<official-title>To direct the Secretary of Defense to submit a report to Congress on the future availability of TRICARE Prime throughout the United States and to ensure that certain TRICARE beneficiaries retain access to a primary care provider, and for other purposes.</official-title>

<section id="H0474FE0FA6374DE98395D020312D71FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>TRICARE Protection Act</short-title></quote>.</text></section> 
<section id="HBD403D1FDB2649B8826E8DA5E8B4AB71" section-type="subsequent-section"><enum>2.</enum><header>Future availability of TRICARE Prime throughout the United States</header> 
<subsection id="H780C2038C7AC46EFB0905C955CF8E157"><enum>(a)</enum><header>Report required</header> 
<paragraph id="H57919F00CC2C445C8AB4C0937FBCFF55"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and the House of Representatives a report setting forth the policy of the Department of Defense on the future availability of TRICARE Prime under the TRICARE program for eligible beneficiaries in all TRICARE regions throughout the United States.</text></paragraph> 
<paragraph id="H0C2E528229A843EBA3EFB8F2857A0078"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall include the following:</text> 
<subparagraph id="HE68F5F57540344BE92E76DD0E3C0BD4E"><enum>(A)</enum><text>A description, by region, of the difference in availability of TRICARE Prime for eligible beneficiaries (other than eligible beneficiaries on active duty in the Armed Forces) under newly awarded TRICARE managed care contracts, including, in particular, an identification of the regions or areas in which TRICARE Prime will no longer be available for such beneficiaries under such contracts.</text></subparagraph> 
<subparagraph id="H9813FC26C8A4445CA7D881D81602F64D"><enum>(B)</enum><text display-inline="yes-display-inline">In accordance with paragraph (3), a plan to ensure that an affected eligible beneficiary identified under subsection (b) retains access to a primary care provider that meets the TRICARE access standards.</text></subparagraph> 
<subparagraph id="H0CCB4151DF7A40BFB96FD6739ACC42FE" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">An estimate of the increased costs to be incurred by an affected eligible beneficiary for health care under the TRICARE program.</text></subparagraph> 
<subparagraph id="HEEFD0C3DA7F14161AA0E84DE94FCDDC6"><enum>(D)</enum><text>An estimate of the savings to be achieved by the Department as a result of the contracts described in subparagraph (A).</text></subparagraph> 
<subparagraph id="HEDFE77795AF54BEC9A9B60D0B877F7FC"><enum>(E)</enum><text display-inline="yes-display-inline">A description of the plans of the Department to continue to assess the impact on access to health care for affected eligible beneficiaries, including the plan to carry out subsection (b).</text></subparagraph></paragraph> 
<paragraph id="H2B4F736D612342C091A91C0F1BB78F85"><enum>(3)</enum><header>Development of plan</header><text display-inline="yes-display-inline">In developing the plan described in paragraph (2)(B), the Secretary shall include the following actions under such plan:</text> 
<subparagraph id="HD52EDFBE01C24A08A24544B62A114B62"><enum>(A)</enum><text display-inline="yes-display-inline">The establishment of a navigator service to assist an affected eligible beneficiary identified under subsection (b) in locating a primary care provider.</text></subparagraph> 
<subparagraph id="H5F9421B68F474180BC0B18B509662A12"><enum>(B)</enum><text>Allowing an affected eligible beneficiary to enroll in TRICARE Prime Remote if the Secretary determines that the beneficiary would not otherwise have access to a primary care provider that meets the TRICARE access standards, regardless of whether such eligible beneficiary would otherwise be eligible for such program.</text></subparagraph> 
<subparagraph id="H9DD50E9AAB0943F4886DAE318C1D4856"><enum>(C)</enum><text>Any other action the Secretary considers appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="H7381C5FFEB4D4786886EA95115284CAA"><enum>(b)</enum><header>Identification of beneficiaries without access to a primary care provider</header><text display-inline="yes-display-inline">The Secretary shall identify the affected eligible beneficiaries whom the Secretary determines, because of the contracts described in subsection (a)(2)(A), will not retain access to a primary care provider that meets the TRICARE access standards.</text> </subsection> 
<subsection id="HA00F7B85EA6B4EC0BCA159964EC27DA1"><enum>(c)</enum><header>Implementation of plan</header> 
<paragraph id="H0816730BB12E46DEB83E4A000EAB2F43"><enum>(1)</enum><header>Initial implementation</header><text display-inline="yes-display-inline">Beginning on the date that is 60 days after the date on which the Secretary submits the report under paragraph (1) of subsection (a), the Secretary shall implement the plan described in paragraph (2)(B) of such subsection.</text></paragraph> 
<paragraph id="H7FBF62611ED2457F87B6B1B93CC1377E"><enum>(2)</enum><header>Duration</header><text>The Secretary shall carry out the implementation of the plan under paragraph (1) until the earlier of the following dates:</text> 
<subparagraph id="HAD318E68248F4623897AE83CF235AA4A"><enum>(A)</enum><text display-inline="yes-display-inline">Any date after the date that is one year after the date on which the Secretary begins to carry out such implementation if the Secretary determines that each affected eligible beneficiary identified under subsection (b) will have access to a primary care provider under a contract described in subsection (a)(2)(A) that meets the TRICARE access standards.</text></subparagraph> 
<subparagraph id="H95DEFBC8C6E24CDF9EA4DA8B9F88C4E2"><enum>(B)</enum><text>The date that is two years after the date on which the Secretary begins to carry out such implementation.</text></subparagraph></paragraph></subsection> 
<subsection id="H3F72C282106D4F21B00FF68AFE0D7580"><enum>(d)</enum><header>Monitoring of access</header><text display-inline="yes-display-inline">Section 711 of the National Defense Authorization Act for Fiscal Year 2008 (Public Law 110–181; 122 Stat. 190; 10 U.S.C. 1073 note) is amended—</text> 
<paragraph id="HA98979361EDE4CF9B3F4A8D365622FAE"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H4941EC9BA2D34F6C90925F23D6D6935C"><enum>(A)</enum><text>in paragraph (1), by adding at the end the following new subparagraph:</text>

<subparagraph id="HD0FCF4AAA29A4EA4934530AE032C6C4D"><enum>(D)</enum><text display-inline="yes-display-inline">The access available for affected eligible beneficiaries to a primary care provider that meets the TRICARE access standards.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HDE05F5D22D1F4B00806B5839793032B4"><enum>(B)</enum><text>in paragraph (3), by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HCABD8F766AD943C48A329212EB260ADF" display-inline="no-display-inline"> 
<subparagraph id="HA5BF5D2592E940B0B0595D2B4DCCF8A2"><enum>(D)</enum><text display-inline="yes-display-inline">In the case of the surveys required by subparagraph (D) of that paragraph, in each region or area in which TRICARE Prime will no longer be available for eligible beneficiaries under newly awarded TRICARE managed care contracts in each of fiscal years 2013 through 2015.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HC5ED358C1D914EE8BD68B4947BB90D41"><enum>(2)</enum><text>in paragraph (2) of subsection (b), by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HFC5F75928538416AAE84C5FD576ECAF8" display-inline="no-display-inline"> 
<subparagraph id="HD7F17EC24265436E97682627CAC5E820"><enum>(I)</enum><text display-inline="yes-display-inline">An assessment of the access available for affected eligible beneficiaries to a primary care provider that meets the TRICARE access standards.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H397EEB975206486DBC6925DA4CC4B43F"><enum>(3)</enum><text>in subsection (e), by adding at the end the following new paragraphs:</text> 
<quoted-block style="OLC" id="H7EC8474BE5524A75B5F4ADD666226B8F" display-inline="no-display-inline"> 
<paragraph id="H0A2927D9837B421EB7C8AFD04776EFFA"><enum>(8)</enum><text display-inline="yes-display-inline">The term <term>affected eligible beneficiary</term> means an eligible beneficiary under the TRICARE Program (other than eligible beneficiaries on active duty in the Armed Forces) who, as of the date of the enactment of this paragraph—</text> 
<subparagraph id="HECFFD0EF2CE542218F2AE33CCE8CCB9B"><enum>(A)</enum><text>is enrolled in TRICARE Prime; and</text></subparagraph> 
<subparagraph id="HEA019F3A79BF4841820D5749F10F8A44"><enum>(B)</enum><text display-inline="yes-display-inline">resides in a region of the United States in which TRICARE Prime enrollment will no longer be available for such beneficiary under a contract described in subsection (a)(3)(D) that does not allow for such enrollment because of the location in which such beneficiary resides.</text></subparagraph></paragraph> 
<paragraph id="HF54D34311CBF454A970ABEBFB5F8DA3B"><enum>(9)</enum><text>The term <term>TRICARE access standards</term> means the standards developed under the TRICARE Program to ensure that beneficiaries do not experience excessive wait times or travel times to access health care.</text></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H42D21DA7CABF4442B801CBD76F6066A1"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HBE840D7A8D2B48A3977C2FD12E1AD2AC"><enum>(1)</enum><text>The term <term>affected eligible beneficiary</term> means an eligible beneficiary under the TRICARE Program (other than eligible beneficiaries on active duty in the Armed Forces) who, as of the date of the enactment of this Act—</text> 
<subparagraph id="H514003DFE82D42819F74764409476074"><enum>(A)</enum><text>is enrolled in TRICARE Prime; and</text></subparagraph> 
<subparagraph id="HE053E7DE80584CEC96ACB5678676DE16"><enum>(B)</enum><text display-inline="yes-display-inline">resides in a region of the United States in which TRICARE Prime enrollment will no longer be available for such beneficiary under a contract described in subsection (a)(2)(A) that does not allow for such enrollment because of the location in which such beneficiary resides.</text></subparagraph></paragraph> 
<paragraph id="HCC61C226A9004194899FA75B1036B4C4"><enum>(2)</enum><text>The term <term>TRICARE access standards</term> means the standards developed under the TRICARE Program to ensure that beneficiaries do not experience excessive wait times or travel times to access health care.</text></paragraph> 
<paragraph id="H96512D194D4845B981E26B459C53EA9E"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>TRICARE Prime</term> means the managed care option of the TRICARE program.</text></paragraph></subsection> </section>
