		<official-title>To make improvements to provisions of the Bank Holding
		  Company Act of 1956 relating to proprietary trading by banking

		<section id="H4984E50A505F44B0BD927C01CEE0175A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>U.S. Financial Services Global
			 Viability Act</short-title></quote>.</text>
		</section><section id="HDC817A931D384006B5557697596071C7"><enum>2.</enum><header>Amendments to the
			 Bank Holding Company Act of 1956</header><text display-inline="no-display-inline">Section 13 of the Bank Holding Company Act
			 of 1956 (12 U.S.C. 1851) is amended—</text>
			<paragraph id="H2A49AA84DB274214B858E34061C9C285"><enum>(1)</enum><text>by redesignating
			 subsection (h) as subsection (i) and by inserting after subsection (g) the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HF8C0D8711A6E422785D1C794CE9BEC03" style="OLC">
					<subsection id="H1F3E321BD44E40F2932C2AD0F9FD50E2"><enum>(h)</enum><header>Identification
				and certification</header>
						<paragraph id="HC0D9DAFB03F64B57941876A4672D8D67"><enum>(1)</enum><header>In
				general</header><text>Subsection (a) and (c) and any rule or regulation
				prescribed pursuant to subsection (b)(2), or any other regulatory action to
				enforce or implement any provision of this section, shall not be effective
				until the Secretary of the Treasury—</text>
							<subparagraph id="H8C88F4A14656405CACA44EAEDDF41AB7"><enum>(A)</enum><text display-inline="yes-display-inline">identifies the foreign countries (including
				the United Kingdom, France, Germany, Switzerland, Japan, Brazil, China, Canada,
				and Mexico) that have foreign banks chartered and headquartered in such
				countries that compete significantly with banking entities subject to the
				provisions of this section; and</text>
							</subparagraph><subparagraph id="H6E6F9D43C53C4077A2E8AE305CE4B208"><enum>(B)</enum><text>certifies that
				such countries have applied to such foreign banks, including the subsidiaries
				and affiliates of such banks, requirements equivalent to those set forth under
				this section.</text>
							</subparagraph></paragraph><paragraph id="HD9EE98CB47D043CD9D8DC8D0F0BC6DDB"><enum>(2)</enum><header>Hearing;
				judicial review</header><text>The certification under paragraph (1)(B) shall be
				determined after interested parties are given the opportunity for a hearing on
				the record in accordance with the procedures set forth under section 554 of
				title 5, United States Code, and such parties are entitled to judicial review
				in accordance with chapter 7 of such title in the United States Court of
				Appeals for the District of Columbia Circuit.</text>
						</paragraph><paragraph id="H6B5C7E9EC52F4983B3C3592328AD038C"><enum>(3)</enum><header>Postponement of
				effective date</header><text>The effective date of the provisions, rules, and
				regulations described under paragraph (1) shall be postponed pending judicial
				review.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HFE0FEB0CF4374F49A27A369E41C86B98"><enum>(2)</enum><text>in subsection (i),
			 as redesignated in paragraph (1)—</text>
				<subparagraph id="H052D63E219B848A4B1CA050A475AF97C"><enum>(A)</enum><text>by redesignating
			 paragraphs (2) through (7) as paragraphs (3) through (8), respectively;
			 and</text>
				</subparagraph><subparagraph id="H625B94CE41474FCF99F1081350F2ABC6"><enum>(B)</enum><text>inserting after
			 paragraph (1) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H1F0D5BECBB09490CBE3C3DD341BE7B9F" style="OLC">
						<paragraph id="H99B9FCE8953A4265BE5918300CABA90D"><enum>(2)</enum><header>Foreign bank;
				foreign country</header><text display-inline="yes-display-inline">The terms
				<term>foreign bank</term> and <term>foreign country</term> shall have the same
				meanings as are given such terms in section 1 of the International Banking Act
				of 1978 (12 U.S.C.
				3101).</text>
