		<official-title>To amend the Office of National Drug Control Policy
		  Reauthorization Act of 2006 to increase congressional oversight of the United
		  States Anti-Doping Agency.</official-title>

		<section id="H4843CB4CAE904A889F023E8A4354B72F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Athlete Due Process Protection Act of
			 2012</short-title></quote>.</text>
		</section><section id="H82996F43B4A64A659FF90314B8BC1219"><enum>2.</enum><header>Congressional
			 review and oversight of the United States Anti-Doping Agency</header>
			<subsection id="HD34061A10AB4462193F191AA2388FE67"><enum>(a)</enum><header>Provision of
			 allegations to athletes</header><text display-inline="yes-display-inline">Section 701(b) of such Act (21 U.S.C.
			 2001(b)) is amended—</text>
				<paragraph id="H5081FDAC66764D36A6A77C9C2033519E"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="HF76E3A1DA9CD4BB2825CFC5F926012B7"><enum>(2)</enum><text>in paragraph (5),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H5D11718C9CB546F7A2721580C06697D3"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H30C4A28D1BB14BBAAE32AB2D1C0F4925" style="OLC">
						<paragraph id="H2342B50C5439499BAE86F82599A78D72"><enum>(6)</enum><text display-inline="yes-display-inline">provide a document to each athlete that it
				investigates that includes the specific doping allegations against such
				athlete.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5922CA1FF0E04B719861CF7E42B87EE3"><enum>(b)</enum><header>Expansion of
			 reporting to Congress</header><text display-inline="yes-display-inline">Section
			 702 of such Act (21 U.S.C. 2002) is amended—</text>
				<paragraph id="HC18D4B78B0054E03AA40965CCFA1A2CB"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting <quote>,
			 including the information under subsection (c)</quote> before the period;
			 and</text>
				</paragraph><paragraph id="H39D96DFD4CD64F1D8C2DBF05D82CD1B4"><enum>(2)</enum><text>by adding at the
			 end the following new subsections:</text>
					<quoted-block display-inline="no-display-inline" id="HB1D753AB77F344DBB8BCD4B7ABFF3D4B" style="OLC">
						<subsection id="H45354DD7C0B8418BA94A27D6D42DE67C"><enum>(c)</enum><header>Additional
				annual report contents</header><text display-inline="yes-display-inline">Beginning with the report that the United
				States Anti-Doping Agency submits to Congress under subsection (b) in fiscal
				year 2014 and annually thereafter, such report shall include the following for
				the previous calendar year:</text>
							<paragraph id="H749CE43583A0464E921A2813976E1CAE"><enum>(1)</enum><text display-inline="yes-display-inline">Information on each athlete that the United
				States Anti-Doping Agency investigated, including—</text>
								<subparagraph id="HA11853C7AD8B45539667E495C605BC65"><enum>(A)</enum><text display-inline="yes-display-inline">the status of each athlete as an amateur
				athlete;</text>
								</subparagraph><subparagraph commented="no" id="HC2E53D6264C04A0EB2C83B9956A95B36"><enum>(B)</enum><text>the nationality of
				each athlete; and</text>
								</subparagraph><subparagraph commented="no" id="H0996A4A819AF4C34A2FB05AC889B0005"><enum>(C)</enum><text display-inline="yes-display-inline">a copy of the document provided to each
				athlete under section 701(b)(6), provided in a manner that does not identify
				any individual athlete.</text>
								</subparagraph></paragraph><paragraph id="H9C151B7DF980496980D8E7D4DC8D0676"><enum>(2)</enum><text>The location of
				each investigation and adjudication that the Agency conducted, including
				investigations and adjudications outside of the United States.</text>
							</paragraph><paragraph id="H757709C047D24F3893C8735C974847AE"><enum>(3)</enum><text display-inline="yes-display-inline">Any investigations or adjudications
				conducted by the Agency that another United States or foreign agency or
				organization concurrently investigated or adjudicated.</text>
							</paragraph><paragraph id="HFE20E45DBB964BD2B4AB294192AB6B74"><enum>(4)</enum><text display-inline="yes-display-inline">The cost of each investigation and
				adjudication that the United States Anti-Doping Agency conducted, including all
				internal and external legal fees associated with each such investigation and
				adjudication.</text>
							</paragraph></subsection><subsection id="H34B31F888BBA472E99BA79BF5302391C"><enum>(d)</enum><header>Report on new
				rules</header>
							<paragraph commented="no" id="H5AFFA4284CA446519CFA07833DBE4B8F"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Beginning on the date
				that is 90 days after the date of the enactment of the Athlete Due Process
				Protection Act of 2012, before a new or revised procedural or evidentiary rule
				that relates to the investigation or adjudication process of the United States
				Anti-Doping Agency can take effect, the United States Anti-Doping Agency shall
				submit to the Committees on the Judiciary of the House of Representatives and
				the Senate a report containing—</text>
								<subparagraph commented="no" id="H0079F0994C8A4AC7B481B9ADE8201AA1"><enum>(A)</enum><text display-inline="yes-display-inline">a copy of the rule;</text>
								</subparagraph><subparagraph commented="no" id="H330EBBB2096745F598BDF0197FF84674"><enum>(B)</enum><text>a concise general
				statement relating to the rule; and</text>
								</subparagraph><subparagraph commented="no" id="H13E4630A16124A9A8DA95039EF350A76"><enum>(C)</enum><text display-inline="yes-display-inline">a list of any other related actions that
				the United States Anti-Doping Agency plans to take to implement the rule.</text>
								</subparagraph></paragraph><paragraph id="H1FA5BD4A1B8D45888BD6A143598DADC4"><enum>(2)</enum><header>Effective date
				of rules</header><text display-inline="yes-display-inline">A rule relating to a
				report submitted under paragraph (1) shall take effect on the date that is 180
				days after the United States Anti-Doping Agency submits a report under
				paragraph (1) if Congress has not voted to override implementation of the rule.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0F19D9858835462EBFEF824472BE4B96"><enum>(c)</enum><header>Due process
			 protections for athletes</header><text>Such Act is amended—</text>
				<paragraph id="HFE9CB0E9AFE3468B8717A19A9A5E136B"><enum>(1)</enum><text>by redesignating
			 section 703 as section 704; and</text>
				</paragraph><paragraph id="H5074C6D57ECC4D80949046294A13340C"><enum>(2)</enum><text>by inserting the
			 following new section:</text>
					<quoted-block display-inline="no-display-inline" id="HCE31843F52D34C8CA3F7C4E67CD03121" style="OLC">
						<section commented="no" id="HBC58F0C9743946009C9F4B242A757418"><enum>703.</enum><header>Due process
				protections for athletes</header><text display-inline="no-display-inline">No
				athlete who participates in an event sponsored or licensed by a National
				Governing Body, or otherwise subject to the jurisdiction of the United States
				Anti-Doping Agency, the World Anti-Doping Agency, or the International
				Association of Athletics Federation, may be fined, suspended, expelled, or
				otherwise penalized unless such athlete has been—</text>
							<paragraph commented="no" id="HBE083669D50C4D7DB1AD507DA9293664"><enum>(1)</enum><text>served with
				written specific charges providing dates and times of alleged conduct in
				quest;</text>
							</paragraph><paragraph commented="no" id="HBEE0F47BF5894F5E836E2B2CA9513EB5"><enum>(2)</enum><text>given a reasonable
				time to prepare such athlete’s defense; and</text>
							</paragraph><paragraph commented="no" id="HC3F5408800A346EE9F8277E1C88AF0B8"><enum>(3)</enum><text>afforded a full
				and fair
				hearing.</text>

				</paragraph></subsection></section></legis-body>
