Authorizations referred to in section 102(a) for advanced research and development shall remain available until September 30, 2012.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H33ABA63FAD3A48C39FDBB6CAFDEFCE3A"><enum>(b)</enum><header display-inline="yes-display-inline">Authorized personnel levels</header><text display-inline="yes-display-inline">The elements within the Intelligence Community Management Account of the Director of National Intelligence are authorized 787 full-time equivalent personnel as of September 30, 2011. Personnel serving in such elements may be permanent employees of the Office of the Director of National Intelligence or personnel detailed from other elements of the United States Government.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H9DB5C462F58E4AFBBD42363262A5644F"><enum>(c)</enum><header display-inline="yes-display-inline">Classified authorizations</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HF083BAD26F8F4348866F9B91E73FD3E7"><enum>(1)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts authorized to be appropriated for the Intelligence Community Management Account by subsection (a), there are authorized to be appropriated for the Community Management Account for fiscal year 2011 such additional amounts as are specified in the classified Schedule of Authorizations referred to in section 102(a). Such additional amounts made available for advanced research and development shall remain available until September 30, 2012.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H4EEEDCC1673F43E58AAFA2192E81CD31"><enum>(2)</enum><header display-inline="yes-display-inline">Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by subsection (b) for elements of the Intelligence Community Management Account as of September 30, 2011, there are authorized such full-time equivalent personnel for the Community Management Account as of that date as are specified in the classified Schedule of Authorizations referred to in section 102(a).</text></paragraph></subsection></section></title> 
<title commented="no" id="HED641E4FABC04404B4CC0A6BC9048BFC" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">CENTRAL INTELLIGENCE AGENCY RETIREMENT AND DISABILITY SYSTEM</header> 
<section commented="no" display-inline="no-display-inline" id="H4A78303234B24842ABC57111715ED758" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and Disability Fund for fiscal year 2011 the sum of $292,000,000.</text></section></title> 
<title commented="no" id="H22C6B99440CE4AE7A56F9BAF66562CCC" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">GENERAL INTELLIGENCE COMMUNITY MATTERS</header> 
<section commented="no" display-inline="no-display-inline" id="H7129BA73B69D4BA583E90C5069499E35" section-type="subsequent-section"><enum>301.</enum><header>Restriction on conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this Act shall not be deemed to constitute authority for the conduct of any intelligence activity which is not otherwise authorized by the Constitution or the laws of the United States.</text></section> 
<section id="H58B417822832490987A5C799C6FD6670" display-inline="no-display-inline"><enum>302.</enum><header>Increase in employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for salary, pay, retirement, and other benefits for Federal employees may be increased by such additional or supplemental amounts as may be necessary for increases in such compensation or benefits authorized by law.</text></section> 
<section commented="no" display-inline="no-display-inline" id="HD6930852D3734257851A0A29B3CB075A" section-type="subsequent-section"><enum>303.</enum><header>Non-reimbursable detail of other personnel</header> 
<subsection id="HFF3C9D8CC3FD47A09ACE55EF6F6AE4E2"><enum>(a)</enum><header>In general</header><text>Section 113A of the National Security Act of 1947 (50 U.S.C. 404h–1) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H8CD35E6BB2444BCB97A9AB02C31124CD" style="traditional"> 
<section id="HF42C7CF87A994C15B0DBB0AE0B26772D"><enum>113A.</enum><header>Non-reimbursable detail of other personnel</header><text display-inline="yes-display-inline">An officer or employee of the United States or member of the Armed Forces may be detailed to the staff of an element of the intelligence community funded through the National Intelligence Program from another element of the intelligence community or from another element of the United States Government on a non-reimbursable basis, as jointly agreed to by the heads of the receiving and detailing elements, for a period not to exceed two years. This section does not limit any other source of authority for reimbursable or non-reimbursable details.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD193544B7EA64C2FB11C804E38DFDD23"><enum>(b)</enum><header>Table of contents amendment</header><text>The table of contents in the first section of such Act is amended by striking the item relating to section 113A and inserting the following:</text>

<paragraph id="HDFD00D13909B4CABAF8A221801743BB8"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>subsection (b)</quote> and inserting <quote>subsections (b) and (c)</quote>;</text></paragraph> 
<paragraph id="HD3ED816A45B744EEBA76A3ED900F80C4"><enum>(2)</enum><text>by redesignating subsections (c) through (f) as subsections (d) through (g), respectively;</text></paragraph>

<paragraph id="HABD758339B09419FBAF7BB04FA3CE4A5" indent="up1"><enum>(2)</enum><text>A grant provided under paragraph (1) may be used to provide programs of study in the following educational disciplines:</text> 
<subparagraph id="H317BD5DE6DB3426692F9E2BDD501C26E"><enum>(A)</enum><text display-inline="yes-display-inline">Intermediate and advanced foreign languages deemed in the immediate interest of the intelligence community, including Farsi, Pashto, Middle Eastern, African, and South Asian dialects.</text></subparagraph> 
<subparagraph id="HB037837E0EBA4832996B1CDE6F178164"><enum>(B)</enum><text>Study abroad programs and cultural immersion programs.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H04C5F4EE88CC44DFA16F1FD6A68A0F9F"><enum>(4)</enum><text>in paragraph (g) (as so redesignated)—</text> 
<subparagraph id="H9C87CB8E2DA14541A733A2AA45FFF95D"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3);</text></subparagraph>

<subparagraph id="H10AF6744B81B48F2A40CB49160E5F539"><enum>(A)</enum><text>takes places outside the geographical boundaries of the United States;</text></subparagraph> 
<subparagraph id="H931ABB3CD176485982EF6A9E389083CF"><enum>(B)</enum><text>focuses on areas of the world that are critical to the national security interests of the United States and are generally underrepresented in study abroad programs at institutions of higher education, including Africa, Asia, Central and Eastern Europe, Eurasia, Latin America, and the Middle East; and</text></subparagraph> 
<subparagraph id="H780C7C9A187E4902A1B6430F22DCD945"><enum>(C)</enum><text>is a credit or noncredit program.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></title>

<section id="H5559D931764E44D6BE1C66EEABD447F7"><enum>401.</enum><header>Schedule and requirements for the National Counterintelligence Strategy</header><text display-inline="no-display-inline">Section 904(d)(2) of the Counterintelligence Enhancement Act of 2002 (50 U.S.C. 402c(d)(2)) is amended—</text> 
<paragraph id="HAC973B001C1643FF946271841572B845"><enum>(1)</enum><text>by striking <quote>Subject</quote> and inserting the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="HB92DFBDA64204671887E61EC3D1AD9BA"><enum>(2)</enum><text>by striking <quote>on an annual basis</quote>; and</text></paragraph> 
<paragraph id="H39D99373C3DA49F99B70F88F6E9F9259"><enum>(3)</enum><text>by adding at the end the following:</text>

<subparagraph id="HCE309C5AFC9146D2B8E98849147D90B4"><enum>(B)</enum><header>Revision and requirement</header><text>The National Counterintelligence Strategy shall be revised or updated at least once every three years and shall be aligned with the strategy and policies of the Director of National Intelligence.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HBE414B1F18A1455D993FAB891FA6204F"><enum>402.</enum><header>Insider threat detection program</header> 
<subsection id="H682D88AF70D2480F859BB70828E71178"><enum>(a)</enum><header>Initial operating capability</header><text>Not later than October 1, 2012, the Director of National Intelligence shall establish an initial operating capability for an effective automated insider threat detection program for the information resources in each element of the intelligence community in order to detect unauthorized access to, or use or transmission of, classified intelligence.</text></subsection> 
<subsection id="HC34AD350A3BD4B32B5A95EDA263B1606"><enum>(b)</enum><header>Full operating capability</header><text>Not later than October 1, 2013, the Director of National Intelligence shall ensure the program described in subsection (a) has reached full operating capability.</text></subsection> 
<subsection id="HC099535C68B1437599B51B24FA2DD844"><enum>(c)</enum><header>Report</header><text>Not later than December 1, 2011, the Director of National Intelligence shall submit to the congressional intelligence committees a report on the resources required to implement the insider threat detection program referred to in subsection (a) and any other issues related to such implementation the Director considers appropriate to include in the report.</text></subsection> 
<subsection id="HFAB3DF65BB68419B8837956505972480"><enum>(d)</enum><header>Information resources defined</header><text>In this section, the term <quote>information resources</quote> means networks, systems, workstations, servers, routers, applications, databases, websites, online collaboration environments, and any other information resources in an element of the intelligence community designated by the Director of National Intelligence.</text></subsection></section> 
<section id="HD760A66233B44080BE7063B5F5E1F793"><enum>403.</enum><header>Inspector General report recruitment and retention of racial and ethnic minorities</header> 
<subsection id="HD52A7B95A7B34BB5840CB727E5B4E06E"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Inspector General of the Intelligence Community shall submit to Congress a report on the degree to which racial and ethnic minorities in the United States are employed in professional positions in the intelligence community and barriers to the recruitment and retention of additional racial and ethnic minorities in such positions.</text></subsection> 
<subsection id="HBD9A87673017438EBD36B81950E2CDD7"><enum>(b)</enum><header>Form</header><text display-inline="yes-display-inline">The report required under subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text></subsection></section> 
<section id="HE10971F2CCFE47BCB5A6D53E95DC4669"><enum>404.</enum><header>Report on potential consolidation of elements of the intelligence community</header><text display-inline="no-display-inline">Not later than December 31, 2011, the Director of National Intelligence shall submit to congress a report containing any recommendations the Director considers appropriate for consolidating elements of the intelligence community.</text></section></subtitle> 
<subtitle id="H258F19EDA88B4E628654A3CE5E3E0203"><enum>B</enum><header>Other Elements</header> 
<section commented="no" display-inline="no-display-inline" id="HD2514F2A2A724F3F9D2C537B19E0E27F" section-type="subsequent-section"><enum>411.</enum><header display-inline="yes-display-inline">Defense Intelligence Agency counterintelligence and expenditures</header><text display-inline="no-display-inline">Section 105 of the National Security Act of 1947 (50 U.S.C. 403–5) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HC67C3A30EBA34980862231973C0D2DE7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(5), by inserting <quote>and counterintelligence</quote> after <quote>human intelligence</quote>;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2BFBA61B96BB49DB97E31B11366B3346"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (c) as subsection (d); and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6200042E519640458B27D1AFA00EA11B"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="H4E8DBA6D8AAE4C59B83582EDA0969D2B"><enum>(c)</enum><header display-inline="yes-display-inline">Expenditure of funds by the Defense Intelligence Agency</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H2891AB8A97644AF1B423E558B6376020"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3), the Director of the Defense Intelligence Agency may expend amounts made available to the Director under the National Intelligence Program for human intelligence and counterintelligence activities for objects of a confidential, extraordinary, or emergency nature, without regard to the provisions of law or regulation relating to the expenditure of Government funds.</text></paragraph> 
<paragraph id="H4E7A31208DC646F8BF6F4DA7FFE19CE3" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The Director of the Defense Intelligence Agency may not expend more than five percent of the amounts made available to the Director under the National Intelligence Program for human intelligence and counterintelligence activities for a fiscal year for objects of a confidential, extraordinary, or emergency nature in accordance with paragraph (1) during such fiscal year unless—</text> 
<subparagraph id="HD7423BDD8B7546E6B68ABF93C54F909C" commented="no"><enum>(A)</enum><text>the Director notifies the congressional intelligence committees of the intent to expend the amounts; and</text></subparagraph> 
<subparagraph id="H7CBAB17C4A2A438DA53EB8AC0D1FA0AC" commented="no"><enum>(B)</enum><text>30 days have elapsed from the date on which the Director notifies the congressional intelligence committees in accordance with subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HC721CA06F6E74162AE6BBC91B22CB562" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">For each expenditure referred to in paragraph (1), the Director shall certify that such expenditure was made for an object of a confidential, extraordinary, or emergency nature.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H52FAAEDF4C6B4DA59312A1EAAEFAE5A9" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Not later than December 31 of each year, the Director of the Defense Intelligence Agency shall submit to the congressional intelligence committees a report on any expenditures made during the preceding fiscal year in accordance with paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </subtitle></title> 
<title id="H5FA29ADFA6E547FB981A757E5D404D2B"><enum>V</enum><header>Other matters</header> 
<section id="H0A24C2C4B86A4C6CA9494E4A3C7B8074"><enum>501.</enum><header>Sense of Congress regarding the priority of railway transportation security</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H332FDD49A6D8462E9D8C40D65D1A3C73"><enum>(1)</enum><text>railway transportation (including subway transit) should be prioritized in the development of transportation security plans by the intelligence community; and</text></paragraph> 
<paragraph id="HD310FAF20DE2402BBF0F39D2217EB557"><enum>(2)</enum><text display-inline="yes-display-inline">railway transportation security (including subway transit security) should be included in transportation security budgets of the intelligence community.</text></paragraph></section></title>

<section id="HE28F98E5A80B40BDAC4369A7B8B816C6"><enum>601.</enum><header>Honoring the members of the intelligence community for their role in the mission that killed Osama bin Laden on May 1, 2011</header><text display-inline="no-display-inline">Congress—</text> 
<paragraph id="H89DE3589F80646E382AE493F8C3683DF"><enum>(1)</enum><text>commends the men and women of the intelligence community for the tremendous commitment, perseverance, professionalism, and sacrifice they displayed in bringing Osama bin Laden to justice;</text></paragraph>
