		<section id="H87E21B36A8834220B2A22B6376A69202" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Detroit Economic Competitiveness
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HB7B46EE29F9942E0A40B7E94A297B382" section-type="subsequent-section"><enum>2.</enum><header>Detroit Jobs Trust
			 Fund</header>
			<subsection id="H79AB9FE9E27F492C9F7376570C88BD4F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter A of
			 chapter 98 of the Internal Revenue Code of 1986 is amended by adding at the end
			 the following new section:</text>
				<quoted-block id="H93505331711E4FEEB4758CB2F196258C">
					<section id="H9A8E0DED8A54475AAC8695C4BA44B6AD"><enum>9512.</enum><header>Detroit Jobs
				Trust Fund</header>
						<subsection id="H6C8E75E92F8240A19265233BCFA67BB1"><enum>(a)</enum><header>Creation of
				trust fund</header><text>There is established in the Treasury of the United
				States a trust fund to be known as the <term>Detroit Jobs Trust Fund</term>,
				consisting of such amounts as may be appropriated or credited to such fund as
				provided in this section or section 9602(b).</text>
						</subsection><subsection id="H18D1A3C016E94A44AFBD754CE14B1B83"><enum>(b)</enum><header>Transfers to
				trust fund</header><text display-inline="yes-display-inline">There are hereby
				appropriated to the Detroit Jobs Trust Fund amounts equivalent to receipts in
				the Treasury of taxes (including all income, excise, and employment taxes
				whether imposed with respect to individuals or businesses) imposed under this
				title (with respect to periods after the date of the enactment of this section)
				which are (as determined by the Secretary) attributable to Detroit, Michigan.
				The city of Detroit, Michigan, shall provide the Secretary such information as
				the Secretary may request for purposes of making the determinations required
				under this subsection. For purposes of this subsection, the taxes imposed on a
				corporation or other business entity shall not be treated as attributable to
				Detroit, Michigan, merely because the headquarters of such corporation or
				entity is located in Detroit, Michigan.</text>
						</subsection><subsection id="H49536B7DF4CF409A93453B3FD030F236"><enum>(c)</enum><header>Expenditures</header>
							<paragraph id="H1F4073E0209B4EC2A9912FE0CE565A89"><enum>(1)</enum><header>In
				general</header><text>Except as otherwise provided in this subsection, amounts
				in the Detroit Jobs Trust Fund shall (without need of any further
				appropriation) be distributed annually by the Secretary to the city of Detroit,
				Michigan, to carry out the purposes described in paragraph (2).</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H768AD26B04A546B6BA3EBF39A370C82A"><enum>(2)</enum><header>Use of
				expenditures</header><text>Amounts distributed to the city of Detroit,
				Michigan, under this section shall be used for the following purposes and in
				the following order of priority:</text>
								<subparagraph id="HA0B32776A4314B47B016081AD24396E0"><enum>(A)</enum><text>First, of the
				amounts distributed with respect the annual period not in excess of the Detroit
				income tax suspension hold harmless amount, for any purpose determined by the
				city government of Detroit, Michigan.</text>
								</subparagraph><subparagraph id="H24406EFE7825471A8BA4A6947231CE3A"><enum>(B)</enum><text>Second, for
				payment of principal and interest on any general obligation issued by the city
				of Detroit, Michigan (to the extent of such obligations).</text>
								</subparagraph><subparagraph id="H3675D92753F14E36A2B8509D00CB9B69"><enum>(C)</enum><text>Third, for payment
				of principal and interest on obligations to which section 103 applies and the
				proceeds of which were used for the public schools of the city of Detroit,
				Michigan (to the extent of such obligations).</text>
								</subparagraph><subparagraph id="H319AC07B9F5247B0B4A7A011753495BD"><enum>(D)</enum><text>Fourth, for jobs
				development, public safety, education, business infrastructure, or public
				infrastructure (to the extent consistent with the plan described in paragraph
				(4)).</text>
								</subparagraph></paragraph><paragraph id="HAFE5861DA8974C6C9B7A8C8E6ECBC51A"><enum>(3)</enum><header>Restriction on
				distributions</header><text>No distribution shall be made by the Secretary
				under paragraph (1) unless—</text>
								<subparagraph id="H1F7DF1DF07054CE099B23A92FC034072"><enum>(A)</enum><text>the city of
				Detroit, Michigan, does not impose an income tax with respect to the period to
				which such distribution relates,</text>
								</subparagraph><subparagraph id="H7121B05242AF4DFAA9466A3941BA0408"><enum>(B)</enum><text>such city has
				reduced the aggregate property taxes imposed by an amount not less than the
				reduction in the payment obligations of such city by reason of the payments
				described in paragraph (2),</text>
								</subparagraph><subparagraph id="HE5846DDBE5754F67BA4D49755BFA276F"><enum>(C)</enum><text>all prior
				distributions made to the city under paragraph (2) were used by the city in a
				manner consistent with the requirements of paragraph (2), and</text>
								</subparagraph><subparagraph id="H36BFDAB973B14141835F25BD35B52C2C"><enum>(D)</enum><text>such city has
				provided such information to the Comptroller General of the United States as
				the Comptroller General may request to carry out section 2(b) of the
				<short-title>Detroit Economic Competitiveness
				Act</short-title>.</text>
								</subparagraph></paragraph><paragraph id="H700B58CBAF034B40BDFACCB8C91606FA"><enum>(4)</enum><header>5-year
				development plan</header><text>A plan is described in this paragraph if such
				plan—</text>
								<subparagraph id="H8AA65AFF36B84F7582DC83332F1992F0"><enum>(A)</enum><text>is a 5-year plan
				describing development goals for Detroit, Michigan, and detailing how
				distributions for purposes described in paragraph (2)(D) will be spent,</text>
								</subparagraph><subparagraph id="H09A0E012FDD745328EEBCAE66041F988"><enum>(B)</enum><text>has been approved
				by simple majority vote of the City Council of Detroit, Michigan (after
				consultation with the Detroit Board of Education), and</text>
								</subparagraph><subparagraph id="H500A9581CC894002A812EBA9885B5564"><enum>(C)</enum><text>has been submitted
				to, and approved by, the Secretary of the Treasury, the Secretary of Housing
				and Urban Development, and the Secretary of Education.</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">No
				distribution shall be made under paragraph (1) for a purpose described in
				paragraph (2)(D) unless a plan described in this paragraph is in effect and all
				prior such distributions for such purposes were used in accordance with such
				plan.</continuation-text></paragraph><paragraph id="H3AC2D3B411E54FC990BE90086C9A3A89"><enum>(5)</enum><header>Special rules
				during period of plan development</header><text>During the period during which
				the plan described in paragraph (4) is developed (but not in excess of the
				5-month period beginning on the date of the first distribution under paragraph
				(1)), amounts distributed may be used concurrently for the purposes described
				in subparagraphs (A), (B), and (C) of paragraph (2).</text>
							</paragraph><paragraph id="H9FAD148E28D0495EA27066AF06A3967E"><enum>(6)</enum><header>Detroit income
				tax suspension hold harmless amount</header>
								<subparagraph id="H1D39B840A2834C25A58E466237B7732C"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of
				paragraph (2)(A), the term <term>Detroit income tax suspension hold harmless
				amount</term> means the amount (as determined by the Secretary) of revenue
				collected by the city of Detroit pursuant to the income tax imposed by such
				city during the calendar year preceding the calendar year which includes the
				date of the enactment of this section.</text>
								</subparagraph><subparagraph id="HFED9507424D84010BC921F136F6AF6B8"><enum>(B)</enum><header>Cross
				reference</header><text>For provision which requires suspension of the Detroit
				income tax, see paragraph (3)(A).</text>
								</subparagraph><subparagraph id="HF256E25AC554431082A2CC57AC577F75"><enum>(C)</enum><header>Tax returns may
				still be required</header><text>The city of Detroit, Michigan, shall not be
				treated as failing to satisfy the requirement of paragraph (3)(A) with respect
				to any period merely because taxpayers are required to file tax returns and
				report income with respect to such period.</text>
								</subparagraph></paragraph><paragraph id="HAEE413A2303D4EA2AA2E7401A51443C1"><enum>(7)</enum><header>Amounts made
				available not to reduce other funding</header><text display-inline="yes-display-inline">Amounts distributed to the city of Detroit,
				Michigan, under this section shall supplement, and not supplant, any other
				funding (including any Federal funding) for such city.</text>
							</paragraph></subsection><subsection id="H0AD1C5B4C9A940499CF34D8FEBCDA7AE"><enum>(d)</enum><header>Termination</header><text>No
				amount shall be distributed from, or appropriated to, the Detroit Jobs Trust
				Fund after the 5-year period beginning on the date of the enactment of this
				section. Any amounts remaining in such Trust Fund at the end of such period
				shall be transferred to the general fund of the Treasury. The 5-year period
				specified in this subsection shall not be renewed or
				extended.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H897B8E4A4F174F30AB614835D618E9CB"><enum>(b)</enum><header>GAO
			 reports</header><text>The Comptroller General of the United States shall submit
			 an annual report to Congress which—</text>
				<paragraph id="H2F320A62F9E542F8B3D116B8F8079A45"><enum>(1)</enum><text>describes the
			 manner and purposes for which distributions made from the Detroit Jobs Trust
			 Fund have been used,</text>
				</paragraph><paragraph id="H08FA0B57FCB14A6B90AA47CA972F630E"><enum>(2)</enum><text>describes the
			 extent to which progress has been made toward meeting the development goals
			 under the plan described in section 9512(c)(4) of the Internal Revenue Code of
			 1986 (as added by this section) and whether such progress is consistent with
			 meeting such goals, and</text>
				</paragraph><paragraph id="H264FF3C51F5046E29630C6494AF4DA04"><enum>(3)</enum><text>includes any
			 recommendations the Comptroller General may have regarding improvements to the
			 program described in section 9512 of such Code.</text>
				</paragraph><continuation-text continuation-text-level="subsection">The first
			 such annual report shall be submitted not later than 90 days after the 1-year
			 period beginning on the date of the enactment of this Act and the last such
			 annual report shall be submitted not later than 90 days after the date on which
			 the Detroit Jobs Trust Fund terminates pursuant to section 9512(d) of such
			 Code.</continuation-text></subsection><subsection id="H2AFEA8F6C60441829E971DAF907B10BA"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections for subchapter A of chapter 98 of
			 the Internal Revenue Code of 1986 is amended by adding at the end the following
			 new item:</text>

			 rate for certain new investments in Detroit, Michigan</header>
			<subsection id="HB399080A7AF54128A621A7209F00AB90"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter Y of
			 chapter 1 of the Internal Revenue Code of 1986 is amended by adding at the end
			 the following new part:</text>

						<toc container-level="part-container" idref="HC53BE6CE567F49F59BBA12AF8EFBEB16" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration">
							<toc-entry idref="H316FF1312F1946E59C90CE11E1A2D383" level="section">Sec. 1400V. Zero capital gains rate for certain new investments
				  in Detroit, Michigan.</toc-entry>
						</toc>
						<section id="H316FF1312F1946E59C90CE11E1A2D383"><enum>1400V.</enum><header>Zero capital
				gains rate for certain new investments in Detroit, Michigan</header>
							<subsection id="H17D5D31D7D2443199F65CB9443686F4B"><enum>(a)</enum><header>In
				general</header><text>Gross income does not include any qualified capital gain
				from the sale or exchange of a specified new investment held for more than 1
				year.</text>
							</subsection><subsection id="HE61136CD5F704A909C97420924018DC2"><enum>(b)</enum><header>Specified new
				investment</header><text>For purposes of this section—</text>
								<paragraph id="HC8A6EE683D694C67887469A8367822DA"><enum>(1)</enum><header>In
				general</header><text>The term <term>specified new investment</term>
				means—</text>
									<subparagraph id="HF7790537AC234A1DBEE178D779381130"><enum>(A)</enum><text>any qualified
				stock,</text>
									</subparagraph><subparagraph id="H8A3279A529E846C59364B1B7C14F0CD2"><enum>(B)</enum><text>any qualified
				partnership interest, and</text>
									</subparagraph><subparagraph id="HDD0C1C5F270444C8BC62F06CCFA94360"><enum>(C)</enum><text>any qualified
				business property.</text>
									</subparagraph></paragraph><paragraph id="H4A812F4F3A264075B0685E431C6D08D9"><enum>(2)</enum><header>Qualified
				stock</header>
									<subparagraph id="HD6E2F9593E3444B4A6FC2A55635BCCAC"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the term
				<term>qualified stock</term> means any stock in a domestic corporation
				if—</text>
										<clause id="H92E7AD5E8B794507B9133638F3B4F79A"><enum>(i)</enum><text>such stock is
				acquired by the taxpayer during the 1-year period beginning on the date of the
				enactment of this section, at its original issue (directly or through an
				underwriter) from the corporation solely in exchange for cash,</text>
										</clause><clause id="H2D4754C5C34D4DB5B0DF5CA6CCBAEBDB"><enum>(ii)</enum><text>as of the time
				such stock was issued, such corporation was a specified Detroit business (or,
				in the case of a new corporation, such corporation was being organized for
				purposes of being a specified Detroit business), and</text>
										</clause><clause id="H0A2E7C86413D4BB9B3822AF61F55FCFB"><enum>(iii)</enum><text>during
				substantially all of the taxpayer’s holding period for such stock, such
				corporation qualified as a specified Detroit business.</text>
										</clause></subparagraph><subparagraph id="H8E2118A4CF58434E9C6E73A2112A6CCA"><enum>(B)</enum><header>Redemptions</header><text>A
				rule similar to the rule of section 1202(c)(3) shall apply for purposes of this
				paragraph.</text>
									</subparagraph></paragraph><paragraph id="H979E557047424AC1B7171147B6C2A315"><enum>(3)</enum><header>Qualified
				partnership interest</header><text>The term <term>qualified partnership
				interest</term> means any capital or profits interest in a domestic partnership
				if—</text>
									<subparagraph id="HD46109750DE54A1BA467DDBBC96F2540"><enum>(A)</enum><text>such interest is
				acquired by the taxpayer during the 1-year period beginning on the date of the
				enactment of this section, from the partnership solely in exchange for
				cash,</text>
									</subparagraph><subparagraph id="HC7C6BFE5C6AB4BA3B7BA72364C98357B"><enum>(B)</enum><text>as of the time
				such interest was acquired, such partnership was a specified Detroit business
				(or, in the case of a new partnership, such partnership was being organized for
				purposes of being a specified Detroit business), and</text>
									</subparagraph><subparagraph id="H2751BE41F2FF4572895D66D7AE288534"><enum>(C)</enum><text>during
				substantially all of the taxpayer’s holding period for such interest, such
				partnership qualified as a specified Detroit business.</text>
									</subparagraph><continuation-text continuation-text-level="paragraph">A rule
				similar to the rule of paragraph (2)(B) shall apply for purposes of this
				paragraph.</continuation-text></paragraph><paragraph id="H9DFD167712DE4D99974A6091304EA9C0"><enum>(4)</enum><header>Qualified
				business property</header>
									<subparagraph id="H4E1E9790850547A8A7C79F7588E8361A"><enum>(A)</enum><header>In
				general</header><text>The term <term>qualified business property</term> means
				tangible property if—</text>
										<clause id="H8844E0B9852A48CA9C89618A14590DD8"><enum>(i)</enum><text>such property was
				acquired by the taxpayer by purchase (as defined in section 179(d)(2)) during
				the 1-year period beginning on the date of the enactment of this
				section,</text>
										</clause><clause id="H70D4BC204686484D8B80B5BAC6627B15"><enum>(ii)</enum><text>the original use
				of such property in Detroit, Michigan, commences with the taxpayer, and</text>
										</clause><clause id="H3DCAC1862FA240AD9A61D862009DE2A8"><enum>(iii)</enum><text>during
				substantially all of the taxpayer’s holding period for such property,
				substantially all of the use of such property was in a specified Detroit
				business of the taxpayer.</text>
										</clause></subparagraph><subparagraph id="H2F651276B3654B7FB56E5D05BE2B442F"><enum>(B)</enum><header>Special rule for
				substantial improvements</header><text>The requirements of clauses (i) and (ii)
				of subparagraph (A) shall be treated as satisfied with respect to—</text>
										<clause id="H4D26B4592B794E78ADC6E17CEC0EEA0B"><enum>(i)</enum><text>property which is
				substantially improved by the taxpayer before the end of the period described
				in subparagraph (A)(i), and</text>
										</clause><clause id="H90EE94B53CB946EB994D844E406568F6"><enum>(ii)</enum><text>any land on which
				such property is located.</text>
										</clause><continuation-text continuation-text-level="subparagraph">The
				determination of whether a property is substantially improved shall be made
				under clause (ii) of section 1400B(b)(4)(B), except that <quote>the date of the
				enactment of section 1400V</quote> shall be substituted for <quote>December 31,
				1997</quote> in such clause.</continuation-text></subparagraph></paragraph></subsection><subsection id="HF20761C862CD4B5F961480948E8B891F"><enum>(c)</enum><header>Qualified
				capital gain</header><text>For purposes of this section—</text>
								<paragraph id="HB2627D9D43B540969A668A5B574EB880"><enum>(1)</enum><header>In
				general</header><text>Except as otherwise provided in this subsection, the term
				<term>qualified capital gain</term> means any gain recognized on the sale or
				exchange of—</text>
									<subparagraph id="H6056A6C349F24BFFA7E7B945D6426A0D"><enum>(A)</enum><text>a capital asset,
				or</text>
									</subparagraph><subparagraph id="H50AEB0261B404FEEA70085ABA4052738"><enum>(B)</enum><text>property used in
				the trade or business (as defined in section 1231(b)).</text>
									</subparagraph></paragraph><paragraph id="HA407408F7CEA4FF2848F6277A2B300B4"><enum>(2)</enum><header>Gain before
				enactment not qualified</header><text>The term <term>qualified capital
				gain</term> shall not include any gain attributable to periods before the date
				of the enactment of this section.</text>
								</paragraph><paragraph id="H114A4F085D0244748614D5ADFD17A2B7"><enum>(3)</enum><header>Certain rules to
				apply</header><text>Rules similar to the rules of paragraphs (3), (4), and (5)
				of section 1400B(e) shall apply for purposes of this subsection.</text>
								</paragraph></subsection><subsection id="HB439CD81390F4B30A632AF91008C3C9A"><enum>(d)</enum><header>Specified
				Detroit business</header><text>For purposes of this section, the term
				<term>specified Detroit business</term> means any enterprise zone business (as
				defined in section 1397C), determined—</text>
								<paragraph commented="no" id="HF4C69F51A8AC4A5892B98ED93506A430"><enum>(1)</enum><text>without regard to
				subsections (b)(6) and (c)(5) thereof,</text>
								</paragraph><paragraph commented="no" id="HCD70F01A8A0242BEA16C87E71E8E0111"><enum>(2)</enum><text>by substituting
				<quote>80 percent</quote> for <quote>50 percent</quote> in subsections (b)(2)
				and (c)(1) thereof,</text>
								</paragraph><paragraph id="H805BD208FD9E473A9143EC2F0E85EBC7"><enum>(3)</enum><text>by treating
				Detroit, Michigan, as an empowerment zone (and by treating no area other than
				Detroit, Michigan, as an empowerment zone).</text>
								</paragraph></subsection><subsection id="H86B904A8864D45D7923118EACBD57C43"><enum>(e)</enum><header>Certain rules To
				apply</header><text>For purposes of this section, rules similar to the rules of
				paragraphs (6) and (7) of subsection (b), and subsections (f) and (g), of
				section 1400B shall apply; except that for such purposes section 1400B(g)(2)
				shall be applied by substituting <quote>before the date of the enactment of
				section 1400V</quote> for <quote>before January 1, 1998, or after December 31,
				2014</quote>.</text>
							</subsection><subsection id="HCE52543CD61A416D9824F9DB6FD31932"><enum>(f)</enum><header>Regulations</header><text>The
				Secretary shall prescribe such regulations as may be appropriate to carry out
				the purposes of this section, including regulations to prevent the abuse of the
				purposes of this
				section.</text>
							</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H794E849DD08F43E69F7839F8A03B8FAF"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of parts for subchapter Y of chapter 1 of
			 such Code is amended by adding at the end the following new item:</text>

						<toc-entry level="part">Part IV. Certain new investments in Detroit,
				Michigan</toc-entry>
					</toc>

			</subsection><subsection id="HB5EE47E888F6480CB82F07768B895EF0"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to property
			 acquired after the date of the enactment of this Act.</text>
