		<official-title>To amend title XVIII of the Social Security Act to
		  clarify the application of Medicare special enrollment periods and secondary
		  payer rules to employer coverage of family members of

		<section id="H50C3F9B500F24206A07EFAD8D3E7E1A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Secondary Payer and Late
			 Enrollment Penalty Family Fairness Act of 2012</short-title></quote>.</text>
		</section><section id="HBECE1EEE17E74ED284CF915B977C4F55"><enum>2.</enum><header>Fair treatment of
			 family members of employees under Medicare special enrollment periods and under
			 secondary payer rules</header>
			<subsection id="HA622C8ACFF324E499C1E09F33DF7CE93"><enum>(a)</enum><header>Special
			 enrollment periods</header><text display-inline="yes-display-inline">Paragraphs
			 (1)(A), (2)(B), and (2)(C) of section 1837(i) of the Social Security Act (42
			 U.S.C. 1395p(i)) are each amended by striking <quote>individual's (or the
			 individual's spouse's) current employment status</quote> and inserting
			 <quote>the individual’s current employment status (or the current employment
			 status of a family member of the individual)</quote>.</text>
			</subsection><subsection id="H44586DABF11544208CDE9CD7E0432E62"><enum>(b)</enum><header>Secondary payer
			 rules</header><text display-inline="yes-display-inline">Section 1862(b) of such
			 Act (42 U.S.C. 1395y(b)) is amended—</text>
				<paragraph id="HD14C6C703D924E15906D909FD53CF407"><enum>(1)</enum><text>in paragraph
			 (1)(A)(i)(I), by striking <quote>the individual’s spouse</quote> and inserting
			 <quote>a family member of the individual</quote>;</text>
				</paragraph><paragraph id="H968E1956C1294FD2938504D2C81923A3"><enum>(2)</enum><text>in paragraph
			 (1)(A)(i)(II), by striking <quote>the spouse</quote> and <quote>(or
			 spouse)</quote> and inserting <quote>a family member</quote> and <quote>(or
			 family member)</quote>, respectively; and</text>
				</paragraph><paragraph id="H31A492472DCF4F1A83044756497EE94F"><enum>(3)</enum><text>in paragraph
			 (5)(C)(i), by striking <quote>spouse</quote> and inserting <quote>family
			 member</quote>.</text>
				</paragraph></subsection><subsection id="HD0F39DEFF4A44F3EBD4556661563E952"><enum>(c)</enum><header>Conforming
			 amendment to late enrollment penalty</header><text>Section 1839(b) of the
			 Social Security Act (42 U.S.C. 1395r(b)) is amended by striking
			 <quote>individual's (or the individual's spouse's) current employment</quote>
			 and inserting <quote>the individual’s current employment status (or the current
			 employment status of a family member of the individual)</quote>.</text>
			</subsection><subsection id="H2AB82FB0F53D4F90A7ACD6B6095138F3"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 January 1, 2013, and shall apply to months beginning on or after such
			 date.</text>
