		<official-title>To amend the Migratory Bird Treaty Act to provide certain
		  exemptions relating to the taking of migratory game birds.</official-title>

		<section id="H760BE414366A4C1FB0245A75C8A3F7F0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Farmers Protection Act of
			 2012</short-title></quote>.</text>
		</section><section id="H8C5DF29687624C85A1751A5D9D6B94A3"><enum>2.</enum><header>Exemptions on
			 certain land</header><text display-inline="no-display-inline">Section 3 of the
			 Migratory Bird Treaty Act (16 U.S.C. 704) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H32D81A46E42F4074A61281FCAF2B6601" style="OLC">
				<subsection id="H3683FB7EECF64252AB8199565F25A26C"><enum>(c)</enum><header>Exemptions on
				certain land</header>
					<paragraph id="H5A031DE65A824383BC0BD4C0686CD421"><enum>(1)</enum><header>In
				general</header><text>Nothing in this section prohibits the taking of any
				migratory game bird, including waterfowl, coots, and cranes, on or over land
				that—</text>
						<subparagraph id="HEC06743515CF4AEB8513178D062A1831"><enum>(A)</enum><text>is not a baited
				area; and</text>
						</subparagraph><subparagraph id="HE79803EA04964A039B81AC656AD3BCC7"><enum>(B)</enum><text>contains—</text>
							<clause id="H3F83C60EE1CD407FAC16503A38C9E590"><enum>(i)</enum><text>a
				standing crop or flooded standing crop, including an aquatic crop;</text>
							</clause><clause id="H5094CFFABCB54066A50297DBDC4D798D"><enum>(ii)</enum><text>standing,
				flooded, or manipulated natural vegetation;</text>
							</clause><clause id="H7C6BCF54F8B94EEAB9696F2FBCC7D09C"><enum>(iii)</enum><text>flooded
				harvested cropland; or</text>
							</clause><clause id="H739FB33E9A7D445F833409A7048FA076"><enum>(iv)</enum><text>based on the
				determination of the applicable State office of the Cooperative Extension
				System of the Department of Agriculture at the request of the Secretary of the
				Interior, an area on which seed or grain has been scattered solely as the
				result of a normal agricultural planting, harvesting, post-harvest
				manipulation, or normal soil stabilization practice.</text>
							</clause></subparagraph></paragraph><paragraph id="H98FDDE06F44C490980FE2735985F5895"><enum>(2)</enum><header>Determinations</header>
						<subparagraph id="H16A788C6B8DE47A19B4C03E771955CDA"><enum>(A)</enum><header>In
				general</header><text>For purposes of making a determination under paragraph
				(1)(B)(iv), each State office of the Cooperative Extension System of the
				Department of Agriculture shall determine the activities in that State that the
				State office considers to be a normal agricultural practice in the State, such
				as mowing, shredding, discing, rolling, chopping, trampling, flattening,
				burning, or carrying out herbicide treatment.</text>
						</subparagraph><subparagraph id="H36697B5548FA4167BDAEFC54D8888DC2"><enum>(B)</enum><header>Revisions</header><text>A
				State office may revise a report described in subparagraph (A) as the State
				office determines to be necessary to reflect changing agricultural
				practices.</text>
