		<official-title>To establish minimum levels of assistance for certain
		  States under the Low-Income Home Energy Assistance Program, and for other

		<section id="H6C29C9168C314BD4BC4D31E54B23D8C4" section-type="section-one"><enum>1.</enum><header>State
			 allotments</header><text display-inline="no-display-inline">Section 2604 of the
			 Low-Income Home Energy Assistance Act of 1981 (42 U.S.C. 8623) is
			 amended—</text>
			<paragraph id="HC6EDF8AFC4104E69A58D0D8A508937FF"><enum>(1)</enum><text>in subsection (c),
			 in the matter preceding paragraph (1), by inserting <quote>or subsection
			 (f)</quote> after <quote>subsection (a)</quote>; and</text>
			</paragraph><paragraph id="H3A4AC7F6BFD64A91B2CE3E1B8F2651B3"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H3F9C0C3AFA5A4DB4B57BC1C916A43676" style="OLC">
					<subsection id="HA436333E450541AD8C88D03485D8AA9C"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF7C2C1A0C9904FABB58021195F751866"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a), of the
				amount appropriated pursuant to section 2602(b) for a fiscal year containing a
				qualifying winter season, the Secretary shall allot to each qualifying State an
				amount that is not less than the amount allotted to such State for fiscal year
				2010, and ratably reduce the amounts allotted under this section to States that
				are not qualifying States if necessary to ensure the allotments to qualifying
				States.</text>
						</paragraph><paragraph id="H68F809120C334AB49C2DCEDA3922D73C" indent="up1"><enum>(2)</enum><text>For the purposes of this
				subsection—</text>
							<subparagraph id="H86788F32F5A34C0F99A024AA28265724"><enum>(A)</enum><text>the term <term>qualifying State</term>
				means a State in which not less than 25 percent of households use heating oil
				as the primary heating fuel, as determined by the Secretary; and</text>
							</subparagraph><subparagraph id="H120AAAD02F304049B6A3E0E9A09D0F8C"><enum>(B)</enum><text>the term <term>qualifying winter
				season</term> means a winter season occurring after the date of enactment of
				this subsection for which the Secretary determines that the projected average
				price of heating oil is greater than the average price of heating oil for the
				winter of 2011–2012.</text>
							</subparagraph></paragraph><paragraph id="H259A309E2ECF476B93280F6B802C05CC" indent="up1"><enum>(3)</enum><text>This subsection shall not be
				effective for a fiscal year if the sums appropriated pursuant to section
				2602(b) for such fiscal year are not sufficient to pay in full the total amount
				required to be allocated to all qualifying States under paragraph
				(1).</text>
