		<official-title>To amend title 5, United States Code, to reduce the
		  number of civil service positions within the executive branch, and for other
		  purposes.</official-title>

		<section id="H48A4898A0D4542439104FE5C69ACD133" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Workforce Reduction Act of
			 2011</short-title></quote>.</text>
		</section><section id="H689A56F2F3434B1496A297219920AF2B"><enum>2.</enum><header>Reducing the
			 number of Federal employees</header><text display-inline="no-display-inline">Section 3101 of title 5, United States Code,
			 is amended—</text>
			<paragraph id="H50D1CC26229047F99FAB32B615DD9093"><enum>(1)</enum><text>by striking
			 <quote>Each Executive agency</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In
			 general</header-in-text>.—Subject to subsection (b), each Executive
			 agency</quote>; and</text>
			</paragraph><paragraph id="H5E608EF0517E4CD986854D1D26CD9B34"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HB11BB81EF21C4995B0841C1479288216" style="USC">
					<subsection id="H4DAA1AE8892743F79C52A0A003DF80CF"><enum>(b)</enum><header>Reduction in
				Number of Employees</header>
						<paragraph id="HE739B1F29B214E12A385C19E60ECCBDD"><enum>(1)</enum><header>Hiring
				freeze</header><text display-inline="yes-display-inline">Except as provided in
				paragraph (2), during fiscal year 2012 and each succeeding fiscal year for
				which the Director of the Office of Management and Budget (in such manner as
				the Director determines to be appropriate) projects a Federal budget deficit,
				the head of an Executive agency may not appoint any individual to a position in
				the agency.</text>
						</paragraph><paragraph id="HBF1EB5D592FE49F9887DBAC770FB951F"><enum>(2)</enum><header>Permitting
				appointments from Federal workforce hiring pool</header>
							<subparagraph id="H585BA286D2B84052B58917E61A110EA1"><enum>(A)</enum><header>Establishment of
				pool</header><text>The President shall establish a Federal workforce hiring
				pool consisting of positions which may be allocated among all Executive
				agencies.</text>
							</subparagraph><subparagraph id="H830755E1107845A8B21A84F56307A72C"><enum>(B)</enum><header>Procedures</header><text>The
				head of an Executive agency may appoint an individual to a position in the
				agency if—</text>
								<clause id="HEB171AE9DDDE486195C03AC8295FCEA3"><enum>(i)</enum><text>there is a
				position available in the Federal workforce hiring pool;</text>
								</clause><clause id="H33884F1B1BF047769353EFD6418A79FD"><enum>(ii)</enum><text>the head of the
				Executive agency submits a request to the President for the allocation of a
				position in the Federal workforce hiring pool to the agency for purposes of
				making an appointment; and</text>
								</clause><clause id="HA5DE70925CB542D0840C99620C173854"><enum>(iii)</enum><text>the President
				approves the request.</text>
								</clause></subparagraph><subparagraph id="H1F94DF7622D94EB79AE88FC99C1151C9"><enum>(C)</enum><header>Process and
				criteria for approving requests</header><text display-inline="yes-display-inline">The President shall promulgate
				regulations—</text>
								<clause id="HDFB46921943846C58E5D717E075FE915"><enum>(i)</enum><text>setting forth the
				process by which the head of an Executive agency may make a request under this
				subsection; and</text>
								</clause><clause id="HFAB7C41E2990422A905C5E263170CB6E"><enum>(ii)</enum><text>setting forth the
				criteria by which the President shall determine on a competitive basis whether
				to approve a request by the head of an Executive agency under this
				subsection.</text>
								</clause></subparagraph><subparagraph id="H357F712AFB894442BCA586D661B81321"><enum>(D)</enum><header>Number of
				positions in pool</header>
								<clause id="HFBE1A48346514E7C82EDA89E0924B96C"><enum>(i)</enum><header>Initial
				number</header><text>As of the first day of fiscal year 2012, the number of
				positions in the Federal workforce hiring pool shall equal zero.</text>
								</clause><clause id="HBC112F76C65446C89B9FB402262182F2"><enum>(ii)</enum><header>Changes to
				initial number</header><text>After the first day of fiscal year 2012, the
				number of positions in the Federal workforce hiring pool—</text>
									<subclause id="H1083576DF1BE46779B5B2529C45E39DE"><enum>(I)</enum><text>shall increase by
				.50 for each full-time-equivalent position in any Executive agency which
				subsequently becomes vacant; and</text>
									</subclause><subclause id="H9B343D9FD9BA45D6B135F45C0D48EE43"><enum>(II)</enum><text>shall decrease by
				1.0 for each request for a full-time equivalent position which is approved by
				the President under this subsection.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="H466B55BBE0DE41998330598901183037"><enum>(3)</enum><header>Waiver in case
				of emergency or need to protect national security</header><text display-inline="yes-display-inline">The President may waive this subsection
				with respect to the hiring of an employee for a position upon a determination
				by the President that—</text>
							<subparagraph id="HE8A5BACFA7734B7A99FE547E8CE56684"><enum>(A)</enum><text>the existence of a
				state of war or other national security concern so requires; or</text>
							</subparagraph><subparagraph id="HF3B033AD7B2F46D0B215C7A784D54D9F"><enum>(B)</enum><text>the existence of
				an extraordinary emergency threatening life, health, safety, or property so
				requires.</text>
							</subparagraph></paragraph><paragraph id="HD72C0C40FC254320BFAA93DFF79320B0"><enum>(4)</enum><header>Action through
				OPM</header><text>The President shall carry out this subsection through the
				Director of the Office of Personnel Management, who shall consult with the
				Director of the Office of Management and Budget.</text>
						</paragraph><paragraph id="HB9127DF7C59943CC87981FC4952C7C39"><enum>(5)</enum><header>Reports to
				Congress</header>
							<subparagraph id="H513B46CA54E7429292B48D9B8CA0F957"><enum>(A)</enum><header>In
				general</header><text>Not later than 90 days after the end of each quarter of a
				fiscal year, the President shall provide Congress with a report containing a
				list of each appointment approved by the President under this subsection during
				the quarter, broken down by executive agency.</text>
							</subparagraph><subparagraph id="H48CE2788DDDE400691A8F6C56CE3E0DE"><enum>(B)</enum><header>Information
				included</header><text>The list contained in a report provided to Congress
				under subparagraph (A) shall include a description of the position associated
				with each approved appointment, but shall not provide any information that may
				be used to identify the individual appointed to the position.</text>
							</subparagraph><subparagraph id="HEE7F2F513C77408AB3BE378E96BD5B31"><enum>(C)</enum><header>Public
				dissemination</header><text>The President shall make each report provided to
				Congress under subparagraph (A) available to the public by posting the report
				on the official public website of the Executive Office of the President in a
				searchable, sortable, and down­load­able manner.</text>
							</subparagraph></paragraph><paragraph id="HEE26F57406094019B8D3520B75F654CF"><enum>(6)</enum><header>Exclusion of
				certain executive agencies</header><text>This subsection does not apply
				to—</text>
							<subparagraph id="HBE4AF0A6147048A0851E99C8578BC1C5"><enum>(A)</enum><text>the Department of
				Defense;</text>
							</subparagraph><subparagraph id="H6D16A894EBBD40788A2463117593C182"><enum>(B)</enum><text>the Department of
				Homeland Security; or</text>
							</subparagraph><subparagraph id="H34AC3BE5CE414E70A8D9C2C2A7EB3082"><enum>(C)</enum><text>the Department of
				Veterans’
				Affairs.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
