		<section id="HE8A5AEF0D91541C2ABE6769F19A013F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Global Investments in America’s Cities
			 Act</short-title></quote>.</text>
		</section><section id="HA89B74A6AAB34C4F83115017DB8ECDC2"><enum>2.</enum><header>Modification of
			 EB–5 visa program</header><text display-inline="no-display-inline">Section
			 203(b)(5) of the Immigration and Nationality Act (8 U.S.C. 1153(b)(5)) is
			 amended by adding at the end the following:</text>
			<quoted-block id="H8C780198EF7E4947AEFDD410F2118B2B" style="OLC">
				<subparagraph display-inline="no-display-inline" id="H3B5D44C858F147F8AEFF9344D895469B"><enum>(E)</enum><header>Set-aside for
				economically distressed urban areas</header>
					<clause id="H30EDDE6C8A0D4CFC98CFDA6FD381ECD4"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not less than 3,000
				of the visas made available under this paragraph in each fiscal year shall be
				reserved for qualified immigrants seeking to invest in a new commercial
				enterprise described in subparagraph (A) which will create employment in an
				economically distressed urban area and—</text>
						<subclause commented="no" display-inline="no-display-inline" id="HEA7DDA7642F94074810EDD73B52DA363"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to which such alien or a
				relative of that alien has invested or, is actively in the process of
				investing, in that new enterprise, capital in an amount not less than the
				amount specified in clause (ii);</text>
						</subclause><subclause id="H332E2C1149574871971111E6754329B4"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to which such alien has
				completed an investment agreement with a qualified venture capital operating
				company for an investment in that new enterprise of an amount not less than the
				amount specified in clause (ii); or</text>
						</subclause><subclause id="H9D7D5B97286B41AB946298EDF29768D2"><enum>(III)</enum><text display-inline="yes-display-inline">with respect to which such alien has
				completed an investment agreement with one or more angel investors for an
				investment in that new enterprise of an amount not less than the amount
				specified in clause (ii).</text>
						</subclause></clause><clause id="HDED1303D073444C8990F544E0514857B"><enum>(ii)</enum><header>Capital amount
				required</header><text>The amount of capital specified in this clause is
				$250,000. To account for inflation, the Secretary of Homeland Security may by
				rule adjust the amount of capital specified in this clause.</text>
					</clause><clause id="H5E7BC535533746D7A7692E6B9ACC7A04"><enum>(iii)</enum><header>Definitions</header><text>In
				this subparagraph:</text>
						<subclause id="H03D3E64D1A024197BCA5DB68C989C3A5"><enum>(I)</enum><header>Angel
				investor</header><text display-inline="yes-display-inline">The term <term>angel
				investor</term> means, with respect to a qualified immigrant, an individual
				who—</text>
							<item id="H50802F5CA17B4530A0C5B56DBBC45F61"><enum>(aa)</enum><text>is
				an accredited investor (as defined in section 230.501(a) of title 17, Code of
				Federal Regulations (as in effect on April 1, 2010));</text>
							</item><item id="H978522A6937B4E77B0BFFC2BF1496E03"><enum>(bb)</enum><text>is
				a United States citizen or an alien lawfully admitted to the United States for
				permanent residence; and</text>
							</item><item id="H9B7ED64295B246918822B5F50C2BE361"><enum>(cc)</enum><text>has
				made at least 2 equity investments of not less than $50,000 in each of the 3
				years before the date of a petition by the qualified immigrant for
				classification under this paragraph.</text>
							</item></subclause><subclause id="H11F79ACA8F60498A9577093706567325"><enum>(II)</enum><header>Economically
				distressed urban area</header><text display-inline="yes-display-inline">The
				term <term>economically distressed urban area</term> means, at the time a
				petition for classification under this paragraph is filed the following:</text>
							<item id="HF0E97AE17E8544F6AFE0428A19CCE194"><enum>(aa)</enum><text>A
				city that has an average unemployment rate of not less than 150 percent of the
				national average rate for the preceding year.</text>
							</item><item id="HE2DA23D3A4E64426979B08E1625FBFC6"><enum>(bb)</enum><text>Any
				principal city for a Metropolitan Statistical Area, as defined by the Office of
				Management and Budget.</text>
							</item></subclause><subclause id="HE145C50C4D4143CF85260FA1930EFFD9"><enum>(III)</enum><header>Qualified
				venture capital operating company</header><text display-inline="yes-display-inline">The term <term>qualified venture capital
				operating company</term> means an entity that—</text>
							<item id="HABA8EC2AC7F54F49B98864FC210B9288"><enum>(aa)</enum><text>is
				registered under the Investment Company Act of 1940 (15 U.S.C. 80a–1 et seq.);
				or</text>
							</item><item id="H51EFA464BDE940F2AC068B41DC2817EA"><enum>(bb)</enum><text>is
				an investment company, as defined in subsection (a)(1) of section 3 of such Act
				(15 U.S.C. 80a–3), that is exempt from registration under subsection (c)(1) or
				(c)(7) of such section, and is not registered.</text>
							</item></subclause><subclause id="H8EAFA0F030AB43849F827EE6D57F79F0"><enum>(IV)</enum><header>Relative</header><text>The
				term <term>relative</term> means, with respect to a qualified immigrant—</text>
							<item id="HDD19AA47881D43F490F306A4FC8B5979"><enum>(aa)</enum><text>a
				spouse;</text>
							</item><item id="H93258AE7F2294EE180ADF093B3725E7D"><enum>(bb)</enum><text>a
				sibling;</text>
							</item><item id="HC441796661C544E18F34B2678CC8DAE6"><enum>(cc)</enum><text>a
				child;</text>
							</item><item id="H6E1725E8C67F49089CCFFA8E1B84E722"><enum>(dd)</enum><text>a
				parent;</text>
							</item><item id="HB70EB8731636467FA5DA1002299B3029"><enum>(ee)</enum><text>an
				aunt or uncle;</text>
							</item><item id="H86AF5B253CE74A3F8C99B6D83448F67A"><enum>(ff)</enum><text>a
				first cousin; or</text>
							</item><item id="H2CCEF08062CE4EE69D5794D92D63404F"><enum>(gg)</enum><text>a
				grandparent.</text>
							</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HAF0DB5AF13684176876CC9335EDC00C9"><enum>3.</enum><header>Expedited
			 processing for certain EB–5 investors</header><text display-inline="no-display-inline">Section 286(u) of the Immigration and
			 Nationality Act (8 U.S.C. 1356(u)) is amended by adding at the end the
			 following: <quote>In the case of a petition filed under section 204(a)(1)(H)
			 for classification under section 203(b)(5)(E), the petitioner shall be
			 guaranteed of a decision on the petition in 60 days or less.</quote>.</text>
		</section><section id="H58BB9B4BED874E979851102533DE42E2"><enum>4.</enum><header>Government
			 accountability office study</header>
			<subsection id="HAED3E37C74F842768D99E5039BDA42EF"><enum>(a)</enum><header>In
			 general</header><text>Not later than 2 years after the date of the enactment of
			 this Act, the Comptroller General of the United States shall submit a report to
			 Congress on the EB–5 Visa Program authorized under section 203(b)(5) of the
			 Immigration and Nationality Act (8 U.S.C. 1153(b)(5)).</text>
			</subsection><subsection id="H0DEFE5C1B6094AB5B1E42E8325B17128"><enum>(b)</enum><header>Contents</header><text>The
			 report described in subsection (a) shall include information regarding—</text>
				<paragraph id="H10216274BFBD4DD7933916D62A7B32DE"><enum>(1)</enum><text>the number of
			 immigrant entrepreneurs who have received a visa under such visa program,
			 listed by country of origin;</text>
				</paragraph><paragraph id="H953303A2DB7E416986EDAD6B358449FC"><enum>(2)</enum><text>the localities in
			 which such immigrant entrepreneurs have initially settled;</text>
				</paragraph><paragraph id="HE00D2EB1B7B04893A3367E55BFBA8F23"><enum>(3)</enum><text>whether such
			 immigrant entrepreneurs generally remain in the localities in which they
			 initially settle;</text>
				</paragraph><paragraph id="H7802C33766D14F549ABE85BAD949265D"><enum>(4)</enum><text>the types of
			 commercial enterprises that such immigrant entrepreneurs have established;
			 and</text>
				</paragraph><paragraph id="HFABCF61A93654E6482E6721AC93B019F"><enum>(5)</enum><text>the types and
			 number of jobs created by such immigrant entrepreneurs.</text>
				</paragraph></subsection></section></legis-body>
