		<official-title>To provide for the establishment, in the Office of
		  Pavement Technology of the Federal Highway Administration, of the position of
		  Recovered Mineral Component Ombudsman.</official-title>

		<section id="H4C0CF4BDF87B4066A06BA447EE40F47F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sustainable, Livable And Green
			 (S.L.A.G.) Highway Construction Act of 2012</short-title></quote>.</text>
		</section><section id="H03636254C1574C618AA9C7B7C9DA8B55"><enum>2.</enum><header>Recovered Mineral
			 Component Ombudsman; procurement guidelines</header>
			<subsection id="H5E38FF2F11904165A01B98EB39242692"><enum>(a)</enum><header>Recovered
			 Mineral Component Ombudsman position</header><text display-inline="yes-display-inline">The Secretary of Transportation shall
			 establish in the Office of Pavement Technology of the Federal Highway
			 Administration the position of Recovered Mineral Component Ombudsman.</text>
			</subsection><subsection id="HC1BA6A4D35FE42899372C52B8EEE138B"><enum>(b)</enum><header>Duties of
			 Ombudsman</header><text display-inline="yes-display-inline">The duties of the
			 Recovered Mineral Component Ombudsman shall include—</text>
				<paragraph id="HC199639E980743988E61888BE01BEA0F"><enum>(1)</enum><text display-inline="yes-display-inline">acting as a liaison between the States and
			 the Department of Transportation on federally funded highway projects;</text>
				</paragraph><paragraph id="H247323AB1A004BFD972EFEACD93851BE"><enum>(2)</enum><text display-inline="yes-display-inline">encouraging States to use recovered mineral
			 component (referred to in this Act as <term>RMCs</term>) to drive down costs
			 and be more environmentally sensitive; and</text>
				</paragraph><paragraph id="HE814EE34F7DF49A394879A670118DCF9"><enum>(3)</enum><text display-inline="yes-display-inline">providing information on—</text>
					<subparagraph id="HB7F335A22E8F4412B7BF6F20975F94D4"><enum>(A)</enum><text>the safety of
			 using RMCs;</text>
					</subparagraph><subparagraph id="HA429A296587645ABA869867867AC611D"><enum>(B)</enum><text>data on projects
			 that use RMCs; and</text>
					</subparagraph><subparagraph id="HBE4FF4E0BCFA489896127D1BDEDACCCD"><enum>(C)</enum><text>training and
			 educational seminars on the environmental benefits, and on the cost saving
			 benefits, of using RMCs through partnerships with the RMC industry groups
			 supported by the Administration.</text>
					</subparagraph></paragraph></subsection><subsection id="H41BAE9404C184348B7A41689EFB670E6"><enum>(c)</enum><header>Definition</header><text>For
			 purposes of this section, the term <term>recovered mineral components</term>
			 and <term>RMCs</term> means—</text>
				<paragraph id="HAB8CA0DC029344418769AE108912077E"><enum>(1)</enum><text>ground granulated
			 blast furnace slag;</text>
				</paragraph><paragraph id="HEC15335A9E3E4D44A4AE82283E99B594"><enum>(2)</enum><text>blast furnace slag
			 aggregate;</text>
				</paragraph><paragraph id="HB407A3ED23AD4A0F9EF891AC074A0B83"><enum>(3)</enum><text>steel furnace slag
			 aggregate; and</text>
				</paragraph><paragraph id="HB02B660AEDFF4312A23446336971FCC1"><enum>(4)</enum><text display-inline="yes-display-inline">any other industry co-product or recovered
			 by-product the Federal Highway Administrator in consultation with an agency
			 head, determines should be treated as recovered mineral component under this
			 section for uses in asphalt or concrete projects paid for, in whole or by part,
			 by such agency.</text>
				</paragraph></subsection><subsection id="HDD0FCCD5E3644D189EB1E8475FF1A222"><enum>(d)</enum><header>Comprehensive
			 procurement guidelines</header><text display-inline="yes-display-inline">The
			 Secretary of Transportation is encouraged to amend the comprehensive
			 procurement guidelines applicable to federally related asphalt and concrete
			 projects to include specifications that encourage the use of ground granulated
			 blast furnace slag, blast furnace slag aggregate, and steel furnace slag
			 aggregate.</text>
			</subsection><subsection id="H6539F0F2F0B94F78BDEF8343D6046DCC"><enum>(e)</enum><header>Environmental
			 standards</header><text>Not later than 120 days after the date of enactment of
			 this Act, the Director of the Environmental Protection Agency shall establish
			 standards to ensure that the use of RMCs does not violate the Federal Water
			 Pollution Control Act (33 U.S.C. 1251 et seq.) or any other environmental
			 law.</text>
