		<official-title>To amend the Internal Revenue Code of 1986 to provide a
		  refundable tax credit for certain expenses of applying to graduate
		  school.</official-title>

		<section id="H8E46723084354181AC8136B3D261E277" section-type="section-one"><enum>1.</enum><header>Short title;
			 findings</header>
			<subsection id="HD92860482F594B20BCDFAFD9C1EB38D2"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Leadership Invests in the
			 Future Through Helping Individuals Gain Higher Education and Retraining Act of
			 2012</short-title></quote> or as the <quote><short-title>LIFT HIGHER Act of 2012</short-title></quote>.</text>
			</subsection><subsection id="H0B73ADC3E2224A7AA9F5E403F653293B"><enum>(b)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="H4441B5E83FE345E3836EFFB32848AC2C"><enum>(1)</enum><text display-inline="yes-display-inline">The median student loan debt for students
			 who graduated from college between 2006 and 2010 is $20,000.</text>
				</paragraph><paragraph id="H12D99380ECAE4D1FBB58ED010E52A3B8"><enum>(2)</enum><text>Application fees
			 for individual schools range from $40 to $140. The cost of taking the Graduate
			 Record Exam once is $150. Law school admission test preparation courses cost
			 upwards of $1,500. These costs make it difficult for many students to apply to
			 graduate school and discourage others from doing so.</text>
				</paragraph><paragraph id="H2C2CDEA9CED94B50A2638034046AA322"><enum>(3)</enum><text>The percentage of
			 Americans with graduate degrees is continuing to rise, with 10.9% of the
			 population having graduate degrees as of 2011.</text>
				</paragraph><paragraph id="HCA063B22D4D8463081DD9F0E7973DA32"><enum>(4)</enum><text>Persons with
			 advanced degrees earn on average $3.2 million in their lifetime compared to
			 those holding a bachelors degree who earn about $2.27 million.</text>
				</paragraph><paragraph id="H861B05E3894642D4AB28D2676539BF94"><enum>(5)</enum><text>It is in the
			 national interest to have highly educated citizenry.</text>
				</paragraph><paragraph id="H36D3441406E84D7EB898D4FEA8224AB3"><enum>(6)</enum><text>University
			 education is the best and most effective way to obtain professional training
			 and skills.</text>
				</paragraph></subsection></section><section id="H6D186CB3D6DE4E7B937BA1A7D4FD654E"><enum>2.</enum><header>Refundable tax
			 credit for graduate school application expenses</header>
			<subsection id="H84686EA4FBAF4C2C8C57AF316ACA326B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart C of part IV
			 of subchapter A of chapter 1 of the Internal Revenue Code of 1986 is amended by
			 inserting after section 36B the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H3C55A7206F304D35BEB5183CAC5EA715" style="OLC">
					<section id="H228668CD940B4620AE95259BDA170D86"><enum>36C.</enum><header>Credit for
				graduate school application expenses</header>
						<subsection id="HF4D8091705A547C2885422AF61213FDE"><enum>(a)</enum><header>Allowance of
				credit</header><text display-inline="yes-display-inline">In the case of a
				specified graduate school applicant, there shall be allowed as a credit against
				the tax imposed by this subtitle for such taxable year an amount equal to the
				qualified graduate school application expenses paid or incurred by such
				applicant during such taxable year.</text>
						</subsection><subsection id="H883D680B7FFB43139DE268F0F16E5505"><enum>(b)</enum><header>Limitations</header>
							<paragraph id="H6F5072AEC6DF4875B7AF8459601FBC3C"><enum>(1)</enum><header>Dollar
				limitation</header><text>The amount allowable as a credit under subsection (a)
				with respect to any individual for any taxable year shall not exceed the excess
				of $500 over the aggregate amount of the credits allowable under subsection (a)
				with respect to such individual for all prior taxable years.</text>
							</paragraph><paragraph id="HEA6CB4E65D694AC19AE2BCC784CC5E6B"><enum>(2)</enum><header>Limitation based
				on modified adjusted gross income</header>
								<subparagraph id="HE3C5F7BEA87D4B3F96D1CEBBF773BD16"><enum>(A)</enum><header>In
				general</header><text>The amount allowable as a credit under subsection (a)
				(determined without regard to this paragraph and after the application of
				paragraph (1)) for the taxable year shall be reduced (but not below zero) by
				the amount which bears the same ratio to the amount which is so allowable
				as—</text>
									<clause id="H4E061B2F7C274C7BB5BF156349742943"><enum>(i)</enum><text>the excess (if
				any) of—</text>
										<subclause id="H7BA2626D8DEE4603BEFFFF89AC71E2E6"><enum>(I)</enum><text>the taxpayer’s
				modified adjusted gross income for such taxable year, over</text>
										</subclause><subclause id="HE4CA3C877C2B4D6AA1C6F2AD4BEFA2EB"><enum>(II)</enum><text>$60,000 ($120,000
				in the case of a joint return), bears to</text>
										</subclause></clause><clause id="H38DFAFE4A4F54C319D55E626AFF46361"><enum>(ii)</enum><text>$5,000.</text>
									</clause></subparagraph><subparagraph id="H58132418955741DFAACE0A4ABA632751"><enum>(B)</enum><header>Modified
				adjusted gross income</header><text>For purposes of subparagraph (A), the term
				<term>modified adjusted gross income</term> means the adjusted gross income of
				the taxpayer for the taxable year increased by any amount excluded from gross
				income under section 911, 931, or 933.</text>
								</subparagraph></paragraph></subsection><subsection id="HF659EB336D2A4988A481A3BB29F1A5AB"><enum>(c)</enum><header>Specified
				graduate school applicant</header><text>For purposes of this section, the term
				<term>specified graduate school applicant</term> means any individual who
				applies to an eligible educational institution (as defined in section
				25A(f)(2)) for acceptance into a program of post­bac­ca­lau­re­ate study
				leading to a graduate degree from such institution.</text>
						</subsection><subsection id="HA7E713F2535A4DFFB3F55EA4B2FC9DA8"><enum>(d)</enum><header>Qualified
				graduate school application expenses</header><text>For purposes of this
				section, the term <term>qualified graduate school application expenses</term>
				means amounts paid or incurred—</text>
							<paragraph id="HB602F69C69DF43DF923C97C7BCB3B10D"><enum>(1)</enum><text>as an application
				fee with respect to applying for the program of study referred to in subsection
				(c),</text>
							</paragraph><paragraph id="H354B1AF6D0D345598AD8319081C1A00B"><enum>(2)</enum><text>as a fee for
				taking any test which is required in connection with applying for such program
				of study,</text>
							</paragraph><paragraph id="H72F5814E0A144CBE98CBD658F2530076"><enum>(3)</enum><text>for study and
				preparation materials (whether printed or electronic) for any test referred to
				in paragraph (2), or</text>
							</paragraph><paragraph id="HDF2BC24CAD4D44F380AD7D763CCA2513"><enum>(4)</enum><text>for tutorial and
				preparation services for any test referred to in paragraph (2) if such services
				are provided by a person approved or licensed under State law to provide such
				services.</text>
							</paragraph></subsection><subsection id="HB28441001B754D5DBF31D9E98286483B"><enum>(e)</enum><header>Credit not
				allowed to individuals who can be claimed as dependents</header><text>No credit
				shall be allowable under subsection (a) with respect to any individual with
				respect to whom a deduction under section 151 is allowable to another taxpayer
				for a taxable year beginning in the calendar year in which the taxable year
				referred to in subsection (a)
				begins.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="HD0C4B5F810864E63A8561B02E4DD7310"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H3CF728FF6F2340BBB28E98E11BC95448"><enum>(1)</enum><text>Subparagraph (A)
			 of section 6211(b)(4) of such Code is amended by inserting <quote>36C, </quote>
			 after <quote>36B,</quote>.</text>
				</paragraph><paragraph id="H4FB970D272FF41C7B4EDF7DE89A34CE4"><enum>(2)</enum><text>Paragraph (2) of
			 section 1324(b) of title 31, United States Code, is amended by inserting
			 <quote>36C,</quote> after <quote>36B,</quote>.</text>
				</paragraph></subsection><subsection id="H872EDF405A464B848B0A96FE2B819088"><enum>(c)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for subpart C of part IV of subchapter A of chapter 1 of the Internal
			 Revenue Code of 1986 is amended by inserting after the item relating to section
			 36B the following new item:</text>

			</subsection><subsection id="H428AF33402344F29965820D3B0D44AC6"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
