<legis-type>AN ACT</legis-type> 
<official-title display="yes">To allow for innovations and alternative technologies that meet or exceed desired energy efficiency goals, and to make technical corrections to existing Federal energy efficiency laws to allow American manufacturers to remain competitive.</official-title> 
</form> 
<legis-body id="H9455EB5DD87D4F06BFC96BB085921E24" style="OLC"> 
<section id="H2CF7321F640C4D29B63C144BE8F0795C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Energy Manufacturing Technical Corrections Act</short-title></quote>.</text> </section> 
<section id="H562F2C2595E643638BACF3F639F22C6F"><enum>2.</enum><header>Innovative component technologies</header><text display-inline="no-display-inline">Section 342(f) of the Energy Policy and Conservation Act (42 U.S.C. 6313(f)) is amended—</text> 
<paragraph id="H7BE4F33663EA40579F11808AAA069804"><enum>(1)</enum><text>in paragraph (1), by striking <quote>paragraphs (2) through (5)</quote> and inserting <quote>paragraphs (2) through (6)</quote>; and</text> </paragraph> 
<paragraph id="H12327E0FA105499685845FB81C66BC29"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H33A9270CAD8B4DF58BDBE75C6682C40A" style="OLC"> 
<paragraph id="HF7BF69390E894B59AAC828564A6F5939"><enum>(6)</enum><header>Innovative component technologies</header><text display-inline="yes-display-inline">Subparagraph (C) of paragraph (1) shall not apply to a walk-in cooler or walk-in freezer component if the component manufacturer has demonstrated to the satisfaction of the Secretary that the component reduces energy consumption at least as much as if such subparagraph were to apply. In support of any demonstration under this paragraph, a manufacturer shall provide to the Secretary all data and technical information necessary to fully evaluate its application.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> 
<section id="H0D4469E59129490CA24D175472AB2EBF" section-type="subsequent-section"><enum>3.</enum><header>Uniform efficiency descriptor for covered water heaters</header><text display-inline="no-display-inline">Section 325(e) of the Energy Policy and Conservation Act (42 U.S.C. 6295(e)) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HC3B211869DDA4D14BDCDB8D8B1D69B39" style="OLC"> 
<paragraph id="HBF2699EB26C248B8BAEE513F8FDB1AFF"><enum>(5)</enum><header>Uniform efficiency descriptor for covered water heaters</header> 
<subparagraph id="H0117ECF9D89A4188AD31487C8E37C9AB"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="HCBC5C6D5BBB14C3E8B50C04875DBA07F"><enum>(i)</enum><header>Covered water heater</header><text>The term <term>covered water heater</term> means—</text> 
<subclause id="HFC9F5E4AFC3D4BC5A7CFF296FB32DDA9"><enum>(I)</enum><text>a water heater; and</text> </subclause> 
<subclause id="H29C640156CC0481E8C53BE90006D6F2F"><enum>(II)</enum><text>a storage water heater, instantaneous water heater, and unfired hot water storage tank (as defined in section 340).</text> </subclause></clause> 
<clause id="H29FF64EC175545F1BEFBF18DF10CCCAF"><enum>(ii)</enum><header>Final rule</header><text>The term <term>final rule</term> means the final rule published under this paragraph.</text> </clause></subparagraph> 
<subparagraph id="H00E4BE61CEBF44559CFAA26699B1B4EA"><enum>(B)</enum><header>Publication of final rule</header><text>Not later than 1 year after the date of enactment of this paragraph, the Secretary shall publish a final rule that establishes a uniform efficiency descriptor and accompanying test methods for covered water heaters.</text> </subparagraph> 
<subparagraph id="HB1728E86CA1B443FA7F2DD70233362C6"><enum>(C)</enum><header>Purpose</header><text>The purpose of the final rule shall be to replace with a uniform efficiency descriptor—</text> 
<clause id="HC16C1BC80FD64AD4A77BDC18A419D21B"><enum>(i)</enum><text>the energy factor descriptor for water heaters established under this subsection; and</text> </clause> 
<clause id="HF042F1574E0C4B389B975404E1635230"><enum>(ii)</enum><text>the thermal efficiency and standby loss descriptors for storage water heaters, instantaneous water heaters, and unfired water storage tanks established under section 342(a)(5).</text> </clause></subparagraph> 
<subparagraph id="HD6A29F403F9C4E5487313FE8A0D40D29"><enum>(D)</enum><header>Effect of final rule</header> 
<clause id="H5FF0E8815C1243F193292C789894A3CC"><enum>(i)</enum><header>In general</header><text>Notwithstanding any other provision of this title, effective beginning on the effective date of the final rule, the efficiency standard for covered water heaters shall be denominated according to the efficiency descriptor established by the final rule.</text> </clause> 
<clause id="H4110F611FB07491282A7E4569B288C93"><enum>(ii)</enum><header>Effective date</header><text>The final rule shall take effect 1 year after the date of publication of the final rule under subparagraph (B).</text> </clause></subparagraph> 
<subparagraph id="H22D4F89B11FD48639324D82DADD3D19E"><enum>(E)</enum><header>Conversion factor</header> 
<clause id="H2D3CB35B126747FE87873802B260F77D"><enum>(i)</enum><header>In general</header><text>The Secretary shall develop a mathematical conversion factor for converting the measurement of efficiency for covered water heaters from the test procedures in effect on the date of enactment of this paragraph to the new energy descriptor established under the final rule.</text> </clause> 
<clause id="HFB0D5CA3A08643A4974932AF5A7A90F8"><enum>(ii)</enum><header>Application</header><text>The conversion factor shall apply to models of covered water heaters affected by the final rule and tested prior to the effective date of the final rule.</text> </clause> 
<clause id="HA7B933CF3D7E494FB78416B87C9639EE"><enum>(iii)</enum><header>Effect on efficiency requirements</header><text>The conversion factor shall not affect the minimum efficiency requirements for covered water heaters otherwise established under this title.</text> </clause> 
<clause id="HD21AF16CCCB14D93BE2C6E2D447019DA"><enum>(iv)</enum><header>Use</header><text>During the period described in clause (v), a manufacturer may apply the conversion factor established by the Secretary to rerate existing models of covered water heaters that are in existence prior to the effective date of the rule described in clause (v)(II) to comply with the new efficiency descriptor.</text> </clause> 
<clause id="HD93BE10217C14B3A9EA061C84854A4BD"><enum>(v)</enum><header>Period</header><text>Clause (iv) shall apply during the period—</text> 
<subclause id="HFCFB7CDE45964F339A48593B329E2CB3"><enum>(I)</enum><text>beginning on the date of publication of the conversion factor in the Federal Register; and</text> </subclause> 
<subclause id="HA952288CD9A343CEB31942FF4B4BCD24"><enum>(II)</enum><text display-inline="yes-display-inline">ending on the later of 1 year after the date of publication of the conversion factor, or December 31, 2015.</text> </subclause></clause></subparagraph> 
<subparagraph id="HDF23DB0262774B9BA181EE86FFDB86F2"><enum>(F)</enum><header>Exclusions</header><text>The final rule may exclude a specific category of covered water heaters from the uniform efficiency descriptor established under this paragraph if the Secretary determines that the category of water heaters—</text> 
<clause id="HDA207BB4614F428DAB35B2FD3E3B9990"><enum>(i)</enum><text>does not have a residential use and can be clearly described in the final rule; and</text> </clause> 
<clause id="HA120B2B729784A13B3693C91DB72F554"><enum>(ii)</enum><text>are effectively rated using the thermal efficiency and standby loss descriptors applied (as of the date of enactment of this paragraph) to the category under section 342(a)(5).</text> </clause></subparagraph> 
<subparagraph id="H72C1AB9F8E914E16B70597D83EE18104"><enum>(G)</enum><header>Options</header><text>The descriptor set by the final rule may be—</text> 
<clause id="H7397B939395B417884A071F637501338"><enum>(i)</enum><text>a revised version of the energy factor descriptor in use as of the date of enactment of this paragraph;</text> </clause> 
<clause id="HC9CAEACBC2C5446AB6376696BAF711A4"><enum>(ii)</enum><text>the thermal efficiency and standby loss descriptors in use as of that date;</text> </clause> 
<clause id="H0B63388D6C154C689CA5F0BD30FBF309"><enum>(iii)</enum><text>a revised version of the thermal efficiency and standby loss descriptors;</text> </clause> 
<clause id="H794E8A52E4204B24ACA95627D1F183DC"><enum>(iv)</enum><text>a hybrid of descriptors; or</text> </clause> 
<clause id="H6DBFB31C79014728964BA33F23F4541A"><enum>(v)</enum><text>a new approach.</text> </clause></subparagraph> 
<subparagraph id="H80E28F8128AC417C96625EC241008297"><enum>(H)</enum><header>Application</header><text>The efficiency descriptor and accompanying test method established under the final rule shall apply, to the maximum extent practicable, to all water heating technologies in use as of the date of enactment of this paragraph and to future water heating technologies.</text> </subparagraph> 
<subparagraph id="HE4B43D430EB34F74BD54A915D3C6AA56"><enum>(I)</enum><header>Participation</header><text>The Secretary shall invite interested stakeholders to participate in the rulemaking process used to establish the final rule.</text> </subparagraph> 
<subparagraph id="HBDB2692F68F54B7AA3D144C6DF72E4E9"><enum>(J)</enum><header>Testing of alternative descriptors</header><text>In establishing the final rule, the Secretary shall contract with the National Institute of Standards and Technology, as necessary, to conduct testing and simulation of alternative descriptors identified for consideration.</text> </subparagraph> 
<subparagraph id="HE67E87210D8C4A22BBA24BE0F0DCF565"><enum>(K)</enum><header>Existing covered water heaters</header><text>A covered water heater shall be considered to comply with the final rule on and after the effective date of the final rule and with any revised labeling requirements established by the Federal Trade Commission to carry out the final rule if the covered water heater—</text> 
<clause id="H1193528D0793409F8D08403CBC1ECB02"><enum>(i)</enum><text>was manufactured prior to the effective date of the final rule; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="HEF2AFF59C4184CB3A2E2D7009365FAC2"><enum>(ii)</enum><text>complied with the efficiency standards and labeling requirements in effect prior to the final rule.</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="H1FE88691E81E45C89D27E0FD1339CCAF"><enum>4.</enum><header>Service over the counter, self-contained, medium temperature commercial refrigerators</header><text display-inline="no-display-inline">Section 342(c) of the Energy Policy and Conservation Act (42 U.S.C. 6313(c)) is amended—</text> 
<paragraph id="H0419FA2916BA472EB7BA4AD5877C7247"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HA4A71926AD5F4D8791630F355E64AB87"><enum>(A)</enum><text>by redesignating subparagraph (C) as subparagraph (E); and</text> </subparagraph> 
<subparagraph id="HCD2E4F6C20594BD4B395C1525E625DE1"><enum>(B)</enum><text>by inserting after subparagraph (B) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HDB302F8BDAE44FA8AB6FE081451EE14B" style="OLC"> 
<subparagraph id="HA3B84F400B94439A9A5EE36CD7AE95E4"><enum>(C)</enum><text>The term <term>service over the counter, self-contained, medium temperature commercial refrigerator</term> or <term>(SOC–SC–M)</term> means a medium temperature commercial refrigerator—</text> 
<clause id="HE7F7198F34AC4AC9A0C7EF02D73245ED"><enum>(i)</enum><text>with a self-contained condensing unit and equipped with sliding or hinged doors in the back intended for use by sales personnel, and with glass or other transparent material in the front for displaying merchandise; and</text> </clause> 
<clause id="H1B635E10D77B4691BB4B72AB04A75D98"><enum>(ii)</enum><text>that has a height not greater than 66 inches and is intended to serve as a counter for transactions between sales personnel and customers.</text> </clause></subparagraph> 
<subparagraph id="H270410467D4842A39A13B83E48868582"><enum>(D)</enum><text>The term <term>TDA</term> means the total display area (ft²) of the refrigerated case, as defined in AHRI Standard 1200.</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph> 
<paragraph id="H7F48E792D864496B9B834112360A5086"><enum>(2)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (5) and (6), respectively; and</text> </paragraph> 
<paragraph id="H69F50B54709F484DB7B7AAF43E9A3712"><enum>(3)</enum><text>by inserting after paragraph (3) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H1CC84A5D8F624B018852CD87DC530167" style="OLC"> 
<paragraph id="HAC643438E9F74BCC9705F2D448633BDC"><enum>(4)</enum>
<subparagraph id="H3F657988A4C04F5CAF4357733A0E34F8" display-inline="yes-display-inline"><enum>(A)</enum><text>Each SOC–SC–M manufactured on or after January 1, 2012, shall have a total daily energy consumption (in kilowatt hours per day) of not more than 0.6 × TDA + 1.0.</text></subparagraph>
<subparagraph id="H823430738EE745FFA5E3CE5E00CBC050" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this paragraph, the Secretary shall—</text>
<clause id="H8C3BB0229AFD47B1B708CDADB07C7768"><enum>(i)</enum><text>determine whether the standard established under subparagraph (A) should be amended; and</text></clause>
<clause id="HDF7EFEA287EB4AD3B81A564F80618729"><enum>(ii)</enum><text>if the Secretary determines that such standard should be amended, issue a final rule establishing an amended standard.</text></clause></subparagraph>
<subparagraph id="H5D8EB13F33B5465CB6570C27D61728EE" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">If the Secretary issues a final rule pursuant to subparagraph (B) establishing an amended standard, the final rule shall provide that the amended standard shall apply to products manufactured on or after the date that is—</text>
<clause id="HA28A5A21E4E74189913F047971423CE6"><enum>(i)</enum><text>3 years after the date on which the final amended standard is published; or</text></clause>
<clause id="H98B5DE8D2A5147749D0A7570E2104FD4"><enum>(ii)</enum><text>if the Secretary determines, by rule, that 3 years is inadequate, not later than 5 years after the date on which the final rule is published.</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> 
<section id="H1734D44A7FA1487B94ED187868C28151"><enum>5.</enum><header>Small duct high velocity systems and administrative changes</header> 
<subsection id="H2A3AD5E5D25D494C94CFF5698539A11D"><enum>(a)</enum><header>Through-the-Wall central air conditioners, through-the-Wall central air conditioning heat pumps, and small duct, high velocity systems</header><text>Section 325(d) of the Energy Policy and Conservation Act (42 U.S.C. 6295(d)) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H3689FD0F8D91429E88305E9346A99966" style="OLC"> 
<paragraph id="HD44EBBA0A0D545A990AA6C4E15CB1929"><enum>(4)</enum><header>Standards for through-the-wall central air conditioners, through-the-wall central air conditioning heat pumps, and small duct, high velocity systems</header> 
<subparagraph id="H64171A53DE0D48D4A132E0F2BD3A37F2"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="HFE512AFC639345958FFE00CB6E8117D2"><enum>(i)</enum><header>Small duct, high velocity system</header><text>The term <term>small duct, high velocity system</term> means a heating and cooling product that contains a blower and indoor coil combination that—</text> 
<subclause id="H2DFC914491C34420977038A1D9FBDD72"><enum>(I)</enum><text>is designed for, and produces, at least 1.2 inches of external static pressure when operated at the certified air volume rate of 220–350 CFM per rated ton of cooling; and</text> </subclause> 
<subclause id="H2900D0BB6F874BC8A5389AC7FC9817FB"><enum>(II)</enum><text>when applied in the field, uses high velocity room outlets generally greater than 1,000 fpm that have less than 6.0 square inches of free area.</text> </subclause></clause> 
<clause id="H6618880F20B442609FEEAD41901893CA"><enum>(ii)</enum><header>Through-the-wall central air conditioner; through-the-wall central air conditioning heat pump</header><text>The terms <term>through-the-wall central air conditioner</term> and <term>through-the-wall central air conditioning heat pump</term> mean a central air conditioner or heat pump, respectively, that is designed to be installed totally or partially within a fixed-size opening in an exterior wall, and—</text> 
<subclause id="H8D1EE3AFF69842C5BC7CB6E808DD9B66"><enum>(I)</enum><text>is not weatherized;</text> </subclause> 
<subclause id="HD1C9545C49BC47E68AFEEA1BFADACD43"><enum>(II)</enum><text>is clearly and permanently marked for installation only through an exterior wall;</text> </subclause> 
<subclause id="HDC3D1188E38E4DBA8AF49F18CF1507F0"><enum>(III)</enum><text>has a rated cooling capacity no greater than 30,000 Btu/hr;</text> </subclause> 
<subclause id="H5E31EBFF97154EF782DA302B8F046110"><enum>(IV)</enum><text>exchanges all of its outdoor air across a single surface of the equipment cabinet; and</text> </subclause> 
<subclause id="HDFD540D1BAE045E4BC0ECF0D0AFD102E"><enum>(V)</enum><text>has a combined outdoor air exchange area of less than 800 square inches (split systems) or less than 1,210 square inches (single packaged systems) as measured on the surface area described in subclause (IV).</text> </subclause></clause> 
<clause id="H1037EE732C33448299D96E0921D63E35"><enum>(iii)</enum><header>Revision</header><text>The Secretary may revise the definitions contained in this subparagraph through publication of a final rule.</text> </clause></subparagraph> 
<subparagraph id="H0E7C1B0264CA4F519B492A9FF7413266"><enum>(B)</enum><header>Small-duct high-velocity systems</header> 
<clause id="H179225BF8B5C42EC9768AFCDB14C9424"><enum>(i)</enum><header>Seasonal energy efficiency ratio</header><text>The seasonal energy efficiency ratio for small-duct high-velocity systems shall be not less than—</text> 
<subclause id="H74C0EE7C43314C98B4FFB070DFA12118"><enum>(I)</enum><text>11.00 for products manufactured on or after January 23, 2006; and</text> </subclause> 
<subclause id="H351E61EC7A7445D59A2B93F1DF77BCF5"><enum>(II)</enum><text>12.00 for products manufactured on or after January 1, 2015.</text> </subclause></clause> 
<clause id="H1AC27B97FE3F4C6F85850B9C7425AC6A"><enum>(ii)</enum><header>Heating seasonal performance factor</header><text>The heating seasonal performance factor for small-duct high-velocity systems shall be not less than—</text> 
<subclause id="H7547776700DF471095F46F76D3EBEA04"><enum>(I)</enum><text>6.8 for products manufactured on or after January 23, 2006; and</text> </subclause> 
<subclause id="H5AD972D51824459EB1C66619E06F759A"><enum>(II)</enum><text>7.2 for products manufactured on or after January 1, 2015.</text> </subclause></clause></subparagraph> 
<subparagraph id="H30D067F3A90E422CB140359434712BA8"><enum>(C)</enum><header>Subsequent rulemakings</header><text>The Secretary shall conduct subsequent rulemakings for through-the-wall central air conditioners, through-the-wall central air conditioning heat pumps, and small duct, high velocity systems as part of any rulemaking under this section used to review or revise standards for other central air conditioners and heat pumps.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H1CB2D780EA554B2F8E8B0B4191BF8C0D"><enum>(b)</enum><header>Duty To review commercial equipment</header><text>Section 342(a)(6) of the Energy Policy and Conservation Act (42 U.S.C. 6313(a)(6)) is amended—</text> 
<paragraph id="HB6DEA9A6BABF446CB24FFC9D56A52DF8"><enum>(1)</enum><text>in subparagraph (A)(i), by inserting <quote>the standard levels or design requirements applicable under that standard to</quote> immediately before <quote>any small commercial</quote>; and</text> </paragraph> 
<paragraph id="H5337D52D33D44DCD9A1D8897044D32C7"><enum>(2)</enum><text>in subparagraph (C)—</text> 
<subparagraph id="HDA0D6E0EACA3476DA3ED2F6422CABC0B"><enum>(A)</enum><text>in clause (i)—</text> 
<clause id="H560358EFAFB743E7ADFA42BAC715B2F2"><enum>(i)</enum><text>by striking <quote>Not later than 6 years after issuance of any final rule establishing or amending a standard, as required for a product under this part,</quote> and inserting <quote>Every 6 years,</quote>; and</text> </clause> 
<clause id="HC70D385B65D54EBC941E9BB3ABF3679F"><enum>(ii)</enum><text>by inserting after <quote>the Secretary shall</quote> the following: <quote>conduct an evaluation of each class of covered equipment and shall</quote>; and</text> </clause></subparagraph> 
<subparagraph id="H81EBB67BEB6C4FBFAE801BB0D6903F50"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H56299A08137E444B9E405638BAFF6D07" style="OLC"> 
<clause id="HDA01C806622B4C639C218BE04DDD8AAF"><enum>(vi)</enum><text>For any covered equipment as to which more than 6 years has elapsed since the issuance of the most recent final rule establishing or amending a standard for the product as of the date of enactment of this clause, the first notice required under clause (i) shall be published by December 31, 2013.</text> </clause><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection> 
<subsection id="HDBECBD691DA5434D8171FF26EB302181"><enum>(c)</enum><header>Petition for amended standards</header><text display-inline="yes-display-inline">Section 325(n) of the Energy Policy and Conservation Act (42 U.S.C. 6295(n)) is amended—</text> 
<paragraph id="HBAAC50DED47D4705B13E981E7ECBAC92"><enum>(1)</enum><text>by redesignating paragraph (3) as paragraph (5); and</text> </paragraph> 
<paragraph id="HA50137EDF81A4333A9222B251F7DB665"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H51D86FDBBA174EC0A6AEF6442B94F53F" style="OLC"> 
<paragraph id="H9B8770E5D0D54E929DD8B9DCDE964EC3"><enum>(3)</enum><header>Notice of decision</header><text>Not later than 180 days after the date of receiving a petition, the Secretary shall publish in the Federal Register a notice of, and explanation for, the decision of the Secretary to grant or deny the petition.</text> </paragraph> 
<paragraph id="HA8867E02B78241B598617B92DD7B964C"><enum>(4)</enum><header>New or amended standards</header><text>Not later than 3 years after the date of granting a petition for new or amended standards, the Secretary shall publish in the Federal Register—</text> 
<subparagraph id="H0EE9D48E393C4BE394E7AFD0633A08CF"><enum>(A)</enum><text>a final rule that contains the new or amended standards; or</text> </subparagraph> 
<subparagraph id="H7D228BD5280F4310A9E978C2F3CC5DF4"><enum>(B)</enum><text>a determination that no new or amended standards are necessary.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
<section id="HCCB3CF5610F94086B1D14DDEF7A060EB"><enum>6.</enum><header>Coordination of research and development of energy efficient technologies for industry</header>
<subsection id="H9F25403ED0D54D218D26D6B0E6807C76"><enum>(a)</enum><header>In general</header><text>As part of the research and development activities of the Industrial Technologies Program of the Department of Energy, the Secretary of Energy (referred to in this section as the <quote>Secretary</quote>) shall establish, as appropriate, collaborative research and development partnerships with other programs within the Office of Energy Efficiency and Renewable Energy (including the Building Technologies Program), the Office of Electricity Delivery and Energy Reliability, and the Office of Science that—</text>
<paragraph id="H74C471AD6DD8463E9D84CA219C94A804"><enum>(1)</enum><text>leverage the research and development expertise of those programs to promote early stage energy efficiency technology development;</text></paragraph>
<paragraph id="H679DE0F54D8C434DB74E58945B7E8CFD"><enum>(2)</enum><text>support the use of innovative manufacturing processes and applied research for development, demonstration, and commercialization of new technologies and processes to improve efficiency (including improvements in efficient use of water), reduce emissions, reduce industrial waste, and improve industrial cost-competitiveness; and</text></paragraph>
<paragraph id="H835B744E793C4BDF8CB373DF9179FBF2"><enum>(3)</enum><text>apply the knowledge and expertise of the Industrial Technologies Program to help achieve the program goals of the other programs.</text></paragraph></subsection>
<subsection id="H1578383D991D4A7D8FB13EFA6EFB4C43"><enum>(b)</enum><header>Reports</header><text>Not later than 2 years after the date of enactment of this Act and biennially thereafter, the Secretary shall submit to Congress a report that describes actions taken to carry out subsection (a) and the results of those actions.</text></subsection></section>
<section id="H3DD21B60E27E4412A5DD40C6A3C8C5F4"><enum>7.</enum><header>Reducing barriers to the deployment of industrial energy efficiency</header>
<subsection id="H3C78E676D9D749B68C41A577DDFD3CF9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HCF78FF75016C46FDAACAC129D3F6A8D4"><enum>(1)</enum><header>Industrial energy efficiency</header><text>The term <quote>industrial energy efficiency</quote> means the energy efficiency derived from commercial technologies and measures to improve energy efficiency or to generate or transmit electric power and heat, including electric motor efficiency improvements, demand response, direct or indirect combined heat and power, and waste heat recovery.</text></paragraph>
<paragraph id="HC506AF65345B493CB530F82E46C4325C"><enum>(2)</enum><header>Industrial sector</header><text>The term <quote>industrial sector</quote> means any subsector of the manufacturing sector (as defined in North American Industry Classification System codes 31–33 (as in effect on the date of enactment of this Act)) establishments of which have, or could have, thermal host facilities with electricity requirements met in whole, or in part, by onsite electricity generation, including direct and indirect combined heat and power or waste recovery.</text></paragraph></subsection>
<subsection id="HB3790E383BCF42819A92C44533CF4F87"><enum>(b)</enum><header>Report on the deployment of industrial energy efficiency</header>
<paragraph id="H1B19E7D52ED6405EA0B0B1DC614853C0"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report describing—</text>
<subparagraph id="H22BB49B531FE48B4BEBD8B2033B6E5AF"><enum>(A)</enum><text>the results of the study conducted under paragraph (2); and</text></subparagraph>
<subparagraph id="HE9B38EB6E09D47BCB9A6C8B731400182"><enum>(B)</enum><text>recommendations and guidance developed under paragraph (3).</text></subparagraph></paragraph>
<paragraph id="H5ABC630FA89941E5BF3216C9F07EC8E3"><enum>(2)</enum><header>Study</header><text>The Secretary, in coordination with the industrial sector and other stakeholders, shall conduct a study of the following:</text>
<subparagraph id="HF9A05BA86DF041E08719E98B41C930AA"><enum>(A)</enum><text>The legal, regulatory, and economic barriers to the deployment of industrial energy efficiency in all electricity markets (including organized wholesale electricity markets, and regulated electricity markets), including, as applicable, the following:</text>
<clause id="H176A13C402434BDB998A76111E0319C9"><enum>(i)</enum><text>Transmission and distribution interconnection requirements.</text></clause>
<clause id="HF3ADBA48532A4822B2CF780626AB3A8C"><enum>(ii)</enum><text>Standby, back-up, and maintenance fees (including demand ratchets).</text></clause>
<clause id="H1A20127092ED4A2DA3164E78ED44F389"><enum>(iii)</enum><text>Exit fees.</text></clause>
<clause id="HE3DDA124DA194AA3825F47FA9EBE2C0C"><enum>(iv)</enum><text>Life of contract demand ratchets.</text></clause>
<clause id="HE926DB365D974FC5AF4D5F6E3D507967"><enum>(v)</enum><text>Net metering.</text></clause>
<clause id="HE380FB1C266A49C399F7B98DFB04A473"><enum>(vi)</enum><text>Calculation of avoided cost rates.</text></clause>
<clause id="HA54A3C357B6541C3870AA21D158C62FB"><enum>(vii)</enum><text>Power purchase agreements.</text></clause>
<clause id="HE80ED0C4B66745F693B0A0EC662E56ED"><enum>(viii)</enum><text>Energy market structures.</text></clause>
<clause id="H9F58FA012E674C349A54FFCDE6B22B39"><enum>(ix)</enum><text>Capacity market structures.</text></clause>
<clause id="H48EC8907EA5A4BC4BBB8E2753347F4B6"><enum>(x)</enum><text>Other barriers as may be identified by the Secretary, in coordination with the industrial sector and other stakeholders.</text></clause></subparagraph>
<subparagraph id="H0969236D0ECA4197934AE702C3D84A42"><enum>(B)</enum><text>Examples of—</text>
<clause id="HB504F35BED884DA2A8046ECD0F3C7171"><enum>(i)</enum><text>successful State and Federal policies that resulted in greater use of industrial energy efficiency;</text></clause>
<clause id="HA00CA44D50374C79B0345041F414A4FC"><enum>(ii)</enum><text>successful private initiatives that resulted in greater use of industrial energy efficiency; and</text></clause>
<clause id="H8B99D57323944A88997D46ECAE6FC365"><enum>(iii)</enum><text>cost-effective policies used by foreign countries to foster industrial energy efficiency.</text></clause></subparagraph>
<subparagraph id="H49382868298A44E0A68CA3D4B3937B31"><enum>(C)</enum><text>The estimated economic benefits to the national economy of providing the industrial sector with Federal energy efficiency matching grants of $5,000,000,000 for 5- and 10-year periods, including benefits relating to—</text>
<clause id="H81A29C9A571A43FBBF4B72B16D2C3CB7"><enum>(i)</enum><text>estimated energy and emission reductions;</text></clause>
<clause id="H94732524548244148F1957DF4D662085"><enum>(ii)</enum><text>direct and indirect jobs saved or created;</text></clause>
<clause id="HDDA175ED7AFB4EF388DDE6B020D6FFFB"><enum>(iii)</enum><text>direct and indirect capital investment;</text></clause>
<clause id="HDB51C7228CF34D13A1175DEC5A9588F7"><enum>(iv)</enum><text>the gross domestic product; and</text></clause>
<clause id="H1C9D5014AE4542D5B8EF3D157B65FBD9"><enum>(v)</enum><text>trade balance impacts.</text></clause></subparagraph>
<subparagraph id="HF2DB3E3CC119479CB9A7259A8F4C97C2"><enum>(D)</enum><text>The estimated energy savings available from increased use of recycled material in energy-intensive manufacturing processes.</text></subparagraph></paragraph>
<paragraph id="HDE607F24F3844CB59F488F33A4A0CF7D"><enum>(3)</enum><header>Recommendations and guidance</header><text>The Secretary, in coordination with the industrial sector and other stakeholders, shall develop policy recommendations regarding the deployment of industrial energy efficiency, including proposed regulatory guidance to States and relevant Federal agencies to address barriers to deployment.</text></paragraph></subsection></section>
<section id="HCE873EABED6446A4AC3199C39F0C476E"><enum>8.</enum><header>Best practices for advanced metering</header><text display-inline="no-display-inline">Section 543(e) of the National Energy Conservation Policy Act (42 U.S.C. 8253(e)) is amended by striking paragraph (3) and inserting the following:</text>
<quoted-block id="H18F8CA65EB4A4CAD93ED824FB865A1C5" style="OLC">
<paragraph id="H66DC0BA5B64B4A79A82C16C0BBE8AB31"><enum>(3)</enum><header>Plan</header><text>Not later than 180 days after the date on which guidelines are established under paragraph (2), in a report submitted by the agency under section 548(a), each agency shall submit to the Secretary a plan describing the manner in which the agency will implement the requirements of paragraph (1), including—</text>
<subparagraph id="H564423674A23496889024EAEA40A450B"><enum>(A)</enum><text>how the agency will designate personnel primarily responsible for achieving the requirements; and</text></subparagraph>
<subparagraph id="H5E000C707EF8487F90D3973E42500FCE"><enum>(B)</enum><text>a demonstration by the agency, complete with documentation, of any finding that advanced meters or advanced metering devices (as those terms are used in paragraph (1)), are not practicable.</text></subparagraph></paragraph>
<paragraph id="H5E6249E8B7834917B4F5B333D4D1BE2A"><enum>(4)</enum><header>Best practices report</header>
<subparagraph id="H4C25A190F1444DE8B9F74A64A90FE29E"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this paragraph, the Secretary of Energy, in consultation with the Secretary of Defense and the Administrator of General Services, shall develop, and issue a report on, best practices for the use of advanced metering of energy use in Federal facilities, buildings, and equipment by Federal agencies.</text></subparagraph>
<subparagraph id="HD04BF0D5B8C14F2DB36FAA9607C37519"><enum>(B)</enum><header>Components</header><text>The report shall include, at a minimum—</text>
<clause id="H9CADA4BA3F854E42A4AD3D2C6488E654"><enum>(i)</enum><text>summaries and analysis of the reports by agencies under paragraph (3);</text></clause>
<clause id="HBF1AE26AE5B04F42A6A70AA91F3ECC07"><enum>(ii)</enum><text>recommendations on standard requirements or guidelines for automated energy management systems, including—</text>
<subclause id="HC662F2CF8D224E00826C51B4C4876DD7"><enum>(I)</enum><text>potential common communications standards to allow data sharing and reporting;</text></subclause>
<subclause id="H211300E14C23417F9846EFCD801F5A72"><enum>(II)</enum><text>means of facilitating continuous commissioning of buildings and evidence-based maintenance of buildings and building systems; and</text></subclause>
<subclause id="HA4313A0495974F32B7516EEE30CB8F2C"><enum>(III)</enum><text>standards for sufficient levels of security and protection against cyber threats to ensure systems cannot be controlled by unauthorized persons; and</text></subclause></clause>
<clause id="HB1E9D712855644EC8298E85B40804D81"><enum>(iii)</enum><text>an analysis of—</text>
<subclause id="HFBDB2F7D169749FF8EECC77B68AD7016"><enum>(I)</enum><text>the types of advanced metering and monitoring systems being piloted, tested, or installed in Federal buildings; and</text></subclause>
<subclause id="HA375617832EB4A479C6FC1DAF5224BC7"><enum>(II)</enum><text>existing techniques used within the private sector or other non-Federal government buildings.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H2A6F3A1330CA4FA8A4038B914AA6F5B8"><enum>9.</enum><header>Federal energy management and data collection standard</header><text display-inline="no-display-inline">Section 543 of the National Energy Conservation Policy Act (42 U.S.C. 8253) is amended—</text>
<paragraph id="H47B269D9A52D4412819C94E97B7B947F"><enum>(1)</enum><text>by redesignating the second subsection (f) (as added by section 434(a) of Public Law 110–140 (121 Stat. 1614)) as subsection (g); and</text></paragraph>
<paragraph id="H3D94BEF2439D465F8B82DD79843BAED6"><enum>(2)</enum><text>in subsection (f)(7), by striking subparagraph (A) and inserting the following:</text>

<clause id="HBC5B3F8ED2F44A42B6E25F769FCD8A90"><enum>(ii)</enum><text>to publish energy and water consumption data on an individual facility basis.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<subclause id="H3475161FBA414C28BA42F0EE16DC9A92"><enum>(II)</enum><text>the savings in operating costs throughout the estimated average life of the product in the type (or class) compared to any increase in the price of, or in the initial charges for, or maintenance expenses of, the products that are likely to result from the imposition of the standard;</text> </subclause> 
<subclause id="HDB2BDF23BD5E46BC9D557FD4F2F9512B"><enum>(III)</enum><text>the total projected quantity of energy savings likely to result directly from the imposition of the standard;</text> </subclause> 
<subclause id="H182EBF9A29674CADB0F6A9CF7C3C6B58"><enum>(IV)</enum><text>any lessening of the utility or the performance of the products likely to result from the imposition of the standard;</text> </subclause> 
<subclause id="HE2FD82EBA30A40CA845E80DC86EFBF6A"><enum>(V)</enum><text>the impact of any lessening of competition, as determined in writing by the Attorney General, that is likely to result from the imposition of the standard;</text> </subclause> 
<subclause id="H0AA3CE079FFF495AB44E757ACD7E5479"><enum>(VI)</enum><text>the need for national energy conservation; and</text> </subclause> 
<subclause id="H2A7A52DA42BD47BDAE6D42FA1CE645B3"><enum>(VII)</enum><text>other factors the Secretary considers relevant.</text> </subclause></clause>

<subclause id="H15E617443CCE451C8B78B1DF9A441760"><enum>(I)</enum><header>Energy use and efficiency</header><text>The Secretary may not prescribe any amended standard under this paragraph that increases the maximum allowable energy use, or decreases the minimum required energy efficiency, of a covered product.</text> </subclause> 
<subclause id="H593632D659814416AD4ECFE271385425"><enum>(II)</enum><header>Unavailability</header> 
<item id="HD2A7280253E9420189480A0A80E20750"><enum>(aa)</enum><header>In general</header><text>The Secretary may not prescribe an amended standard under this subparagraph if the Secretary finds (and publishes the finding) that interested persons have established by a preponderance of the evidence that a standard is likely to result in the unavailability in the United States in any product type (or class) of performance characteristics (including reliability, features, sizes, capacities, and volumes) that are substantially the same as those generally available in the United States at the time of the finding of the Secretary.</text> </item>
