expedite national Medicare coverage determinations for evidence-based treatment
services</header>
<subsection commented="no" id="H774BA54EF53D4A54A475BD098F18C401"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary of
Health and Human Services shall—</text>
<paragraph commented="no" id="H2FACE783C9CB40879BE8F9B038612760"><enum>(1)</enum><text>not later than
January 1, 2014, issue national Medicare coverage determinations for
evidence-based services to treat overweight and obesity that have an Evidence
Category <quote>A</quote> or <quote>B</quote> designation for treating
overweight and obesity as defined by the <quote>Clinical Guidelines on the
Identification, Evaluation, and Treatment of Overweight and Obesity in
Adults</quote> of the National Heart, Lung, and Blood Institute; and</text>
</paragraph><paragraph commented="no" id="HC9CA03AB9EC447A587FE98B35599732F"><enum>(2)</enum><text>update such
coverage determinations based on future updates to such Guidelines.</text>
</paragraph></subsection><subsection commented="no" id="H8D93432E1CDF4E028D655C092911A1F1"><enum>(b)</enum><header>Updating NHLBI
Guidelines</header><text>Not later than December 31, 2014, and at least once
every 3 years thereafter, the Secretary of Health and Human Services, acting
through the Director of the National Heart, Lung, and Blood Institute, shall
update the NHLBI Guidelines referred to in subsection (a).</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="H4ECC6B95C0804ECEA23CBE6F5FD2B037" section-type="subsequent-section"><enum>102.</enum><header>Expansion of obesity
treatment services under Medicare</header>
<subsection id="HC79659053BC44D63B6986FC52191C77E"><enum>(a)</enum><header>Coverage</header><text display-inline="yes-display-inline">Section 1861 of the Social Security Act (42
U.S.C. 1395x) is amended—</text>
<paragraph commented="no" id="H7E774332717C49BF8F7F3F3A6D7E7374"><enum>(1)</enum><text>in subsection
(s)(2)—</text>
<subparagraph commented="no" id="H938A87F8F88C410996849EBC84360BAC"><enum>(A)</enum><text>in subparagraph
(EE), by striking at the end <quote>and</quote>;</text>
</subparagraph><subparagraph commented="no" id="HFFF1CE51E24F4387BF4063B015AB0F40"><enum>(B)</enum><text>in subparagraph
(FF), by adding at the end <quote>and</quote>; and</text>
</subparagraph><subparagraph commented="no" id="HC237AD77681A4F02B9B9424248BD2B66"><enum>(C)</enum><text>by adding at the
end the following new subparagraph:</text>

obesity treatment program (as defined in subsection
(iii));</text>
</subparagraph><after-quoted-block>;
and</after-quoted-block></quoted-block>
</subparagraph></paragraph><paragraph commented="no" id="HCFADFEFFE60B409BAFEBDF8F05CCC763"><enum>(2)</enum><text>by adding at the
end the following new subsection:</text>
<quoted-block display-inline="no-display-inline" id="HA4B168B7E914420A8B69D63E5A862CE3" other-style="archaic" style="other">
<subsection commented="no" id="HC902FFDA9A7C4D329E99AEB814FF6E9E"><enum>(iii)</enum><header>Obesity Treatment Program</header><paragraph commented="no" display-inline="yes-display-inline" id="H6F8D5DD60A52451BA88A476D4A0C2FEA"><enum>(1)</enum><text>The term <term>obesity
treatment program</term> means medical services delivered to eligible
individuals under a plan of care for the purpose of reducing body mass index
and the associated co-morbidities of obesity, including the following:</text>
<subparagraph id="HAC34315672754AE89B65D065902E0DA0"><enum>(A)</enum><text>The development of
an initial plan of care and subsequent revisions to that plan of care.</text>
</subparagraph><subparagraph id="H226976395D5F4BE48ED22CF8DD9A6561"><enum>(B)</enum><text>Medical and
surgical interventions as determined appropriate by the Secretary for which
payment would not otherwise be made under this title.</text>
</subparagraph><subparagraph id="H3CCFA75F3A6D4E87B372AF6588B5B811"><enum>(C)</enum><text>Additional
services for which payment would not otherwise be made under this title that
the Secretary may specify that encourage the receipt of, or improve the
effectiveness of, the services described in the preceding subparagraphs.</text>
</subparagraph><continuation-text continuation-text-level="paragraph" indent="up1">In carrying out subparagraph (C), the Secretary shall
consider clinical practice guidelines for treatment of overweight, obesity, and
severe obesity issued by professional medical societies and consensus
statements and guidelines on effective treatment of overweight, obesity, and
severe obesity issued by the National Institutes of Health, professional
medical societies, and other authoritative sources (such as those identified in
the Clinical Guidelines on the Identification, Evaluation, and Treatment of
Overweight and Obesity in Adults released by the National Heart Lung and Blood
Institute).</continuation-text></paragraph><paragraph commented="no" id="H0F771532AE9446868A46B63003724BF7" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the
term <term>eligible individual</term> means any of the following:</text>
<subparagraph commented="no" id="HBDD823CA83C34F0D80AEF3FEFC48F2EB"><enum>(A)</enum><text>An individual who has been diagnosed
with obesity by a physician or provider of services, without regard to body
mass index or the presence of any comorbid condition.</text>
</subparagraph><subparagraph commented="no" id="H1B758830DA064085ACC85686F26A45B5"><enum>(B)</enum><text>An individual who has a body mass
index of at least 30, without regard to the presence of any comorbid
condition.</text>
</subparagraph><subparagraph commented="no" id="HD838FD64B08C4BC3BB9A7627F1B9EDAC"><enum>(C)</enum><text>An individual who has a body mass
index of at least 27 with at least one weight-related comorbid
condition.</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection id="HB2DBE08357844B6798C68E420CF5135A"><enum>(b)</enum><header>Payment</header><text>Section
1833(a)(1) of the Social Security Act (42 U.S.C. 1395l(a)(1)) is
amended—</text>
<paragraph id="HC4A7093D4F9547D0A21A7DE71E00D98C"><enum>(1)</enum><text>by striking
<quote>and</quote> before <quote>(Z)</quote>; and</text>
</paragraph><paragraph id="HB6729AB5FAC34D00BE988DBEF2ABE350"><enum>(2)</enum><text>by inserting
before the semicolon at the end the following: <quote>, and (AA) with respect
to items and services furnished under an obesity treatment program (as defined
in section 1861(iii)), the amount paid shall be 80 percent of the lesser of the
actual charge for the services or the amount determined under a fee schedule
established by the Secretary for purposes of this subparagraph</quote>.</text>
</paragraph></subsection><subsection id="HA535EA0D8EE649788A440A07785A375F"><enum>(c)</enum><header>Effective
date</header><text>The amendments made by this section shall apply to items and
services furnished on or after January 1, 2014.</text>
</subsection></section><section id="HC435FEB346D4496DBD215E064CFB86FA"><enum>103.</enum><header>Chronic weight
management drugs covered under Medicaid and Medicare part D</header>
<subsection id="H41EFC91D2B8343B58E661E5002C44BBD"><enum>(a)</enum><header>Medicaid
coverage</header><text display-inline="yes-display-inline">Section
1927(d)(2)(A) of the Social Security Act (42 U.S.C. 1396r–8(d)(2)(A)) is
amended by inserting before the period at the end the following: <quote>except
prescription agents approved by the Food and Drug Administration used for
chronic weight management in the treatment of obesity or overweight with a
weight related co-morbidity</quote>.</text>
</subsection><subsection id="HC17537A8AD2D49D298C4919081077079"><enum>(b)</enum><header>Medicare part D
coverage</header><text display-inline="yes-display-inline">Section
1860D–2(e)(1) of the Social Security Act (42 U.S.C. 1395w–102(e)(1)) is amended
by inserting before the period at the end the following: <quote>and includes
prescription agents approved by the Food and Drug Administration used for
chronic weight management in the treatment of obesity or overweight with a
weight related co-morbidity</quote>.</text>
</subsection><subsection id="H4235B508900F435DBA2A06CD630F0935"><enum>(c)</enum><header>Effective
date</header><text>The amendments made by this section shall apply to items and
services furnished on or after January 1, 2014.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="H45DE3FC12B8849AD839DD1DCBF8B1780" section-type="subsequent-section"><enum>104.</enum><header>Grants to provide
training for health profession students</header><text display-inline="no-display-inline">Section 747 of the
<act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
293k) is amended—</text>
<paragraph id="H8DE3235A3478479F85BB291E71A7B954"><enum>(1)</enum><text>by redesignating
subsection (c) as subsection (d); and</text>
</paragraph><paragraph id="H4A56FE6DDE33405BA889939EA508295F"><enum>(2)</enum><text>by inserting after
subsection (b) the following:</text>
<quoted-block display-inline="no-display-inline" id="H1D156EECB4394E8BA4EFE999769F1D96" style="OLC">
<subsection id="H0F1ED148750E4188B86A9634E1B06DB9"><enum>(c)</enum><header>Special
consideration</header><text display-inline="yes-display-inline">In awarding
grants or contracts under subsection (a) or (b), the Secretary shall give
special consideration to qualified applicants proposing a project or program
which will prepare practitioners to care for individuals (including children)
who are overweight or obese (as such terms are defined in section
399W(j)).</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="H3A454F6FE5E2489886AF9667CF06914C" section-type="subsequent-section"><enum>105.</enum><header>Grants to provide
training for health professionals</header><text display-inline="no-display-inline">Section 399Z of the
<act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
280h–3) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H662D304CCC7540DDAF13C5776B90D1B0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by striking
<quote>2005</quote> and inserting <quote>2018</quote>;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFCC141050C954FBAB160332AD5BEF9F5"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as
subsection (c);</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H828E93D716B74D63978118FF48DBBB13"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
following:</text>

<subsection commented="no" display-inline="no-display-inline" id="HB68E6A1FC0864B80B872563898A5B0C1"><enum>(b)</enum><header>Grants</header>
<paragraph commented="no" display-inline="no-display-inline" id="H2E358791674E46D48B612618D404AEC1"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary may
award grants to eligible entities to train primary care physicians and other
licensed or certified health professionals on how to treat and prevent obesity
and aid individuals who are obese or overweight.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5709301566B54CDC85741CE0BB273F78"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">An entity that desires a grant under this
subsection shall submit an application at such time, in such manner, and
containing such information as the Secretary may require, including a plan for
the use of funds that may be awarded and an evaluation of the training that
will be provided.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H73E1AA54A920438EA957089AAF0F76C1"><enum>(3)</enum><header>Use of
funds</header><text display-inline="yes-display-inline">An entity that receives
a grant under this subsection shall use the funds made available through such
grant to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HBDBF5284CE0E46D69D54A321CA7954D4"><enum>(A)</enum><text display-inline="yes-display-inline">use evidence-based findings or
recommendations that pertain to the prevention and treatment of obesity and
being overweight to conduct educational conferences, including Internet-based
courses and teleconferences, on—</text>
<clause commented="no" display-inline="no-display-inline" id="HD7F4B97C35EC433DB019FE6F6F3D017A"><enum>(i)</enum><text display-inline="yes-display-inline">how to treat or prevent obesity and being
overweight;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H95DE5FB4FE4D4104A460413D6C935F17"><enum>(ii)</enum><text display-inline="yes-display-inline">the link between obesity and being
overweight and related serious and chronic medical conditions;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H58D76869D97D4AC7BC568553480E2FE0"><enum>(iii)</enum><text display-inline="yes-display-inline">how to discuss varied strategies with
patients from at-risk and diverse populations to promote positive behavior
change and healthy lifestyles to avoid obesity and being overweight;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="HCE648B9B76DA4448BE6F0E4226E6F43E"><enum>(iv)</enum><text display-inline="yes-display-inline">how to identify individuals who are or are
at risk for being obese or being overweight and, therefore, are at risk for
related serious and chronic medical conditions; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="H5BB777BDB3EA4945935F78AC1D5369BE"><enum>(v)</enum><text display-inline="yes-display-inline">how to conduct a comprehensive assessment
of individual and familial health risk factors; and</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA8F5AE0A19E04671AB1565523ECAE32D"><enum>(B)</enum><text display-inline="yes-display-inline">evaluate the effectiveness of the training
provided by such entity in increasing knowledge and changing attitudes and
behaviors of trainees.</text>
</subparagraph></paragraph></subsection><after-quoted-block>;
and</after-quoted-block></quoted-block>
</paragraph><paragraph id="H12CA486B2D3C4D86B1E4119BE4476E1D"><enum>(4)</enum><text>in subsection (c)
(as so redesignated)—</text>

services block grant</header><text display-inline="no-display-inline">Section
1904(a)(1) of the <act-name parsable-cite="PHSA">Public Health Service
Act</act-name> (42 U.S.C. 300w–3(a)(1)) is amended by adding at the end the
following:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="HFF2D435424AD49EEB6A70DDDA0DE5B66" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">Activities and community education programs
designed to address and prevent obesity and being overweight through effective
programs to promote healthy eating, and exercise habits and
behaviors.</text>
</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="HA5E5425CF23642808402BBD95F301276"><enum>107.</enum><header>Health
Empowerment for At-Risk Teens and Youth (HEARTY) program</header><text display-inline="no-display-inline">Title III of the Public Health Service Act
is amended by inserting after section 317T of such Act (42 U.S.C. 247b–22) the
following:</text>

<section id="H621A925AD12E4D7B8E6E89C479DBD5AC"><enum>317U.</enum><header>Healthy
Empowerment for At-risk Teens and Youth (HEARTY) program</header>
<subsection id="H41BFA620CF1A4EE9A3AEA9B8EE03B958"><enum>(a)</enum><header>In
general</header><text>The Secretary, acting through the Director of the Centers
for Disease Control and Prevention, may make grants to eligible entities to
carry out nationally-based or community-based qualified childhood obesity
prevention initiatives.</text>
</subsection><subsection id="HC161D6C0AEE04FE09AA0DFDE27EF3948"><enum>(b)</enum><header>Eligible
entities</header><text>To be eligible to seek a grant under this section, an
entity shall be—</text>
<paragraph id="HF689CE2E74EF4F8E98878E3D38ACCE90"><enum>(1)</enum><text>a nationally-based
nonprofit organization qualified in childhood obesity prevention and youth
mentoring proposing to implement programs described in subsection (c);
or</text>
</paragraph><paragraph id="H1DFB359BE06C4864AE3961922011CFDC"><enum>(2)</enum><text>a community-based
nonprofit organization qualified in childhood obesity prevention and youth
mentoring proposing to implement a program described in subsection (c).</text>
</paragraph></subsection><subsection id="HAB15471B782B4A12AB9BB2FAEAB94F67"><enum>(c)</enum><header>Qualified
childhood obesity prevention initiative</header><text>To qualify as a childhood
obesity prevention initiative eligible for funding under this section, an
initiative shall consist of programs that—</text>
<paragraph id="H36384B9C70B449308C84009E375711A3"><enum>(1)</enum><text>serve both male
and female children or adolescents most at risk for being overweight and obese
in predominantly economically disadvantaged communities;</text>
</paragraph><paragraph id="HF112334414FC473AAFC9F9ADD51AE068"><enum>(2)</enum><text>serve both male
and female children or adolescents during after-school hours, weekends, or
summer hours;</text>
</paragraph><paragraph id="H75932F580DCC4C2D835CBDE36B086BD3"><enum>(3)</enum><text>provide structured
physical fitness activities, including organized sports, which engage each
participant in a minimum of 60 minutes of moderate to vigorous physical
activity at least three days per week for a period of at least 24 weeks in a
given year;</text>
</paragraph><paragraph id="H999477C9A992473BA423EDFD567F47E8"><enum>(4)</enum><text>demonstrate
cost-effectiveness as defined by the Secretary; and</text>
</paragraph><paragraph id="HB38E6F9CDBD441F1AD93EC0F2D88F125"><enum>(5)</enum><text>demonstrate
measurable results for reducing childhood obesity on the part of participants,
including through—</text>
<subparagraph id="H21B707CFA16D490A90FDC20B8944D518"><enum>(A)</enum><text>measurement and
study of participants’ moderate to vigorous physical activity (MVPA) each day,
both as part of the programs funded under this section and on the participants’
own initiative;</text>
</subparagraph><subparagraph id="HBD7B837C0D4042EB8D4C099CC9D10376"><enum>(B)</enum><text display-inline="yes-display-inline">increased knowledge of and awareness about
the importance of maintaining healthy, active lifestyles by balancing
recommended levels of physical activity and caloric intakes;</text>
</subparagraph><subparagraph id="HAA658CD78A9642F2A93758897493D992"><enum>(C)</enum><text>keeping track of
and reporting increased consumption of healthy items and increased levels of
unstructured, self-initiated physical activity outside of the programs funded
under this section; and</text>
</subparagraph><subparagraph id="HA234EBF088FF42D4A0AD0890FE14E584"><enum>(D)</enum><text>measurement and
study of participants’ body mass index (BMI) indicating that—</text>
<clause id="H320F3AAC1EDF4C3DA024DB5A1D4E466F"><enum>(i)</enum><text>children entering
programs funded under this section with a healthy body mass index maintain it
while participating in such programs; and</text>
</clause><clause id="H1FF09F22F7EB494EB0E6396DEDD79E74"><enum>(ii)</enum><text>children
participating in such programs with an unhealthy body mass index halt any
negative trend lines towards obesity or begin trend lines in a positive
direction.</text>
</clause></subparagraph></paragraph></subsection><subsection id="H9F61C0B235C74B3AB86646EB9764D054"><enum>(d)</enum><header>Priority</header><text>In
selecting among applicants for grants under this section, the Secretary shall
give priority to eligible entities proposing to carry out programs that
show:</text>
<paragraph id="H23C6F769E09249489585BD72D41F5F9A"><enum>(1)</enum><text>effectiveness in
working with ethnic and racial minority groups;</text>
</paragraph><paragraph id="H73DEA25E6AD645A089C93B630B88E40A"><enum>(2)</enum><text>effectiveness in
recruiting participants from communities with substantial immigrant
populations, as defined by the Secretary; and</text>
</paragraph><paragraph id="H4871966DE48F4619B351A99600933D11"><enum>(3)</enum><text>program evaluation
by an independent, third-party evaluator, of category specified by the
Secretary.</text>
</paragraph></subsection><subsection id="HC8D8520E97454507828A268F79CF219A"><enum>(e)</enum><header>Distribution of
funds</header><text>Of the amount made available to carry out this section for
a fiscal year, the Secretary shall award—</text>
<paragraph id="H298B20998B174601973CE87F2A380E8B"><enum>(1)</enum><text>not less than 25
percent of such amount to nationally-based nonprofit organizations described in
subsection (b)(1); and</text>
</paragraph><paragraph id="H47B663C16FB94B6D8A189F8FBA056790"><enum>(2)</enum><text>not more than 75
percent of such amount to community-based nonprofit organizations described in
subsection (b)(2).</text>
</paragraph></subsection><subsection id="HC7AFABF61DAA474798E6A43F66A3DDCE"><enum>(f)</enum><header>Cost-Share
requirements</header><text>With respect to the costs of a qualified childhood
obesity prevention initiative to be carried out under this section, there shall
be no non-federal match requirement.</text>
</subsection><subsection id="HA67304D913EC49F48862F0E6FC6CE58A"><enum>(g)</enum><header>Report to
congress</header><text>Not later than one year after the first appropriation of
Federal funds to carry out this section, the Secretary shall report to the
Congress on the progress made in carrying out programs funded by grants under
this section.</text>
</subsection><subsection id="H6D71FEDB93A543B4BB4FEDA5EE01232A"><enum>(h)</enum><header>Authorization of
appropriations</header><text>To carry out this section, there are authorized to
be appropriated such sums as may be necessary for each of fiscal years 2014
through
2018.</text>

</section><enum>II</enum><header>Improving access
to and opportunity for physical activity for adults and children</header>
<subtitle id="HE8A050D7A5564F9F97D6CAEFAC960CF7"><enum>A</enum><header>National Program
Promoting Lifelong Active Youth (PLAY) and Implementation Grants</header>
<section id="HEB98B8876881413FA66B6F5AC0881E9E"><enum>201.</enum><header>Play assessment
tools</header>
<subsection id="H63C9DD4B70104455B593850AF084FB46"><enum>(a)</enum><header>In
general</header><text>The Secretary of Health and Human Services (in this
section referred to as the Secretary), acting through the Director of the
Centers for Disease Control and Prevention, shall develop a list of
well-validated assessment tools, which can measure the policy, program, or
environmental barriers in communities to participating in physical activity.
Tools on the Secretary’s recommended list shall include—</text>
<paragraph id="H3A671062C35444D891D0AF6D28163A5E"><enum>(1)</enum><text>cross-cutting
measurements that—</text>
<subparagraph id="H4F5CBA3E026D43AA83915101FD1AE47A"><enum>(A)</enum><text>examine barriers
to physical activities across multiple settings, including homes, after-school
and child care sites, schools, the community-at-large, and worksites;
and</text>
</subparagraph><subparagraph id="HE9CB630E17E649889CA36873829B2521"><enum>(B)</enum><text>focus on
the—</text>
<clause id="H8E8785D1C5C84DC68A50B286080D79E2"><enum>(i)</enum><text>availability of
adequate spaces and places for physical activity;</text>
</clause><clause id="H51CB9866DB0540768481231AFDF40CF7"><enum>(ii)</enum><text>availability of,
and access to, high-quality physical activity and physical education programs;
and</text>
</clause><clause id="HFF03535B6DA84D7DA7309DE68C42FEFB"><enum>(iii)</enum><text>the availability
of programs, activities, and leaders to educate about the importance of
physical activity for the community; and</text>
</clause></subparagraph></paragraph><paragraph id="HD97E50CFA1E04286A928AB8D5A3A48EE"><enum>(2)</enum><text>additional
measurements to assist economically and culturally diverse communities in
examining the social determinants of health.</text>
</paragraph></subsection><subsection id="H6D8CA403CAD94116A0861D4D172E5EC0"><enum>(b)</enum><header>Guidance and
training</header><text>The Secretary shall provide guidelines and
recommendations to develop training on utilizing such tools.</text>
</subsection></section><section display-inline="no-display-inline" id="H3772830928454C479F7CF518C13BA3F5" section-type="subsequent-section"><enum>202.</enum><header>Model communities of
play implementation grants</header>
<subsection id="H567151A0B3D4462CAF177749B43CCD63"><enum>(a)</enum><header>Program
Authorized</header>
<paragraph id="H15EB63DC29B44EB0AEA474D47483CBB5"><enum>(1)</enum><header>In
general</header><text>The Secretary of Health and Human Services (in this
section referred to as the <quote>Secretary</quote>), acting through the
Director of the Centers for Disease Control and Prevention, shall award grants
to State health departments to enable the State health departments to work in
partnership with eligible community-based coalitions to plan and implement
model communities of play that increase—</text>
<subparagraph id="H3D1BBD76C9894B6BB8355F0128C9B867"><enum>(A)</enum><text>the physical
spaces and places available for physical activity;</text>
</subparagraph><subparagraph id="HE3B17F94B0FA463996FAF800337353B2"><enum>(B)</enum><text>the opportunities
for children and families to participate in high-quality play, and the number
of children and families participating in high-quality play;</text>
</subparagraph><subparagraph id="H3F0B7A68F66F429CB0DE03E482D94A1B"><enum>(C)</enum><text>knowledge and
awareness about the importance of individuals achieving 60 minutes of
recommended physical activity every day; and</text>
</subparagraph><subparagraph id="H16164ED417714C93AAB779BC856E0F01"><enum>(D)</enum><text>school siting
practices in which elementary and secondary schools are located within
neighborhoods to increase the likelihood of students walking and biking to
school.</text>
</subparagraph></paragraph><paragraph id="H6845578A0FC6455E944421502541AE38"><enum>(2)</enum><header>Amount of
grants</header><text>A grant awarded to a State health department under this
subsection shall be in the amount of $250,000 to $1,000,000.</text>
</paragraph></subsection><subsection id="H1D5A4D037A17448BB9399F9DF0F6DB63"><enum>(b)</enum><header>Application</header><text>A
State health department desiring a grant under subsection (a) shall submit an
application to the Secretary at such time, in such manner, and containing such
information as the Secretary may require.</text>
</subsection><subsection id="H2D54640EB6114C60B674DD47F37EF6B8"><enum>(c)</enum><header>Coordination</header><text>In
awarding grants under subsection (a), the Secretary shall ensure that the
proposed programs assisted under each grant are coordinated in substance and
format with programs currently funded through other Federal departments and
agencies, including—</text>
<paragraph id="H4ED4F969F998486D99E7BE165BF6466C"><enum>(1)</enum><text>State-based
nutrition and physical activity programs, comprehensive school health education
programs, and community-based health and wellness programs of the Centers for
Disease Control and Prevention;</text>
</paragraph><paragraph id="H0F9425ECC80A45BDB0CB437F65D2ED35"><enum>(2)</enum><text>the physical
education programs under subpart 10 of part D of title V of the Elementary and
Secondary Education Act of 1965 (20 U.S.C. 7261 et seq.);</text>
</paragraph><paragraph id="H450E7B043A3F4F33942569A245FAC915"><enum>(3)</enum><text>the safe routes to
schools program under section 1404 of the Safe, Accountable, Flexible,
Efficient Transportation Equity Act: A Legacy for Users (23 U.S.C. 402 note);
and</text>
</paragraph><paragraph id="HA8F2284913C8432D85A8EE22005BC6B4"><enum>(4)</enum><text>other health and
wellness programs operating within the community.</text>
</paragraph></subsection><subsection id="HDA989D65E47D4891BB209F4717B4744E"><enum>(d)</enum><header>Partnership With
Community Coalitions</header><text>A State health department receiving a grant
under subsection (a) shall use the majority of grant funds to carry out the
activities described in subsection (e) in partnership with 1 or more community
coalitions that meet all of the following requirements:</text>
<paragraph id="H2BF7C9380DFB4C91B00B8A7BB75B5CC5"><enum>(1)</enum><text>The community
coalition is comprised of a representative sampling of community partners,
including not less than half of the following types of individuals and
entities:</text>
<subparagraph id="H9AA8E3256B814430A81E7B7B3D35CBF3"><enum>(A)</enum><text>A community-based
organization that focuses on children and youth, preventive health, physical
activity, or physical education.</text>
</subparagraph><subparagraph id="H16E8D62631754DB0B0C2760F9BE9B317"><enum>(B)</enum><text>A local parks and
recreation department.</text>
</subparagraph><subparagraph id="H1E16027CD53849DCBFA62BB33BEEBD07"><enum>(C)</enum><text>A local health
department.</text>
</subparagraph><subparagraph id="H1A9D0F959FC640BAAA36AF98E0A94C1B"><enum>(D)</enum><text>A local
educational agency, as defined in section 9101 of the Elementary and Secondary
Education Act of 1965 (20 U.S.C. 7801).</text>
</subparagraph><subparagraph id="H4C7AFCB35AA548D8BF525DA637A7AEDE"><enum>(E)</enum><text>A local city
planning agency.</text>
</subparagraph><subparagraph id="H92B54EB97C90478CBA2E3287C81A1896"><enum>(F)</enum><text>A local health
care provider.</text>
</subparagraph><subparagraph id="HCC60F0338AD84464AD5386F47D84A57A"><enum>(G)</enum><text>An institution of
higher education, as defined in section 101 of the Higher Education Act of 1965
(20 U.S.C. 1001).</text>
</subparagraph><subparagraph id="H9ABC061F77284A458A47EE3F91AC0289"><enum>(H)</enum><text>A tribal health
facility, where applicable.</text>
</subparagraph><subparagraph id="H6D3DA75A37D74FD69E651921AD1BC0CA"><enum>(I)</enum><text>A tribal
educational agency, where applicable.</text>
</subparagraph><subparagraph id="H131C6AB9255B4523AEC5211F01CBE498"><enum>(J)</enum><text>A federally
qualified health center or rural health clinic (as such terms are defined in
section 1861(aa) of the Social Security Act (42 U.S.C. 1395x(aa)), where
applicable.</text>
</subparagraph><subparagraph id="HDC36C0418E69442BB5C3753F453BBE0D"><enum>(K)</enum><text>A hospital.</text>
</subparagraph><subparagraph id="H9F4825E0A84846BE95D0CD29FE1DA2B9"><enum>(L)</enum><text>A faith-based
organization.</text>
</subparagraph><subparagraph id="H0897391D054248679164D9EB8EE35932"><enum>(M)</enum><text>A policymaker or
elected official.</text>
</subparagraph><subparagraph id="H40ACBDD2FA02440993E332BC98D78780"><enum>(N)</enum><text>A community
planning organization.</text>
</subparagraph><subparagraph id="H5988F4AC4C96497BA18F25AAB053E96C"><enum>(O)</enum><text>A business.</text>
</subparagraph></paragraph><paragraph id="HAE7D44295CF2482DA9A0C4E99B81CF16"><enum>(2)</enum><text>The community
coalition completed and submitted to the State health department—</text>
<subparagraph id="HFFC610CDEB6548FE8E80286AF43EDF92"><enum>(A)</enum><text>an assessment tool
identified by the Secretary under section 201 for the community that identifies
the gaps and barriers to physical activity in the community to children and
youth; and</text>
</subparagraph><subparagraph id="HCB444FA2695C4B30B3E67193C53E35F9"><enum>(B)</enum><text>a community action
plan describing the programs, policies, and environmental change strategies
that will be implemented with grant funds to help children and youth in the
community reach the recommended 60 minutes of physical activity every
day.</text>
</subparagraph></paragraph><paragraph id="H0532FFD8B7FD4450B906B8951756D3C2"><enum>(3)</enum><text>The community
coalition provided—</text>
<subparagraph id="H97E2CF2AF14348A788163FDCAF550AD6"><enum>(A)</enum><text>documentation to
the State health department on the manner in which the coalition will
coordinate with appropriate State and local authorities, including—</text>
<clause id="H584A5AC6F81E42968B2AE595147F42D6"><enum>(i)</enum><text>State or local
health departments;</text>
</clause><clause id="HB09528DCC8E14432BD5EA43FC372CC25"><enum>(ii)</enum><text>State educational
agencies or local educational agencies, as defined in section 9101 of the
Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801);</text>
</clause><clause id="H00EC877C7CC04431B04CAB14E68723C4"><enum>(iii)</enum><text>State or local
parks and recreation departments or associations;</text>
</clause><clause id="HA096BD8158994E04ADF7903D244C68EA"><enum>(iv)</enum><text>State or local
departments of transportation or city planning;</text>
</clause><clause id="HF0F0777C04E449E4B751D32A6EAA4877"><enum>(v)</enum><text>community
foundations; and</text>
</clause><clause id="H9B1E5229522649DEADDC3FC78F3D1EFC"><enum>(vi)</enum><text>any
other entities determined to be appropriate by the Secretary; and</text>
</clause></subparagraph><subparagraph id="H24E5FC20725542CB93F058B1E4EF686F"><enum>(B)</enum><text>a description of
the manner in which the coalition will evaluate the effectiveness of the
programs carried out with grant funds.</text>
</subparagraph></paragraph></subsection><subsection id="H3D32A963C3AE4AE1A0BDDD5DEF90C16A"><enum>(e)</enum><header>Authorized
Activities</header><text>A State health department that receives a grant under
subsection (a) shall use the majority of funds available through the grant to
carry out the following activities:</text>
<paragraph id="HA79B1EA43AC44365B18D2E6EA530C98C"><enum>(1)</enum><text>Train
community-based coalitions on how to utilize assessment tools to measure the
program, policy, and environmental barriers to promoting lifelong physical
activity for youth.</text>
</paragraph><paragraph id="H8FEF7E4E926548BF95A26231A3AB0C8E"><enum>(2)</enum><text>Work in
partnership with one or more community coalitions described in subsection (d)
to enable the coalitions to carry out the coalition’s community action plan and
promote a model community of play, which may include the following:</text>
<subparagraph id="H67013508858646B3806177E96F64BE6E"><enum>(A)</enum><text>Enabling the
maximum use of, or the creation of spaces and places for, physical activity for
children, families, and communities before, during, and after school or work,
which may include increasing the number of—</text>
<clause id="HE255EB32005D41AE821A2A687B097BF7"><enum>(i)</enum><text>programs that
increase the number of safe streets and sidewalks in the community to walk and
bike to school, work, or other community destinations, such as recreation
sites, parks, or community centers;</text>
</clause><clause id="HEFD9F2C102384E5E8D6AE870B4C38A02"><enum>(ii)</enum><text>schools,
faith-based organizations, and recreational facilities serving the community
that provide programming on physical activity and physical education before,
during, or after school;</text>
</clause><clause id="H192FE37745F842CC8D321FC0E601A774"><enum>(iii)</enum><text>schools serving
the community that provide recess, physical education, and physical activity
for children and youth;</text>
</clause><clause id="H345D07F21C9141168137B73737CED780"><enum>(iv)</enum><text>day
care, child care, and after-school care sites in the community that provide
physical activity for children and youth;</text>
</clause><clause id="H1379CDDAF08B4E8FA7F41BD2893E4C8B"><enum>(v)</enum><text>venues in the
community that provide co-curricular physical activity programs, including
sports fields and courts, especially venues for all-inclusive intramural
programs and physical activity clubs;</text>
</clause><clause id="HA55FA0F3CB5E42FFAB6AA99C6C8E3BCD"><enum>(vi)</enum><text>playgrounds and
activity sites in the community for young children, including sites that offer
programs that provide physical activity instruction that meets the various
needs and interests of all students, including those with illness, injury, and
physical and developmental disabilities, as well as those who live sedentary
lifestyles or have a disinterest in traditional team sports;</text>
</clause><clause id="HDB1C0791FA7440D49DC42EE07F4EE105"><enum>(vii)</enum><text>capital
improvement projects that increase opportunities for physical activity in the
community; and</text>
</clause><clause id="H383BE01F545D435EACFE2172A2EB1C49"><enum>(viii)</enum><text>networks of
walking and cycling trails where trails do not exist in the community, that
offer both a functional alternative to automobile travel and an opportunity for
exercise, recreation, and community connectedness.</text>
</clause></subparagraph><subparagraph id="H06EC70DD6707435DA81629DB9B3A709B"><enum>(B)</enum><text>Enhancing
opportunities and access for children and youth in the community to participate
in high-quality physical activity and physical education programs before,
during, and after school, which may include increasing the number of—</text>
<clause id="H8CA1BA932C28491EAC1EAA809C873BA7"><enum>(i)</enum><text>school and
after-school care sites in the community that implement proven health
curricula, physical education (including developing innovative approaches to
teaching and staffing physical education), and physical activity
programming;</text>
</clause><clause id="H07F1CBB2287D45DAA34CFF856E4EF1C3"><enum>(ii)</enum><text>children and
youth in the community who are able to participate in physical education or
activity before, during, or after school, by ensuring that adequate equipment
is available to such children and youth;</text>
</clause><clause id="H0D3F178A17244098AC5D53335AF3BCAB"><enum>(iii)</enum><text>scholarships to
low-income children and youth for physical activity programs;</text>
</clause><clause id="H48A348F5E89C4B1CB62F482887051EFF"><enum>(iv)</enum><text>education and
training programs for education, recreation, leisure, child care, and coaching
professionals regarding high-quality physical education and physical activity
programs and policies;</text>
</clause><clause id="H83A39AE548184A48A0E9403F7B4C11C2"><enum>(v)</enum><text>training programs
to assist physicians and other health care professionals in—</text>
<subclause id="H65E1D00219534F2E832711780B6E08E4"><enum>(I)</enum><text>carefully
communicating the results of body mass index (BMI) tests to parents and, in an
age-appropriate manner, to the children and youth themselves;</text>
</subclause><subclause id="HA63EEDA9E01F45E3AF9F2C7171A42C71"><enum>(II)</enum><text>providing
information to families so they may make informed decisions about physical
activity and nutrition; and</text>
</subclause><subclause id="HF29B328B9C6A4E2A8E9D92C4008F84AF"><enum>(III)</enum><text>explaining the
benefits associated with physical activity and the risks associated with
childhood overweight and obesity;</text>
</subclause></clause><clause id="HCD037E16AB6F4F5CBA14CC196A8A2184"><enum>(vi)</enum><text>assessment tools
used to measure the quality of physical activity, sports, and intramural sports
programs;</text>
</clause><clause id="H1970B00F3BC24109AB5FD6BFBDC51A76"><enum>(vii)</enum><text>guidelines and
informational materials used by teachers, parents, caregivers, and health care
professionals who are interested in promoting physical activity for infants,
toddlers, and preschoolers; and</text>
</clause><clause id="H8CBAB7ADC3B145D193B4D0A6C1F915C3"><enum>(viii)</enum><text>guidelines and
informational materials used to promote—</text>
<subclause id="H7D664DBF39A84AED97FC78B44BE84711"><enum>(I)</enum><text>physical activity
with the intent of improving the current health, fitness, and wellness of
preadolescent children (ages 6 through 12); and</text>
</subclause><subclause id="H93D5809DFEBC4184A7B96C94B38ABFC9"><enum>(II)</enum><text>lifelong physical
activity.</text>
</subclause></clause></subparagraph><subparagraph id="H997F5D0E9F254D4D823A0C6A54CFE46B"><enum>(C)</enum><text>Identifying,
engaging, and mobilizing community leaders, decisionmakers, experts, and the
media to raise awareness and educate the public about the importance of
securing 60 minutes of physical activity every day, which may include
increasing the number of—</text>
<clause id="H2684286DE2D64606A7E9B4CCCEEDF943"><enum>(i)</enum><text>school and
after-school care faculty and staff, including coaches, who serve as positive
role models for students regarding regular physical activity;</text>
</clause><clause id="HDB9DD07454E74B759B535B85C16A87D5"><enum>(ii)</enum><text>businesses that
serve as role models by providing physical space and incentives for employees
to participate in physical activity;</text>
</clause><clause id="H4436A8D1A77B4406A56EB468D99A155E"><enum>(iii)</enum><text>businesses that
serve as role models to communities by—</text>
<subclause id="HDE8C594AA1BE45F289694570A6A8C2DE"><enum>(I)</enum><text>providing support
to intramural teams, clubs, sports leagues, playgrounds, trails, biking and
walking paths, and fields and venues for sports, play, and physical
activity;</text>
</subclause><subclause id="H21477B03969549D688DCA895DCD46E32"><enum>(II)</enum><text>incorporating
built environment strategies into new construction of facilities;</text>
</subclause><subclause id="H035D2AA672234B9C8127B6704F37FB00"><enum>(III)</enum><text>adopting safe
routes to school programs;</text>
</subclause><subclause id="H578DC072CBC04C8FAE69AFC809A5D64F"><enum>(IV)</enum><text>providing bike
racks at the office; and</text>
</subclause><subclause id="HDE59E150411A4D42B5EFCD065366336E"><enum>(V)</enum><text>encouraging the
use of the stairs;</text>
</subclause></clause><clause id="HA886E5DBF9DB4255975D040019D06F97"><enum>(iv)</enum><text>insurers that
cover obesity screening and prevention services in routine clinical
practice;</text>
</clause><clause id="HA9D7626F004F43949F508C24298EDDE1"><enum>(v)</enum><text>groups
representing low-income individuals or individuals with disabilities, that can
promote and secure safer and more accessible sites for activity;</text>
</clause><clause id="HE57DB8C2316846B5811790010A587055"><enum>(vi)</enum><text>consumer
research-driven marketing strategies for ongoing initiatives and interventions
that enhance physical activity for children and youth;</text>
</clause><clause id="HC178ABB307F549D9BAC1FC16E44FFEFA"><enum>(vii)</enum><text>products and
opportunities provided or offered by leisure, entertainment, and recreation
industries that promote regular physical activity and reduce sedentary
behaviors;</text>
</clause><clause id="HAEBF6C7B7E6844C59FB71075F33372E2"><enum>(viii)</enum><text>media advocacy
training programs for public health and exercise scientists so as to empower
the scientists to disseminate their knowledge to a broad audience; and</text>
</clause><clause id="HA88080D6F3934393A2672253348254BD"><enum>(ix)</enum><text>campaigns to
foster awareness about the health benefits of regular physical activity of not
less than 60 minutes a day for all children and youth.</text>
</clause></subparagraph></paragraph><paragraph id="HC711FBC57EB143A19F20408AF0278060"><enum>(3)</enum><text>Support the
evaluation of community action plans of community coalitions described in
subsection (d) and activities carried out pursuant to this Act.</text>
</paragraph></subsection><subsection id="HCEFB56388D8E4D4581F0271151103F26"><enum>(f)</enum><header>Definition</header><text>In
this section, the term <term>State</term> includes the District of Columbia and
any commonwealth, territory, or possession of the United States.</text>
</subsection><subsection id="H5004476A8D32411AA4FA3473C2E70195"><enum>(g)</enum><header>Authorization of
appropriations</header><text>To carry out this section, there are authorized to
be appropriated such sums as may be necessary for fiscal years 2014 through
2019.</text>

<paragraph id="H1D8F6D07FB5F4D5AB675A6BE2E762C4E"><enum>(1)</enum><header>Eligible
entity</header><text>The term <term>eligible entity</term> means—</text>
<subparagraph id="H44AF121E2D0443908930470327F89EB4"><enum>(A)</enum><text>a State; or</text>
</subparagraph><subparagraph id="H56EC872493A04F9680881338F7604336"><enum>(B)</enum><text>a consortium from
one State that may include such State and municipalities, entities of local or
tribal governments, parks and recreation departments or districts, school
districts, institutions of higher education, or nonprofit organizations.</text>
</subparagraph></paragraph><paragraph id="HA3A7C6BBEF97411E8D7F0B56A1DB389F"><enum>(2)</enum><header>Local
partners</header><text>The term <term>local partners</term> means a
municipality, entity of local or tribal government, parks and recreation
departments or districts, Indian tribe, school district, institution of higher

</paragraph><paragraph id="H957C577A932246448922AAE65C71D80A"><enum>(3)</enum><header>Secretary</header><text>The
term <term>Secretary</term> means the Secretary of the Interior.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1ACA08C415524820BAD41072569D8F2D"><enum>(4)</enum><header>State</header><text>The
term <term>State</term> means any of the several States, the District of
Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands,
Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, any
other territory or possession of the United States, or any Indian tribe.</text>
</paragraph></section><section id="H3466624237D845D0B23FBE31CE6F2B15"><enum>212.</enum><header>Cooperative
agreements for development or implementation of healthy kids outdoors State
strategies</header>
<subsection id="HAF3E78B742D44F7C8CE74BDC8857473C"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary is
authorized to issue one cooperative agreement per State to eligible entities to
develop, implement, and update a 5-year State strategy, to be known as a
<quote>Healthy Kids Outdoors State Strategy</quote>, designed to encourage
Americans, especially children, youth, and families, to be physically active
outdoors.</text>
</subsection><subsection id="HA6E4EC17A2FB4CCB91DE37720E2DA2CE"><enum>(b)</enum><header>Submission and
approval of strategies</header>
<paragraph id="H91BE29E70D604BCF96514E166F760B10"><enum>(1)</enum><header>Applications</header><text display-inline="yes-display-inline">An application for a cooperative agreement
under subsection (a) shall—</text>
<subparagraph id="HD85EA1A8CA964973B5252280B2C0015B"><enum>(A)</enum><text display-inline="yes-display-inline">be submitted not later than 120 days after
the Secretary publishes guidelines under subsection (f)(1); and</text>
</subparagraph><subparagraph id="H9EBEACE685B0495DB57A6B95EE695DC8"><enum>(B)</enum><text display-inline="yes-display-inline">include a Healthy Kids Outdoors State
Strategy meeting the requirements of subsection (c) or a proposal for
development and submission of such a strategy.</text>
</subparagraph></paragraph><paragraph id="HFF05B64C22524D8A843B579808297FB5"><enum>(2)</enum><header>Approval of
strategy; peer review</header><text display-inline="yes-display-inline">Not
later than 90 days after submission of a Healthy Kids Outdoors State Strategy,
the Secretary shall, through a peer review process, approve or recommend
changes to the strategy.</text>
</paragraph><paragraph id="H25D6BA8652614358BEA475032B94CDA4"><enum>(3)</enum><header>Strategy
update</header><text display-inline="yes-display-inline">An eligible entity
receiving funds under this section shall update its Healthy Kids Outdoors State
Strategy at least once every 5 years. Continued funding under this section
shall be contingent upon submission of such updated strategies and reports that
document impact evaluation methods consistent with the guidelines in subsection
(f)(1) and lessons learned from implementing the strategy.</text>
</paragraph></subsection><subsection id="HAAFCE787ADC646A689D227548FEDFEE7"><enum>(c)</enum><header>Comprehensive
strategy requirements</header><text display-inline="yes-display-inline">The
Healthy Kids Outdoors State Strategy under subsection (a) shall include—</text>
<paragraph id="HBA5121539BA84AADA59BFD073202B16E"><enum>(1)</enum><text display-inline="yes-display-inline">a description of how the eligible entity
will encourage Americans, especially children, youth, and families, to be
physically active in the outdoors through State, local, and tribal—</text>
<subparagraph id="H165BBC1C2EBE496D9E9D948DDABC7DE8"><enum>(A)</enum><text display-inline="yes-display-inline">public health systems;</text>
</subparagraph><subparagraph id="H597C6C933ABF41E4B72CD69006044097"><enum>(B)</enum><text display-inline="yes-display-inline">public parks and recreation systems;</text>
</subparagraph><subparagraph id="H181D33804C3D485183C194D6D9922605"><enum>(C)</enum><text display-inline="yes-display-inline">public transportation and city planning
systems; and</text>
</subparagraph><subparagraph id="H9650958019694D4EAED19DC153A8828A"><enum>(D)</enum><text display-inline="yes-display-inline">other public systems that connect
Americans, especially children, youth, and families, to the outdoors;</text>
</subparagraph></paragraph><paragraph id="HCBBC3B461EE84E23BB2EBF52B309B605"><enum>(2)</enum><text display-inline="yes-display-inline">a description of how the eligible entity
will partner with nongovernmental organizations, especially those that serve
children, youth, and families, including those serving military families and
tribal agencies;</text>
</paragraph><paragraph id="H8B1B6E4A0D564741B4E99984F23FB713"><enum>(3)</enum><text display-inline="yes-display-inline">a description of how State agencies will
collaborate with each other to implement the strategy;</text>
</paragraph><paragraph id="HCCC0E97D4248491EA70E35A74A6C4348"><enum>(4)</enum><text display-inline="yes-display-inline">a description of how funding will be spent
through local planning and implementation subgrants under subsection
(d);</text>
</paragraph><paragraph id="H1030FD91C4DF4681B58C009CEE796E98"><enum>(5)</enum><text display-inline="yes-display-inline">a description of how the eligible entity
will evaluate the effectiveness of, and measure the impact of, the strategy,
including an estimate of the costs associated with such evaluation;</text>
</paragraph><paragraph id="H18728011FE20490BA990EF4E76195B28"><enum>(6)</enum><text display-inline="yes-display-inline">a description of how the eligible entity
will provide opportunities for public involvement in developing and
implementing the strategy;</text>
</paragraph><paragraph id="HDF13972AD7884C2A801DD637469735DF"><enum>(7)</enum><text display-inline="yes-display-inline">a description of how the strategy will
increase visitation to Federal public lands within the state; and</text>
</paragraph><paragraph id="H543AF4029CCE491CAEC98F432F97BA70"><enum>(8)</enum><text>a
description of how the eligible entity will leverage private funds to expand
opportunities and further implement the strategy.</text>
</paragraph></subsection><subsection id="HF119AF168CC743A397240EFCCFDFDD9A"><enum>(d)</enum><header>Local planning
and implementation</header>
<paragraph id="HF65E6E12C6BF4FC28D726FBCEEC099A1"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">A Healthy Kids
Outdoors State Strategy shall provide for subgrants by the cooperative
agreement recipient under subsection (a) to local partners to implement the
strategy through one or more of the program activities described in paragraph
(2).</text>
</paragraph><paragraph id="HBF53ECCD9C664F24804B83E7D6EBDA1D"><enum>(2)</enum><header>Program
activities</header><text display-inline="yes-display-inline">Program activities
may include—</text>
<subparagraph id="HDEBEE6197CBD47B9914338885B787175"><enum>(A)</enum><text display-inline="yes-display-inline">implementing outdoor recreation and youth
mentoring programs that provide opportunities to experience the outdoors, be
physically active, and teach skills for lifelong participation in outdoor
activities, including fishing, hunting, recreational shooting, archery, hiking,
camping, outdoor play in natural environments, and wildlife watching;</text>
</subparagraph><subparagraph id="H0EDD2CF47F3947E9B329B2AB2FCF756C"><enum>(B)</enum><text display-inline="yes-display-inline">implementing programs that connect
communities with safe parks, green spaces, and outdoor recreation areas through
affordable public transportation and trail systems that encourage walking,
biking, and increased physical activity outdoors;</text>
</subparagraph><subparagraph id="H51BADA7B20E942FFB7E6667432DE7366"><enum>(C)</enum><text display-inline="yes-display-inline">implementing school-based programs that use
outdoor learning environments, such as wildlife habitats or gardens, and
programs that use service learning to restore natural areas and maintain
recreational assets; and</text>
</subparagraph><subparagraph id="H276E713389284CA289A67C9503F155EE"><enum>(D)</enum><text display-inline="yes-display-inline">implementing education programs for parents
and caregivers about the health benefits of active time outdoors to fight
obesity and increase the quality of life for Americans, especially children,
youth, and families.</text>
</subparagraph></paragraph></subsection><subsection id="HC899EC2913514DD6A3E3EC904CC02F72"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">In making cooperative agreements under
subsection (a) and subgrants under subsection (d)(1), the Secretary and the
recipient under subsection (a), respectively, shall give preference to entities
that serve individuals who have limited opportunities to experience nature,
including those who are socioeconomically disadvantaged or have a disability or
suffer disproportionately from physical and mental health stressors.</text>
</subsection><subsection id="H79EB5EB9E8C74DFEAC8CAB7102707419"><enum>(f)</enum><header>Guidelines</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
the enactment of this Act, and after notice and opportunity for public comment,
the Secretary shall publish in the Federal Register guidelines on the
implementation of this subtitle, including guidelines for—</text>
<paragraph id="H6FB346B1B48B408686EB20465530A4D1"><enum>(1)</enum><text display-inline="yes-display-inline">developing and submitting strategies and
evaluation methods under subsection (b); and</text>
</paragraph><paragraph id="H332082ADA6374835A54AFF9EA53D7618"><enum>(2)</enum><text display-inline="yes-display-inline">technical assistance and dissemination of
best practices under section 215.</text>
</paragraph></subsection><subsection id="HA7A76E64D70D471C9D90E5BBCA59A685"><enum>(g)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than 2 years after the Secretary
approves the Healthy Kids Outdoors State Strategy of an eligible entity
receiving funds under this section, and every year thereafter, the eligible
entity shall submit to the Secretary a report on the implementation of the
strategy based on the entity’s evaluation and assessment of meeting the goals
specified in the strategy.</text>
</subsection><subsection id="H6C66BC7244D74417A600CAE0B7E9DFD8"><enum>(h)</enum><header>Allocation of
funds</header><text display-inline="yes-display-inline">An eligible entity
receiving funding under subsection (a) for a fiscal year—</text>
<paragraph id="HAEF1BE21F261432A908627FFD3855E41"><enum>(1)</enum><text display-inline="yes-display-inline">may use not more than 5 percent of the
funding for administrative expenses; and</text>
</paragraph><paragraph id="H39B549C97A2B486AB32A3E6EC07EFBCC"><enum>(2)</enum><text display-inline="yes-display-inline">shall use at least 95 percent of the
funding for subgrants to local partners under subsection (d).</text>
</paragraph></subsection><subsection id="H0D5DEB7C5CA94462BD0800E8DA9D589F"><enum>(i)</enum><header>Match</header><text display-inline="yes-display-inline">An eligible entity receiving funding under
subsection (a) for a fiscal year shall provide a 25-percent match through
in-kind contributions or cash.</text>
</subsection></section><section id="H564A0B5F58DA4C359BD446034458AA9B"><enum>213.</enum><header>National
strategy for encouraging Americans to be active outdoors</header>
<subsection id="HD647881705EE4C9BBB236DF17FED450F"><enum>(a)</enum><header>In
general</header><text>Not later than September 30, 2013, the President, in
cooperation with appropriate Federal departments and agencies, shall develop
and issue a national strategy for encouraging Americans, especially children,
youth, and families, to be physically active outdoors. Such a strategy shall
include—</text>
<paragraph id="HC651DBC8BD324C22AE3AC27285F3CC0D"><enum>(1)</enum><text>identification of
barriers to Americans, especially children, youth, and families, spending
healthy time outdoors and specific policy solutions to address those
barriers;</text>
</paragraph><paragraph id="H78A45C185B5744B9A68C20A5196321CD"><enum>(2)</enum><text>identification of
opportunities for partnerships with Federal, State, tribal, and local
partners;</text>
</paragraph><paragraph id="H4E9D234230D648D594C6CC68841ECCC7"><enum>(3)</enum><text>coordination of
efforts among Federal departments and agencies to address the impacts of
Americans, especially children, youth, and families, spending less active time
outdoors on—</text>
<subparagraph id="HB15B325822244BAE8DCDA05ACB31AD50"><enum>(A)</enum><text>public health,
including childhood obesity, attention deficit disorders and stress;</text>
</subparagraph><subparagraph id="H8C5B1E3962EA4566B3AAB45CCFBA4D77"><enum>(B)</enum><text>the future of
conservation in the United States; and</text>
</subparagraph><subparagraph id="H9C8E145ECFBB49B8A69EDF50268E42C9"><enum>(C)</enum><text>the
economy;</text>
</subparagraph></paragraph><paragraph id="H2D39A14A9ECC47E29E44A5E16C831ADC"><enum>(4)</enum><text>identification of
ongoing research needs to document the health, conservation, economic, and
other outcomes of implementing the national strategy and State
strategies;</text>
</paragraph><paragraph id="HEAA199F2C8C8436A97656A3D6CE40A85"><enum>(5)</enum><text>coordination and
alignment with Healthy Kids Outdoors State Strategies; and</text>
</paragraph><paragraph id="H21D8B77A4D174111A92DAC61A4E65F0C"><enum>(6)</enum><text>an action plan for
implementing the strategy at the Federal level.</text>
</paragraph></subsection><subsection id="H1B96D73C3E224AD9830491065F9F8C20"><enum>(b)</enum><header>Strategy
development</header>
<paragraph id="HB54199A4D8484B76A7BA2E772E986828"><enum>(1)</enum><header>Public
participation</header><text>Throughout the process of developing the national
strategy under subsection (a), the President may use, incorporate, or otherwise
consider existing Federal plans and strategies that, in whole or in part,
contribute to connecting Americans, especially children, youth, and families,
with the outdoors and shall provide for public participation, including a
national summit of participants with demonstrated expertise in encouraging
individuals to be physically active outdoors in nature.</text>
</paragraph><paragraph id="H88EFFA8D53B943509584104EEABB54A7"><enum>(2)</enum><header>Updating the
national strategy</header><text>The President shall update the national
strategy not less than 5 years after the date the first national strategy is
issued under subsection (a), and every 5 years thereafter. In updating the
strategy, the President shall incorporate results of the evaluation under
section 214.</text>
</paragraph></subsection></section><section id="HC40921371E0648918BA07C25D052CB55"><enum>214.</enum><header>National
evaluation of health impacts</header><text display-inline="no-display-inline">The Secretary, in coordination with the
Secretary of Health and Human Services, shall—</text>
<paragraph id="H818F78E60DA24300814B4D74ACA3064A"><enum>(1)</enum><text>develop
recommendations for appropriate evaluation measures and criteria for a study of
national significance on the health impacts of the strategies under this
subtitle; and</text>
</paragraph><paragraph id="H872128B1DC4C4B749D8B64C5A5D08ACD"><enum>(2)</enum><text>carry out such a
study.</text>
</paragraph></section><section id="HE7B6492051594078B411D7E2914D9345"><enum>215.</enum><header>Technical
assistance and best practices</header><text display-inline="no-display-inline">The Secretary shall—</text>
<paragraph id="H7A8A16F321C34930A2655C7BE3DC70E8"><enum>(1)</enum><text display-inline="yes-display-inline">provide technical assistance to grantees
under section 212 through cooperative agreements with national organizations
with a proven track record of encouraging Americans, especially children,
youth, and families, to be physically active outdoors; and</text>
</paragraph><paragraph id="H7BF53C80118F4BAAB4EFAAC684341C9D"><enum>(2)</enum><text display-inline="yes-display-inline">disseminate best practices that emerge from
strategies funded under this subtitle.</text>
</paragraph></section><section id="H7BF482330C2B40A2B8634FB472C8E310"><enum>216.</enum><header>Authorization
of appropriations</header>
<subsection id="HD74DC97027324CF1B54EBCDEEA962A0C"><enum>(a)</enum><header>In
general</header><text>There are authorized to be appropriated to the Secretary
to carry out this subtitle such sums as may be necessary for each of fiscal
years 2014 through 2018.</text>
</subsection><subsection id="HA2A04E722966498EBD94B15F7424344C"><enum>(b)</enum><header>Limitation</header><text>Of
the amounts made available to carry out this subtitle for a fiscal year, not
more than 5 percent may be made available for carrying out section 215.</text>
</subsection><subsection id="H02D0E02EA6E84C8AA022F6AE8494AAE8"><enum>(c)</enum><header>Supplement, not
supplant</header><text>Funds made available under this subtitle shall be used
to supplement, and not supplant, any other Federal, State, or local funds
available for activities that encourage Americans, especially children, youth,
and families to be physically active outdoors.</text>
</subsection></section></subtitle><subtitle id="H1DB40AEF413840338CBF0985535107C3"><enum>C</enum><header>Other
provisions</header>
<section id="H2756A398101849F6A56A35FC7C9521F6"><enum>221.</enum><header>Physical
education guidelines for elementary and secondary schools</header><text display-inline="no-display-inline">The Secretary of Health and Human Services,
acting through the Director of the Centers for Disease Control and
Prevention—</text>
<paragraph id="HF6184038D3AC4248808FC6EE59DB53E4"><enum>(1)</enum><text>not later than 1
year after the date of the enactment of this Act, shall issue and make
available to the public guidelines for physical education in elementary and
secondary schools; and</text>
</paragraph><paragraph id="H376902A3A80B4191A7F89C62C196F93F"><enum>(2)</enum><text display-inline="yes-display-inline">not less than every 5 years thereafter,
update such guidelines as appropriate.</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="H9C1904E410214076982CE56615D89937" section-type="subsequent-section"><enum>222.</enum><header>Treating physical
education as a core academic subject for elementary and secondary education
grants</header><text display-inline="no-display-inline">Section 9101(11) of the
Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801(11)) is amended
by inserting <quote>physical education,</quote> after
<quote>arts,</quote>.</text>
</section><section display-inline="no-display-inline" id="HF10343496E6B49EB976AB311A6CE8D29" section-type="subsequent-section"><enum>223.</enum><header>Physical activity
guidelines for preschool children</header><text display-inline="no-display-inline">Not later than 1 year after the date of the
enactment of this Act, the Secretary of Health and Human Services, acting
through the Centers for Disease Control and Prevention, shall—</text>
<paragraph id="H1761EFEC3CFD49FEA847050B6886EFE8"><enum>(1)</enum><text>issue physical
activity guidelines for preschool children,</text>
</paragraph><paragraph id="H052FB514F6F34051A8EF7C3911FC29E8"><enum>(2)</enum><text>make such
guidelines available to the public, and</text>
</paragraph><paragraph id="H73532454FD074FDEA63B946F12DE9955"><enum>(3)</enum><text>make a
recommendation to each Head Start agency that such agency implement such
guidelines as appropriate in the Head Start program carried out by such
agency.</text>
</paragraph></section><section id="HB5C505DD410544548CF5771C18F3527D"><enum>224.</enum><header>Tracking
physical activity in schools</header>
<subsection id="H37D35302883344B9A64C612B0BE88549"><enum>(a)</enum><header>Report
cards</header><text>Section 1111(h) of the Elementary and Secondary Education
Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20
U.S.C. 6311(h)</external-xref>) is amended—</text>
<paragraph id="H763F111EB64742E796C231BE20D14EC0"><enum>(1)</enum><text>in paragraph
(1)(C)—</text>
<subparagraph id="H71F97314A4FF46A383644F29B7B35AD2"><enum>(A)</enum><text>in clause (vii),
by striking <quote>and</quote> after the semicolon;</text>
</subparagraph><subparagraph id="H071E32F9344C43B29761746E72D41A4A"><enum>(B)</enum><text>in clause (viii),

agencies in the State that have a required, age-appropriate physical education
curriculum for all students in elementary schools, middle schools, and
secondary schools that adheres to national guidelines adopted by the Centers
for Disease Control and Prevention and State standards;</text>
</clause><clause id="H527F0E2ED5224CFBB6FF3C4CC1CD10ED"><enum>(xi)</enum><text display-inline="yes-display-inline">the percentage of elementary school and
secondary school physical education teachers who are State licensed or
certified as physical education teachers; and</text>
</clause><clause id="H7AA2A2FDEA234DB3BAF0068710146176"><enum>(xii)</enum><text>the percentage
of schools that have a School Health Council that includes parents, students,
representatives of the school food authority, representatives of the school
board, school administrators and members of the public and that meets monthly
to promote a healthy school
environment.</text>
</clause><after-quoted-block>;</after-quoted-block></quoted-block>
</subparagraph></paragraph><paragraph id="H58AD0CCF87F045D9A2B449029889833B"><enum>(2)</enum><text>in paragraph

</subparagraph></paragraph></subsection><subsection id="HB3BC7CBF1E004897B1C615EB677272DD"><enum>(b)</enum><header>Promoting
physical education and activity in school programs</header>
<paragraph id="HF3E3650018E940049812EE7A31E9D8FB"><enum>(1)</enum><header>Elementary and
secondary school counseling programs</header><text>Section 5421 of the
Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7245">20 U.S.C. 7245</external-xref>) is amended—</text>

Research Council Study</header><text>Not later than 180 days after the date of
enactment of this Act, the Secretary of Education shall enter into a contract
with the National Research Council of the National Academy of Sciences
to—</text>
<paragraph id="H22453677F13A45F0B3C5B596C2D0BB9C"><enum>(1)</enum><text display-inline="yes-display-inline">examine and make recommendations
regarding—</text>
<subparagraph id="H863904F927A04DC4822F1F9EF3159BB3"><enum>(A)</enum><text display-inline="yes-display-inline">various means that may be employed to
incorporate physical activity into Head Start and childcare settings,
elementary, middle, and high school settings, and before- and after-school
programs; and</text>
</subparagraph><subparagraph id="HB409E94DEF634F169EB827AA4A0C5C52"><enum>(B)</enum><text>innovative and
effective ways to increase physical activity for all students;</text>
</subparagraph></paragraph><paragraph id="H9EAFB1811CFB4A039F0086A0D0CE682E"><enum>(2)</enum><text>study the impact
of health, level of physical activity, and amount of physical education on
students’ ability to learn and maximize performance in school; and</text>
</paragraph><paragraph id="H7E08A74A24234E15AEDBA47DB161DC8B"><enum>(3)</enum><text>study and provide
specific recommendations for—</text>
<subparagraph id="HC6A67B1995A04356826375C741D869F4"><enum>(A)</enum><text>effectively
measuring the progress of students, at the school level, in improving their
health and well-being, including improving their—</text>
<clause id="H21C104A0844D4A858B776CF5D4FADA19"><enum>(i)</enum><text>knowledge,
awareness, and behavior changes, related to nutrition and physical
activity;</text>
</clause><clause id="H5C9B8742C6B84BCFAEA4EF1E5C4D096F"><enum>(ii)</enum><text>cognitive
development, and fitness improvement, in physical education;</text>
</clause><clause id="H2C24119DA3BF486E9027015336836976"><enum>(iii)</enum><text>knowledge of
lifetime physical activity and health promotion;</text>
</clause><clause id="H07630ED294124244BD05EC4629CD4D61"><enum>(iv)</enum><text>decrease in
obesity; and</text>
</clause><clause id="H117FE9A831B14086B138519E9B8E2999"><enum>(v)</enum><text>levels on overall
health indicators; and</text>
</clause></subparagraph><subparagraph id="H344694E62A764A14B5AAFE23E2957F13"><enum>(B)</enum><text>effectively
measuring the progress of students, at the school level, in increasing physical
activity.</text>
</subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="HC78F4781BB794202B135788A76F6AFA8" section-type="subsequent-section"><enum>225.</enum><header>Employer-provided
off-premises health club services</header>
<subsection id="HBDD2FFC96E0F4B359DAF36DF06E28501"><enum>(a)</enum><header>Treatment as
fringe benefit</header><text>Subparagraph (A) of section 132(j)(4) of the
Internal Revenue Code of 1986 (relating to on-premises gyms and other athletic
facilities) is amended to read as follows:</text>

<subparagraph id="H47292E41530A40EFA312D492C3C02E0E"><enum>(A)</enum><header>In
general</header><text>Gross income shall not include—</text>

on-premises athletic facility provided by an employer to the employer’s
employees, and</text>
</clause><clause id="H61A8A3FE1C96478FA1247BB8E1F05634"><enum>(ii)</enum><text>so much of the
fees, dues, or membership expenses paid by an employer to an athletic or
fitness facility described in subparagraph (C) on behalf of the employer’s
employees as does not exceed $900 per employer per
year.</text>
</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="H85B0DF6007E44F338937014C603062AD"><enum>(b)</enum><header>Athletic
facilities described</header><text>Paragraph (4) of section 132(j) of such Code
is amended by adding at the end the following new subparagraph:</text>

or fitness facilities described</header><text>For purposes of subparagraph
(A)(ii), an athletic or fitness facility described in this subparagraph is a
facility—</text>
<clause id="H8C480FAE3CA84B0EA476910FD093CC66"><enum>(i)</enum><text>providing
instruction in a program of physical exercise, offering facilities for the
preservation, maintenance, encouragement, or development of physical fitness,
or serving as the site of such a program of a State or local government,</text>
</clause><clause id="HF2DDF8394ACE45938416BE55E3D33744"><enum>(ii)</enum><text>which is not a
private club owned and operated by its members,</text>
</clause><clause id="H92AC11424F65483BB7AED2F33FB385B7"><enum>(iii)</enum><text>which does not
offer golf, hunting, sailing, or riding facilities,</text>
</clause><clause id="HD6CEDDB4D62D47C88E303D1238226FA0"><enum>(iv)</enum><text>whose health or
fitness facility is not incidental to its overall function and purpose,
and</text>
</clause><clause id="H0112C71940DE498E8D03DF9F8C4E6FAB"><enum>(v)</enum><text>which is fully
compliant with the State of jurisdiction and Federal anti-discrimination
laws.</text>
</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

<clause id="H7863F9AB97C049C5B50EC68D63C1EE98"><enum>(i)</enum><text>for membership at
a fitness center,</text>
</clause><clause id="H5E34AD277D8B477FBF2A17C105EFE71F"><enum>(ii)</enum><text>for participation
or instruction in a program of physical exercise or physical activity,
and</text>
</clause><clause id="H90A87E2164C843BE960CAB07E52626B2"><enum>(iii)</enum><text>for equipment
for use in a program (including a self-directed program) of physical exercise
or physical activity.</text>
</clause></subparagraph><subparagraph id="H5EF02D3FEC2E44878AA8D0046F6526D7"><enum>(B)</enum><header>Overall dollar
limitation</header><text>The aggregate amount treated as qualified sports and
fitness expenses with respect to any taxpayer for any taxable year shall not
exceed $1,000 ($2,000 in the case of a joint return or a head of household (as
defined in section 2(b))).</text>
</subparagraph><subparagraph display-inline="no-display-inline" id="H6DB627723E35428084921DEE2F15D74B"><enum>(C)</enum><header>Fitness facility
defined</header><text>For purposes of subparagraph (A)(i), the term
<term>fitness facility</term> means a facility—</text>
<clause id="H3D30CC0CBFF34BB88F9E50D5354B7151"><enum>(i)</enum><text>providing
instruction in a program of physical exercise, offering facilities for the
preservation, maintenance, encouragement, or development of physical fitness,
or serving as the site of such a program of a State or local government,</text>
</clause><clause id="HD356761F52A4483FBC57AD4113929D23"><enum>(ii)</enum><text>which is not a
private club owned and operated by its members,</text>
</clause><clause id="H1FADB38DED07409393EBFD5927B65172"><enum>(iii)</enum><text>which does not
offer golf, hunting, sailing, or riding facilities,</text>
</clause><clause id="HA7D3F1AFC764430DB0340411B4A46FED"><enum>(iv)</enum><text>whose health or
fitness facility is not incidental to its overall function and purpose,
and</text>
</clause><clause id="HD2F0C4A41F994FA5AC790B79806F53C0"><enum>(v)</enum><text>which is fully
compliant with the State of jurisdiction and Federal anti-discrimination
laws.</text>
</clause></subparagraph><subparagraph id="HE4A525E07C1F4159BD2DBCDFE4527C87"><enum>(D)</enum><header>Limitations
related to sports and fitness equipment</header><text>Amounts paid for
equipment described in subparagraph (A)(iii) shall be treated as a qualified
sports and fitness expense only—</text>
<clause id="H424BF8CCF1CD4DD0A7B26CC00923C5C5"><enum>(i)</enum><text>if
such equipment is utilized exclusively for participation in fitness, exercise,
sport, or other physical activity programs,</text>
</clause><clause id="HC1BFF39D87724CD881CCB8B31445AF2E"><enum>(ii)</enum><text>if such equipment
is not apparel or footwear, and</text>
</clause><clause id="H16A8E845C0224E37937A992D1668246B"><enum>(iii)</enum><text>in the case of
any item of sports equipment (other than exercise equipment), with respect to
so much of the amount paid for such item as does not exceed $250.</text>
</clause></subparagraph><subparagraph id="H08C1B757A60D496797EC6573034E49E5"><enum>(E)</enum><header>Programs which
include components other than physical exercise and physical
activity</header><text display-inline="yes-display-inline">Rules similar to the
rules of section 213(d)(6) shall apply in the case of any program that includes
physical exercise or physical activity and also other components. For purposes
of the preceding sentence, travel and accommodations shall be treated as an
other
component.</text>
</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="HD73822BA65DE4332A1B3BB9D984A5274"><enum>(c)</enum><header>Exception for
health savings accounts</header><text>Subparagraph (A) of section 223(d)(2) of
such Code is amended by inserting <quote>, determined without regard to
paragraph (1)(E) thereof</quote> after <quote>section 213(d)</quote>.</text>
</subsection><subsection id="HAD66D07E8A584820BE6B86C8B13E9987"><enum>(d)</enum><header>Effective
date</header><text>The amendment made by this section shall apply to taxable
years beginning after the date of the enactment of this Act.</text>
</subsection></section><section id="H75F1788CB45449D3983AF88904BF272E"><enum>227.</enum><header>National youth
sports program revitalization</header><text display-inline="no-display-inline">Section 682(g) of the Community Services
Block Grant Act (42 U.S.C. 9923(g)) is amended by striking
<quote>$15,000,000</quote> and all that follows through <quote>2003</quote>,
and inserting <quote>$20,000,000 for each of the fiscal years 2014 through
2024</quote>.</text>
</section></subtitle><enum>III</enum><header>Improving access
to nutritional information and healthy foods</header>
<section id="HC79FFB04E6C8437198D4218D3B4D604E"><enum>301.</enum><header>Consumer
education</header><text display-inline="no-display-inline">Subsection (c) of
section 2 of the Nutrition Labeling and Education Act of 1990 (Pub. L. 101–535;
104 Stat. 2353, 2357; 21 U.S.C. 343 note) is amended to read as follows:</text>

<subsection id="H9B78DD89115E4C7FAEB6C3F39FDDF83C"><enum>(c)</enum><header>Consumer
education</header>
<paragraph id="HCD2AF27181F84440BAC2318A2910405D"><enum>(1)</enum><header>In
general</header><text>The Secretary of Health and Human Services shall carry
out activities which educate consumers about—</text>
<subparagraph id="HA7D95A76638644AA8FB9C035536835E7"><enum>(A)</enum><text>the availability
of nutrition information in the label or labeling of food;</text>
</subparagraph><subparagraph id="HCBEEF49670484FDDB9DE499F5C0EADEB"><enum>(B)</enum><text>the importance of
that information in maintaining healthy dietary practices;</text>
</subparagraph><subparagraph id="HBFC0E992ED624FE296F3C47C0F18FFA8"><enum>(C)</enum><text>the importance of
physical activity and healthy lifestyles; and</text>
</subparagraph><subparagraph id="HB12CAD19B2B44B8C8F9F32BF7FF45436"><enum>(D)</enum><text>the importance of
maintaining an energy balance in consumption and activity.</text>
</subparagraph></paragraph><paragraph id="HF8BE728987EC4D91A31B8C279983AA42"><enum>(2)</enum><header>Certain
activities</header><text>Activities under paragraph (1) shall include the use
of public education campaigns, public statements, and other resources designed
to educate consumers about the subjects described in subparagraphs (A) through
(D) of such
paragraph.</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="HB811102C68164BA2ACB29F6DCCF05F6B"><enum>302.</enum><header>Expand team
nutrition training grants</header><text display-inline="no-display-inline">Section 19 of the Child Nutrition Act of
1966 (20 U.S.C. 1788) is amended—</text>
<paragraph id="H7B528692E44046FB81C020F7172CF0B4"><enum>(1)</enum><text>by redesignating
subsection (l) as subsection (m); and</text>
</paragraph><paragraph id="HC6735FF663ED4FA198D399A82997C44F"><enum>(2)</enum><text>by inserting after
subsection (k), the following:</text>
<quoted-block display-inline="no-display-inline" id="H6632EED25B1041A88905BA9580FB504A" style="OLC">
<subsection id="HB563408D03944CB1BC4B91F59B1EF2A7"><enum>(l)</enum><header>Infrastructure
improvement grants</header>
<paragraph id="HC2FC880E44DD49DE8C7A3848660D87B3"><enum>(1)</enum><header>In
general</header><text>Subject to the availability of funds to carry out this
subsection, the Secretary shall award one-time grants, on a competitive basis,
to eligible State agencies to assist such State agencies in carrying out
infrastructure improvements for the purpose of improving children’s lifelong
eating and physical habits, consistent with the most recent Dietary Guidelines
for Americans published under section 301 of the National Nutrition Monitoring
and Related Research Act of 1990 (7 U.S.C. 5341).</text>
</paragraph><paragraph id="H0CFB9209D99D41C298578777086DB04B"><enum>(2)</enum><header>Eligible State
agency</header><text>For purposes of this subsection, an <quote>eligible State
agency</quote> means—</text>
<subparagraph id="H20CC1B4C3CE14127BCB158CC206F8866"><enum>(A)</enum><text>a State agency
that participates in—</text>
<clause id="H1EDA8856B8DD4B4684E9A104BFD415F5"><enum>(i)</enum><text>the school lunch
program under the Richard B. Russell National School Lunch Act (42 U.S.C. 1751
et seq.);</text>
</clause><clause id="H18E9628BD48B4E9A83AE63406700E83D"><enum>(ii)</enum><text>the school
breakfast program under section 4 of this Act; or</text>
</clause><clause id="H103D1C4A61C949AE9BC142208D59241A"><enum>(iii)</enum><text display-inline="yes-display-inline">the child and adult care food program under
the Richard B. Russell National School Lunch Act (42 U.S.C. 1766); or</text>
</clause></subparagraph><subparagraph id="H45F2BDB01A89442C8C84DE98D0CED5A8"><enum>(B)</enum><text>a consortium of 2
or more such State agencies—</text>
<clause id="HCEDA455DAE614CAAAB37B2984A315B27"><enum>(i)</enum><text>located in the
same State; or</text>
</clause><clause id="HE9466021C23446BAA2BFBC735F0BB9DD"><enum>(ii)</enum><text>located in
different States.</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="H8A1E50AA96A142A6AD84756FE722A4E4"><enum>(3)</enum><header>Application</header><text display-inline="yes-display-inline">To receive a grant under this subsection,
an eligible State agency shall submit to the Secretary an application at such
time, in such manner, and containing such information as the Secretary may
require.</text>
</paragraph><paragraph id="H3FA66BCEE1FB45B5AAC928D0381C7890"><enum>(4)</enum><header>Uses of
funds</header>
<subparagraph id="H8ABAA989FB0746D0BC1D73BF4408BA7B"><enum>(A)</enum><header>Required
uses</header><text>An eligible State agency that receives a grant under this
subsection shall use such funds to cover the costs of infrastructure
improvements related to the school lunch program, school breakfast program, or
the child and adult food care program, including improvements in kitchen
equipment and other foodservice equipment used to serve or store food offered
to children under any such program.</text>
</subparagraph><subparagraph id="HD3686FE01C6E4ADD88C5F61C49DB6DE6"><enum>(B)</enum><header>Authorized
uses</header><text>An eligible State agency that receives a grant under this
subsection may use such funds to award subgrants to local educational agencies
to carry out the activities described in subparagraph (A).</text>
</subparagraph></paragraph><paragraph id="HD164848C55D44E899DB106E5D19A09E0"><enum>(5)</enum><header>Recordkeeping</header><text>An
eligible State agency receiving a grant under this subsection shall keep a
record of the use of the grant
funds.</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section id="H3CDE6364D30F4093986EFF158D9DCB70"><enum>303.</enum><header>Urban and
Native-American Community Garden Grant Program</header>
<subsection id="H5E6F391BF83C444D8C55B23351FB7323"><enum>(a)</enum><header>Program
established</header><text display-inline="yes-display-inline">From the amounts
appropriated to carry out this section, the Secretary of Agriculture shall
award grants to eligible entities to expand, establish, or maintain urban
community gardens.</text>
</subsection><subsection id="H69990BA16B494258ABA8B7A1B26043BB"><enum>(b)</enum><header>Eligible
entity</header><text>For purposes of this section, an eligible entity
means—</text>
<paragraph id="HD3C0C02E5B8A47B0815771DA4F17A0D5"><enum>(1)</enum><text>a
private or for-profit organization; or</text>
</paragraph><paragraph id="H3D6A0D14A98A491982D033F605EE8C28"><enum>(2)</enum><text>a
unit of general local government, or tribal government, located on tribal land
or in a low-income community.</text>
</paragraph></subsection><subsection id="HFAEDBBB4C72B4369887071EAF41B996C"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">In order to receive a grant under this
section, an eligible entity shall submit to the Secretary an application at
such time, in such manner, and containing such information as the Secretary may
require, including—</text>
<paragraph id="H035C9BD0FF9D41958D6AE5C8BEE5ACC0"><enum>(1)</enum><text>an assurance that
priority for hiring for jobs created by the expansion, establishment, or
maintenance of an urban community garden funded with a grant received under
this section will be given to individuals who reside in the community where the
garden is located; and</text>
</paragraph><paragraph id="H28243C64B04D4782B9C87C396E856A7B"><enum>(2)</enum><text>a
demonstration that the eligible entity is committed to providing non-Federal
financial or in-kind support (such as providing a water supply) for the urban
community garden for which the entity receives funds under this section.</text>
</paragraph></subsection><subsection id="HF6396C45E9954B3F996A088CE6774F54"><enum>(d)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph id="H93DB92F72A164CC7BEE6A80963A45E7B"><enum>(1)</enum><header>Low-income
community</header><text>The term <term>low-income communities</term>
includes—</text>
<subparagraph id="H70FA91B867D54B659BF78C549BB92BA8"><enum>(A)</enum><text display-inline="yes-display-inline">communities with a high percentage of
children eligible for free and reduced priced lunches under the Richard B.
Russell National School Lunch Act (42 U.S.C. 1751 et seq.); and</text>
</subparagraph><subparagraph id="H759420AC68CE45F3A591AD281C0AF121"><enum>(B)</enum><text>any other
communities determined by the Secretaries to be low-income for purposes of this
section.</text>
</subparagraph></paragraph><paragraph id="H6C5E0AF5FE49479D8C77D8E0159AFA43"><enum>(2)</enum><header>Unit of general
local government</header><text>The term <term>unit of general local
government</term> has the meaning given such term in section 102 of the Housing
and Community Development Act of 1974 (42 U.S.C. 5302).</text>
</paragraph></subsection><subsection display-inline="no-display-inline" id="H19418864DECB4283B356BB8D51020FBF"><enum>(e)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">For each of
fiscal years 2014 through 2018, there are authorized to be appropriated to the
Secretary such sums as may be necessary to award grants under this
section.</text>
</subsection></section><enum>IV</enum><header>Realigning
Transportation Policy to Help Promote Healthy Lifestyles</header>
<section id="H8006F60FA5F7480EB0927771D2586125" section-type="subsequent-section"><enum>401.</enum><header>Grants to promote
planning decisions and policies that increase access to physical
activity</header>
<subsection id="H87740E603DD346E08EF368E12A6364A9"><enum>(a)</enum><header>Grants</header><text>The
Secretary of Transportation may make grants to eligible entities for the
purpose of assisting local planning decisions and policies that increase the
access of individuals to physical activity.</text>
</subsection><subsection id="HBEC699FF4A494F90A2E02F23ADA083A4"><enum>(b)</enum><header>Activities under
grants</header><text>The activities of eligible entities that may be funded by
a grant under subsection (a) include the following:</text>
<paragraph id="HB5DC947D51DD4F539EE69C6F7E326547"><enum>(1)</enum><text display-inline="yes-display-inline">The coordination of activities carried out
by local government officials (including planning, public works, housing, and
transportation officials), school boards, and others to increase the access of
individuals to physical activity through—</text>
<subparagraph id="H7429324E0E344DCEB18A6375529A2BDA"><enum>(A)</enum><text>improved
integration of land use, housing, transportation, and infrastructure planning;
and</text>
</subparagraph><subparagraph id="HFF90EBACCE354F46A795C42DF113B22C"><enum>(B)</enum><text>consideration of
impacts on physical activity levels during such planning.</text>
</subparagraph></paragraph><paragraph id="HFC3792E46A4B4DD484003F63AF15ED57"><enum>(2)</enum><text>The formulation of
strategies to establish and implement—</text>
<subparagraph id="H77CC5DD415434188B68712387A35892C"><enum>(A)</enum><text>plans and policies
that increase infrastructure for pedestrians and bicyclists to connect such
individuals to schools, recreation opportunities, jobs, and retail
opportunities, including policies requiring developers to build sidewalks and
bicycle lanes; or</text>
</subparagraph><subparagraph id="HA9DF864780CC40C7BC15458512F9CBBA"><enum>(B)</enum><text display-inline="yes-display-inline">plans and policies that place schools
within neighborhoods and provide bike paths, sidewalks, trails, and other
infrastructure to encourage and make possible the walking and bicycling to
school of students and staff.</text>
</subparagraph></paragraph><paragraph id="HAA30449C4E004E00B4905EA998EB57BE"><enum>(3)</enum><text display-inline="yes-display-inline">The carrying out of health impact
assessments with respect to proposals for the placement or construction of
buildings, sidewalks, roads, trails, schools, or other aspects of the built
environment.</text>
</paragraph></subsection><subsection id="H627E7F577E984D0FB146EBD886038ED5"><enum>(c)</enum><header>Reporting</header>
<paragraph id="HB5AEB96FD1F246C0BE04B62919B87B3C"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">An eligible entity
that receives a grant under subsection (a) shall submit to Congress and the
Secretary of Transportation a report on the extent to which such grant
has—</text>
<subparagraph id="HDE0E081008344FDCB7ED20467C01D5B3"><enum>(A)</enum><text display-inline="yes-display-inline">led to planning decisions and policies that
increase the access of individuals to physical activity; and</text>
</subparagraph><subparagraph id="H9EE51414939341588BA7174B7D9C75BC"><enum>(B)</enum><text>led to an
improvement in the health of individuals.</text>
</subparagraph></paragraph><paragraph id="H4ECD6136B45844CCA62A9A18DDC97A5E"><enum>(2)</enum><header>Timing</header><text display-inline="yes-display-inline">A report under paragraph (1) shall be made
not less than 3 years and not more than 5 years after the date on which such
grant is received.</text>
</paragraph></subsection><subsection id="H6BF1F69EF66F4E919D3CCC16136855BA"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions
apply:</text>
<paragraph id="HB7F13888259146CFAE516CA5E09CBDAE"><enum>(1)</enum><header>Built
environment</header><text display-inline="yes-display-inline">The term
<term>built environment</term> means any buildings or spaces that are created
or modified by individuals, including homes, schools, workplaces, parks and
other recreation areas, greenways, business areas, and transportation
areas.</text>
</paragraph><paragraph id="H9066A0CE6E0B447F8B80967CF47F9201"><enum>(2)</enum><header>Eligible
entity</header><text>The term <term>eligible entity</term> means a local
government agency or group of such agencies with jurisdiction over planning or
land use decisions.</text>
</paragraph><paragraph id="H484B44D1E8504149B32B857F5A6983D3"><enum>(3)</enum><header>Health impact
assessment</header><text>The term <term>health impact assessment</term> means,
in relation to a proposal, an assessment of the impact that the proposal will
have on the health of individuals if implemented.</text>
</paragraph></subsection></section><section id="H7AB3EB801C404C7AABF699E65A5E6B47" section-type="subsequent-section"><enum>402.</enum><header>Joint use
agreements</header>
<subsection id="HE694855F043C447F90C6484EA7CE210A"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary may make a grant to any
eligible school or other public or nonprofit entity for the purposes of meeting
either or both of the following:</text>
<paragraph id="H8B41F56E9171432E9A4AA8E715D7FC1B"><enum>(1)</enum><text display-inline="yes-display-inline">Costs incurred by the school or other
entity in negotiating or entering into a joint use agreement.</text>
</paragraph><paragraph id="H08FC60199D0745D48C8B4C045A5FD041"><enum>(2)</enum><text display-inline="yes-display-inline">Costs payable under a joint use agreement
during the first year in which the joint use agreement is in force.</text>
</paragraph></subsection><subsection id="H10DA94345E40459A95269B1A5A50E85A"><enum>(b)</enum><header>Priority</header><text display-inline="yes-display-inline">In making grants under subsection (a), the
Secretary shall give priority to schools or other public or nonprofit entities
in areas—</text>
<paragraph id="HAD768FB2B91E4F6F8A5B3F503719F20E"><enum>(1)</enum><text>where obesity
rates are above the national average;</text>
</paragraph><paragraph id="H47499AB30864488E828220208D997247"><enum>(2)</enum><text display-inline="yes-display-inline">where at least 50 percent of the residents
are below the poverty line; or</text>
</paragraph><paragraph id="H0088AC4B98E44D1E8C0B55249F4513A2"><enum>(3)</enum><text>that lack safe,
accessible, and affordable fitness and recreational facilities.</text>
</paragraph></subsection><subsection id="H0FD9E9330F974F36B3D164A20200394C"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions
apply:</text>
<paragraph commented="no" id="H9EF250DA9FCD4211AEC8BB19AF0A6E2A"><enum>(1)</enum><header>Eligible
school</header><text display-inline="yes-display-inline">The term
<term>eligible school</term> means any elementary school or secondary school
within the meaning of section 9101 of the Elementary and Secondary Education
Act of 1965 (20 U.S.C. 7801).</text>
</paragraph><paragraph id="HFB3E4805763A4F008C0AA55532E95CBA"><enum>(2)</enum><header>Joint use
agreement</header><text display-inline="yes-display-inline">The term
<term>joint use agreement</term> means an agreement between an eligible school
and another public or nonprofit entity relating to the use of a school’s
facilities or equipment by people other than the school’s students or
staff.</text>
</paragraph><paragraph id="H4046CD7C89564E1F884B6FC945A1CC78"><enum>(3)</enum><header>Poverty
line</header><text display-inline="yes-display-inline">The term <term>poverty
line</term> has the meaning given such term in section 673 of the Community
Services Block Grant Act (42 U.S.C. 9902).</text>
</paragraph><paragraph id="HC0E1DFA298BC4A4BA97E84A70D9E73BB"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
Secretary of Health and Human Services acting through the Director of the
Centers for Disease Control and Prevention.</text>
</paragraph></subsection></section><enum>V</enum><header>Research and
Assessment Tools</header>
<section commented="no" display-inline="no-display-inline" id="HF026969725104C809745F72CC8B5DCA7" section-type="subsequent-section"><enum>501.</enum><header>National Center for
Health Statistics</header><text display-inline="no-display-inline">Section 306
of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42
U.S.C. 242k) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H943760A7A6594AEB8DD48834669E02DF"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (m)(4)(B), by striking

fitness levels and energy expenditure of children and youth; and</text>

Secretary, acting through the Center, may make grants to States, public
entities, and nonprofit entities.</text>

may provide technical assistance, standards, and methodologies to grantees
supported by this subsection in order to maximize the data quality and
comparability with other

research</header>
<subsection commented="no" display-inline="no-display-inline" id="H7A6F8E63D2EC4BF3AC9849B61F6628C7"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Not later than 1 year
after the date of enactment of this Act, the Secretary of Health and Human
Services shall submit to the Committee on Health, Education, Labor, and
Pensions of the Senate and the Committee on Energy and Commerce of the House of
Representatives a report on research conducted on causes and health
implications (including mental health implications) of obesity and being
overweight.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="H87126B2D6BDC4DB38A6EC0647FC67FC4"><enum>(b)</enum><header>Content</header><text display-inline="yes-display-inline">The report described in subsection (a)
shall contain—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HCE89651C471647F68079C2C6501B15A9"><enum>(1)</enum><text display-inline="yes-display-inline">descriptions on the status of relevant,
current, ongoing research being conducted in the Department of Health and Human
Services including research at the National Institutes of Health, the Centers
for Disease Control and Prevention, the Agency for Healthcare Research and
Quality, the Health Resources and Services Administration, and other offices
and agencies;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H21CA6768274E410B9A12B7F751F2C1C4"><enum>(2)</enum><text display-inline="yes-display-inline">information about what these studies have
shown regarding the causes, prevention, and treatment of, obesity and being
overweight; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H949739A13F98400FAAFA487CEE7835AC"><enum>(3)</enum><text display-inline="yes-display-inline">recommendations on further research that is
needed, including research among diverse populations, the plan of the
Department of Health and Human Services for conducting such research, and how
current knowledge can be disseminated.</text>
