		<section id="HD5528147D4AD44B8AF4B733ACFF210C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Recalcitrant Cancer Research Act of
			 2012</short-title></quote>.</text>
		</section><section id="HD29187D91E3C4816BD2E51E99C9CD19C"><enum>2.</enum><header>Scientific
			 framework for recalcitrant cancers</header><text display-inline="no-display-inline">Subpart 1 of part C of title IV of the
			 Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/285">42 U.S.C. 285 et seq.</external-xref>) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HE644C19810AA48269AAA794B1BB4F0A0" style="OLC">
				<section id="H9B2ECD2C059247EEB610CAB826640BC1"><enum>417G.</enum><header>Scientific
				framework for recalcitrant cancers</header>
					<subsection id="HF8EE744B20CE4584B9F8970313E74DAC"><enum>(a)</enum><header>Development of
				scientific framework</header>
						<paragraph id="H65382B9B9D224907A902F6E8F8E8A5B1"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">For each recalcitrant
				cancer identified under
				<internal-xref idref="H55A2BB6AACBE4E138487D1C4F0FD760E" legis-path="2.(b)">subsection (b)</internal-xref>, the Director of the
				Institute shall develop (in accordance with subsection (c)) a scientific
				framework for the conduct or support of research on such cancer.</text>
						</paragraph><paragraph id="HBE289878886B475B842448090B5E7F08"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The scientific framework with respect to a
				recalcitrant cancer shall include the following:</text>
							<subparagraph id="HA87D6B13E6DB463395D82140200D2713"><enum>(A)</enum><header>Current
				status</header>
								<clause id="H62DAF925ECD74DC09736AEF4E272016F"><enum>(i)</enum><header>Review of
				literature</header><text display-inline="yes-display-inline">A summary of
				findings from the current literature in the areas of—</text>
									<subclause id="H57A57C59C48F4D739B6A937BE5292B56"><enum>(I)</enum><text>the prevention,
				diagnosis, and treatment of such cancer;</text>
									</subclause><subclause id="HC93D4F52BBF94459BC5C13188A5D9D3C"><enum>(II)</enum><text display-inline="yes-display-inline">the fundamental biologic processes that
				regulate such cancer (including similarities and differences of such processes
				from the biological processes that regulate other cancers); and</text>
									</subclause><subclause id="HEAB14F0AA46D47319606C0B5078B1ECC"><enum>(III)</enum><text>the epidemiology
				of such cancer.</text>
									</subclause></clause><clause id="HDD2B60D552C549D58BB791F242323339"><enum>(ii)</enum><header>Scientific
				advances</header><text>The identification of relevant emerging scientific areas
				and promising scientific advances in basic, translational, and clinical science
				relating to the areas described in subclauses (I) and (II) of
				<internal-xref idref="H62DAF925ECD74DC09736AEF4E272016F" legis-path="2.(a)(2)(A)(i)">clause (i)</internal-xref>.</text>
								</clause><clause id="HCAB6AEC8C87242B188761D42349FDCB3"><enum>(iii)</enum><header>Researchers</header><text>A
				description of the availability of qualified individuals to conduct scientific
				research in the areas described in
				<internal-xref idref="H62DAF925ECD74DC09736AEF4E272016F" legis-path="2.(a)(2)(A)(i)">clause (i)</internal-xref>.</text>
								</clause><clause id="HD5AD6CDA601347DE845EA304BF33B376"><enum>(iv)</enum><header>Coordinated
				research initiatives</header><text display-inline="yes-display-inline">The
				identification of the types of initiatives and partnerships for the
				coordination of intramural and extramural research of the Institute in the
				areas described in clause (i) with research of the relevant national research
				institutes, Federal agencies, and non-Federal public and private entities in
				such areas.</text>
								</clause><clause id="H93BAF6373B994730A37B04CF2B1A3DCD"><enum>(v)</enum><header>Research
				resources</header><text display-inline="yes-display-inline">The identification
				of public and private resources, such as patient registries and tissue banks,
				that are available to facilitate research relating to each of the areas
				described in
				<internal-xref idref="H62DAF925ECD74DC09736AEF4E272016F" legis-path="2.(a)(2)(A)(i)">clause (i)</internal-xref>.</text>
								</clause></subparagraph><subparagraph id="HDC35ADC2BA104938BEA4779AF51FB3C4"><enum>(B)</enum><header>Identification
				of research questions</header><text display-inline="yes-display-inline">The
				identification of research questions relating to basic, translational, and
				clinical science in the areas described in subclauses (I) and (II) of
				<internal-xref idref="H62DAF925ECD74DC09736AEF4E272016F" legis-path="2.(a)(2)(A)(i)">subparagraph (A)(i)</internal-xref> that have not
				been adequately addressed with respect to such recalcitrant cancer.</text>
							</subparagraph><subparagraph id="H0B6BD71CA67E4B14BFDC9B7A16B1ACA4"><enum>(C)</enum><header>Recommendations</header><text display-inline="yes-display-inline">Recommendations for appropriate actions
				that should be taken to advance research in the areas described in
				<internal-xref idref="H62DAF925ECD74DC09736AEF4E272016F" legis-path="2.(a)(2)(A)(i)">subparagraph (A)(i)</internal-xref> and to address
				the research questions identified in
				<internal-xref idref="HDC35ADC2BA104938BEA4779AF51FB3C4" legis-path="2.(a)(2)(B)">subparagraph (B)</internal-xref>, as well as for
				appropriate benchmarks to measure progress on achieving such actions, including
				the following:</text>
								<clause id="HA433C0D06A614CE495F63F9124AFA4C7"><enum>(i)</enum><header>Researchers</header><text display-inline="yes-display-inline">Ensuring adequate availability of qualified
				individuals described in
				<internal-xref idref="HCAB6AEC8C87242B188761D42349FDCB3" legis-path="2.(a)(2)(A)(iii)">subparagraph (A)(iii)</internal-xref>.</text>
								</clause><clause id="H86EC4C3A4E43450ABB73A2EE70C17678"><enum>(ii)</enum><header>Coordinated
				research initiatives</header><text display-inline="yes-display-inline">Promoting and developing initiatives and
				partnerships described in
				<internal-xref idref="HD5AD6CDA601347DE845EA304BF33B376" legis-path="2.(a)(2)(A)(iv)">subparagraph (A)(iv)</internal-xref>.</text>
								</clause><clause id="HC06EE3CA63A4439598FA18D72AC6CCF1"><enum>(iii)</enum><header>Research
				resources</header><text>Developing additional public and private resources
				described in
				<internal-xref idref="H93BAF6373B994730A37B04CF2B1A3DCD" legis-path="2.(a)(2)(A)(v)">subparagraph (A)(v)</internal-xref> and
				strengthening existing resources.</text>
								</clause></subparagraph></paragraph><paragraph id="HD0BF619E60E94D0396E26FD073487A9D"><enum>(3)</enum><header>Timing</header>
							<subparagraph id="HAF35DE1847C7448E8B7DB79F3B638732"><enum>(A)</enum><header>Initial
				development and subsequent update</header><text>For each recalcitrant cancer
				identified under
				<internal-xref idref="H1B1D59E30B7C4B378834A120650038EA" legis-path="2.(b)(1)">subsection (b)(1)</internal-xref>, the Director of the
				Institute shall—</text>
								<clause id="H37B829274FD1496FA2ECD5EEFDF16B65"><enum>(i)</enum><text>develop a
				scientific framework under this subsection not later than 18 months after the
				date of the enactment of this section; and</text>
								</clause><clause id="H46B12FC54C984BFA97D4DCD734EFE45F"><enum>(ii)</enum><text>review and update
				the scientific framework not later than 5 years after its initial
				development.</text>
								</clause></subparagraph><subparagraph commented="no" id="HEB06C14FFBC34840B227BE9CC33968F4"><enum>(B)</enum><header>Other
				updates</header><text>The Director of the Institute may review and update each
				scientific framework developed under this subsection as necessary.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H26486575BBD442F38863076C9D5CAB23"><enum>(4)</enum><header>Public
				notice</header><text display-inline="yes-display-inline">With respect to each
				scientific framework developed under subsection (a), not later than 30 days
				after the date of completion of the framework, the Director of the Institute
				shall—</text>
							<subparagraph commented="no" id="HD8DF462AF55C4FBCAB7C03F5260EDF00"><enum>(A)</enum><text display-inline="yes-display-inline">submit such framework to the Committee on
				Energy and Commerce and Committee on Appropriations of the House of
				Representatives, and the Committee on Health, Education, Labor, and Pensions
				and Committee on Appropriations of the Senate; and</text>
							</subparagraph><subparagraph commented="no" id="HC2D50D1D9F3D4ADEACE2F0557C8F271E"><enum>(B)</enum><text>make such
				framework publically available on the Internet website of the Department of
				Health and Human Services.</text>
							</subparagraph></paragraph></subsection><subsection id="H55A2BB6AACBE4E138487D1C4F0FD760E"><enum>(b)</enum><header>Identification
				of recalcitrant cancer</header>
						<paragraph id="H1B1D59E30B7C4B378834A120650038EA"><enum>(1)</enum><header>In
				general</header><text>Not later than 6 months after the date of the enactment
				of this section, the Director of the Institute shall identify two or more
				recalcitrant cancers that each—</text>
							<subparagraph id="HC1DDB25BA9954B41AF266D6D2BEF32D0"><enum>(A)</enum><text>have a 5-year
				relative survival rate of less than 20 percent; and</text>
							</subparagraph><subparagraph id="H72E31E29FDA842FABE898018604F6361"><enum>(B)</enum><text>are estimated to
				cause the death of at least 30,000 individuals in the United States per
				year.</text>
							</subparagraph></paragraph><paragraph id="HFC48F5FE63174E1EB0FDFE36A8B69B80"><enum>(2)</enum><header>Additional
				cancers</header><text display-inline="yes-display-inline">The Director of the
				Institute may, at any time, identify other recalcitrant cancers for purposes of
				this section. In identifying a recalcitrant cancer pursuant to the previous
				sentence, the Director may consider additional metrics of progress (such as
				incidence and mortality rates) against such type of cancer.</text>
						</paragraph></subsection><subsection id="H73B0290075404E42BB0F7CCDEEBF6DDB"><enum>(c)</enum><header>Working
				groups</header><text>For each recalcitrant cancer identified under subsection
				(b), the Director of the Institute shall convene a working group comprised of
				representatives of appropriate Federal agencies and other non-Federal entities
				to provide expertise on, and assist in developing, a scientific framework under
				subsection (a). The Director of the Institute (or the Director’s designee)
				shall participate in the meetings of each such working group.</text>
					</subsection><subsection id="H19A17E57E2734C8685E76AB96B1AF487"><enum>(d)</enum><header>Reporting</header>
						<paragraph id="HC9F4354DE2BA4415A9030A8A8D04EA9E"><enum>(1)</enum><header>Biennial
				reports</header><text display-inline="yes-display-inline">The Director of NIH
				shall ensure that each biennial report under section 403 includes information
				on actions undertaken to carry out each scientific framework developed under
				subsection (a) with respect to a recalcitrant cancer, including the
				following:</text>
							<subparagraph id="H1A6A93AFB6434B54B06EC56389C87B83"><enum>(A)</enum><text display-inline="yes-display-inline">Information on research grants awarded by
				the National Institutes of Health for research relating to such cancer.</text>
							</subparagraph><subparagraph id="H1B9D222A3D0C48C58D01A330A26FD6D3"><enum>(B)</enum><text display-inline="yes-display-inline">An assessment of the progress made in
				improving outcomes (including relative survival rates) for individuals
				diagnosed with such cancer.</text>
							</subparagraph><subparagraph id="H41A5535F0CFC49498BA8CA048B248787"><enum>(C)</enum><text>An update on
				activities pertaining to such cancer under the authority of section
				413(b)(7).</text>
							</subparagraph></paragraph><paragraph id="H55FB061902444463B10F5E2820D5C40B"><enum>(2)</enum><header>Additional
				one-time report for certain frameworks</header><text>For each recalcitrant
				cancer identified under subsection (b)(1), the Director of the Institute shall,
				not later than 6 years after the initial development of a scientific framework
				under subsection (a), submit a report to the Congress on the effectiveness of
				the framework (including the update required by subsection (a)(3)(A)(ii)) in
				improving the prevention, detection, diagnosis, and treatment of such
				cancer.</text>
						</paragraph></subsection><subsection id="HE569120B32A6434DBF15A06AF6AA6062"><enum>(e)</enum><header>Recommendations
				for exception funding</header><text display-inline="yes-display-inline">The
				Director of the Institute shall consider each relevant scientific framework
				developed under subsection (a) when making recommendations for exception
				funding for grant applications.</text>
					</subsection><subsection id="H6148559EC34F47BC860D23D9A7604583"><enum>(f)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term
				<term>recalcitrant cancer</term> means a cancer for which the five-year
				relative survival rate is below 50
				percent.</text>
