		<section id="HF2B73CBD27EC4E799A1EF7CAEF0D1976" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Supporting Access to Formulated and
			 Effective Compounded Drugs Act of 2012</short-title></quote> or the
			 <quote><short-title>S.A.F.E. Compounded Drugs Act of
			 2012</short-title></quote>.</text>
		</section><section id="HCDCAABCF192647D9820B9DED6CE88045"><enum>2.</enum><header>Enhanced
			 requirements for compounded drugs</header>
			<subsection id="H9282F024B4C047C6BDFFF9BFE516B288"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 503A of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 353a) is amended—</text>
				<paragraph id="H696CC2BB242246178DFC11F5335ABFED"><enum>(1)</enum><text>in subsection
			 (a)(1)(A), by inserting <quote>that is registered with the Secretary under
			 subsection (b)(6) (or is subject to the exception under subsection
			 (b)(6)(C))</quote> after <quote>State licensed pharmacy</quote>;</text>
				</paragraph><paragraph id="HBAC879A93FF04EFBB05E324F1A705D37"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="HB0D3D507AC734D27BF43FEBF92D02E68"><enum>(A)</enum><text>in paragraph
			 (1)(D), by striking <quote>regularly or in inordinate amounts (as defined by
			 the Secretary)</quote>; and</text>
					</subparagraph><subparagraph id="H9A0F2993050D4275A9C73E92A54EB165"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H2EDB32A9557B4005835E0521171D29B8" style="OLC">
							<paragraph id="HB8020B8BEF324388993F07BABAEEB66A"><enum>(4)</enum><header>Notification</header>
								<subparagraph id="HB53AE9E52CB7491699DA8D0833DD90F6"><enum>(A)</enum><header>Prescriber
				notification</header><text>Before providing a prescription order for a drug to
				be compounded under subsection (a), the physician or other licensed
				practitioner who will write such order shall—</text>
									<clause id="H13D3140EF2ED40A086C8D6FC493A0235"><enum>(i)</enum><text>inform the
				individual patient for whom such order is being written that a compounded drug
				is being prescribed; and</text>
									</clause><clause id="HADFA1C817B5C4523AB8D85C4D5482F0D"><enum>(ii)</enum><text>provide such
				patient with a written document containing information concerning the
				availability, safety, and production of compounded drugs.</text>
									</clause></subparagraph><subparagraph id="H7BD4295CE42D4BB88A4E7C1DD12D9CA3"><enum>(B)</enum><header>Confirmation by
				pharmacist</header><text>Except in the case of a compounded drug product used
				in a procedure described in
				<internal-xref idref="H4F9283AE04CF412791AA4084F0456660" legis-path="(4)(C)">subparagraph (C)</internal-xref>, a licensed pharmacist or
				licensed physician who dispenses a compounded drug under subsection (a) shall,
				at the time such drug is dispensed—</text>
									<clause id="H564667B39B8F4CA5A7136786311C6468"><enum>(i)</enum><text>confirm that the
				patient (or the individual to whom the drug is delivered on behalf of the
				patient) understands that the drug is a compounded drug; and</text>
									</clause><clause id="H41F77BF2CE6A432E81DCA372B29C0276"><enum>(ii)</enum><text>provide a written
				document containing the information described in
				<internal-xref idref="HADFA1C817B5C4523AB8D85C4D5482F0D" legis-path="(4)(A)(ii)">subparagraph (A)(ii)</internal-xref>.</text>
									</clause></subparagraph><subparagraph id="H4F9283AE04CF412791AA4084F0456660"><enum>(C)</enum><header>Provider
				notification</header><text>Prior to providing a health care service that will
				be conducted by a health care provider in a health care setting (such as a
				hospital or a physician’s office) and during which service a drug compounded
				under subsection (a) will be administered to a patient for purposes of treating
				such patient, the health care provider shall—</text>
									<clause id="HD74F6091DBEC4754912F4A4DFEA500B9"><enum>(i)</enum><text>inform the patient
				that a compounded drug will be used during the procedure; and</text>
									</clause><clause id="HF360F16BF9FA43BAA65DC099A21A21F8"><enum>(ii)</enum><text>provide such
				patient with a written document containing the information described in
				<internal-xref idref="HADFA1C817B5C4523AB8D85C4D5482F0D" legis-path="(4)(A)(ii)">subparagraph (A)(ii)</internal-xref>.</text>
									</clause></subparagraph></paragraph><paragraph id="H80B85E6F8E7F42E395563AC9EEC41F89"><enum>(5)</enum><header>Labeling</header>
								<subparagraph id="H57878E4043334316BDC0018B13174ED7"><enum>(A)</enum><header>In
				general</header><text>A drug product compounded under subsection (a) shall be
				clearly labeled as a <term>non-FDA approved compounded drug
				product</term>.</text>
								</subparagraph><subparagraph id="HC75E0A9B09074685B7772A8DE57297F0"><enum>(B)</enum><header>Development of
				requirements</header><text>In determining the requirements for the label under
				<internal-xref idref="H57878E4043334316BDC0018B13174ED7" legis-path="(5)(A)">subparagraph (A)</internal-xref>, the Secretary—</text>
									<clause id="H0F4F8ABF8AE640718A0E05804CEE6FC8"><enum>(i)</enum><text display-inline="yes-display-inline">shall establish, and consult with, a
				temporary advisory committee on compounded drug product labeling requirements;
				and</text>
									</clause><clause id="HC8C64E387D0046B89112026B18A5E126"><enum>(ii)</enum><text>may establish
				different labeling requirements for—</text>
										<subclause id="H752D530C28EB4150952555E034780921"><enum>(I)</enum><text>a compounded drug
				product intended for use by a health care provider in an office or treatment
				setting; and</text>
										</subclause><subclause id="H1600DDE040A940528EE6A0D38C9FC815"><enum>(II)</enum><text>a compounded drug
				product intended for any use not described in
				<internal-xref idref="H752D530C28EB4150952555E034780921" legis-path="(5)(B)(ii)(I)">subclause (I)</internal-xref>.</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H3FA2DBEB58F640A8A822B203C3B2812E"><enum>(6)</enum><header>Registration</header>
								<subparagraph commented="no" id="HDFCA6C87B39844C58CCEDA603B3D40BF"><enum>(A)</enum><header>Establishment of
				process</header><text>The Secretary, in consultation with experts and
				representatives of stakeholders including pharmacies, compounding pharmacies,
				State regulators, and health care providers, shall establish a process for
				pharmacies described in subsection (a)(1)(A) to register as a compounding
				pharmacy. Such registration shall be conducted through an electronic
				method.</text>
								</subparagraph><subparagraph id="H2C9EFD39563645D4BB9B08CB16FE4F0F"><enum>(B)</enum><header>Registration
				requirement</header><text>Except as provided in
				<internal-xref idref="HF8CDB8506F0D45418A92A2E1AE98270E" legis-path="(6)(C)">subparagraph (C)</internal-xref>, in order to be registered
				with the Secretary for purposes of subsection (a)(1)(A), every person who owns
				or operates a pharmacy shall submit to the Secretary, in such time and manner
				as the Secretary may require—</text>
									<clause id="H90B64E82BB3840A69EF4E0FDDB808FC3"><enum>(i)</enum><text>contact
				information for the pharmacy;</text>
									</clause><clause id="H2950203FE27E4182B16074E2AB98310A"><enum>(ii)</enum><text>the State or
				States that the pharmacy is licensed in;</text>
									</clause><clause id="H3189E60E8F45465D8F8D22906661BEE2"><enum>(iii)</enum><text>the methods used
				by the facility in compounding; and</text>
									</clause><clause commented="no" id="HEBA60C55EC804C5F93FA22C8806385E9"><enum>(iv)</enum><text>any additional
				information required by the Secretary, which may include the quantity of
				product compounded at such pharmacy for the purpose of determining if a drug
				manufacturing facility is inappropriately registering as a com­pound­ing
				pharmacy.</text>
									</clause></subparagraph><subparagraph commented="no" id="HF8CDB8506F0D45418A92A2E1AE98270E"><enum>(C)</enum><header>Exception</header><text>A
				pharmacy shall be exempt from the requirement to register under subsection
				(a)(1)(A) if the pharmacy—</text>
									<clause id="HE8C0A8A1E8E44C5B8628880B471E0A21"><enum>(i)</enum><text>employs fewer than
				20 full-time employees (or 20 full-time equivalents); and</text>
									</clause><clause id="H3FAEAC956897484BBF692F3D4766C720"><enum>(ii)</enum><text>performs
				traditional com­pound­ing of drug products for use in a single
				State.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H5E9C74DE514B4CC8AAC8F978C2212332"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF6F4222F5F9646538B77EB5852A0ECAE" style="OLC">
						<subsection id="H0FCD675F7FCA4D4081C1A93BFC9FBF00"><enum>(g)</enum><header>Database</header>
							<paragraph id="H3BF5E56290F74EABABAA17ED56654EB3"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish and maintain a database of
				information on pharmacies compounding drug products under subsection (a) that
				are licensed in more than one State, including—</text>
								<subparagraph id="HF3A34B80DEE24944B8FB1550068E06DF"><enum>(A)</enum><text>the minimum
				standards for a compounding pharmacy license in each State;</text>
								</subparagraph><subparagraph id="H7D644DA04DE74D0C8F1EECF7B92777F7"><enum>(B)</enum><text>relevant
				information provided to the Secretary by State agencies that regulate
				pharmacies; and</text>
								</subparagraph><subparagraph id="H413DAFDA195F4C168BAABC898D691848"><enum>(C)</enum><text>other information
				determined relevant by the Secretary.</text>
								</subparagraph></paragraph><paragraph id="HCD89AAC8A73F48CA920E4B2E92C09C21"><enum>(2)</enum><header>Design</header><text>The
				database under
				<internal-xref idref="H3BF5E56290F74EABABAA17ED56654EB3" legis-path="(g)(1)">paragraph (1)</internal-xref>—</text>
								<subparagraph id="H648D24039CF54BC085789A7C487D1F38"><enum>(A)</enum><text>shall be
				accessible, as determined appropriate by the Secretary, to State agencies that
				regulate pharmacies that compound drug products;</text>
								</subparagraph><subparagraph id="H46CBC231A8C24F98947BAE37196A565F"><enum>(B)</enum><text>shall enable
				States and the Secretary to share information to ensure appropriate oversight
				of pharmacies that compound drug products; and</text>
								</subparagraph><subparagraph id="HC8B7F9606CE948168A041F2FBFEE8EA2"><enum>(C)</enum><text>shall be used by
				the Secretary to inform the Federal inspection and oversight of pharmacies that
				compound drug products to ensure that issues and pharmacies identified in the
				database receive appropriate oversight.</text>
								</subparagraph></paragraph></subsection><subsection id="H34CF91401B764CCB82FAC4CBDF080D02"><enum>(h)</enum><header>Minimum
				standards</header>
							<paragraph id="HAAEB65FC728F46828A0A8434781BE416"><enum>(1)</enum><text>The Secretary
				shall establish minimum standards for the safe production of compounded drug
				products.</text>
							</paragraph><paragraph id="H428DDB25DEA24DE897D1897C63A916AF"><enum>(2)</enum><text>The Secretary
				shall determine these minimum standards and shall determine the drug products
				that must meet the minimum standards.</text>
							</paragraph><paragraph id="H9D1CE9A524104E31888C74A01A89EEF4"><enum>(3)</enum><text>The standards may
				include but is not limited to the intended route of administration and if the
				drug is sterile or non-sterile. If appropriate, the Secretary may consider the
				different types of drug products and set appropriate minimum standards for
				specific drug types or drug uses.</text>
							</paragraph></subsection><subsection id="H928822EE24344D1AA9A5F69273CF9FDE"><enum>(i)</enum><header>Training</header><text>The
				Secretary shall conduct a series of regional training opportunities for State
				agencies that regulate pharmacies that compound drug products. These training
				opportunities should include information on the minimum standards discussed in
				(h), sample inspection protocol, and recordkeeping to facilitate the inclusion
				of State findings and inspections into the database discussed in
				(g).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HECC406B31557484B85EC2284E306BB71"><enum>(b)</enum><header>Deadlines and
			 advisory committees</header>
				<paragraph id="H36C891E54CF1400E90CD4B6D5C099846"><enum>(1)</enum><header>Deadline for
			 issuance of regulations</header><text>Not later than 18 months after the date
			 of enactment of this Act, the Secretary of Health and Human Services shall
			 issue regulations to implement—</text>
					<subparagraph id="H6FC9B03D989543F7988380D7B94654EE"><enum>(A)</enum><text>paragraphs (4) and
			 (5) of section 503A(b) of the Federal Food, Drug, and Cosmetic Act, as added by
			 subsection (a); and</text>
					</subparagraph><subparagraph id="H241856D7FA4F42FDA4EBDB9974878651"><enum>(B)</enum><text>subsection (g) of
			 section 503A of such Act.</text>
					</subparagraph></paragraph><paragraph id="HBBEF53695EF0473FB487411EE71AEE04"><enum>(2)</enum><header>Labeling
			 advisory committee</header>
					<subparagraph id="HFB3AAF1CB1174EF3979A5128A33C17CC"><enum>(A)</enum><header>Establishment</header><text>The
			 Secretary of Health and Human Services shall establish an advisory committee on
			 labeling (as defined in section 201 of the Federal Food, Drug, and Cosmetic Act
			 (21 U.S.C. 321)) of compounded drug products and shall consult such committee
			 in the development of the regulations under
			 <internal-xref idref="H6FC9B03D989543F7988380D7B94654EE" legis-path="2.(b)(1)(A)">paragraph (1)(A)</internal-xref>.</text>
					</subparagraph><subparagraph id="H008270336CD044198CB05A299F48E935"><enum>(B)</enum><header>Membership</header><text>The
			 advisory committee shall include representatives of patients or consumers,
			 health care providers, com­pound­ing pharmacies, State agencies that regulate
			 compounding pharmacies, and at least one member with expertise on clearly
			 communicating information in such labeling of drugs.</text>
					</subparagraph><subparagraph id="H9B7C6A0B450C4DC982EA4437207AE24C"><enum>(C)</enum><header>Meetings</header><text>The
			 advisory committee shall hold an initial meeting not later than 6 months after
			 the date of enactment of this Act.</text>
					</subparagraph><subparagraph id="H5D31E1507CA74B0F830F3201E11476C2"><enum>(D)</enum><header>Recommendations</header><text>Not
			 later than 12 months after the date of enactment of this Act, the advisory
			 committee shall submit to the Secretary of Health and Human Services
			 recommendations on the regulations under
			 <internal-xref idref="H6FC9B03D989543F7988380D7B94654EE" legis-path="2.(b)(1)(A)">paragraph (1)(A)</internal-xref>, including
			 recommendations on the type of information and language that should be included
			 on the labels of drug products that are compounded pursuant to section 503A of
			 the Federal Food, Drug, and Cosmetic Act.</text>
					</subparagraph><subparagraph id="H3506F6D6A8DD4B41A0EDD6AFDC5F349F"><enum>(E)</enum><header>Termination</header><text>The
			 advisory committee under this subparagraph shall terminate upon the submission
			 of the recommendations under
			 <internal-xref idref="H5D31E1507CA74B0F830F3201E11476C2" legis-path="2.(b)(2)(D)">subparagraph (D)</internal-xref>.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H19794E4E6E7C4962B573ABA580E9D71E"><enum>(3)</enum><header>Database
			 advisory committee</header>
					<subparagraph id="HDA33C4C074454DD8ADABC3197706EB7C"><enum>(A)</enum><header>Establishment</header><text>The
			 Secretary of Health and Human Services shall establish an advisory committee on
			 the database described in section 503A(g) of the Federal Food, Drug, and
			 Cosmetic Act, as added by subsection (a), and shall consult such committee in
			 the development of the regulations under
			 <internal-xref idref="H241856D7FA4F42FDA4EBDB9974878651" legis-path="2.(b)(1)(B)">paragraph (1)(B)</internal-xref>.</text>
					</subparagraph><subparagraph id="H229B5BF6E8D9446491010688D9B971D2"><enum>(B)</enum><header>Membership</header><text display-inline="yes-display-inline">The advisory committee shall include
			 representatives of patients or consumers, health care providers, com­pound­ing
			 pharmacies, State agencies that regulate compounding pharmacies, and
			 information technology experts.</text>
					</subparagraph><subparagraph id="HBFCAC635891B40CB82E1FA22591460F1"><enum>(C)</enum><header>Meetings</header><text>The
			 advisory committee shall hold an initial meeting not later than 6 months after
			 the date of enactment of this Act.</text>
					</subparagraph><subparagraph id="HC79EA00BD08A49B78A3792AB9F028EC1"><enum>(D)</enum><header>Recommendations</header><text>Not
			 later than 12 months after the date of enactment of this Act, the advisory
			 committee shall submit to the Secretary of Health and Human Services
			 recommendations on the regulations under
			 <internal-xref idref="H241856D7FA4F42FDA4EBDB9974878651" legis-path="2.(b)(1)(B)">paragraph (1)(B).</internal-xref></text>
					</subparagraph><subparagraph id="H8B170C4241CF4F7682DF6F06C97F1EB1"><enum>(E)</enum><header>Termination</header><text>The
			 advisory committee under this subparagraph shall terminate upon the submission
			 of the recommendations under
			 <internal-xref idref="HC79EA00BD08A49B78A3792AB9F028EC1" legis-path="2.(b)(3)(D)">subparagraph (D)</internal-xref>.</text>
					</subparagraph></paragraph><paragraph id="HBCDD3B60B41B41F6A283E7279013C777"><enum>(4)</enum><header>Permanent
			 advisory committee on pharmacy compounding</header><text>The Secretary shall
			 convene the Advisory Committee on Pharmacy Compounding as appropriate to
			 consider issues related to the safety and availability of compounded drug
			 products.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H7C8FE8AB9E404E2F8F190A21333E7575" section-type="subsequent-section"><enum>3.</enum><header>Reports and
			 studies</header>
			<subsection id="H316BEA62857841258779FB29EB6BBC08"><enum>(a)</enum><header>Biannual
			 reports</header><text>Not later than 6 months after the date of enactment of
			 this Act, and at the end of each succeeding 6-month period that ends before the
			 25th month after the date of enactment of this Act, the Secretary of Health and
			 Human Services shall submit to the Congress a report on the status of the
			 implementation of the requirements of this Act, and the amendments made by this
			 Act.</text>
			</subsection><subsection id="H2FF913B59B56472698D50E7B1304DD79"><enum>(b)</enum><header>Third-Party
			 Accreditation</header><text display-inline="yes-display-inline">Not later than
			 12 months after the date of enactment of this Act, the Secretary shall submit
			 to the Congress a report that contains—</text>
				<paragraph id="H100BB79F83564DBCB8F5F30687FA0168"><enum>(1)</enum><text>a
			 review of the standards used by organizations that provide accreditation to
			 compounding pharmacies; and</text>
				</paragraph><paragraph id="H7839CDE138294D62BAB90BA0305C27AD"><enum>(2)</enum><text>an evaluation of
			 the effectiveness of such standards in ensuring the production of safe and
			 effective compounded drug products.</text>
				</paragraph></subsection><subsection id="HC9A767181DC34858B657B049DD4CD720"><enum>(c)</enum><header>Structure of
			 State oversight</header><text>Not later than 18 months after the date of
			 enactment of this Act, the Secretary shall submit to the Congress a report that
			 contains—</text>
				<paragraph id="HB5BCC50B327344F28706A2880ABEE6A6"><enum>(1)</enum><text>a
			 review of the models used by States to structure their oversight of pharmacies
			 that compound drug products, including the structure of the agency or office
			 responsible for oversight and its relationship with the industry that it
			 regulates; and</text>
				</paragraph><paragraph id="HFE6840AC2CEF49A69F527F2FEA165F99"><enum>(2)</enum><text>consideration of
			 how the structure and relationship of State regulators may impact the
			 development and enforcement of regulations to ensure safe compounded drug
			 products.</text>
				</paragraph></subsection><subsection id="H5562CEA44BE2437CAA9E6EE9E913B5F5"><enum>(d)</enum><header>GAO
			 report</header><text>The Comptroller General of the United States shall
			 review—</text>
				<paragraph id="H83E28EB1482F4F34A2E2998299C0ECB9"><enum>(1)</enum><text display-inline="yes-display-inline">the extent to which Federal health care
			 programs (as such term is defined in section 1128B(f) of the Social Security
			 Act (42 U.S.C. 1320a–7b)) ensure that compounded drug products which are paid
			 for by such programs are compounded in facilities that comply with the
			 requirements of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301 et
			 seq.);</text>
				</paragraph><paragraph id="H31C87E1D907D4A5E8317269C21F808D6"><enum>(2)</enum><text>whether the
			 reimbursement rates for compounded drug products under such Federal health care
			 programs are appropriate, taking into consideration the cost of production of
			 such compounded drug products; and</text>
				</paragraph><paragraph id="H4A2369BAA9744C2E9D33CF68FF837903"><enum>(3)</enum><text>whether such
			 Federal health care programs encourage the use of compounded drug products in
			 place of otherwise available lawfully marketed drug products.</text>
				</paragraph></subsection></section><section id="H618654B9557546DB90FDE666C08BEADE"><enum>4.</enum><header>Prohibitions and
			 penalties</header>
			<subsection id="H4E578402FDE0410390D7B079B5A555A9"><enum>(a)</enum><header>Prohibition of
			 violations of section 503A</header><text>Section 301(d) of the Federal Food,
			 Drug, and Cosmetic Act (21 U.S.C. 331(d)) is amended by inserting
			 <quote>503A,</quote> before <quote>505,</quote>.</text>
			</subsection><subsection id="HB87650B8FCD0488B92EB6023DD045CEC"><enum>(b)</enum><header>Penalties</header><text>Section
			 303(b) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 333(b)) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3EE9C6CDA242467E897D3BE1E60A26FE" style="OLC">
					<paragraph id="HB9F58E98EAAB4C94A9665F58940FE27A"><enum>(8)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a), any person
				who violates section 301(d) with respect to any compounded drug product—</text>
						<subparagraph id="H0CF9DB16D93740AFBFD42DE90FCAA0FB"><enum>(A)</enum><text>knowingly and
				intentionally to defraud or mislead; or</text>
						</subparagraph><subparagraph id="H10C15661E0654DC1BE1AA2C7A1FBAEF9"><enum>(B)</enum><text>with conscious or
				reckless disregard of a risk of death or serious bodily injury,</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">shall be
				fined under title 18, United States Code, imprisoned for not more than 10
				years, or
