		<official-title>To amend title II of the Social Security Act to provide
		  that the waiting period for disability insurance benefits shall not be
		  applicable in the case of a recovering service member.</official-title>

		<section id="H70548665B7254E2AA986FC29308C272F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Recovering Service Members Disability Benefits
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H87F1559C158F485E90190214DD3D2303"><enum>2.</enum><header>Exception from
			 waiting period for disability insurance benefits of recovering service
			 members</header>
			<subsection id="H0D4FC2F7C96D46B282D8452A9412029B"><enum>(a)</enum><header>Exception from
			 waiting period</header><text display-inline="yes-display-inline">The first
			 sentence of section 223(a)(1) of the <act-name parsable-cite="SSA">Social
			 Security Act</act-name> (42 U.S.C. 423(a)(1)) is amended, in clause (ii)
			 thereof in the matter following subparagraph (E)—</text>
				<paragraph id="H9CD922776ECA4B1FA9BD185140EDC37E"><enum>(1)</enum><text>by inserting
			 <quote>(I)</quote> after <quote>but only</quote>; and</text>
				</paragraph><paragraph id="H5ED30E0FB250449F98EE7B3B45870F94"><enum>(2)</enum><text>by inserting
			 <quote>or (II) if such individual is a recovering service member,</quote> after
			 <quote>the first month in which he is under such disability,</quote>.</text>
				</paragraph></subsection><subsection id="H18F966BBD1A6489ABABAF6BC6E6DFD00"><enum>(b)</enum><header>Definition of
			 recovering service member</header><text>Section 223(a) of the Social Security
			 Act (42 U.S.C. 423(a)) is further amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H3783954A36F44A0788726081DDD5A4DD" style="traditional">
					<paragraph display-inline="no-display-inline" id="HA9576F8C16014159969E5B395E57AE9F"><enum>(3)</enum><text display-inline="yes-display-inline">For purposes of this subsection—</text>
						<subparagraph id="HBDEF667FA2754B7684B50ADA2FCB8508"><enum>(A)</enum><text>the term
				<quote>recovering service member</quote> means a member of the Armed Forces,
				including a member of the National Guard or a Reserve component, who is
				undergoing medical treatment, recuperation, or therapy while recovering from a
				serious bodily injury or physical illness related to the member’s military
				service; and</text>
						</subparagraph><subparagraph id="HC24F0F770F524988AA945DD3A7501C34"><enum>(B)</enum><text display-inline="yes-display-inline">the term <quote>serious bodily injury or
				physical illness</quote> means in the case of a member of the Armed Forces, a
				bodily injury or physical illness incurred by the member in line of duty on
				active duty in the Armed Forces while in a combat zone designated under section
				112(c)(2) of the Internal Revenue Code of 1986, that may render the member
				medically unfit to perform the duties of the member’s office, grade, rank, or
				rating.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section display-inline="no-display-inline" id="H977804368F964FE7B274C22700D855D3" section-type="subsequent-section"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply with respect to applications for benefits filed on or
			 after the date that is 90 days after the date of enactment of this Act.</text>
