		<official-title>To amend the National Flood Insurance Act of 1968 to
		  allow the rebuilding of certain structures located in special flood hazard
		  zones, and for other purposes.</official-title>

		<section id="H2EF91D27B04C44A4B70CF79FC46CB118" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fire-Damaged Home Rebuilding Act of
			 2012</short-title></quote>.</text>
		</section><section id="H3D2C9DFFFAA04BD3846D2E0A41F0EDF4"><enum>2.</enum><header>Requirements for
			 State and local land use controls</header><text display-inline="no-display-inline">Subsection (a) of section 1315 of the
			 National Flood Insurance Act of 1968 (42 U.S.C. 4022(a)) is amended by adding
			 at the end the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H3E8F9DC78D2E415A893E8179E74D6402" style="OLC">
				<paragraph id="HE4C8D73E338B4B0C85440756217812D9"><enum>(3)</enum><header>Variance for
				certain residential structures</header>
					<subparagraph id="HA81B0062C6E4493D896A70AA23ECA949"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				Act, after the expiration of the 3-month period beginning on the date of the
				enactment of the <short-title>Fire-Damaged Home Rebuilding
				Act of 2012</short-title>, any land use and control measures required to be
				adopted pursuant to paragraph (1) shall not, for purposes of such paragraph, be
				considered to be adequate or consistent with the comprehensive criteria for
				land management and use under section 1361 unless such measures provide that,
				in the case of any residential structure that is located in an area having
				special flood hazards and is substantially damaged other than as a result of a
				flood, a variance in accordance with subparagraph (B) may be granted.</text>
					</subparagraph><subparagraph id="H9D5519A43BF244E89A10C369CD564FA3"><enum>(B)</enum><header>Variance;
				considerations</header><text display-inline="yes-display-inline">A variance in
				accordance with this subparagraph is a variance from compliance with such land
				use and control measures that—</text>
						<clause id="HECF97CA066A44A3FB0E11467D57F7A63"><enum>(i)</enum><text>allows for the
				repair and restoration of such structure to its predamaged condition on the
				original location of the structure without elevation of the structure, but only
				if the owner of such structure at the time of such damage repairs and restores
				such structure for the purpose of continued occupancy; and</text>
						</clause><clause id="H450E1FB577884445B5E029DCFF799E3F"><enum>(ii)</enum><text display-inline="yes-display-inline">may be granted only by the appropriate
				regional director of the Federal Emergency Management Agency, after taking into
				consideration—</text>
							<subclause id="H18BA82A0D2EC461EAAAC2A369A925B40"><enum>(I)</enum><text>whether granting
				such a variance would help avoid blight in the neighborhood in which the
				structure is located; and</text>
							</subclause><subclause id="H92D37C94581348C3B4E57A71227A8977"><enum>(II)</enum><text>whether denying
				such a variance would require the structure to be elevated in a manner such
				that the structure is inappropriate with respect to adjacent structures;</text>
							</subclause><subclause id="H3A7DDF61EF9046449EE09FDBB9E39C75"><enum>(III)</enum><text>the history and
				frequency of flooding in the area in which the structure is located; and</text>
							</subclause><subclause id="H64D69657061A48778FE1947788953CE4"><enum>(IV)</enum><text>the cost to the
				homeowner of elevating the structure so that it is in compliance with such land
				use and control
				measures.</text>
							</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HCE4B6E3B9CA34597BA3BFDEBD58F67D2"><enum>3.</enum><header>Premium
			 rates</header><text display-inline="no-display-inline">Section 1308 of the
			 National Flood Insurance Act of 1968 (42 U.S.C. 4015) is amended by adding at
			 the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HE2BC80082332476795F6E4D0279AEB97" style="OLC">
				<subsection id="HB9B5A5EA51D04B5CA49CC0E4765DC691"><enum>(j)</enum><header>Premium rates
				for structures with certain variances</header><text>Notwithstanding any other
				provision of this Act, the chargeable premium rate for coverage under this
				title for any residential structure provided a variance pursuant to section
				1315(a)(3) shall, after repair and restoration of the structure pursuant to
				such variance, be the rate that otherwise would apply to such structure if the
				structure had not been substantially damaged and repaired and restored pursuant
				to such
				variance.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
