		<official-title>To amend the Illegal Immigration Reform and Immigrant
		  Responsibility Act of 1996 (8 U.S.C. 1324a note) to make the E-Verify Program
		  permanent and mandatory, and to provide for certain changes to procedures for

		<section id="HF6CCF928BA954FE386853F2A34AA0AC2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>E-Verify Modernization Act of
			 2011</short-title></quote>.</text>
		</section><section id="HCCD42468A5C74547BCA5CDE6E51324B1"><enum>2.</enum><header>E-verify made
			 permanent and mandatory</header>
			<subsection id="HD658276471F340D289BDDE474A5A73BF"><enum>(a)</enum><header>Made
			 permanent</header><text display-inline="yes-display-inline">Section 401(b) of
			 the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8
			 U.S.C. 1324a note) is amended by adding before the period at the end of the
			 last sentence the following: <quote>, except that the E-Verify Program
			 described in section 403(a) shall be a permanent program</quote>.</text>
			</subsection><subsection id="H41ABB3F3522A46ABA1C9C1DCB5B7432B"><enum>(b)</enum><header>Made
			 mandatory</header><text display-inline="yes-display-inline">Section 402 of such
			 Act is amended—</text>
				<paragraph id="HCE899E241A8E48D1A4D302B8ECCD777B"><enum>(1)</enum><text>in subsection (a),
			 by inserting after <quote>Except as specifically provided in subsection
			 (e)</quote> the following: <quote>or subsection (g)</quote>; and</text>
				</paragraph><paragraph id="H411D8076CBB64A84A55D67B054EC2BE9"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF5AF127110FF4A68BE6457EB31A82E34" style="OLC">
						<subsection id="HE8617740506E4E8296125354C5C65AF0"><enum>(g)</enum><header>Mandatory
				participation in the E-Verify Program</header><text display-inline="yes-display-inline">Not later than 60 days after the date of
				enactment of the E-Verify Modernization Act of 2011, every person or other
				entity that hires one or more individuals for employment in the United States
				shall elect to participate in the E -Verify program described in section
				403(a), and shall comply with the terms and conditions of such an election,
				including by verifying through the E-Verify program that each such individual
				is authorized to work in the United
				States.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H493DD412816A4C80ABF371AAE04BF72E"><enum>3.</enum><header>Procedures for
			 participants</header><text display-inline="no-display-inline">Section 403 of
			 the Illegal Immigration Reform and Immigrant Responsibility Act of 1996
			 (division C of Public Law 104–208; 8 U.S.C. 1324a note) is amended—</text>
			<paragraph id="H00D9102745714831959644920AED2594"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(3)(A), by adding at the
			 end the following: <quote>The person or other entity may wait for confirmation
			 of the individual's identity and work eligibility before beginning to pay or
			 train the individual.</quote>;</text>
			</paragraph><paragraph id="H6FD4D8F38B9B41EE91D9DCA4D444DEEF"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)(3), by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H55D50E60607F40EB99DB44193296CAF6" style="OLC">
					<subparagraph id="H90791724AA234998A7CD12F1431808DD"><enum>(C)</enum><header>Current
				employees</header><text display-inline="yes-display-inline">Not later than 14
				business days after beginning to participate in the program, a person or other
				entity may use the program to verify the employment authorization of an
				employee hired prior to the participation in the program only if the person or
				other entity verifies the employment authorization of every employee hired
				prior to the participation in the
				program.</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H182AD355D5F64006A17D1A74762715F9"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (a)(4)(B)(iii), by inserting
			 after <quote>until a nonconfirmation becomes final</quote> the following:
			 <quote>and the individual exhausts any administrative or judicial review if the
			 individual initiates such review.</quote>.</text>
