		  additional advance refunding for certain tax-exempt bonds.</official-title>

		<section id="HAFBC22E473E84F29B1F76D929FF975C4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Local Schools and Infrastructure
			 Improvement Act of 2012</short-title></quote>.</text>
		</section><section id="HDCF038A8C3CB45B0BC7DA2E501DA79F5"><enum>2.</enum><header>Additional
			 advance refunding of certain tax-exempt bonds</header>
			<subsection id="H7AEB715060AC4FE48DE21CCEED7A8DA1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Clause (i) of section
			 149(d)(3)(A) of the Internal Revenue Code of 1986 is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HAFEEDBBAD31C4628AA245DCFA1D4C23B" style="OLC">
					<clause id="H1E3E56F157C1428AB7069C5EB8D49EEE"><enum>(i)</enum><text display-inline="yes-display-inline">the refunding bond is only the 1st or 2nd
				advance refunding of the original
				bond,</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8265338FE59449958A6353AA7016EE37"><enum>(b)</enum><header>Advance
			 refunding bond requirements</header>
				<paragraph id="HE08FB618D4B343CE839F7B5607023D10"><enum>(1)</enum><header>In
			 general</header><text>Subparagraph (A) of section 149(d)(3) of such Code is
			 amended by striking <quote>and</quote> at the end of clause (iv), by striking
			 the period at the end of clause (v), and by adding at the end the following new
			 clause:</text>
					<quoted-block display-inline="no-display-inline" id="H75D43A27D9E048C083BDE411294A506C" style="OLC">
						<clause id="H2D5992C2B0DA4FCB83C5602D85273992"><enum>(vi)</enum><text display-inline="yes-display-inline">in the case of the 2nd advance refunding of
				the original bond—</text>
							<subclause id="HCE0B9DB7A05645B5AA0D26747170C82D"><enum>(I)</enum><text>the issuer is
				projected to realize present value debt service savings (determined without
				regard to administrative expenses) in connection with the issue of which the
				refunding bond is a part,</text>
							</subclause><subclause id="H8A3D4403637B4C4986B43AF1A6E38910"><enum>(II)</enum><text>the average
				maturity date of the issue of which the refunding bond is a part is not later
				than the average maturity date of the bonds to be refunded by such issue,
				and</text>
							</subclause><subclause id="H973ABC37F9D44CE8A5CEEBD81BEECABB"><enum>(III)</enum><text>the amount of
				the refunding bond does not exceed the outstanding amount of the refunded
				bond.</text>
							</subclause><continuation-text continuation-text-level="clause">For purposes
				of clause (vi)(II), average maturity dates shall be determined under rules
				similar to the rules of section
				172(b)(2).</continuation-text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HDABB4A6C32F8441F85BAEB45F646D416"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
			 (3) of section 149(d) of such Code is amended by adding after subparagraph (B)
			 the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H9B137E7E172442EEAC1535B71727EA63" style="OLC">
						<subparagraph id="HF553AF6AFC9542C685E6175DC038E4D7"><enum>(C)</enum><header>Special rule for
				2nd advance refundings</header><text display-inline="yes-display-inline">Clause
				(vi) of subparagraph (A) shall not apply in the case of a 2nd advance refunding
				if—</text>
							<clause id="HBCF9666719A14652AF547817F3AC6831"><enum>(i)</enum><text>the original bond
				has been redeemed, or</text>
							</clause><clause id="H067A7A06593D4706BB02B25473C423CF"><enum>(ii)</enum><text display-inline="yes-display-inline">the issuer determines that the 2nd advance
				refunding is necessary to avoid or terminate a default in the payment of debt
				service on the refunded
				bond.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H97895C77EC54461DB872821266B972C5"><enum>(c)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to refunding
			 bonds issued on or after the date of the enactment of this Act.</text>
			</subsection></section></legis-body>
