		<section id="H5CD0008CBED94EE0B5C206344F632E2D" section-type="section-one"><enum>1.</enum><header>Technical
			 corrections</header>
			<subsection id="HA3D24CBC0FD34FE7A9367FA30C794995"><enum>(a)</enum><header>Advice of
			 counsel</header><text>Notwithstanding section 35 of the Leahy-Smith America
			 Invents Act (<external-xref legal-doc="usc" parsable-cite="usc/35/1">35 U.S.C.
			 1</external-xref> note),
			 <external-xref legal-doc="usc" parsable-cite="usc/35/298">section
			 298</external-xref> of title 35, United States Code, shall apply to any civil
			 action commenced on or after the date of the enactment of this Act.</text>
			</subsection><subsection id="H439A808D45554B6CA7926F74580C099E"><enum>(b)</enum><header>Transitional
			 program for covered business method patents</header><text>Section 18 of the
			 Leahy-Smith America Invents Act (<external-xref legal-doc="usc" parsable-cite="usc/35/321">35 U.S.C. 321</external-xref> note) is
			 amended—</text>
				<paragraph id="HD968F2230CF7458F809D286456715230"><enum>(1)</enum><text>in subsection
			 (a)(1)(C)((i), by striking <quote>of such title</quote> the second place it
			 appears; and</text>
				</paragraph><paragraph id="HAAC214950556485D9584DF5F86DBA456"><enum>(2)</enum><text>in subsection
			 (d)(2), by striking <quote>subsection</quote> and inserting
			 <quote>section</quote>.</text>
				</paragraph></subsection><subsection id="H071EEDF4E82B4166A63077894DE2775C"><enum>(c)</enum><header>Joinder of
			 parties</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/299">Section 299(a)</external-xref> of title 35, United
			 States Code, is amended in the matter preceding paragraph (1) by striking
			 <quote>or counterclaim defendants only if</quote> and inserting <quote>only
			 if</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H5B8D4866B5D84D8A8FF5DF85EEB496B4"><enum>(d)</enum><header>Dead
			 zones</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HC725BD62F75F43D7AF4F2EAB453B8AF8"><enum>(1)</enum><header>Inter partes
			 review</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/311">Section 311(c)</external-xref> of title 35, United
			 States Code, shall not apply to a petition to institute an inter partes review
			 of a patent that is not a patent described in section 3(n)(1) of the
			 Leahy-Smith America Invents Act (<external-xref legal-doc="usc" parsable-cite="usc/35/100">35 U.S.C. 100</external-xref> note).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE73CC93CC7A44C52BE71AFD9A75E5801"><enum>(2)</enum><header>Reissue</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/35/311">Section 311(c)(1)</external-xref> of title 35,
			 United States Code, is amended by striking <quote>or issuance of a reissue of a
			 patent</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD641D5A1CD43421EB52100B2A2AE0190"><enum>(e)</enum><header>Correct
			 inventor</header>
				<paragraph id="H4EFD2B32D2CA436FAE507B49DDC746A0"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/135">Section 135(e)</external-xref> of title 35, United
			 States Code, as amended by section 3(i) of the Leahy-Smith America Invents Act,
			 is amended by striking <quote>correct inventors</quote> and inserting
			 <quote>correct inventor</quote>.</text>
				</paragraph><paragraph id="H82A3DA75DA504BB9BD2C891038C2E416"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by paragraph (1) shall be effective as if
			 included in the amendment made by section 3(i) of the Leahy-Smith America
			 Invents Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6F2D8E01C10C47D8B0768DF14F529AC6"><enum>(f)</enum><header>Inventor's oath
			 or declaration</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/115">Section 115</external-xref> of title 35, United
			 States Code, as amended by section 4 of the Leahy-Smith America Invents Act, is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HB2E0FA0660564F43A5F51D52B497C68C"><enum>(1)</enum><text>by striking
			 subsection (f) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4F889ED1EA2B455B9873735A5F97895B" style="OLC">
						<subsection id="H86B66379F37F4984BE246AEAF272FE00"><enum>(f)</enum><header>Time for
				filing</header><text>The applicant for patent shall provide each required oath
				or declaration under subsection (a), substitute statement under subsection (d),
				or recorded assignment meeting the requirements of subsection (e) no later than
				the date on which the issue fee for the patent is
				paid.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9217CA538FF442429D65F7769A2901D9"><enum>(2)</enum><text>in subsection
			 (g)(1), by striking <quote>who claims</quote> and inserting <quote>that
			 claims</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7BBB689D697541EDA79A0146688F5789"><enum>(g)</enum><header>Travel expenses
			 and payment of administrative judges</header><text>Notwithstanding section 35
			 of the Leahy-Smith America Invents Act (<external-xref legal-doc="usc" parsable-cite="usc/35/1">35 U.S.C. 1</external-xref> note), the amendments made
			 by section 21 of the Leahy-Smith America Invents Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/29">Public Law
			 112–29</external-xref>; 125 Stat. 335) shall be effective as of September 16,
			 2011.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H5518174EF678419485F2DA4EFD3C8D82"><enum>(h)</enum><header>Patent term
			 adjustments</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/154">Section 154(b)</external-xref> of title 35, United
			 States Code, is amended—</text>
				<paragraph id="HCE9FAB6DAEB642B48C9BACDF9662F041"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H6D0EF36F9CCF4F768465B0104146FAF2"><enum>(A)</enum><text>in subparagraph
			 (A)(i)(II), by striking <quote>on which an international application fulfilled
			 the requirements of section 371 of this title</quote> and inserting <quote>of
			 commencement of the national stage under section 371 in an international
			 application</quote>; and</text>
					</subparagraph><subparagraph id="H469AC933FFDA4DBD9B793D92413CAD30"><enum>(B)</enum><text>in subparagraph
			 (B), in the matter preceding clause (i), by striking <quote>the application in
			 the United States</quote> and inserting <quote>the application under section
			 111(a) in the United States or, in the case of an international application,
			 the date of commencement of the national stage under section 371 in the
			 international application</quote>;</text>
					</subparagraph></paragraph><paragraph id="H495F3FAB142B4A6F9ECF0DFE92893398"><enum>(2)</enum><text>in paragraph
			 (3)(B)(i), by striking <quote>with the written notice of allowance of the
			 application under section 151</quote> and inserting <quote>no later than the
			 date of issuance of the patent</quote>; and</text>
				</paragraph><paragraph id="HDB12B6636B6C44A7965C0EA46A20FBB7"><enum>(3)</enum><text>in paragraph
			 (4)(A)—</text>
					<subparagraph id="H8F6A720468F24B898BB9F855A266372A"><enum>(A)</enum><text>by striking
			 <quote>a determination made by the Director under paragraph (3) shall have
			 remedy</quote> and inserting <quote>the Director’s decision on the applicant’s
			 request for reconsideration under paragraph (3)(B)(ii) shall have exclusive
			 remedy</quote>; and</text>
					</subparagraph><subparagraph id="H220AB3D7904746CC9F9DA161FFB1B25C"><enum>(B)</enum><text>by striking
			 <quote>the grant of the patent</quote> and inserting <quote>the date of the
			 Director’s decision on the applicant’s request for
			 reconsideration</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H13FD752EB9934BD48588DE25FD0B72CB"><enum>(i)</enum><header>Improper
			 applicant</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/373">Section 373</external-xref> of title 35, United
			 States Code, and the item relating to that section in the table of sections for
			 chapter 37 of such title, are repealed.</text>
			</subsection><subsection id="H8378058A9B4D4DDE835BA8B197DC68C5"><enum>(j)</enum><header>Financial
			 management clarifications</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/42">Section 42(c)(3)</external-xref> of title 35, United
			 States Code, is amended—</text>
				<paragraph id="HC9AFE51965194823B640C05AC2FDDD0B"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph id="HA18D48047BB14E42A81BC86C8F70AB7F"><enum>(A)</enum><text>by striking
			 <quote>sections 41, 42, and 376,</quote> and inserting <quote>this
			 title,</quote>; and</text>
					</subparagraph><subparagraph id="HD4A9E277C52A45A099EAF47C14B984B0"><enum>(B)</enum><text>by striking
			 <quote>a share of the administrative costs of the Office relating to
			 patents</quote> and inserting <quote>a proportionate share of the
			 administrative costs of the Office</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HC97010EB006D43449BBE329830CC00AD"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>a share of the administrative costs of the Office
			 relating to trademarks</quote> and inserting <quote>a proportionate share of
			 the administrative costs of the Office</quote>.</text>
				</paragraph></subsection><subsection id="HF957960B6DB0421A90F14E7864D6BD58"><enum>(k)</enum><header>Derivation
			 proceedings</header>
				<paragraph id="H1E4339CA814845AE92552B05FF68BD89"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/35/135">Section 135(a)</external-xref> of
			 title 35, United States Code, as amended by section 3(i) of the Leahy-Smith
			 America Invents Act, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H6FABAF1800DB437BBBFCE1748EE4059A" style="OLC">
						<subsection id="H5667D3E5CFF44F9FBA886277D8F5C934"><enum>(a)</enum><header>Institution of
				proceeding</header>
							<paragraph id="H6261977D8D9B4EF794CC0E072976278E"><enum>(1)</enum><header>In
				general</header><text>An applicant for patent may file a petition with respect
				to an invention to institute a derivation proceeding in the Office. The
				petition shall set forth with particularity the basis for finding that an
				individual named in an earlier application as the inventor or a joint inventor
				derived such invention from an individual named in the petitioner’s application
				as the inventor or a joint inventor and, without authorization, the earlier
				application claiming such invention was filed. Whenever the Director determines
				that a petition filed under this subsection demonstrates that the standards for
				instituting a derivation proceeding are met, the Director may institute a
				derivation proceeding.</text>
							</paragraph><paragraph id="HCB941E16DF444AA5AAC7DA9DB7A7C3F6"><enum>(2)</enum><header>Time for
				filing</header><text>A petition under this section with respect to an invention
				that is the same or substantially the same invention as a claim contained in a
				patent issued on an earlier application, or contained in an earlier application
				when published or deemed published under section 122(b), may not be filed
				unless such petition is filed during the 1-year period following the date on
				which the patent containing such claim was granted or the earlier application
				containing such claim was published, whichever is earlier.</text>
							</paragraph><paragraph id="H93DBA6961C6B4403AF22550D0C0771B5"><enum>(3)</enum><header>Earlier
				application</header><text>For purposes of this section, an application shall
				not be deemed to be an earlier application with respect to an invention,
				relative to another application, unless a claim to the invention was or could
				have been made in such application having an effective filing date that is
				earlier than the effective filing date of any claim to the invention that was
				or could have been made in such other application.</text>
							</paragraph><paragraph id="HBC11D9BC468C4956A6D0173F6FD00E94"><enum>(4)</enum><header>No
				appeal</header><text>A determination by the Director whether to institute a
				derivation proceeding under paragraph (1) shall be final and not
				appealable.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph display-inline="no-display-inline" id="H3157F0CF21C44A638301FE6E21352C91"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by paragraph (1) shall be effective as if
			 included in the amendment made by section 3(i) of the Leahy-Smith America
			 Invents Act.</text>
				</paragraph><paragraph id="H538061550CF64201AC8BD6929659EB82"><enum>(3)</enum><header>Review of
			 interference decisions</header><text>The provisions of sections
			 <external-xref legal-doc="usc" parsable-cite="usc/35/6">6</external-xref> and
			 <external-xref legal-doc="usc" parsable-cite="usc/35/141">141</external-xref>
			 of title 35, United States Code, and
			 <external-xref legal-doc="usc" parsable-cite="usc/28/1295">section
			 1295(a)(4)(A)</external-xref> of title 28, United States Code, as in effect on
			 September 15, 2012, shall apply to interference proceedings that are declared
			 after September 15, 2012, under
			 <external-xref legal-doc="usc" parsable-cite="usc/35/135">section
			 135</external-xref> of title 35, United States Code, as in effect before the
			 effective date under section 3(n) of the Leahy-Smith America Invents Act. The
			 Patent Trial and Appeal Board may be deemed to be the Board of Patent Appeals
			 and Interferences for purposes of such interference proceedings.</text>
				</paragraph></subsection><subsection commented="no" id="H0305E32E21EB43CB8BA101D830C697DF"><enum>(l)</enum><header>Patent and
			 trademark public advisory committees</header>
				<paragraph commented="no" id="H144424AF0A6B4669A9BEF4B32C0715CD"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/5">Section 5(a)</external-xref> of title 35, United
			 States Code, is amended—</text>
					<subparagraph commented="no" id="HF30BB1C2D1304EA6BAE969B52452AE19"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>Members of</quote> and all that follows through <quote>such
			 appointments.</quote> and inserting the following: <quote>In each year, 3
			 members shall be appointed to each Advisory Committee for 3-year terms that
			 shall begin on December 1 of that year. Any vacancy on an Advisory Committee
			 shall be filled within 90 days after it occurs. A new member who is appointed
			 to fill a vacancy shall be appointed to serve for the remainder of the
			 predecessor’s term.</quote>;</text>
					</subparagraph><subparagraph commented="no" id="HA1091CF6304147D79FF4102E94ED2671"><enum>(B)</enum><text>by striking
			 paragraph (2) and inserting the following:</text>
						<quoted-block id="H6518606B2D5546D2A53F4889640B42FA" style="OLC">
							<paragraph commented="no" id="H90B429E770294337BBDED40E6EC837F4"><enum>(2)</enum><header>Chair</header><text>The
				Secretary of Commerce, in consultation with the Director, shall designate a
				Chair and Vice Chair of each Advisory Committee from among the members
				appointed under paragraph (1). If the Chair resigns before the completion of
				his or her term, or is otherwise unable to exercise the functions of the Chair,
				the Vice Chair shall exercise the functions of the
				Chair.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" id="HEAEEDAAF2EA6424EAEBA9AE1C076D4F8"><enum>(C)</enum><text>by striking
			 paragraph (3).</text>
					</subparagraph></paragraph><paragraph commented="no" id="H1CD16024A54443FFAC08DFF44A10FCB0"><enum>(2)</enum><header>Transition</header>
					<subparagraph commented="no" id="H472B5E5C820E4F599F47B9F4334309D0"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of Commerce shall, in the Secretary’s
			 discretion, determine the time and manner in which the amendments made by
			 paragraph (1) shall take effect, except that, in each year following the year
			 in which this Act is enacted, 3 members shall be appointed to each Advisory
			 Committee (to which such amendments apply) for 3-year terms that begin on
			 December 1 of that year, in accordance with
			 <external-xref legal-doc="usc" parsable-cite="usc/35/5">section
			 5(a)</external-xref> of title 35, United States Code, as amended by paragraph
			 (1) of this subsection.</text>
					</subparagraph><subparagraph commented="no" id="HE88FDD379FC6418982ED19D904F2C786"><enum>(B)</enum><header>Deemed
			 termination of terms</header><text display-inline="yes-display-inline">In order
			 to implement the amendments made by paragraph (1), the Secretary of Commerce
			 may determine that the term of an existing member of an Advisory Committee
			 under <external-xref legal-doc="usc" parsable-cite="usc/35/5">section
			 5</external-xref> of title 35, United States Code, shall be deemed to terminate
			 on December 1 of a year beginning after the date of the enactment of this Act,
			 regardless of whether December 1 is before or after the date on which such
			 member’s term would terminate if this Act had not been enacted.</text>
					</subparagraph></paragraph></subsection><subsection id="HD676354E379A47E3B516FC97E3458B78"><enum>(m)</enum><header>Report on
			 pre-GATT applications</header><text display-inline="yes-display-inline">Using
			 existing resources, not later than four months after the date of the enactment
			 of this Act, the Director of the United States Patent and Trademark Office
			 shall submit a report to the Committees on the Judiciary of the United States
			 House of Representatives and the Senate that describes—</text>
				<paragraph id="HD30303CB4785468D804D67D809C99E53"><enum>(1)</enum><text display-inline="yes-display-inline">the total number of pending United States
			 applications for patent that—</text>
					<subparagraph id="H49DB5C0E7C7F456F8AC48D4B1BB2BFBE"><enum>(A)</enum><text display-inline="yes-display-inline">are not subject to an order under
			 <external-xref legal-doc="usc" parsable-cite="usc/35/181">section
			 181</external-xref> of title 35, United States Code; and</text>
					</subparagraph><subparagraph id="HC07EACFE96BE4B2E9A056A8EC4E87DE8"><enum>(B)</enum><text display-inline="yes-display-inline">were filed before the effective date of the
			 amendments made by section 532 of the Uruguay Round Agreements Act
			 (<external-xref legal-doc="public-law" parsable-cite="pl/103/465">Public Law
			 103–465</external-xref>; 108 Stat. 4983);</text>
					</subparagraph></paragraph><paragraph id="H56B01519FAB54C09BC0081A171E9D522"><enum>(2)</enum><text display-inline="yes-display-inline">the filing date of each such
			 application;</text>
				</paragraph><paragraph id="H23C9179C3E8548A5803FE2172949902B"><enum>(3)</enum><text display-inline="yes-display-inline">the filing date of the earliest application
			 for which each such application claims the benefit of or a right of priority to
			 its filing date;</text>
				</paragraph><paragraph id="HA41A024C5A0C4A2BBED864694705039F"><enum>(4)</enum><text display-inline="yes-display-inline">the inventor and assignee named on each
			 such application;</text>
				</paragraph><paragraph id="H49E22C39086C40A3929A7887707E9C1B"><enum>(5)</enum><text display-inline="yes-display-inline">the amount of time that examination of each
			 such application has been delayed because of a proceeding under
			 <external-xref legal-doc="usc" parsable-cite="usc/35/135">section
			 135(a)</external-xref> of title 35, United States Code, an appeal to the Patent
			 Trial and Appeal Board under section 134(a) of such title, a civil action in a
			 United States District Court under section 145 or 146 of such title, or an
			 appeal to the United States Court of Appeals for the Federal Circuit under
			 section 141 of such title; and</text>
				</paragraph><paragraph id="H74DE01E2A8D941C19BFD77A5EE07CE4B"><enum>(6)</enum><text display-inline="yes-display-inline">other information about such applications
			 that the Director believes is relevant to their pendency.</text>
				</paragraph></subsection><subsection id="HA2022C398E4F49B49ECEDFCC003DFDE2"><enum>(n)</enum><header>Clerical
			 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/123">Section 123(a)</external-xref> of title 35, United
			 States Code, is amended in the matter preceding paragraph (1) by inserting
			 <quote>of this title</quote> after <quote>For purposes</quote>.</text>
			</subsection><subsection id="HAC1F999B4B5547FA83C6E776ED7084A9"><enum>(o)</enum><header>Effective
			 date</header><text>Except as otherwise provided in this Act, the amendments
			 made by this Act shall take effect on the date of the enactment of this Act and
			 shall apply to proceedings commenced on or after such date of enactment.</text>
			</subsection></section></legis-body>
