					</section><subtitle id="HD566DDC3CD2F43BDB50D9198F0783147"><enum>A</enum><header>Retraining
		Veterans</header>
						<section id="H6635E2E0D5F34A6A8C2558105ED137E1"><enum>211.</enum><header>Veterans
		retraining assistance program</header>
							<subsection id="HE7B74C914E2649C5A4CEBF061CB721DD"><enum>(a)</enum><header>Program
		authorized</header>
								<paragraph id="HC114E71E16284E39BA51A8F1FE26E1FF"><enum>(1)</enum><header>In
		general</header><text>Not later than July 1, 2012, the Secretary of Veterans
		Affairs shall, in collaboration with the Secretary of Labor, establish and
		commence a program of retraining assistance for eligible veterans.</text>
								</paragraph><paragraph id="HE3E43C92A6714D568E46442DB86ADFDD"><enum>(2)</enum><header>Number of
		eligible veterans</header><text display-inline="yes-display-inline">The number
		of unique eligible veterans who participate in the program established under
		paragraph (1) may not exceed—</text>
									<subparagraph id="H713BB7F9207B47A39F3FDF4E8611F9C0"><enum>(A)</enum><text>45,000 during
		fiscal year 2012; and</text>
									</subparagraph><subparagraph id="H4AF1136A9728493E80022066D8AF5C6C"><enum>(B)</enum><text>54,000 during the
		period beginning October 1, 2012, and ending March 31, 2014.</text>
									</subparagraph></paragraph></subsection><subsection id="H6842A237E2F64540A53441174C3FEE0E"><enum>(b)</enum><header>Retraining
		assistance</header><text display-inline="yes-display-inline">Except as provided
		by subsection (k), each veteran who participates in the program established
		under subsection (a)(1) shall be entitled to up to 12 months of retraining
		assistance provided by the Secretary of Veterans Affairs. Such retraining
		assistance may only be used by the veteran to pursue a program of education (as
		such term is defined in section 3452(b) of title 38, United States Code) for
		training, on a full-time basis, that—</text>
								<paragraph id="HAB94BA01BEDD43A7AFA4D2E99F79C14A"><enum>(1)</enum><text>is
		approved under chapter 36 of such title;</text>
								</paragraph><paragraph id="HB24DF9C98FA94FA2939A947B26ACC7BE"><enum>(2)</enum><text>is
		offered by a community college or technical school;</text>
								</paragraph><paragraph id="HA6FD84DBC69A49BFACFC769E77244F29"><enum>(3)</enum><text display-inline="yes-display-inline">leads to an associate degree or a
		certificate (or other similar evidence of the completion of the program of
		education or training);</text>
								</paragraph><paragraph id="HE46C4ED6FD9C4959871F9C71C005C677"><enum>(4)</enum><text>is
		designed to provide training for a high-demand occupation, as determined by the
		Commissioner of Labor Statistics; and</text>
								</paragraph><paragraph id="idB7D0E29855C94C198664CA9B0AA6FA22"><enum>(5)</enum><text>begins on or
		after July 1, 2012.</text>
								</paragraph></subsection><subsection id="HC236C3422C894DEF9D3DD07E6B976000"><enum>(c)</enum><header>Monthly
		certification</header><text display-inline="yes-display-inline">Each veteran
		who participates in the program established under subsection (a)(1) shall
		certify to the Secretary of Veterans Affairs the enrollment of the veteran in a
		program of education described in subsection (b) for each month in which the
		veteran participates in the program.</text>
							</subsection><subsection id="H213D5A559AFD4D8F903B52942940A44F"><enum>(d)</enum><header>Amount of
		assistance</header><text>The monthly amount of the retraining assistance
		payable under this section is the amount in effect under section 3015(a)(1) of
		title 38, United States Code.</text>
							</subsection><subsection id="H5E8898C9B7874E5F81D0218DA4707EBA"><enum>(e)</enum><header>Eligibility</header>
								<paragraph id="id540B42B466454523A7FB297395CDA19C"><enum>(1)</enum><header>In
		general</header><text>For purposes of this section, an eligible veteran is a
		veteran who—</text>
									<subparagraph id="H15BE115F4DE1442BBCAC712075CA57EC"><enum>(A)</enum><text>as
		of the date of the submittal of the application for assistance under this
		section, is at least 35 years of age but not more than 60 years of age;</text>
									</subparagraph><subparagraph id="H3BE25E71C2FD497292EF55D00A1FB4BD"><enum>(B)</enum><text>was last
		discharged from active duty service in the Armed Forces under conditions other
		than dishonorable;</text>
									</subparagraph><subparagraph id="idE66CC0FF96E147DC89451B715CC345E2"><enum>(C)</enum><text>as of the date of
		the submittal of the application for assistance under this section, is
		unemployed;</text>
									</subparagraph><subparagraph id="H055F16CD86634D8E89E96A2A45E25FA3"><enum>(D)</enum><text>as
		of the date of the submittal of the application for assistance under this
		section, is not eligible to receive educational assistance under chapter 30,
		31, 32, 33, or 35 of title 38, United States Code, or chapter 1606 or 1607 of
		title 10, United States Code;</text>
									</subparagraph><subparagraph id="id13B3FC58471E4C1FBB380387798A9FFF"><enum>(E)</enum><text>is not in receipt
		of compensation for a service-connected disability rated totally disabling by
		reason of unemployability;</text>
									</subparagraph><subparagraph commented="no" id="id8B4FF083427C417DAC322277CD216130"><enum>(F)</enum><text>was not and is
		not enrolled in any Federal or State job training program at any time during
		the 180-day period ending on the date of the submittal of the application for
		assistance under this section; and</text>
									</subparagraph><subparagraph id="HB1C9132022614DE29CD1E5D882A41AC9"><enum>(G)</enum><text>by
		not later than October 1, 2013, submits to the Secretary of Labor an
		application for assistance under this section containing such information and
		assurances as that Secretary may require.</text>
									</subparagraph></paragraph><paragraph id="id71BE0740919C4E12B47CE2DB4604265D"><enum>(2)</enum><header>Determination
		of eligibility</header>
									<subparagraph id="id1519C6ED7B754632867FD7519BB1E5B1"><enum>(A)</enum><header>Determination
		by Secretary of Labor</header>
										<clause id="idD42EFB869C554747BAD50139104C508F"><enum>(i)</enum><header>In
		general</header><text>For each application for assistance under this section
		received by the Secretary of Labor from an applicant, the Secretary of Labor
		shall determine whether the applicant is eligible for such assistance under
		subparagraphs (A), (C), (F), and (G) of paragraph (1).</text>
										</clause><clause id="id832B78F5E06847EAB697DCEFB046DC57"><enum>(ii)</enum><header>Referral to
		Secretary of Veterans Affairs</header><text>If the Secretary of Labor
		determines under clause (i) that an applicant is eligible for assistance under
		this section, the Secretary of Labor shall forward the application of such
		applicant to the Secretary of Veterans Affairs in accordance with the terms of
		the agreement required by subsection (h).</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA655A913BC0B4E7E90AEEADD2B0EDCCD"><enum>(B)</enum><header>Determination
		by Secretary of Veterans Affairs</header><text>For each application relating to
		an applicant received by the Secretary of Veterans Affairs under subparagraph
		(A)(ii), the Secretary of Veterans Affairs shall determine under subparagraphs
		(B), (D), and (E) of paragraph (1) whether such applicant is eligible for
		assistance under this section.</text>
									</subparagraph></paragraph></subsection><subsection id="id7170B1250A8F48CEBD2CDA3AC6C4DD77"><enum>(f)</enum><header>Employment
		assistance</header><text>For each veteran who participates in the program
		established under subsection (a)(1), the Secretary of Labor shall contact such
		veteran not later than 30 days after the date on which the veteran completes,
		or terminates participation in, such program to facilitate employment of such
		veteran and availability or provision of employment placement services to such
		veteran.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id7CDADDC0914047318DDA3A7F6B690A5C"><enum>(g)</enum><header>Charging of
		assistance against other entitlement</header><text>Assistance provided under
		this section shall be counted against the aggregate period for which section
		3695 of title 38, United States Code, limits the individual's receipt of
		educational assistance under laws administered by the Secretary of Veterans
		Affairs.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idA0B7978C9DAC40FF8EFA7E58680A1DB1"><enum>(h)</enum><header display-inline="yes-display-inline">Joint agreement</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idF9BFBDAA75D2433F9EC0F371514D9A41"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">The Secretary of
		Veterans Affairs and the Secretary of Labor shall enter into an agreement to
		carry out this section.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id264444977258443AB6178E827F088263"><enum>(2)</enum><header>Appeals
		process</header><text>The agreement required by paragraph (1) shall include
		establishment of a process for resolving disputes relating to and appeals of
		decisions of the Secretaries under subsection (e)(2).</text>
								</paragraph></subsection><subsection id="HD976C01589FF4338B16F7E050FC3E653"><enum>(i)</enum><header>Report</header>
								<paragraph id="idA75AE92FC4644879A5DB999B4478F82C"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">Not later than July
		1, 2014, the Secretary of Veterans Affairs shall, in collaboration with the
		Secretary of Labor, submit to the appropriate committees of Congress a report
		on the retraining assistance provided under this section.</text>
								</paragraph><paragraph id="id73082F5B276D4B33AB16BE9DE6E6E27A"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall
		include the following:</text>
									<subparagraph id="HE4F8D382C714481F95AC52292177CD7F"><enum>(A)</enum><text>The total number
		of—</text>
										<clause id="H7166AEB5504E4A5FA5F65927F8D6C1C6"><enum>(i)</enum><text>eligible
		veterans who participated; and</text>
										</clause><clause id="H60C0710DDE7D4E7F9C5661CE69718158"><enum>(ii)</enum><text display-inline="yes-display-inline">associates degrees or certificates awarded
		(or other similar evidence of the completion of the program of education or
		training earned).</text>
										</clause></subparagraph><subparagraph id="H81BB4D604F614C299CBD17040F03E243"><enum>(B)</enum><text>Data related to
		the employment status of eligible veterans who participated.</text>
									</subparagraph></paragraph></subsection><subsection id="H8C7D10DEE2AC4254843E946D66BB1F31"><enum>(j)</enum><header>Funding</header><text>Payments
		under this section shall be made from amounts appropriated to or otherwise made
		available to the Department of Veterans Affairs for the payment of readjustment
		benefits. Not more than $2,000,000 shall be made available from such amounts
		for information technology expenses (not including personnel costs) associated
		with the administration of the program established under subsection
		(a)(1).</text>
							</subsection><subsection id="HFF420589B241474ABA082D717FA4783E"><enum>(k)</enum><header>Termination of
		authority</header><text>The authority to make payments under this section shall
		terminate on March 31, 2014.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idCFC59F43E9644E2FA1B076FF7738416D"><enum>(l)</enum><header>Appropriate
		committees of Congress defined</header><text>In this section, the term
		<term>appropriate committees of Congress</term> means—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idA8D23187DC154C449FC380AD882D9D54"><enum>(1)</enum><text>the Committee on
		Veterans' Affairs and the Committee on Health, Education, Labor, and Pension of
		the Senate; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71C30763AEB84897A3609029EA287006"><enum>(2)</enum><text>the Committee on
		Veterans' Affairs and the Committee on Education and the Workforce of the House
		of Representatives.</text>
								</paragraph></subsection></section></subtitle><subtitle id="H4BA3E32A5BAB43549CBEF91D969EEC6D"><enum>B</enum><header>Improving the
		Transition Assistance Program</header>
						<section id="id9c385f77-60b9-48d7-a9d0-6f3bd4e8613f"><enum>221.</enum><header>Mandatory
		participation of members of the Armed Forces in the Transition Assistance
		Program of Department of Defense</header>
							<subsection id="id5b8e0ae3-2c5d-4567-9cdc-69e17166eed3"><enum>(a)</enum><header>In
		general</header><text display-inline="yes-display-inline">Subsection (c) of
		section 1144 of title 10, United States Code, is amended to read as
		follows:</text>
								<quoted-block display-inline="no-display-inline" id="id20817662C9BF4C7792130DE37F6F6AE5" style="OLC">
									<subsection id="idBACF966EF2F64F20B74BA9CB98EB4A26"><enum>(c)</enum><header>Participation</header><paragraph commented="no" display-inline="yes-display-inline" id="id55A292098BBA434CBE80B23ABC501458"><enum>(1)</enum><text>Except as provided in
		  paragraph (2), the Secretary of Defense and the Secretary of Homeland Security
		  shall require the participation in the program carried out under this section
		  of the members eligible for assistance under the program.</text>
										</paragraph><paragraph id="idE0404870BF4C4B9C859D1BEAA9052C96" indent="up1"><enum>(2)</enum><text>The Secretary of Defense and the
		  Secretary of Homeland Security may, under regulations such Secretaries shall
		  prescribe, waive the participation requirement of paragraph (1) with respect
		  to—</text>
											<subparagraph id="id31066428363B40FF8AF5482826328055"><enum>(A)</enum><text>such groups or classifications of
		  members as the Secretaries determine, after consultation with the Secretary of
		  Labor and the Secretary of Veterans Affairs, for whom participation is not and
		  would not be of assistance to such members based on the Secretaries'
		  articulable justification that there is extraordinarily high reason to believe
		  the exempted members are unlikely to face major readjustment, health care,
		  employment, or other challenges associated with transition to civilian life;
		  and</text>
											</subparagraph><subparagraph id="idDD8933018C174F7DB240CBE267ED82DD"><enum>(B)</enum><text>individual members possessing
		  specialized skills who, due to unavoidable circumstances, are needed to support
		  a unit's imminent
		  deployment.</text>
											</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id6e5e118b-31f8-4ec2-97c7-684389aa5107"><enum>(b)</enum><header>Required
		use of employment assistance, job training assistance, and other transitional
		services in preseparation counseling</header><text>Section 1142(a)(2) of such
		title is amended by striking <quote>may</quote> and inserting
		<quote>shall</quote>.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idE41B4410E8AE4B4D85C60333AB1E1FA9"><enum>(c)</enum><header>Effective
		date</header><text>The amendments made by subsections (a) and (b) shall take
		effect on the date that is 1 year after the date of the enactment of this
		Act.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="id20f7c657-9c1c-4bc6-b7a9-1f115f7a1085"><enum>222.</enum><header>Individualized
		assessment for members of the Armed Forces under transition assistance on
		equivalence between skills developed in military occupational specialties and
		qualifications required for civilian employment with the private
		sector</header>
							<subsection commented="no" display-inline="no-display-inline" id="ide5467d51-f6b9-40e8-9ae0-a6c1a4d35c93"><enum>(a)</enum><header>Study on
		equivalence required</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id3258649b-60c9-4aee-9447-cc84e33b274c"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">The Secretary of
		Labor shall, in consultation with the Secretary of Defense and the Secretary of
		Veterans Affairs, enter into a contract with a qualified organization to
		conduct a study to identify any equivalences between the skills developed by
		members of the Armed Forces through various military occupational specialties
		(MOS), successful completion of resident training courses, attaining various
		military ranks or rates, or other military experiences and the qualifications
		required for various positions of civilian employment in the private
		sector.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0bcd8de6-e977-4e66-ae10-91dc3cdbc788"><enum>(2)</enum><header>Cooperation
		of Federal agencies</header><text>The departments and agencies of the Federal
		Government, including the Office of Personnel Management, the General Services
		Administration, the Government Accountability Office, the Department of
		Education, and other appropriate departments and agencies, shall cooperate with
		the contractor under paragraph (1) to conduct the study required under that
		paragraph.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcf0e1d12-ab63-490b-a497-7abbf366ba5d"><enum>(3)</enum><header>Report</header><text>Upon
		completion of the study conducted under paragraph (1), the contractor under
		that paragraph shall submit to the Secretary of Defense, the Secretary of
		Veterans Affairs, and the Secretary of Labor a report setting forth the results
		of the study. The report shall include such information as the Secretaries
		shall specify in the contract under paragraph (1) for purposes of this
		section.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide39af9ad-f809-404a-afa3-790f78ed23d4"><enum>(4)</enum><header>Transmittal
		to Congress</header><text>The Secretary of Labor shall transmit to the
		appropriate committees of Congress the report submitted under paragraph (3),
		together with such comments on the report as the Secretary considers
		appropriate.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08D5A4B0B7FB4A9D918C42868A7155F8"><enum>(5)</enum><header>Appropriate
		committees of Congress defined</header><text>In this subsection, the term
		<term>appropriate committees of Congress</term> means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id1942C092BF3A47EA9C386EA6F6BC1CCF"><enum>(A)</enum><text>the Committee on
		Veterans' Affairs, the Committee on Armed Services, and the Committee on
		Health, Education, Labor, and Pension of the Senate; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD8E7810F0C494E789A83E22B65C1DE6A"><enum>(B)</enum><text>the Committee on
		Veterans' Affairs, the Committee on Armed Services, and the Committee on
		Education and the Workforce of the House of Representatives.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6C721AE44B07420F8A2ACA4C2A61C197"><enum>(b)</enum><header>Publication</header><text>The
		secretaries described in subsection (a)(1) shall ensure that the equivalences
		identified under subsection (a)(1) are—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id06AD946D5FFC4244889F9E82DB53C7ED"><enum>(1)</enum><text>made publicly
		available on an Internet website; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6A325AB80A494249A2DFD7D263E11AEE"><enum>(2)</enum><text>regularly updated
		to reflect the most recent findings of the secretaries with respect to such
		equivalences.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id755cdb9c-633a-402b-ac43-0a4845f4c538"><enum>(c)</enum><header>Individualized
		assessment of civilian positions available through military
		experiences</header><text>The Secretary of Defense shall ensure that each
		member of the Armed Forces who is participating in the Transition Assistance
		Program (TAP) of the Department of Defense receives, as part of such member's
		participation in that program, an individualized assessment of the various
		positions of civilian employment in the private sector for which such member
		may be qualified as a result of the skills developed by such member through
		various military occupational specialties (MOS), successful completion of
		resident training courses, attaining various military ranks or rates, or other
		military experiences. The assessment shall be performed using the results of
		the study conducted under subsection (a) and such other information as the
		Secretary of Defense, in consultation with the Secretary of Veterans Affairs
		and the Secretary of Labor, considers appropriate for that purpose.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id05427e23-a837-4aeb-9c34-3ebb13734c8d"><enum>(d)</enum><header>Further use
		in employment-related transition assistance</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id676f19be-446d-493f-abc9-efa45d96b20e"><enum>(1)</enum><header>Transmittal
		of assessment</header><text>The Secretary of Defense shall make the
		individualized assessment provided a member under subsection (a) available
		electronically to the Secretary of Veterans Affairs and the Secretary of
		Labor.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8b20ff64-bd7b-466e-a0bc-9a95102c8db6"><enum>(2)</enum><header>Use in
		assistance</header><text>The Secretary of Veterans Affairs and the Secretary of
		Labor may use an individualized assessment with respect to an individual under
		paragraph (1) for employment-related assistance in the transition from military
		service to civilian life provided the individual by such Secretary and to
		otherwise facilitate and enhance the transition of the individual from military
		service to civilian life.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB50EC5253CE44BD5828690708FAD35AA"><enum>(e)</enum><header>Effective
		date</header><text>This section shall take effect on the date that is one year
		after the date of the enactment of this Act.</text>
							</subsection></section><section id="H5B565D41C76D487B893B7B7044020856"><enum>223.</enum><header>Transition
		Assistance Program contracting</header>
							<subsection id="H25698545A92947638F76B5A086B520D7"><enum>(a)</enum><header>Transition
		Assistance Program contracting</header>
								<paragraph id="HED8E0E0A304641A9A2867261DD40ED2C"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">Section 4113 of title
		38, United States Code, is amended to read as follows:</text>
									<quoted-block display-inline="no-display-inline" id="H21A844F3FC6B48CFA83864ACF7C97633" style="USC">
										<section id="H7B8E66632F4F42039A8A58363C6FE2DF"><enum>4113.</enum><header>Transition
		  Assistance Program personnel</header>
											<subsection id="HB8A7E86E368F414B92C74D26EEAFF253"><enum>(a)</enum><header>Requirement to
		  Contract</header><text display-inline="yes-display-inline">In accordance with
		  section 1144 of title 10, the Secretary shall enter into a contract with an
		  appropriate private entity or entities to provide the functions described in
		  subsection (b) at all locations where the program described in such section is
		  carried out.</text>
											</subsection><subsection id="H7B369663358E4F368FEE20897CFF2710"><enum>(b)</enum><header>Functions</header><text display-inline="yes-display-inline">Contractors under subsection (a) shall
		  provide to members of the Armed Forces who are being separated from active duty
		  (and the spouses of such members) the services described in section 1144(a)(1)
		  of title 10, including the following:</text>
												<paragraph id="HC04678168055444DBFCF1E099C3863EB"><enum>(1)</enum><text>Counseling.</text>
												</paragraph><paragraph id="H39ACF740D8D34CC792286ADC0457ECA6"><enum>(2)</enum><text>Assistance in
		  identifying employment and training opportunities and help in obtaining such
		  employment and training.</text>
												</paragraph><paragraph id="id0B7541BBFDE147A8977A3C11466E152C"><enum>(3)</enum><text>Assessment of
		  academic preparation for enrollment in an institution of higher learning or
		  occupational training.</text>
												</paragraph><paragraph id="H9E33B913BE6D42C280F012F701096400"><enum>(4)</enum><text>Other related
		  information and services under such section.</text>
												</paragraph><paragraph id="HBFE0204673F64419A574FBB44B13B3DF"><enum>(5)</enum><text>Such other
		  services as the Secretary considers
		  appropriate.</text>
												</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph><paragraph id="HA859D6801F994A6FA4C1639861FFB0F0"><enum>(2)</enum><header>Clerical
		amendment</header><text display-inline="yes-display-inline">The table of
		sections at the beginning of chapter 41 of title 38, United States Code, is
		amended by striking the item relating to section 4113 and inserting the

		this Act.</text>
							</subsection></section><section id="idEAB6FF17D323401FAA5961CEE22158EC"><enum>224.</enum><header>Contracts with
		private entities to assist in carrying out Transition Assistance Program of
		Department of Defense</header><text display-inline="no-display-inline">Section
		1144(d) of title 10, United States Code, is amended—</text>
							<paragraph id="idC5BF464B6C974C579205CA447A9F5AC0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>public
		or private entities; and</quote> and inserting <quote>public
		entities;</quote>;</text>
							</paragraph><paragraph id="idA44BA4D68B1F4ED7AA421B949DDFDDF5"><enum>(2)</enum><text>by
		redesignating paragraph (6) as paragraph (7); and</text>
							</paragraph><paragraph id="id43412ED5611B4D83A728AA340EDECC6F"><enum>(3)</enum><text>by
		inserting after paragraph (5), the following new paragraph (6):</text>
								<quoted-block display-inline="no-display-inline" id="id83FB2C2403194B05920C122811CE002E" style="OLC">
									<paragraph id="IDa425f28fae944af68a3d20788eb120b4"><enum>(6)</enum><text>enter into
		  contracts with private entities, particularly with qualified private entities
		  that have experience with instructing members of the armed forces eligible for
		  assistance under the program carried out under this section on—</text>

		  culture, resume writing, career networking, and training on job search
		  technologies;</text>
										</subparagraph><subparagraph id="idB66B576600374669934C6C10ECE3D157"><enum>(B)</enum><text>academic
		  readiness and educational opportunities; or</text>
										</subparagraph><subparagraph id="idB2A83F5B0B6441E690AD061AE493513C"><enum>(C)</enum><text>other relevant
		  topics;
		  and</text>
										</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</paragraph></section><section commented="no" display-inline="no-display-inline" id="idEE4FD479EF55444CBF0C45967F3EDC02"><enum>225.</enum><header>Improved
		access to apprenticeship programs for members of the Armed Forces who are being
		separated from active duty or retired</header><text display-inline="no-display-inline">Section 1144 of title 10, United States
		Code, is amended by adding at the end the following new subsection:</text>
							<quoted-block display-inline="no-display-inline" id="idAC91582FE8B4496C9B1C951055E1B799" style="OLC">
								<subsection commented="no" display-inline="no-display-inline" id="id24346F67C71243689983EC81145C5F5E"><enum>(e)</enum><header>Participation
		  in apprenticeship programs</header><text>As part of the program carried out
		  under this section, the Secretary of Defense and the Secretary of Homeland
		  Security may permit a member of the armed forces eligible for assistance under
		  the program to participate in an apprenticeship program registered under the
		  Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship
		  Act</quote>; 50 Stat. 664, chapter 663; 29 U.S.C. 50 et seq.), or a
		  pre-apprenticeship program that provides credit toward a program registered
		  under such Act, that provides members of the armed forces with the education,
		  training, and services necessary to transition to meaningful employment that
		  leads to economic
		  self-sufficiency.</text>
								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</section><section id="H54FA15B9258C43CD83299C92ADE2615A"><enum>226.</enum><header>Comptroller
		General review</header><text display-inline="no-display-inline">Not later than
		two years after the date of the enactment of this Act, the Comptroller General
		of the United States shall conduct a review of the Transition Assistance
		Program (TAP) and submit to Congress a report on the results of the review and
		any recommendations of the Comptroller General for improving the
		program.</text>
						</section></subtitle><subtitle id="H6487CCBC24F94D0DAA255DE09EFFBAF1"><enum>C</enum><header>Improving the
		transition of veterans to civilian employment</header>
						<section id="id4338c3ac-2163-4b83-b874-5cf0c957628c"><enum>231.</enum><header>Two-year
		extension of authority of Secretary of Veterans Affairs to provide
		rehabilitation and vocational benefits to members of the Armed Forces with
		severe injuries or illnesses</header><text display-inline="no-display-inline">Section 1631(b)(2) of the Wounded Warrior
		Act (title XVI of Public Law 110–181; 10 U.S.C. 1071 note) is amended by
		striking <quote>December 31, 2012</quote> and inserting <quote>December 31,
		2014</quote>.</text>
						</section><section id="id00259a28-5d60-4351-832b-2b5e8bedf2d4"><enum>232.</enum><header>Expansion
		of authority of Secretary of Veterans Affairs to pay employers for providing
		on-job training to veterans who have not been rehabilitated to point of
		employability</header><text display-inline="no-display-inline">Section
		3116(b)(1) of title 38, United States Code, is amended by striking <quote>who
		have been rehabilitated to the point of employability</quote>.</text>
						</section><section id="idcd040597-4692-4a8d-9945-b97541a10970"><enum>233.</enum><header>Training
		and rehabilitation for veterans with service-connected disabilities who have
		exhausted rights to unemployment benefits under State law</header>
							<subsection id="idaba35b86-6621-4cf7-b7ae-07319466ccc8"><enum>(a)</enum><header>Entitlement
		to additional rehabilitation programs</header>
								<paragraph id="idfa73300f-dff8-474a-a845-1ea61f8264a6"><enum>(1)</enum><header>In
		general</header><text>Section 3102 of title 38, United States Code, is
		amended—</text>
									<subparagraph id="id79935f2a-d2eb-46bb-a72f-9b92f5e096a1"><enum>(A)</enum><text>in the matter

		  rehabilitation programs for persons who have exhausted rights to unemployment
		  benefits under State law</header><paragraph commented="no" display-inline="yes-display-inline" id="id24e25862-fea1-4fb6-a85a-8e513b0a06e6"><enum>(1)</enum><text>Except as provided
		  in paragraph (4), a person who has completed a rehabilitation program under
		  this chapter shall be entitled to an additional rehabilitation program under
		  the terms and conditions of this chapter if—</text>
													<subparagraph id="idee922b5b-316d-4191-a35c-5f1ac0fa46a0" indent="up1"><enum>(A)</enum><text>the person is described by paragraph
		  (1) or (2) of subsection (a); and</text>
													</subparagraph><subparagraph id="id2ec8ad80-2b57-4a2b-b358-85176337f3e0" indent="up1"><enum>(B)</enum><text>the person—</text>
														<clause id="id09666ed2-2c44-419a-9f69-814646ee65f3"><enum>(i)</enum><text>has exhausted all rights to regular
		  compensation under the State law or under Federal law with respect to a benefit
		  year;</text>
														</clause><clause id="id7cd58278-3d31-4e0e-a20a-101842be3582"><enum>(ii)</enum><text>has no rights to regular
		  compensation with respect to a week under such State or Federal law; and</text>
														</clause><clause id="id39ee2db9-4921-4bb0-b977-38578e29a97f"><enum>(iii)</enum><text>is not receiving compensation
		  with respect to such week under the unemployment compensation law of Canada;
		  and</text>
														</clause></subparagraph><subparagraph id="iddff9dc8c-726b-45ce-b681-51ac56ae2416" indent="up1"><enum>(C)</enum><text>begins such additional rehabilitation
		  program within six months of the date of such exhaustion.</text>
													</subparagraph></paragraph><paragraph id="id9b928207-ce3f-4f82-bc46-d436822e1371" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1)(B)(i),
		  a person shall be considered to have exhausted such person's rights to regular
		  compensation under a State law when—</text>
													<subparagraph id="id4277ddfc-a10d-46d4-ae3c-5f455597d79e"><enum>(A)</enum><text>no payments of regular compensation
		  can be made under such law because such person has received all regular
		  compensation available to such person based on employment or wages during such
		  person's base period; or</text>
													</subparagraph><subparagraph id="iddc878923-9225-4841-8a2c-08e92d6dc698"><enum>(B)</enum><text>such person's rights to such
		  compensation have been terminated by reason of the expiration of the benefit
		  year with respect to which such rights existed.</text>
													</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd09534b0-5233-4a0b-a2da-e0abfb7d6dc1" indent="up1"><enum>(3)</enum><text>In this subsection, the terms
		  <term>compensation</term>, <term>regular compensation</term>, <term>benefit
		  year</term>, <term>State</term>, <term>State law</term>, and <term>week</term>
		  have the respective meanings given such terms under section 205 of the
		  Federal-State Extended Unemployment Compensation Act of 1970 (26 U.S.C. 3304
		  note).</text>
												</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9013A0F34D584E25804F92899FD10648" indent="up1"><enum>(4)</enum><text>No person shall be entitled to an
		  additional rehabilitation program under paragraph (1) from whom the Secretary
		  receives an application therefor after March 31,
		  2014.</text>
												</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
									</subparagraph></paragraph><paragraph id="id44ecedd8-3d64-41a4-99fd-276d8ab64bae"><enum>(2)</enum><header>Duration of
		additional rehabilitation program</header><text>Section 3105(b) of such title
		is amended—</text>
									<subparagraph id="id49587063-1576-4e37-866e-b80c542d49e3"><enum>(A)</enum><text>by striking
		<quote>Except as provided in subsection (c) of this section,</quote> and
		inserting <quote>(1) Except as provided in paragraph (2) and in subsection
		(c),</quote>; and</text>
									</subparagraph><subparagraph id="ide297a49e-3e4c-4df4-9361-f793f27c56d4"><enum>(B)</enum><text>by adding at
		the end the following new paragraph:</text>
										<quoted-block display-inline="no-display-inline" id="id8651a4b4-b63e-4039-b560-73fa3336158f" style="OLC">
											<paragraph id="id507a33de-4e4c-4cd6-906e-e0349ec07e40" indent="up1"><enum>(2)</enum><text>The period of a vocational
		  rehabilitation program pursued by a veteran under section 3102(b) of this title
		  following a determination of the current reasonable feasibility of achieving a
		  vocational goal may not exceed 12
		  months.</text>
											</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
									</subparagraph></paragraph></subsection><subsection id="idfb30fed9-53d1-4621-bd5e-072877dc0ba4"><enum>(b)</enum><header>Extension
		of period of eligibility</header><text>Section 3103 of such title is
		amended—</text>
								<paragraph id="id078d45a3-6cf8-4368-8dce-7bf9eaa6ee8c"><enum>(1)</enum><text>in subsection
		(a), by striking <quote>in subsection (b), (c), or (d)</quote> and inserting
		<quote>in subsection (b), (c), (d), or (e)</quote>;</text>
								</paragraph><paragraph id="id49cfd46f-a923-4613-a063-a77809421df2"><enum>(2)</enum><text>by
		redesignating subsection (e) as subsection (f); and</text>
								</paragraph><paragraph id="id815d9025-6ec1-4a8d-a813-332812f6a133"><enum>(3)</enum><text>by inserting
		after subsection (d) the following new subsection (e):</text>
									<quoted-block display-inline="no-display-inline" id="id4e8928ff-7d35-4bc6-bfde-6f84cbc5201e" style="OLC">
										<subsection id="idad660455-a7cb-498a-9b84-089e0ce42189"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id738a8aa9-c3cb-43db-a453-83191a259e2a"><enum>(1)</enum><text>The limitation in
		  subsection (a) shall not apply to a rehabilitation program described in
		  paragraph (2).</text>
											</paragraph><paragraph id="idda864527-7618-4307-94fb-0f364dc7a2e0" indent="up1"><enum>(2)</enum><text>A rehabilitation program described in
		  this paragraph is a rehabilitation program pursued by a veteran under section
		  3102(b) of this
		  title.</text>
											</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0CECCDEECC184633BF017F58C2DCC2CA"><enum>(c)</enum><header>Effective
		date</header><text>The amendments made by subsections (a) and (b) shall take
		effect on June 1, 2012, and shall apply with respect to rehabilitation programs
		beginning after such date.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id3A0B2186B5AC400C9316CC9F0A915F7E"><enum>(d)</enum><header>Comptroller
		General review</header><text>Not later than two years after the date of the
		enactment of this Act, the Comptroller General of the United States
		shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id22483F5ED08E481B977C9B938AF81EE1"><enum>(1)</enum><text>conduct a review
		of the training and rehabilitation under chapter 31 of title 38, United States
		Code; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9788022896004A52BC97849F4B112803"><enum>(2)</enum><text>submit to
		Congress a report on the findings of the Comptroller General with respect to
		the review and any recommendations of the Comptroller General for improving
		such training and rehabilitation.</text>
								</paragraph></subsection></section><section id="id3d0ad0e5-2cbd-4e84-ab3b-45e31e8c33dd"><enum>234.</enum><header>Collaborative
		veterans' training, mentoring, and placement program</header>
							<subsection id="id4c6cc1ef-7770-49bc-8851-b89a5d69e6e7"><enum>(a)</enum><header>In
		general</header><text>Chapter 41 of title 38, United States Code, is amended by
		inserting after section 4104 the following new section:</text>

									<section id="id05629e0e-a690-4c3e-879b-ed9b25058578"><enum>4104A.<?LEXA-Enum 4104A.?></enum><header>Collaborative veterans' training,
		  mentoring, and placement program</header>
										<subsection id="id3a6e8118-5e66-4ee4-91ac-0b242a7c8413"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary shall award grants to
		  eligible nonprofit organizations to provide training and mentoring for eligible
		  veterans who seek employment. The Secretary shall award the grants to not more
		  than three organizations, for periods of two years.</text>
										</subsection><subsection id="id1b97577b-ec71-495f-9c54-6c22affc0285"><enum>(b)</enum><header>Collaboration
		  and facilitation</header><text display-inline="yes-display-inline">The
		  Secretary shall ensure that the recipients of the grants—</text>
											<paragraph id="idcaf99375-bc63-44a1-9f99-465485030e65"><enum>(1)</enum><text display-inline="yes-display-inline">collaborate with—</text>
												<subparagraph id="id8d5f0fe2-b590-4414-bbc1-b7c76f740b40"><enum>(A)</enum><text display-inline="yes-display-inline">the appropriate disabled veterans' outreach
		  specialists (in carrying out the functions described in section 4103A(a)) and
		  the appropriate local veterans' employment representatives (in carrying out the
		  functions described in section 4104); and</text>
												</subparagraph><subparagraph id="idb9fbae8b-a7ab-4519-882c-337257121fd4"><enum>(B)</enum><text>the
		  appropriate State boards and local boards (as such terms are defined in section
		  101 of the Workforce Investment Act of 1998 (29 U.S.C. 2801)) for the areas to
		  be served by recipients of the grants; and</text>
												</subparagraph></paragraph><paragraph id="id0daf49b7-1aa2-41d1-b999-a4d9ab106efd"><enum>(2)</enum><text display-inline="yes-display-inline">based on the collaboration, facilitate the
		  placement of the veterans that complete the training in meaningful employment
		  that leads to economic self-sufficiency.</text>
											</paragraph></subsection><subsection id="idb5bac3da-1a66-4175-8f76-6fc6009ead21"><enum>(c)</enum><header>Application</header><text>To
		  be eligible to receive a grant under this section, a nonprofit organization
		  shall submit an application to the Secretary at such time, in such manner, and
		  containing such information as the Secretary may require. At a minimum, the
		  information shall include—</text>
											<paragraph id="id922f5624-e307-45c9-ae60-53b969c80359"><enum>(1)</enum><text>information
		  describing how the organization will—</text>
												<subparagraph id="idddf7e44b-d559-48db-be34-5f79b7f16125"><enum>(A)</enum><text>collaborate
		  with disabled veterans' outreach specialists and local veterans' employment
		  representatives and the appropriate State boards and local boards (as such
		  terms are defined in section 101 of the Workforce Investment Act of 1998 (29
		  U.S.C. 2801));</text>
												</subparagraph><subparagraph id="id7c9f52d2-1ea0-4aa0-a3ae-74a0ba4fe02e"><enum>(B)</enum><text>based on the
		  collaboration, provide training that facilitates the placement described in
		  subsection (b)(2); and</text>
												</subparagraph><subparagraph id="id5ed11868-1b80-478e-a96d-8f21f031c84e"><enum>(C)</enum><text>make
		  available, for each veteran receiving the training, a mentor to provide career
		  advice to the veteran and assist the veteran in preparing a resume and
		  developing job interviewing skills; and</text>
												</subparagraph></paragraph><paragraph id="id014b0c26-1033-4521-83e4-2f0f435f1839"><enum>(2)</enum><text>an assurance
		  that the organization will provide the information necessary for the Secretary
		  to prepare the reports described in subsection (d).</text>
											</paragraph></subsection><subsection id="ida1ea0d29-132c-42c2-8e1b-6cfce2058e81"><enum>(d)</enum><header>Reports</header><paragraph commented="no" display-inline="yes-display-inline" id="id6a2560e6-9ada-4c00-8acc-0a7f3a4864ab"><enum>(1)</enum><text>Not later than six
		  months after the date of the enactment of the <short-title>VOW to Hire Heroes Act of 2011</short-title>, the
		  Secretary shall prepare and submit to the appropriate committees of Congress a
		  report that describes the process for awarding grants under this section, the
		  recipients of the grants, and the collaboration described in subsections (b)
		  and (c).</text>
											</paragraph><paragraph id="id0db68838-283e-4b2b-a205-93a3aa6ada59" indent="up1"><enum>(2)</enum><text>Not later than 18 months after the
		  date of enactment of the <short-title>VOW to Hire Heroes
		  Act of 2011</short-title>, the Secretary shall—</text>
												<subparagraph id="id1fe1636a-850c-4c7b-ac2f-eaf538292496"><enum>(A)</enum><text>conduct an assessment of the
		  performance of the grant recipients, disabled veterans' outreach specialists,
		  and local veterans' employment representatives in carrying out activities under
		  this section, which assessment shall include collecting information on the
		  number of—</text>
													<clause id="idaaaca906-378f-423a-be93-44790d55e99b"><enum>(i)</enum><text>veterans who applied for training
		  under this section;</text>
													</clause><clause id="id2867fd80-79b3-4721-8432-660610459c5c"><enum>(ii)</enum><text>veterans who entered the
		  training;</text>
													</clause><clause id="iddca803db-8308-4351-a390-01117d14e48f"><enum>(iii)</enum><text>veterans who completed the
		  training;</text>
													</clause><clause id="ida3bfbc85-f949-46d6-a318-fc243c4dd5bb"><enum>(iv)</enum><text>veterans who were placed in
		  meaningful employment under this section; and</text>
													</clause><clause id="id9e4e7a3e-c4a3-4509-a778-ae8342ebefc3"><enum>(v)</enum><text>veterans who remained in such
		  employment as of the date of the assessment; and</text>
													</clause></subparagraph><subparagraph id="idbf07bc3f-8e20-44b1-ad80-ab2424d48dcd"><enum>(B)</enum><text>submit to the appropriate committees
		  of Congress a report that includes—</text>
													<clause id="id64701549-294a-4331-8f51-6aaf5ae5d0e8"><enum>(i)</enum><text>a description of how the grant
		  recipients used the funds made available under this section;</text>
													</clause><clause id="id7dee3638-f7a6-4edc-a548-b6c65ff8a9df"><enum>(ii)</enum><text>the results of the assessment
		  conducted under subparagraph (A); and</text>
													</clause><clause id="id7821f3e0-522d-4bec-b79f-b8856f6c9607"><enum>(iii)</enum><text>the recommendations of the
		  Secretary as to whether amounts should be appropriated to carry out this
		  section for fiscal years after 2013.</text>
													</clause></subparagraph></paragraph></subsection><subsection id="idbef85e15-4988-4541-abb7-e82d6e0f6f3a"><enum>(e)</enum><header>Authorization
		  of appropriations</header><text>There is authorized to be appropriated to carry
		  out this section $4,500,000 for the period consisting of fiscal years 2012 and
		  2013.</text>
										</subsection><subsection id="idb6097ed9-1cc5-4c0f-aba8-73c76edb5942"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>
											<paragraph commented="no" display-inline="no-display-inline" id="id1fd6e3eb-c760-4c75-a000-fc39ed307c15"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>appropriate committees of
		  Congress</term> means—</text>
												<subparagraph commented="no" display-inline="no-display-inline" id="idCECBF891E22A43B2964F53C1127DE65A"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Veterans' Affairs and the
		  Committee on Health, Education, Labor, and Pension of the Senate; and</text>
												</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7FB6C2C2EE8B41F9A0B71D46DFCF297C"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Veterans' Affairs and the
		  Committee on Education and Workforce of the House of Representatives;
		  and</text>
												</subparagraph></paragraph><paragraph id="id281f5212-dce6-4a2b-91ce-c5481271ada1"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>nonprofit
		  organization</term> means an organization that is described in section
		  501(c)(3) of the Internal Revenue Code of 1986 and that is exempt from taxation
		  under section 501(a) of such
		  Code.</text>
											</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
							</subsection><subsection id="id03b83210-d728-425f-94e2-a11dcd9e9d98"><enum>(b)</enum><header>Conforming
		amendment</header><text>Section 4103A(a) of title 38, United States Code, is
		amended—</text>
								<paragraph id="id8f2890bb-2727-4069-b09c-08113820c539"><enum>(1)</enum><text>in paragraph
		(1), by inserting <quote>and facilitate placements</quote> after
		<quote>intensive services</quote>; and</text>
								</paragraph><paragraph id="id7d5a90ca-589f-469e-b255-6006d35fd4ce"><enum>(2)</enum><text>by adding at
		the end the following:</text>
									<quoted-block display-inline="no-display-inline" id="id134892e4-0c06-46fc-99f8-1615b25b6d7f" style="OLC">
										<paragraph id="id8b7483f6-5ebb-4aa0-b8b7-83f5a872cc00" indent="up1"><enum>(3)</enum><text>In facilitating placement of a
		  veteran under this program, a disabled veterans' outreach program specialist
		  shall help to identify job opportunities that are appropriate for the veteran's
		  employment goals and assist that veteran in developing a cover letter and
		  resume that are targeted for those particular
		  jobs.</text>
										</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph></subsection><subsection id="id304209e0-5b31-44dd-9666-9b19293cfdba"><enum>(c)</enum><header>Clerical
		amendment</header><text>The table of sections at the beginning of chapter 41 of
		such title is amended by inserting after the item relating to section 4104 the
		following new item:</text>

		of honorably discharged members and other employment assistance</header>
							<subsection id="id27AF48BAAA80464792EA081C88231160"><enum>(a)</enum><header>Appointments to
		competitive service positions</header>
								<paragraph id="id583EEEB979AA4F9088A2C3DF39122D5D"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">Chapter 21 of title
		5, United States Code, is amended by inserting after section 2108 the
		following:</text>
									<quoted-block display-inline="no-display-inline" id="id65A1331D35E74DF287582ADD9919558C" style="USC">
										<section id="idEEB4546380CC457994DCDF3F273C8C4A"><enum>2108a.<?LEXA-Enum 2108a.?></enum><header>Treatment of certain individuals as
		  veterans, disabled veterans, and preference eligibles</header>
											<subsection id="id4DCD195C706B40FBA3EFE676E31FB5B3"><enum>(a)</enum><header>Veteran</header>
												<paragraph id="id242C64F55DE840F68602ECFAB4843806"><enum>(1)</enum><header>In
		  general</header><text display-inline="yes-display-inline">Except as provided
		  under paragraph (3), an individual shall be treated as a veteran defined under
		  section 2108(1) for purposes of making an appointment in the competitive
		  service, if the individual—</text>
													<subparagraph id="id81D47C46F5994F008D60D074600602E6"><enum>(A)</enum><text>meets the
		  definition of a veteran under section 2108(1), except for the requirement that
		  the individual has been discharged or released from active duty in the armed
		  forces under honorable conditions; and</text>
													</subparagraph><subparagraph id="id666D07EF226D4DCB8705856CC6D37E5B"><enum>(B)</enum><text>submits a
		  certification described under paragraph (2) to the Federal officer making the
		  appointment.</text>
													</subparagraph></paragraph><paragraph id="id5D76ECBF69D5415C808E14CA2C2F634D"><enum>(2)</enum><header>Certification</header><text>A
		  certification referred to under paragraph (1) is a certification that the
		  individual is expected to be discharged or released from active duty in the
		  armed forces under honorable conditions not later than 120 days after the date
		  of the submission of the certification.</text>
												</paragraph></subsection><subsection id="idB57E669BFF634ED881613439BD2DC9CE"><enum>(b)</enum><header>Disabled
		  veteran</header>
												<paragraph id="idCC5C351F34FE468A8C06174BB0FECE49"><enum>(1)</enum><header>In
		  general</header><text display-inline="yes-display-inline">Except as provided
		  under paragraph (3), an individual shall be treated as a disabled veteran
		  defined under section 2108(2) for purposes of making an appointment in the
		  competitive service, if the individual—</text>
													<subparagraph id="id39127A779E3F459B9CC15BADC1B6DECA"><enum>(A)</enum><text>meets the
		  definition of a disabled veteran under section 2108(2), except for the
		  requirement that the individual has been separated from active duty in the
		  armed forces under honorable conditions; and</text>
													</subparagraph><subparagraph id="idEFA72352D19744059C0E700FB14BA6ED"><enum>(B)</enum><text>submits a
		  certification described under paragraph (2) to the Federal officer making the
		  appointment.</text>
													</subparagraph></paragraph><paragraph id="idB96ABE0257674287B6A8DC4357A11CEA"><enum>(2)</enum><header>Certification</header><text>A
		  certification referred to under paragraph (1) is a certification that the
		  individual is expected to be separated from active duty in the armed forces
		  under honorable conditions not later than 120 days after the date of the
		  submission of the certification.</text>
												</paragraph></subsection><subsection id="idFF6AEC4AD841458D8E788839AF230B0A"><enum>(c)</enum><header>Preference
		  eligible</header><text>Subsections (a) and (b) shall apply with respect to
		  determining whether an individual is a preference eligible under section
		  2108(3) for purposes of making an appointment in the competitive
		  service.</text>
											</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph><paragraph id="id13A57BB7C8F94D2087FBFD35CAED0E3D"><enum>(2)</enum><header>Technical and
		conforming amendments</header>
									<subparagraph id="idFFBCCAC8C8334F40A40D23593E2B4BA9"><enum>(A)</enum><header>Definitions</header><text>Section
		2108 of title 5, United States Code, is amended—</text>
										<clause id="idB60E57ACDB6C45BD96E7C534F3752E87"><enum>(i)</enum><text>in

									<subparagraph id="idb0fd66c7-a3bd-477d-97fa-b1103f561e0b"><enum>(A)</enum><text>the term
		<term>agency</term> has the meaning given the term <term>Executive
		agency</term> in section 105 of title 5, United States Code; and</text>
									</subparagraph><subparagraph id="idabb9b08f-8b75-4473-9633-bf6cc3be70f5"><enum>(B)</enum><text>the term
		<term>veteran</term> has the meaning given that term in section 101 of title
		38, United States Code.</text>
									</subparagraph></paragraph><paragraph id="id23bcc4db-3ffb-4ced-a714-cd2a2c43e93d"><enum>(2)</enum><header>Responsibilities
		of Office of Personnel Management</header><text>The Director of the Office of
		Personnel Management shall—</text>
									<subparagraph id="id995c1006-98e6-4234-9e7b-c8f2aa2f5687"><enum>(A)</enum><text>designate
		agencies that shall establish a program to provide employment assistance to
		members of the Armed Forces who are being separated from active duty in
		accordance with paragraph (3); and</text>
									</subparagraph><subparagraph id="id1a74a734-d94e-48dd-b741-a8ed9c77a6c5"><enum>(B)</enum><text>ensure that
		the programs established under this subsection are coordinated with the
		Transition Assistance Program (TAP) of the Department of Defense.</text>
									</subparagraph></paragraph><paragraph id="id8c3a6aba-bd7e-4082-9949-4353ade6150a"><enum>(3)</enum><header>Elements of
		program</header><text>The head of each agency designated under paragraph
		(2)(A), in consultation with the Director of the Office of Personnel
		Management, and acting through the Veterans Employment Program Office of the
		agency established under Executive Order 13518 (74 Fed. Reg. 58533; relating to
		employment of veterans in the Federal Government), or any successor thereto,
		shall—</text>
									<subparagraph id="idbb569f6a-f030-4e30-be73-50f12303d2f4"><enum>(A)</enum><text>establish a
		program to provide employment assistance to members of the Armed Forces who are
		being separated from active duty, including assisting such members in seeking
		employment with the agency;</text>
									</subparagraph><subparagraph id="id8b26a7ca-60a1-4e69-94b0-cd2117621179"><enum>(B)</enum><text>provide such
		members with information regarding the program of the agency established under
		subparagraph (A); and</text>
									</subparagraph><subparagraph id="idba9455c1-3aa4-4619-9760-2349f3790097"><enum>(C)</enum><text>promote the
		recruiting, hiring, training and development, and retention of such members and
		veterans by the agency.</text>
									</subparagraph></paragraph><paragraph id="id38797f9c-424b-4cbe-9fbe-d5bbd9d10fa4"><enum>(4)</enum><header>Other
		office</header><text>If an agency designated under paragraph (2)(A) does not
		have a Veterans Employment Program Office, the head of the agency, in
		consultation with the Director of the Office of Personnel Management, shall
		select an appropriate office of the agency to carry out the responsibilities of
		the agency under paragraph (3).</text>
								</paragraph></subsection></section><section id="id3c7a24e4-e63c-4ade-959b-71f1432d61e3"><enum>236.</enum><header>Department
		of Defense pilot program on work experience for members of the Armed Forces on
		terminal leave</header>
							<subsection id="id2b1df4d1-f061-4f64-92a8-659af894bc46"><enum>(a)</enum><header>In
		general</header><text display-inline="yes-display-inline">The Secretary of
		Defense may establish a pilot program to assess the feasibility and
		advisability of providing to members of the Armed Forces on terminal leave work
		experience with civilian employees and contractors of the Department of Defense
		to facilitate the transition of the individuals from service in the Armed
		Forces to employment in the civilian labor market.</text>
							</subsection><subsection id="id89c031b9-7b73-4639-ba24-14b86fbe5fd0"><enum>(b)</enum><header>Duration</header><text>The
		pilot program shall be carried out during the two-year period beginning on the
		date of the commencement of the pilot program.</text>
							</subsection><subsection id="idcbf3b6eb-b4af-47c4-8b57-fb798fb7dcef"><enum>(c)</enum><header>Report</header><text>Not
		later than 540 days after the date of the commencement of the pilot program,
		the Secretary shall submit to the Committee on Armed Services and the Committee
		on Veterans' Affairs of the Senate and the Committee on Armed Services and the
		Committee on Veterans' Affairs of the House of Representatives an interim
		report on the pilot program that includes the findings of the Secretary with
		respect to the feasibility and advisability of providing covered individuals
		with work experience as described in subsection (a).</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="id01faf21c-a66c-4962-9093-6910fd7e5e0e"><enum>237.</enum><header>Enhancement
		of demonstration program on credentialing and licensing of veterans</header>
							<subsection commented="no" display-inline="no-display-inline" id="id3D7C59B386E2489786780D82C01A6124"><enum>(a)</enum><header>In
		general</header><text display-inline="yes-display-inline">Section 4114 of title
		38, United States Code, is amended—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id49288055-251e-465c-95fb-b6c8b3edbf4b"><enum>(1)</enum><text>in subsection
		(a), by striking <quote>may</quote> and inserting <quote>shall</quote>;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddcd4f80e-10c9-42e0-ae2e-2a047eae3570"><enum>(2)</enum><text>in subsection
		(b)—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idAC0844A6C34041DE95157E9BB8EDCC9D"><enum>(A)</enum><text>in paragraph
		(1)—</text>
										<clause commented="no" display-inline="no-display-inline" id="idfe24b6ed-fc82-41d2-becf-d0b073bc5028"><enum>(i)</enum><text>by striking
		<quote>Assistant Secretary shall</quote> and inserting <quote>Assistant

										</clause><clause commented="no" display-inline="no-display-inline" id="id9491282a-1f2f-4102-be9a-7361e0832f7a"><enum>(iii)</enum><text>by
		inserting <quote>for Veterans' Employment and Training</quote> after
		<quote>selected by the Assistant Secretary</quote>; and</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0A4C4178F1E147BB910AC0C40139661E"><enum>(B)</enum><text>in paragraph (2),
		by striking <quote>consult with appropriate Federal, State, and industry
		officials to</quote> and inserting <quote>enter into a contract with an
		appropriate entity representing a coalition of State governors to consult with
		appropriate Federal, State, and industry officials and</quote>; and</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90312ef4-ffcf-4a9c-ac73-5ea584f9b275"><enum>(3)</enum><text>by striking
		subsections (d) through (h) and inserting the following:</text>
									<quoted-block display-inline="no-display-inline" id="id4179497e-8e99-4800-9df2-463f3b7cdef7" style="OLC">
										<subsection commented="no" display-inline="no-display-inline" id="ida60f6123-4d33-4939-92ea-c7f603b1b6cc"><enum>(d)</enum><header>Period of
		  project</header><text>The period during which the Assistant Secretary shall
		  carry out the demonstration project under this section shall be the two-year
		  period beginning on the date of the enactment of the
		  <short-title>VOW to Hire Heroes Act of
		  2011</short-title>.</text>
										</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph></subsection><subsection id="idFD344F343BD249F3AEAF3388C932B303"><enum>(b)</enum><header>Study comparing
		costs incurred by Secretary of Defense for training for military occupational
		specialties without credentialing or licensing with costs incurred by Secretary
		of Veterans Affairs and Secretary of Labor in providing employment-related
		assistance</header>
								<paragraph id="id810EAF2134764AAEA52E08826CC5B177"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">Not later than 180
		days after the conclusion of the period described in subsection (d) of section
		4114 of title 38, United States Code, as added by subsection (a), the Assistant
		Secretary of Labor of Veterans' Employment and Training shall, in consultation
		with the Secretary of Defense and the Secretary of Veterans Affairs, complete a
		study comparing the costs incurred by the Secretary of Defense in training
		members of the Armed Forces for the military occupational specialties selected
		by the Assistant Secretary of Labor of Veterans' Employment and Training
		pursuant to the demonstration project provided for in such section 4114, as
		amended by subsection (a), with the costs incurred by the Secretary of Veterans
		Affairs and the Secretary of Labor in providing employment-related assistance
		to veterans who previously held such military occupational specialties,
		including—</text>
									<subparagraph id="id4982F1453040460B8E95111A2800D48C"><enum>(A)</enum><text display-inline="yes-display-inline">providing educational assistance under laws
		administered by the Secretary of Veterans Affairs to veterans to obtain
		credentialing and licensing for civilian occupations that are similar to such
		military occupational specialties;</text>
									</subparagraph><subparagraph id="id2154CC48DBC642CE88FD28EBE17A9AD5"><enum>(B)</enum><text display-inline="yes-display-inline">providing assistance to unemployed veterans
		who, while serving in the Armed Forces, were trained in a military occupational
		specialty; and</text>
									</subparagraph><subparagraph id="id7E2C93D92BA3410D93167C55C989BCC5"><enum>(C)</enum><text display-inline="yes-display-inline">providing vocational training or counseling
		to veterans described in subparagraph (B).</text>
									</subparagraph></paragraph><paragraph id="id2F2F2E4D914B4F42BD23D1800E64835B"><enum>(2)</enum><header>Report</header>
									<subparagraph id="idDBBCF05DFADA431F8E14771DAD64AFAF"><enum>(A)</enum><header>In
		general</header><text>Not later than 180 days after the conclusion of the
		period described in subsection (d) of section 4114 of title 38, United States
		Code, as added by subsection (a), the Assistant Secretary of Labor of Veterans'
		Employment and Training shall submit to Congress a report on the study carried
		out under paragraph (1).</text>
									</subparagraph><subparagraph id="id40F432C1D7C54FD4BD3F9DBA04FECC82"><enum>(B)</enum><header>Elements</header><text>The
		report required by subparagraph (A) shall include the following:</text>
										<clause id="id9D9633FC6185483E9DBB6A8FFA3E77DE"><enum>(i)</enum><text>The
		findings of the Assistant Secretary with respect to the study required by
		paragraph (1).</text>
										</clause><clause id="id1E909F063601406F88120E4E13CA62E5"><enum>(ii)</enum><text>A
		detailed description of the costs compared under the study required by
		paragraph (1).</text>
										</clause></subparagraph></paragraph></subsection></section><section id="H6D17E50E519E4EE5B4785B133141E1B1" section-type="subsequent-section"><enum>238.</enum><header>Inclusion of
		performance measures in annual report on veteran job counseling, training, and
		placement programs of the Department of Labor</header><text display-inline="no-display-inline">Section 4107(c) of title 38, United States
		Code, is amended—</text>
							<paragraph id="H7709E12E07F04B70880708F5C65B7E81"><enum>(1)</enum><text>in
		paragraph (2), by striking <quote>clause (1)</quote> and inserting
		<quote>paragraph (1)</quote>;</text>
							</paragraph><paragraph id="HF151CD5C99D14469ABB163B63035EA5E"><enum>(2)</enum><text>in
		paragraph (5), by striking <quote>and</quote> at the end;</text>

		  participants in programs under this chapter who find employment before the end
		  of the first 90-day period following their completion of the program;</text>
										</subparagraph><subparagraph id="id4509B85D052A4E43A7C1B4B28813011B"><enum>(B)</enum><text>the percentage of
		  participants described in subparagraph (A) who are employed during the first
		  180-day period following the period described in such subparagraph;</text>
										</subparagraph><subparagraph id="idE9ED2A3B2C2E48A796AF314C6E25C860"><enum>(C)</enum><text>the median
		  earnings of participants described in subparagraph (A) during the period
		  described in such subparagraph;</text>
										</subparagraph><subparagraph id="id0359EEB3837F428CB70FC444B95C9406"><enum>(D)</enum><text>the median
		  earnings of participants described in subparagraph (B) during the period
		  described in such subparagraph; and</text>
										</subparagraph><subparagraph id="id995091C053694EC9A6AA739B976D34FF"><enum>(E)</enum><text>the percentage of
		  participants in programs under this chapter who obtain a certificate, degree,
		  diploma, licensure, or industry-recognized credential relating to the program
		  in which they participated under this chapter during the third 90-day period
		  following their completion of the
		  program.</text>
										</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</paragraph></section><section id="H089EBE0871BE480BAF996D997D1C79C3"><enum>239.</enum><header>Clarification
		of priority of service for veterans in Department of Labor job training
		programs</header><text display-inline="no-display-inline">Section 4215 of title
		38, United States Code, is amended—</text>
							<paragraph id="HFB956AEE825747AC8708ACE2F49951EE"><enum>(1)</enum><text>in
		subsection (a)(3), by adding at the end the following: <quote>Such priority
		includes giving access to such services to a covered person before a
		non-covered person or, if resources are limited, giving access to such services
		to a covered person instead of a non-covered person.</quote>; and</text>
							</paragraph><paragraph id="H1ACE32E077EE411DAC549A2E29802D8E"><enum>(2)</enum><text>by
		amending subsection (d) to read as follows:</text>
								<quoted-block display-inline="no-display-inline" id="H640A139D0F6C403C88A2C078BC9F4061" style="USC">
									<subsection commented="no" id="HCF2FF88FB1AA4BBD93E29D6CC4E62DD5"><enum>(d)</enum><header>Addition to
		  Annual Report</header><paragraph commented="no" display-inline="yes-display-inline" id="H7C1C163308784315A17EAB619AF1E88A"><enum>(1)</enum><text>In the annual report
		  required under section 4107(c) of this title for the program year beginning in
		  2003 and each subsequent program year, the Secretary of Labor shall evaluate
		  whether covered persons are receiving priority of service and are being fully
		  served by qualified job training programs. Such evaluation shall
		  include—</text>
											<subparagraph commented="no" id="H7A4F6BE9CD7444758AE207E7BC7BB904" indent="up1"><enum>(A)</enum><text>an analysis of the implementation of
		  providing such priority at the local level;</text>
											</subparagraph><subparagraph id="H5DA520691FC744139F4A7E6D820A1129" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">whether the representation of veterans in
		  such programs is in proportion to the incidence of representation of veterans
		  in the labor market, including within groups that the Secretary may designate
		  for priority under such programs, if any; and</text>
											</subparagraph><subparagraph commented="no" id="H996C6CEC9B464FE1A67EBD09357812DB" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">performance measures, as determined by the
		  Secretary, to determine whether veterans are receiving priority of service and
		  are being fully served by qualified job training programs.</text>
											</subparagraph></paragraph><paragraph id="H3039888DA6C4472BAB3CE9BE14E5F5D8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may not use the proportion of
		  representation of veterans described in subparagraph (B) of paragraph (1) as
		  the basis for determining under such paragraph whether veterans are receiving
		  priority of service and are being fully served by qualified job training
		  programs.</text>
										</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</paragraph></section><section id="H412E2BD7C42E4082817586BA977D504D" section-type="subsequent-section"><enum>240.</enum><header>Evaluation of
		individuals receiving training at the National Veterans’ Employment and
		Training Services Institute</header>
							<subsection id="HE3309D34370E4880A742D61493BD6902"><enum>(a)</enum><header>In
		general</header><text display-inline="yes-display-inline">Section 4109 of title
		38, United States Code, is amended by adding at the end the following new
		subsection:</text>
								<quoted-block display-inline="no-display-inline" id="HB383A30AF7C142E18362A0AEE7CF8929" style="USC">
									<subsection id="H94085A104B034B1FAA6ED6B25578924E"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idD671E896C0FF42F498799855AA73A4FA"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall require that each
		  disabled veterans' outreach program specialist and local veterans' employment
		  representative who receives training provided by the Institute, or its
		  successor, is given a final examination to evaluate the specialist's or
		  representative's performance in receiving such training.</text>
										</paragraph><paragraph id="id43A69E216A274402AEC894CF4B618B91" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The results of such final examination shall
		  be provided to the entity that sponsored the specialist or representative who
		  received the
		  training.</text>
										</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</subsection><subsection id="H4E2B5FC50CC349B48AECCA462D355199"><enum>(b)</enum><header>Effective
		date</header><text display-inline="yes-display-inline">Subsection (d) of
		section 4109 of title 38, United States Code, as added by subsection (a), shall
		apply with respect to training provided by the National Veterans’ Employment
		and Training Services Institute that begins on or after the date that is 180
		days after the date of the enactment of this Act.</text>
							</subsection></section><section id="HA4A4D73D0B814CD79E1204B19A67D64D"><enum>241.</enum><header>Requirements
		for full-time disabled veterans’ outreach program specialists and local
		veterans’ employment representatives</header>
							<subsection id="H6F6020584BA343B0912A34BCF7E5893A"><enum>(a)</enum><header>Disabled
		veterans’ outreach program specialists</header><text display-inline="yes-display-inline">Section 4103A of title 38, United States
		Code, is amended by adding at the end the following new subsection:</text>
								<quoted-block display-inline="no-display-inline" id="H00D905AF8E414772AAF50A1374EBB033" style="USC">
									<subsection id="HB5CDDC49C20346FA8EF88497D3AA877E"><enum>(d)</enum><header>Additional
		  requirement for full-time employees</header><paragraph commented="no" display-inline="yes-display-inline" id="H7C83BB5E29484F90A754E2E281503EBA"><enum>(1)</enum><text>A full-time disabled
		  veterans’ outreach program specialist shall perform only duties related to
		  meeting the employment needs of eligible veterans, as described in subsection
		  (a), and shall not perform other non-veteran-related duties that detract from
		  the specialist's ability to perform the specialist's duties related to meeting
		  the employment needs of eligible veterans.</text>
										</paragraph><paragraph id="H184C951717F24DE08D8D0372FF96718D" indent="up1"><enum>(2)</enum><text>The Secretary shall conduct regular
		  audits to ensure compliance with paragraph (1). If, on the basis of such an
		  audit, the Secretary determines that a State is not in compliance with
		  paragraph (1), the Secretary may reduce the amount of a grant made to the State
		  under section 4102A(b)(5) of this
		  title.</text>
										</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</subsection><subsection id="H59F43E67F6B448BFBDA996E72A63E75E"><enum>(b)</enum><header>Local veterans’
		employment representatives</header><text>Section 4104 of such title is
		amended—</text>
								<paragraph id="H3B9E874013AC44CC8BB1815278236062"><enum>(1)</enum><text>by
		redesignating subsection (e) as subsection (f); and</text>
								</paragraph><paragraph id="HB6989D3AC72E4ED7B007B659CF96659E"><enum>(2)</enum><text>by
		inserting after subsection (d) the following new subsection (e):</text>
									<quoted-block display-inline="no-display-inline" id="H96BC0F01BFB04C37B881CA7E6376A460" style="USC">
										<subsection id="H515B2D66D4154346BF93943E149633D5"><enum>(e)</enum><header>Additional
		  requirements for full-time employees</header><paragraph commented="no" display-inline="yes-display-inline" id="H3B1C148C83DF4C41ADEACA87789EFCBD"><enum>(1)</enum><text>A full-time local
		  veterans’ employment representative shall perform only duties related to the
		  employment, training, and placement services under this chapter, and shall not
		  perform other non-veteran-related duties that detract from the representative's
		  ability to perform the representative's duties related to employment, training,
		  and placement services under this chapter.</text>
											</paragraph><paragraph id="H9954E64F38724D4FAF25141C24EA4590" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall conduct regular audits
		  to ensure compliance with paragraph (1). If, on the basis of such an audit, the
		  Secretary determines that a State is not in compliance with paragraph (1), the
		  Secretary may reduce the amount of a grant made to the State under section
		  4102A(b)(5) of this
		  title.</text>
											</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph></subsection><subsection id="id110CB9EE47B34EAC9EA94EDAD1CA3BF4"><enum>(c)</enum><header>Consolidation</header><text>Section
		4102A of such title is amended by adding at the end the following new
		subsection:</text>
								<quoted-block display-inline="no-display-inline" id="idD1E4B31AE2C84F72857F8E0BF2D7BC22" style="OLC">
									<subsection id="id9128A5B92B7B486C8B6877223884EE60"><enum>(h)</enum><header>Consolidation
		  of disabled veterans' outreach program specialists and veterans' employment
		  representatives</header><text>The Secretary may allow the Governor of a State
		  receiving funds under subsection (b)(5) to support specialists and
		  representatives as described in such subsection to consolidate the functions of
		  such specialists and representatives if—</text>
										<paragraph id="idD80790D146BE4E6CA00A2042440AD7C9"><enum>(1)</enum><text>the Governor
		  determines, and the Secretary concurs, that such consolidation—</text>
											<subparagraph id="id5A6D8E5180344DB9B9A6FFE6453CBBF6"><enum>(A)</enum><text>promotes a more
		  efficient administration of services to veterans with a particular emphasis on
		  services to disabled veterans; and</text>
											</subparagraph><subparagraph id="idA7E1A1A2ED4B4C6390CFE8E20258F467"><enum>(B)</enum><text>does not hinder
		  the provision of services to veterans and employers; and</text>
											</subparagraph></paragraph><paragraph id="idEB5FB76265E14D1D8E48A4757512649A"><enum>(2)</enum><text>the Governor
		  submits to the Secretary a proposal therefor at such time, in such manner, and
		  containing such information as the Secretary may
		  require.</text>
										</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</subsection></section></subtitle><subtitle id="HBAE17443DFA943CBADBA67932A398F94"><enum>D</enum><header>Improvements to
		Uniformed Services Employment and Reemployment Rights</header>

		Code of 1986 is amended by striking <quote>($12,000 per year in the case of any

		  veteran will be treated as certified by the designated local agency as having
		  aggregate periods of unemployment meeting the requirements of clause (ii)(II)
		  or (iv) of such paragraph (whichever is applicable) if such veteran is
		  certified by such agency as being in receipt of unemployment compensation under
		  State or Federal law for not less than 6 months during the 1-year period ending
		  on the hiring date, and</text>
											</subclause><subclause id="HF7218F8670CA4C368F50EFEDF7906757"><enum>(II)</enum><text>a
		  veteran will be treated as certified by the designated local agency as having
		  aggregate periods of unemployment meeting the requirements of clause (iii) of
		  such paragraph if such veteran is certified by such agency as being in receipt
		  of unemployment compensation under State or Federal law for not less than 4
		  weeks (but less than 6 months) during the 1-year period ending on the hiring
		  date.</text>

		  authority</header><text>The Secretary may provide alternative methods for
		  certification of a veteran as a qualified veteran described in clause (ii)(II),

		allowable</header><text>Section 3111 of such Code is amended by adding at the
		end the following new subsection:</text>

		  general</header><text>If a qualified tax-exempt organization hires a qualified
		  veteran with respect to whom a credit would be allowable under section 38 by
		  reason of section 51 if the organization were not a qualified tax-exempt
		  organization, then there shall be allowed as a credit against the tax imposed
		  by subsection (a) on wages paid with respect to employment of all employees of
		  the organization during the applicable period an amount equal to the credit
		  determined under section 51 (after application of the modifications under
		  paragraph (3)) with respect to wages paid to such qualified veteran during such
		  period.</text>
											</paragraph><paragraph id="id133D6373837F41A296323E4DECC5883B"><enum>(2)</enum><header>Overall
		  limitation</header><text>The aggregate amount allowed as a credit under this
		  subsection for all qualified veterans for any period with respect to which tax
		  is imposed under subsection (a) shall not exceed the amount of the tax imposed
		  by subsection (a) on wages paid with respect to employment of all employees of
		  the organization during such period.</text>
											</paragraph><paragraph id="id2A852A40060F4401AD3BDA5E24EF3861"><enum>(3)</enum><header>Modifications</header><text>For
		  purposes of paragraph (1), section 51 shall be applied—</text>
												<subparagraph id="idE9C6911405F94A9A8DC49B82A8B102E6"><enum>(A)</enum><text>by substituting
		  <quote>26 percent</quote> for <quote>40 percent</quote> in subsection (a)
		  thereof,</text>
												</subparagraph><subparagraph id="id96A32EA24AB340BD990A8AA4869DA8B5"><enum>(B)</enum><text>by substituting
		  <quote>16.25 percent</quote> for <quote>25 percent</quote> in subsection
		  (i)(3)(A) thereof, and</text>
												</subparagraph><subparagraph id="id47AE7865C6EA47A8B3515836E2A46E3C"><enum>(C)</enum><text>by only taking
		  into account wages paid to a qualified veteran for services in furtherance of
		  the activities related to the purpose or function constituting the basis of the
		  organization's exemption under section 501.</text>
												</subparagraph></paragraph><paragraph id="idDEDC49133C06474781E6545D6690DF52"><enum>(4)</enum><header>Applicable
		  period</header><text>The term <term>applicable period</term> means, with
		  respect to any qualified veteran, the 1-year period beginning with the day such
		  qualified veteran begins work for the organization.</text>
											</paragraph><paragraph id="idC9F82BE175E14B0E81AB989B63FC54BC"><enum>(5)</enum><header>Definitions</header><text>For
		  purposes of this subsection—</text>
												<subparagraph id="idA8467BA85C2E4BD39901C059C58B74D6"><enum>(A)</enum><text>the term
		  <term>qualified tax-exempt organization</term> means an employer that is an
		  organization described in section 501(c) and exempt from taxation under section
		  501(a), and</text>
												</subparagraph><subparagraph id="id9E42A304BBC74D589038E82073953BCA"><enum>(B)</enum><text>the term
		  <term>qualified veteran</term> has meaning given such term by section
		  51(d)(3).</text>
												</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph><paragraph id="idEFA571345DFE404090F8979FDC471652"><enum>(3)</enum><header>Transfers to
		Federal Old-Age and Survivors Insurance Trust Fund</header><text>There are
		hereby appropriated to the Federal Old-Age and Survivors Trust Fund and the
		Federal Disability Insurance Trust Fund established under section 201 of the
		Social Security Act (42 U.S.C. 401) amounts equal to the reduction in revenues
		to the Treasury by reason of the amendments made by paragraphs (1) and (2).
		Amounts appropriated by the preceding sentence shall be transferred from the
		general fund at such times and in such manner as to replicate to the extent
		possible the transfers which would have occurred to such Trust Fund had such
		amendments not been enacted.</text>
								</paragraph></subsection><subsection id="H2A816859273341C1AD4B84FE3F972918"><enum>(f)</enum><header>Treatment of
		Possessions</header>
								<paragraph id="H938AA959B3FA428784A6F838ED1DBF25"><enum>(1)</enum><header>Payments to
		possessions</header>
									<subparagraph id="H9048B9FE95A2490F825E4960F7FE0A98"><enum>(A)</enum><header>Mirror code
		possessions</header><text>The Secretary of the Treasury shall pay to each
		possession of the United States with a mirror code tax system amounts equal to
		the loss to that possession by reason of the amendments made by this section.
		Such amounts shall be determined by the Secretary of the Treasury based on
		information provided by the government of the respective possession of the
		United States.</text>
									</subparagraph><subparagraph id="H98C35F4E595646B18512970323DB386B"><enum>(B)</enum><header>Other
		possessions</header><text>The Secretary of the Treasury shall pay to each
		possession of the United States which does not have a mirror code tax system
		the amount estimated by the Secretary of the Treasury as being equal to the
		loss to that possession that would have occurred by reason of the amendments
		made by this section if a mirror code tax system had been in effect in such
		possession. The preceding sentence shall not apply with respect to any
		possession of the United States unless such possession establishes to the
		satisfaction of the Secretary that the possession has implemented (or, at the
		discretion of the Secretary, will implement) an income tax benefit which is
		substantially equivalent to the income tax credit in effect after the
		amendments made by this section.</text>
									</subparagraph></paragraph><paragraph id="H86CC89714BE148649992A82422802271"><enum>(2)</enum><header>Coordination
		with credit allowed against united states income taxes</header><text>The credit
		allowed against United States income taxes for any taxable year under the
		amendments made by this section to section 51 of the Internal Revenue Code of
		1986 to any person with respect to any qualified veteran shall be reduced by
		the amount of any credit (or other tax benefit described in paragraph (1)(B))
		allowed to such person against income taxes imposed by the possession of the
		United States by reason of this subsection with respect to such qualified
		veteran for such taxable year.</text>
								</paragraph><paragraph id="H2BCE4BC6C2ED462BB695A6FE2DE7FB06"><enum>(3)</enum><header>Definitions and
		special rules</header>
									<subparagraph id="HDFB56546A0F4445F93F0F6FA04E41CCD"><enum>(A)</enum><header>Possession of
		the united states</header><text>For purposes of this subsection, the term
		<term>possession of the United States</term> includes American Samoa, Guam, the
		Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico,
		and the United States Virgin Islands.</text>
									</subparagraph><subparagraph id="HB2D710D9327E482E833FA156F3192EFB"><enum>(B)</enum><header>Mirror code tax
		system</header><text>For purposes of this subsection, the term <term>mirror
		code tax system</term> means, with respect to any possession of the United
		States, the income tax system of such possession if the income tax liability of
		the residents of such possession under such system is determined by reference
		to the income tax laws of the United States as if such possession were the
		United States.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEDB79A02915E48C59A175AA7AAEB8CBF"><enum>(C)</enum><header>Treatment of
		payments</header><text>For purposes of section 1324(b)(2) of title 31, United
		States Code, the payments under this subsection shall be treated in the same
		manner as a refund due from credit provisions described in such section.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCB217A86FF414612AD2CDA314DF37284"><enum>(g)</enum><header>Effective
		date</header><text>The amendments made by this section shall apply to
		individuals who begin work for the employer after the date of the enactment of
		this Act.</text>
							</subsection></section><section id="HCC29D25FD04D46E7B3B1C7AC11465CA0"><enum>262.</enum><header>Extension of
		reduced pension for certain veterans covered by Medicaid plans for services
		furnished by nursing facilities</header><text display-inline="no-display-inline">Section 5503(d)(7) of title 38, United
		States Code, is amended by striking <quote>May 31, 2015</quote> and inserting
		<quote>September 30, 2016</quote>.</text>
						</section><section id="H04FB3BFFFA0B44C99615003BF4A9BAF2"><enum>263.</enum><header>Reimbursement
		rate for ambulance services</header><text display-inline="no-display-inline">Section 111(b)(3) of title 38, United States
		Code, is amended by adding at the end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="H666C293F3CA046C6B0ED4169201832BF" style="USC">
								<subparagraph id="H9FF84DA00D494BB3A356AE4568946D80" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of transportation of a person
		  under subparagraph (B) by ambulance, the Secretary may pay the provider of the
		  transportation the lesser of the actual charge for the transportation or the
		  amount determined by the fee schedule established under section 1834(l) of the
		  Social Security Act (42 U.S.C. 1395(l)) unless the Secretary has entered into a
		  contract for that transportation with the
		  provider.</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</section><section id="IDd5eda32d3cd549e2ae06f18271fe3cb4"><enum>264.</enum><header>Extension of
		authority for Secretary of Veterans Affairs to obtain information from
		Secretary of Treasury and Commissioner of Social Security for income
		verification purposes</header><text display-inline="no-display-inline">Section
		5317(g) of title 38, United States Code, is amended by striking
		<quote>September 30, 2011</quote> and inserting <quote>September 30,
		2016</quote>.</text>

					<section commented="no" display-inline="no-display-inline" id="H3BFC40FD871A4BF48EFD6CE4E82DCE17" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">One hundred percent levy for payments to
		Federal vendors relating to property</header>
						<subsection commented="no" display-inline="no-display-inline" id="H36DA5479FF754A0A870AEFB456C1454B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/6331">Section 6331(h)(3)</external-xref> of the Internal
		Revenue Code of 1986 is amended by striking <quote>goods or services</quote>
		and inserting <quote>property, goods, or services</quote>.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HA4ED4C7095674E34A46F22B030F4C81C"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
		date</header><text display-inline="yes-display-inline">The amendment made by
		this section shall apply to levies issued after the date of the enactment of
		this Act.</text>
						</subsection></section><section id="H2838893524844ED7B7263750C16FE6E0" section-type="subsequent-section"><enum>302.</enum><header>Study and report on
		reducing the amount of the tax gap owed by Federal contractors</header>
						<subsection id="id433ADE18D69741E1A5AC51DC5BEBFF1A"><enum>(a)</enum><header>Study</header>
							<paragraph id="id1685D51B41634F5787C32CD0C1765E44"><enum>(1)</enum><header>In
		general</header><text>The Secretary of the Treasury, or the Secretary's
		delegate, in consultation with the Director of the Office of Management and
		Budget and the heads of such other Federal agencies as the Secretary determines
		appropriate, shall conduct a study on ways to reduce the amount of Federal tax
		owed but not paid by persons submitting bids or proposals for the procurement
		of property or services by the Federal government.</text>
							</paragraph><paragraph id="idB463700ECF7848898274743CF48E1AF7"><enum>(2)</enum><header>Matters
		studied</header><text>The study conducted under paragraph (1) shall include the
		following matters:</text>
								<subparagraph id="IDa8f5e411bef848b1ba20ffec2c01c10e"><enum>(A)</enum><text>An estimate of
		the amount of delinquent taxes owed by Federal contractors.</text>
								</subparagraph><subparagraph id="IDdedee39e1a754d86b765f1c897112d32"><enum>(B)</enum><text>The extent to
		which the requirement that persons submitting bids or proposals certify whether
		such persons have delinquent tax debts has—</text>
									<clause id="idE2A7069777E243F9B0DADD57363775F4"><enum>(i)</enum><text>improved tax
		compliance; and</text>
									</clause><clause id="id5377724057EA4F8F93A5B942B6D23001"><enum>(ii)</enum><text>been a
		factor in Federal agency decisions not to enter into or renew contracts with
		such contractors.</text>
									</clause></subparagraph><subparagraph id="ID0cdae8a29da14e28a72730a3209a2629"><enum>(C)</enum><text>In cases in which
		Federal agencies continue to contract with persons who report having delinquent
		tax debt, the factors taken into consideration in awarding such
		contracts.</text>
								</subparagraph><subparagraph id="ID972d0ec109c44215966ce10ad7be88dd"><enum>(D)</enum><text>The degree of the
		success of the Federal lien and levy system in recouping delinquent Federal
		taxes from Federal contractors.</text>
								</subparagraph><subparagraph id="IDc401abb133c349b99f71d85393c371aa"><enum>(E)</enum><text>The number of
		persons who have been suspended or debarred because of a delinquent tax debt
		over the past 3 years.</text>
								</subparagraph><subparagraph id="IDfcf0503067804c54b14f0bb8a0eae885"><enum>(F)</enum><text>An estimate of
		the extent to which the subcontractors under Federal contracts have delinquent
		tax debt.</text>
								</subparagraph><subparagraph id="ID29369f3ff6a746ebb65f06a68500ef62"><enum>(G)</enum><text>The Federal
		agencies which have most frequently awarded contracts to persons
		notwithstanding any certification by such person that the person has delinquent
		tax debt.</text>
								</subparagraph><subparagraph id="id928280F6CD7943C9B58AF826218DD213"><enum>(H)</enum><text>Recommendations
		on ways to better identify Federal contractors with delinquent tax
		debts.</text>
								</subparagraph></paragraph></subsection><subsection id="id5B6D9B6EFCFC4E5FA94794BAA9AC559C"><enum>(b)</enum><header>Report</header><text>Not
		later than 12 months after the date of the enactment of this Act, the Secretary
		of the Treasury shall submit to the Committee on Ways and Means of the House of
		Representatives, the Committee on Finance of the Senate, the Committee on
		Oversight and Government Reform of the House of Representatives, and the
		Committee on Homeland Security and Government Affairs of the Senate, a report
		on the study conducted under subsection (a), together with any legislative
		recommendations.</text>
						</subsection></section></title><title id="id78D2F1CCB9A64E589037D7DB64C65418"><enum>IV</enum><header>Modification of
		calculation of modified adjusted gross income for determining certain
		healthcare program eligibility</header>
					<section id="H28131BA3C9EA4626A28F33F3E10AA6E3" section-type="subsequent-section"><enum>401.</enum><header>Modification of
		calculation of modified adjusted gross income for determining certain
		healthcare program eligibility</header>
						<subsection id="H9D93E523932C4543B1AC6BB3B21402B1"><enum>(a)</enum><header>In
		general</header><text display-inline="yes-display-inline">Subparagraph (B) of
		section 36B(d)(2) of the Internal Revenue Code of 1986 is amended by striking
		<quote>and</quote> at the end of clause (i), by striking the period at the end
		of clause (ii) and inserting <quote>, and</quote>, and by adding at the end the
		following new clause:</text>
							<quoted-block display-inline="no-display-inline" id="H58F1D04D3B40466ABE6BB83EFF6C06EE" style="OLC">
								<clause id="HB50C24D6BAE94DC18EBA5A2B853F246F"><enum>(iii)</enum><text display-inline="yes-display-inline">an amount equal to the portion of the
		  taxpayer's social security benefits (as defined in section 86(d)) which is not
		  included in gross income under section 86 for the taxable
		  year.</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H24582BD23039464BAAD523665E5A0A85"><enum>(b)</enum><header>Effective
		date</header><text>The amendments made by this section shall take effect on the
		date of the enactment of this Act.</text>
						</subsection><subsection id="ID05cfccff40f146c08841092aca85d2e3"><enum>(c)</enum><header>No impact on
		social security trust funds</header>
							<paragraph id="ID7f9bba6b43204597a50bbb6db0697565"><enum>(1)</enum><header>Estimate of
		Secretary</header><text>The Secretary of the Treasury, or the Secretary's
		delegate, shall annually estimate the impact that the amendments made by
		subsection (a) have on the income and balances of the trust funds established
		under section 201 of the Social Security Act (42 U.S.C. 401).</text>
							</paragraph><paragraph id="IDf75771d49139431f8fc4fa3ade48ec56"><enum>(2)</enum><header>Transfer of
		Funds</header><text>If, under paragraph (1), the Secretary of the Treasury or
		the Secretary's delegate estimates that such amendments have a negative impact
		on the income and balances of such trust funds, the Secretary shall transfer,
		not less frequently than quarterly, from the general fund an amount sufficient
		so as to ensure that the income and balances of such trust funds are not
		reduced as a result of such amendments.</text>
							</paragraph></subsection></section></title><title id="id047F0BC214344DDCBD61C6925468D584"><enum>V</enum><header>Budgetary
		effects</header>
					<section id="H9D57E8746F98434187A41F7077D61854"><enum>501.</enum><header>Statutory
		Pay-As-You-Go Act of 2010</header><text display-inline="no-display-inline">The
		budgetary effects of this Act, for the purpose of complying with the Statutory
		Pay-As-You-Go Act of 2010, shall be determined by reference to the latest
		statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this
		Act, submitted for printing in the Congressional Record by the Chairman of the
		House Budget Committee, provided that such statement has been submitted prior
		to the vote on passage.</text>
