		<section id="H1F82CFEB658F485C92940962EA8ADED6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Public Buildings Reform Act of
			 2012</short-title></quote>.</text>
		</section><title id="H401221FB66AD4424961C1147B6980957"><enum>I</enum><header>Reduction of
			 Federal Space Footprint</header>
			<section id="H8041F942E28440D596DF4AEA6D86DD07"><enum>101.</enum><header>Required
			 offsets for new space</header>
				<subsection id="HD07FCCE34115403791E03DC3BD532B2F"><enum>(a)</enum><header>Offsets and
			 reduction of space inventory</header><text display-inline="yes-display-inline">At the end of chapter 33 of title 40,
			 United States Code, add the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8776301B983F47B788FE31982FBD81E6" style="USC">
						<section id="H9FDB2F3B01164D16A61C860CE6D8D3C8"><enum>3317.</enum><header>Offsets and
				reduction of space inventory</header>
							<subsection id="H5F6BC81A841A4863B2FFBBE760CFCC51"><enum>(a)</enum><header>Information in
				prospectus</header><text display-inline="yes-display-inline">Any prospectus
				that proposes new space, whether leased or owned, transmitted pursuant to
				section 3307(b) of title 40, United States Code, for fiscal years 2014, 2015,
				and 2016 shall contain information outlining the details of the elimination of
				at least a corresponding amount of space.</text>
							</subsection><subsection id="HA45FAB9EDA2447DBB1B10D11BB71A84E"><enum>(b)</enum><header>Reduction in
				leased and owned property</header><text display-inline="yes-display-inline">Each calendar year through 2016, the
				Administrator of General Services shall reduce by a minimum of 1,000,000 square
				feet of the leased and owned property in the inventory of the General Services
				Administration and shall report on an annual basis to the Committee on
				Transportation and Infrastructure of the House of Representatives and the
				Committee on Environment and Public Works of the Senate a report detailing the
				reductions for the previous
				year.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HDBC5CD93B76448CFA5D66835EFBAF605"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>

			 of Federal Space</header>
			<section id="H0FE7FA23B9434BED8D33502079BA0714"><enum>201.</enum><header>Minimizing
			 costs of leased space</header>
				<subsection id="HBCF72A4E99D6481B8E5FBF409E777AA2"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3301(a) of title 40, United States
			 Code, is amended—</text>
					<paragraph id="H25D7C4D486C54DB19D8F1907DC4024FF"><enum>(1)</enum><text>by redesignating
			 paragraphs (5) and (6) as paragraphs (6) and (7), respectively; and</text>
					</paragraph><paragraph id="H316768AE44564443B76E924CB01401C8"><enum>(2)</enum><text>by inserting after
			 paragraph (4) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HD9ECD3C042414459882F14EECEF7F659" style="OLC">
							<paragraph id="H72B12514312C4E34B31CA5B785E4DE25"><enum>(5)</enum><header>Maximum rental
				rate</header><text display-inline="yes-display-inline">The term <quote>maximum
				rental rate</quote> means the maximum rate by rentable square feet estimated by
				the Administrator for the lease of commercial space for the purposes of a
				public building for a given geographical
				location.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H278E52A3BD2E4F7D864EC61F12D740C0"><enum>(b)</enum><header>Restrictions on
			 below-Prospectus projects</header><text display-inline="yes-display-inline">Section 3307(g) of title 40, United States
			 Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB626E7E7770C4F6897712E483C76BCAC" style="OLC">
						<paragraph id="H41D034F52BE94D45BABD9E08CC880A89"><enum>(3)</enum><header>Limitation on
				below-prospectus level</header>
							<subparagraph id="H7FD699B8930340FC865A07B8BCEC57B9" indent="down1"><enum>(A)</enum><header>Restriction on rental
				rate</header><text display-inline="yes-display-inline">The Administrator may
				not lease space at an amount below the average annual rental rate established
				pursuant to subsections (a) and (h) that exceeds the maximum rental rate
				established by the Administrator for the respective geographical location
				unless the Committee on Transportation and Infrastructure of the House of
				Representatives and the Committee on Environment and Public Works of the Senate
				are notified in writing at least 10 days before executing such lease.</text>
							</subparagraph><subparagraph id="H3E4CE352FFCD436C9E23A69E63ECDE5C" indent="down1"><enum>(B)</enum><header>Annual reports</header><text display-inline="yes-display-inline">The Administrator shall submit, on an
				annual basis, to the Committee on Transportation and Infrastructure of the
				House of Representatives and the Committee on Environment and Public Works of
				the Senate reports detailing the maximum rental rates established by the
				Administrator by geographical location.</text>
							</subparagraph></paragraph><paragraph id="HADA6DDC6C9F642D9AC2CA2F36B543552"><enum>(4)</enum><header>Limitation on
				Other Below-Prospectus Level Projects</header><text display-inline="yes-display-inline">At least 30 days before entering into any
				lease-construction agreement, regardless of the thresholds established pursuant
				to subsections (a) and (h), the Administrator shall notify the Committee on
				Transportation and Infrastructure of the House of Representatives and the
				Committee on Environment and Public Works of the Senate in writing of the
				intention to enter into such agreement and include in the notification details
				of the project and any associated
				information.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H3D2B03473B9246FE89EB408216A255CC"><enum>202.</enum><header>Reducing costs
			 related to courthouses</header>
				<subsection id="H09A2239B696E42D483B5C88814B3DC49"><enum>(a)</enum><header>Limitation on
			 new courthouses</header><text>The Administrator of General Services may not
			 commence construction of any new courthouse if—</text>
					<paragraph id="H62969DAC5782456A8D8077D56FDF2775"><enum>(1)</enum><text>construction has
			 not begun on or before November 1, 2012; and</text>
					</paragraph><paragraph id="HA94043890B4443DAA2E44A832CCFFC85"><enum>(2)</enum><text>in the same
			 jurisdiction in which the new Federal courthouse will serve, the existing
			 utilization of courtrooms in a courthouse is not, at a minimum, in accordance
			 with subsection (b).</text>
					</paragraph></subsection><subsection id="H653FFCBE78434164A4C19623BCBD605D"><enum>(b)</enum><header>Definitions</header><text>For
			 the purposes of this section:</text>
					<paragraph id="H0791EFFD8AD2422894D5EE0AF97CA35C"><enum>(1)</enum><header>Commence
			 construction</header><text>The term <quote>commence construction</quote> means
			 the Administrator has obligated funds for the construction phase of a
			 courthouse project, but in no case shall construction be construed as
			 commencing on the basis of any obligation of funds or actions taken for site
			 acquisition, design, excavation, demolition, or preliminary site work and in
			 accordance with paragraph (2).</text>
					</paragraph><paragraph id="H69FFFB0C5B3A461EBF9766362406344D"><enum>(2)</enum><header>Courtroom
			 sharing requirements</header><text>The term <quote>courtroom sharing
			 requirements</quote> means—</text>
						<subparagraph id="HB821CCD47CC749F29012F6964EC255BA"><enum>(A)</enum><text display-inline="yes-display-inline">in courthouses with 10 or more active
			 district judges, 2 courtrooms per 3 active district judges;</text>
						</subparagraph><subparagraph id="HB0D60A132CAE40168EE3190643B59BF7"><enum>(B)</enum><text>in courthouses
			 with 2 or more bankruptcy judges, 2 courtrooms per 3 bankruptcy judges;</text>
						</subparagraph><subparagraph id="HB8FA38AA88844E68AE2A4109FBA6174F"><enum>(C)</enum><text>in courthouses
			 with 2 or more senior district judges, 1 courtroom per 2 senior district
			 judges; and</text>
						</subparagraph><subparagraph id="H88A9E1272C464B3FBB18D4EB8FD7B465"><enum>(D)</enum><text>in courthouses
			 with 2 or more magistrate judges, 1 courtroom per 2 magistrate judges.</text>
						</subparagraph></paragraph></subsection><subsection id="H0C11658819604F928D57D8BDAAC33C43"><enum>(c)</enum><header>United States
			 courts design guide</header><text>Not later than 6 months after the date of
			 enactment of this Act, the Design Guide for courthouses shall be updated to
			 incorporate courtroom sharing to the maximum extent practicable consistent with
			 the requirements outlined in subsection (b).</text>
				</subsection></section><section id="HF42F2EA8EB174EB1BAA6B2DF04BD84F0"><enum>203.</enum><header>Reducing costs
			 of real estate transactions</header>
				<subsection id="HEA7EBD4F9A28465FB57E84614297BD44"><enum>(a)</enum><header>Use of private
			 sector expertise</header><text>The Administrator of General Services shall, to
			 the maximum extent practicable, utilize customary and industry real estate
			 management and services, including the use of a commercial real estate leasing
			 brokerage and related property management services.</text>
				</subsection><subsection id="HD70488D964F54B9DAA15754108C72F6C"><enum>(b)</enum><header>Reports</header><text>The
			 Administrator shall submit a report on a quarterly basis to the Committee on
			 Transportation and Infrastructure of the House of Representatives, the
			 Committee on Environment and Public Works of the Senate, and the Comptroller
			 General detailing—</text>
					<paragraph id="H7AAF0C4BC69A4781A9C803813F961429"><enum>(1)</enum><text>lease procurements
			 entered into by the Administrator through the use of in house personnel, and
			 lease procurements entered into through the use of commercial real estate
			 brokerage agreements under a national or other type of contract, and a
			 comparison of savings of each method of procurement, including lease costs
			 relative to market, tenant agency rent credits, and any concessions affecting
			 the total costs of such lease;</text>
					</paragraph><paragraph id="H6DF2536FA740481FAB34190E1B00460F"><enum>(2)</enum><text>other real estate
			 management services carried out through commercial real estate agreements;
			 and</text>
					</paragraph><paragraph id="HC0DB0118B3D3400EA721200A40C9EAF1"><enum>(3)</enum><text display-inline="yes-display-inline">a breakdown of total time and costs of
			 lease procurements conducted by Federal full-time equivalent employees and
			 General Services Administration contract employees assigned to manage
			 transactions conducted internally, and procurements conducted through
			 commercial real estate brokerage services through agreements with General
			 Services Administration and associated staffing costs of such agreements. The
			 analysis of costs shall include costs of all personnel, including the costs of
			 salaries and benefits, office and related space, travel, training, and other
			 related costs for all personnel directly or indirectly assigned to such
			 procurements. The analysis of the time required for each method of procuring
			 leased space shall take into account—</text>
						<subparagraph id="HAF7287CCAFB242AD8C18F4424F3AE7A2"><enum>(A)</enum><text>the type of
			 procurement and whether it is a simple lease renewal, lease extension,
			 superseding lease, standstill lease agreement, full and open competition, or
			 other than full and open competition, and whether a procurement is low price,
			 technically acceptable, or source selection and whether such lease is a
			 simplified lease, streamlined lease, or standard lease;</text>
						</subparagraph><subparagraph id="HA79F09FC7A3F4684B0C2BE4473D2A598"><enum>(B)</enum><text>any changes to
			 procurement schedules and whether such schedules are adjusted;</text>
						</subparagraph><subparagraph id="H7E90C617FD134592B9EDCF3D80AB4A33"><enum>(C)</enum><text>Federal agency
			 requirements’ modifications; and</text>
						</subparagraph><subparagraph id="HB29180B1A7354E86B107DB64E55EA9A5"><enum>(D)</enum><text display-inline="yes-display-inline">internal policy shifts and other changes
			 that may affect the timing of such transactions so that an accurate comparison
			 may be conducted between the differences of procurements conducted by in-house
			 and contract personnel under the control of the Administration, and those
			 procurements conducted by leasing brokerages services.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="H4839B8895F9C459989B6A5A46C823337"><enum>(c)</enum><header>GAO
			 review</header><text>As requested by the Committee on Transportation and
			 Infrastructure of the House of Representatives or the Committee on Environment
			 and Public Works of the Senate, the Comptroller General shall report on the
			 information and data provided pursuant to subsection (b). The review shall
			 consider, among other requested elements—</text>
					<paragraph commented="no" id="H78B93507AD2F4EEE8156E5026AAFE099"><enum>(1)</enum><text>the reliability of
			 the data provided pursuant to subsection (b); and</text>
					</paragraph><paragraph commented="no" id="HDA86EC13A0F44FF4B99A3B38B201476E"><enum>(2)</enum><text>an assessment of
			 any analyses provided pursuant to subsection (b).</text>
					</paragraph></subsection><subsection id="H96DD5C1967ED492696CD36FEA0B299BF"><enum>(d)</enum><header>Access to
			 information</header><text>The Administrator shall provide the Comptroller
			 General any additional data and information requested by the Comptroller
			 General to carry out subsection (c). The Comptroller General shall notify the
			 Committee on Transportation and Infrastructure of the House of Representatives
			 and the Committee on Environment and Public Works of the Senate if the
			 Administrator of General Services fails to provide data, analyses, or other
			 information required under this section.</text>
				</subsection></section><section id="H7720D6A59E484B338080E33E9DD75495"><enum>204.</enum><header>Reduction in
			 personnel</header><text display-inline="no-display-inline">Not later than
			 fiscal year 2015, the Administrator of General Services shall reduce the total
			 number of full time equivalent positions of the Public Buildings Service to
			 6,000.</text>
			</section></title><title id="HB85C1AEB0ED8493893622D55892F2B2F"><enum>III</enum><header>Elimination of
			 Waste and Abuse</header>
			<section id="H5593812EA5014C0099F10DBB460C13D1"><enum>301.</enum><header>Prohibition on
			 bonuses</header>
				<subsection id="HEB3C458BFCCB4E68B6290E70B4B2A99B"><enum>(a)</enum><header>Moratorium on
			 bonuses</header><text display-inline="yes-display-inline">Section 592 of title
			 40, United States Code is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H44C001853B704139A0ADFD65A7FDC377" style="OLC">
						<subsection id="H79DD452DB8224DF49044AD5EB8873D6D"><enum>(g)</enum><header>Moratorium on
				bonuses</header>
							<paragraph id="HECA205B187AC48AC9F09DCF833ACACD3"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Unless specifically
				authorized by Congress in a given fiscal year, no funds in the Federal
				Buildings Fund may be available for bonuses, performance awards, or similar
				expenditures for members of the Senior Executive Service.</text>
							</paragraph><paragraph id="H9409EB2866244634B5EE1B14C9E11803"><enum>(2)</enum><header>Termination</header><text>This
				subsection shall cease to be effective on October 1,
				2014.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HCAA56B67C67B4D35A0F0F454B8671B6B"><enum>(b)</enum><header>Restrictions on
			 conferences and travel</header><text display-inline="yes-display-inline">Chapter 33 of title 40, United States Code,
			 as amended by section 101 of this Act, is further amended by adding at the end
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4FD5E938E8F84010BEFD12781A807A4A" style="OLC">
						<section id="H6D40705D62A4488281182DF7631B0FD6"><enum>3318.</enum><header>Restrictions
				on conferences and travel</header>
							<subsection id="H0985E4EA59FA403F955E3680250770E4"><enum>(a)</enum><header>In
				general</header>
								<paragraph id="H7A25F55C40E9493386A60915A54E68C8"><enum>(1)</enum><header>Notification
				regarding conferences</header><text>The Administrator shall submit to the
				Committee on Transportation and Infrastructure of the House of Representatives
				and the Committee on Environment and Public Works of the Senate a written
				notification not less than 30 days before entering into any contract related to
				any conference that includes personnel of the Public Buildings Service. The
				notification shall include the following:</text>
									<subparagraph id="H43F28FB1BD9C4CC2A6CFD7BE5742964C"><enum>(A)</enum><text>The purpose of the
				conference.</text>
									</subparagraph><subparagraph id="H0CF746E87D5E43989B52B89EDCF59A16"><enum>(B)</enum><text>A detailed budget
				for the conference, including related travel, lodging, and per diem
				costs.</text>
									</subparagraph><subparagraph id="H2541C8925C3B456A849693FD2AEB5177"><enum>(C)</enum><text>The expected
				number of participants.</text>
									</subparagraph><subparagraph id="HBD9554CEDD8048ADAEB61A9FF3D4CB97"><enum>(D)</enum><text>The location and
				length of the conference.</text>
									</subparagraph><subparagraph id="HF72D93E79D4C4FA78C94AE5E8A172771"><enum>(E)</enum><text>Any expected
				non-Federal funding or sponsorships.</text>
									</subparagraph></paragraph><paragraph id="H74388452CA6B4BEF9A0D52E1D5FAF971"><enum>(2)</enum><header>Conference
				review</header><text>Not later than 60 days after each conference referred to
				in subsection (a), the Administrator shall submit to the committees identified
				in subsection (a) the following:</text>
									<subparagraph id="H5A8BEF4F6D0F4C2196CCAC27D13C7A09"><enum>(A)</enum><text>Details on the
				actual expenditures and costs of the conference and a comparison to the budget
				submitted pursuant to paragraph (1).</text>
									</subparagraph><subparagraph id="HE9F26D5A0E9A4D358A14026B2B5C2C50"><enum>(B)</enum><text>The actual number
				of participants of the Public Buildings Service, including job title and
				classifications, and associated travel, lodging, and per diem costs.</text>
									</subparagraph><subparagraph id="H0A518BC5CDBF4A27866F64F4AF3EDECD"><enum>(C)</enum><text>An agenda of
				conference programming and
				events.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H78959A846EFD442984661AF78543052D"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is further amended by
			 adding at the end the following:</text>

							<toc-entry level="section">3318. Restrictions on conference and

				</subsection></section><section id="H822FCA6DDCCF4F4F8C92E5559E2985BB"><enum>302.</enum><header>Limitation on
			 internships</header>
				<subsection id="H3161293F717347CE936266C40A24A746"><enum>(a)</enum><header>Restriction on
			 interns</header><text>Through fiscal year 2015, the Public Buildings Service
			 shall have not more than 50 individuals, paid or un-paid, participating in any
			 intern program, recent graduate program, or Presidential Management Fellow
			 program, or similar program in any given fiscal year.</text>
				</subsection><subsection id="HC0FC19575C5B41DAABAFE63BD2D4B879"><enum>(b)</enum><header>Inspector
			 general review</header><text>The Inspector General of the General Services
			 Administration shall review the Public Buildings Service’s internship program,
			 recent graduate program and Presidential Management Fellow program and any
			 similar program and report to the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on Environment
			 and Public Works of the Senate on the following:</text>
					<paragraph id="H970830393F1D410A912874F58FD1C16A"><enum>(1)</enum><text>The costs
			 associated with the programs.</text>
					</paragraph><paragraph id="H5427FC5619A443179E6507CC852D2B6E"><enum>(2)</enum><text>Value added to the
			 Public Buildings Service of the programs.</text>
					</paragraph><paragraph id="H4F4E6AA501B24B90B0BF2868C3E14546"><enum>(3)</enum><text>Recommendations on
			 improving the programs.</text>
					</paragraph><paragraph id="H60AA062056B349D08091BE8BCD5C47F1"><enum>(4)</enum><text>Compliance with
			 Federal hiring laws, practices, and standards.</text>
					</paragraph></subsection></section></title><title id="HD00043C68484443598E70273481CC5C7"><enum>IV</enum><header>Improving
			 Transparency and Accountability</header>
			<section id="HB2E11F7D339D42FB8CDF5DBF39C6C512" section-type="subsequent-section"><enum>401.</enum><header>Administrative costs
			 specified</header>
				<subsection id="HB9C76D84CFA64AED93CE3C66162F7028"><enum>(a)</enum><header>Administrative
			 costs specified</header><text display-inline="yes-display-inline">Section
			 592(c) of title 40, United States Code, is amended by adding at the end the
			 following:</text>

				Service unless an amount specified for such expenses is specifically authorized

				</subsection><subsection id="HF4D28E6BAC604E4AB256B58240ADA24F"><enum>(b)</enum><header>Reporting of
			 administrative expenses</header><text display-inline="yes-display-inline">Section 3307 of title 40, United States
			 Code, is amended by adding at the end the following:</text>

				submits the budget request to Congress pursuant to section 1105 of title 31,
				United States Code, the Administrator of General Services shall submit a
				proposed budget for the Public Buildings Service to the Committee on
				Transportation and Infrastructure of the House of Representatives, the
				Committee on Environment and Public Works of the Senate, and the Committees on
				Appropriations of the House of Representatives and the Senate detailing all
				proposed administrative expenses for such Service for the following fiscal
				year.</text>
							</paragraph><paragraph id="H6CB002835C1C4968BB13F39F63100249" indent="down1"><enum>(2)</enum><header>Specifics of budget
				proposal</header><text>Such proposed budget shall include the following:</text>
								<subparagraph id="HA5A83FCB59E34143AD1C3CEE034B7836"><enum>(A)</enum><text display-inline="yes-display-inline">A
				breakdown of proposed administrative expenses of the Public Buildings Service
				and the expenses of the previous fiscal year, including a breakdown of object
				classification and subclassification to include salaries, bonuses, travel and
				transportation, training, and conferences.</text>
								</subparagraph><subparagraph id="H8CCE22A71AAB4875B6918310AA479953"><enum>(B)</enum><text>A breakdown as described in subparagraph
				(A) for the Public Buildings Service headquarters, Commissioner’s office, and
				each of the regional offices.</text>
								</subparagraph><subparagraph id="H7211B42998614A0EB1486D0E583E2337"><enum>(C)</enum><text>A breakdown of proposed staffing levels,
				including the number of full-time equivalents and number of Federal employees
				by job classification and title of the Public Buildings Service, the Service
				headquarters, Commissioner’s office, and the regional offices, and the numbers
				for such expenses for the prior fiscal year.</text>
								</subparagraph><subparagraph id="H89B7C4513DD04764A1687C42ED3EA55E"><enum>(D)</enum><text>A detailed justification for any proposed
				increase in administrative expenses or staffing.</text>
								</subparagraph></paragraph><paragraph id="H464EAD10EDC743B6910D33C4F6589899" indent="down1"><enum>(3)</enum><header>Administrative cost
				categories</header><text display-inline="yes-display-inline">The budget
				proposal information described in paragraph (2) shall provide the required
				information consistent with the following administrative cost
				categories:</text>
								<subparagraph id="H3BACBE7BEF894AF482785C45E61684BB"><enum>(A)</enum><text display-inline="yes-display-inline">Building Operations and Maintenance,
				including cleaning, utilities and fuels, and maintenance.</text>
								</subparagraph><subparagraph id="H1B44B2DC3EC74429A4B072C1B9A780F7"><enum>(B)</enum><text>Salaries and Expenses, including other
				building services, space acquisition, staff support, and information technology
				services.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H73DAB774AED346B78BFE1067FFED9420"><enum>402.</enum><header>Limitation on
			 authorizations</header><text display-inline="no-display-inline">Section 3307 of
			 title 40, United States Code, as amended by section 401(b) of this Act, is
			 further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF3EB2BE36D4A4A22838D1C660F09CE7E" style="OLC">
					<subsection id="H89AE1D01EC9144B0A3CD128A8B12E8B9"><enum>(j)</enum><header>Expiration of
				committee resolutions</header><text display-inline="yes-display-inline">Unless
				a lease is executed or a construction, alteration, repair, design or
				acquisition project is initiated within 5 years of the resolution approvals
				adopted by the Committee on Transportation and Infrastructure of the House of
				Representatives and the Committee on Environment and Public Works of the Senate
				pursuant to subsection (a) such resolution approvals shall be deemed
				expired.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="H40E82E2BE7104227819B77B3BA906523"><enum>403.</enum><header>Limitation on
			 certain leasing authorities</header>
				<subsection id="HC1831EC2739B4B4ABB5D796961A8BC17"><enum>(a)</enum><header>Limitation on
			 leasing authority of other agencies</header><text display-inline="yes-display-inline">Chapter 33 of title 40, United States Code,
			 is further amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3A8F2067267A41A6AD66A1A7DBB13B2E" style="USC">
						<section id="H37BF30E737AC41EA96A2E98175C79ECD"><enum>3319.</enum><header>Limitation on
				leasing authority of other agencies</header>
							<subsection id="H02B937196A764CDBABADE0BEF8DA3120"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, no executive agency may lease space for the purposes of
				a public building as defined under section 3301, except as provided under
				section 585, and the provisions of this chapter.</text>
							</subsection><subsection id="HF570EFD6FB5048098AE23497E1DACEAF"><enum>(b)</enum><header>Public
				building</header><text display-inline="yes-display-inline">For the purposes of
				this section, the term <quote>public building</quote> includes leased
				space.</text>
							</subsection><subsection id="H9E3F0831F6864E0EBCD782B01AECD4F2"><enum>(c)</enum><header>Further
				exclusions</header><text display-inline="yes-display-inline">This section shall
				not apply to—</text>
								<paragraph id="H500703DCB0744B58805F5A9CEB0F112F"><enum>(1)</enum><text display-inline="yes-display-inline">properties that are excluded for reasons of
				national security by the President; and</text>
								</paragraph><paragraph id="H8063135889FE4DE1967638B050ADD89F"><enum>(2)</enum><text>properties of the
				Department of Veterans Affairs.</text>
								</paragraph></subsection><subsection id="H2CEDEF20377C49ACA8ADCC4D74417D91"><enum>(d)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				as creating new authority for executive agencies to enter into leases or limit
				the authority of the Administrator under section
				3314.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H9FF349C0724343DEB3DF812572405EF7"><enum>(b)</enum><header>Small
			 businesses</header><text display-inline="yes-display-inline">When using
			 commercial leasing services, the Administrator shall adhere to the requirements
			 of the Small Business Act (15 U.S.C. et seq.).</text>
				</subsection><subsection id="HB9065EAE9FC547FF869852F1C8C1B786"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter, as amended by section
			 301 of this Act, is further amended by adding at the end:</text>

				</subsection></section><section id="H188CE757B27A40CD9BD3C1F161F99EA0"><enum>404.</enum><header>Utilization
			 rates</header>
				<subsection id="H11CB32AF10994D4592D017658D916B46"><enum>(a)</enum><header>Measurement of
			 space utilization</header><text display-inline="yes-display-inline">Not later
			 than 6 months after the date of enactment of this Act, the Administrator of
			 General Services shall develop and implement a method of measuring actual
			 utilization rates of its owned and leased inventory of public buildings space
			 and a plan for incorporating such utilization rates as performance metrics by
			 owned and leased buildings and by region.</text>
				</subsection><subsection id="HC98BC4A77069439EAA6A71A8A72AFE11"><enum>(b)</enum><header>Space
			 utilization</header><text display-inline="yes-display-inline">Any method
			 developed and implemented pursuant to subsection (a) shall be based on actual
			 utilization by rentable square feet per Federal employee.</text>
				</subsection><subsection id="H65F121B6956E41649A31BFC02C16358B"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, and annually
			 thereafter, the Administrator shall report to the Committee on Transportation
			 and Infrastructure of the House of Representatives and the Committee on
			 Environment and Public Works of the Senate utilization rates measured pursuant
			 to subsection (a) and performance metrics for owned and leased
			 buildings.</text>
				</subsection><subsection id="H6EC95DC74E7B45BE9588A2B4F7CC5315"><enum>(d)</enum><header>Certification</header><text display-inline="yes-display-inline">The Administrator and tenant Federal
			 agencies shall, not later than 6 months after the date of enactment of this
			 Act, and every 6 months thereafter, certify in writing to the appropriate
			 committees of Congress the actual number of personnel housed in each building,
			 leased or owned, in the inventory of the General Services Administration. Such
			 written certification shall detail the number of Federal employees, number of
			 temporary employees, number of contractors, and number of any other non-Federal
			 employees.</text>
				</subsection><subsection id="H72D7F14BE09840E0A9724CA71D86BAF9"><enum>(e)</enum><header>Increase in
			 rental payments</header><text>If a tenant Federal agency fails to submit
			 required utilization information, the Administrator may increase the rent for
			 any property occupied by such tenant agency by 5 percent for a period of 6
			 months.</text>
				</subsection><subsection id="HAB718ED57AC546A2AF4627950BD0D5A4"><enum>(f)</enum><header>Database</header>
					<paragraph id="H1B1D7B2AC5B94BCDA4319C1A9398D9AB"><enum>(1)</enum><header>In
			 general</header><text>The Administrator shall maintain a current database of
			 utilization rates and metrics developed pursuant to this section.</text>
					</paragraph><paragraph id="H4E45685B829141519609334A2F8827B7"><enum>(2)</enum><header>Accessibility</header><text>The
			 database base described in paragraph (1) shall be made available upon request
			 by congressional committees.</text>
					</paragraph><paragraph id="HA9DE9AA476A94759A7219E20A5FB1322"><enum>(3)</enum><header>Exclusions</header><text>For
			 reasons of national security, the President may exclude any property from the
			 requirements of this subsection.</text>
					</paragraph></subsection></section><section id="H245264BD65A6463E81200B519566AAF0"><enum>405.</enum><header>Limitation on
			 space acquisitions and leasing</header>
				<subsection id="H1BAE27E396DF4B24981B186616F80244"><enum>(a)</enum><header>Limitation on
			 acquisitions</header><text display-inline="yes-display-inline">Chapter 33 of
			 title 40, United States Code, is further amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HBE068DFA8D5248B59A0D7C048A61AA05" style="USC">
						<section id="H509200D6169547488994EE85EA9B2634"><enum>3320.</enum><header>Limitation on
				acquisitions</header>
							<subsection id="HA3691529747F43EDB8A6487306FA81A2"><enum>(a)</enum><header>Authorization
				necessary</header><text>Notwithstanding the provisions of this title or any
				other provision of Federal law, the Administrator of General Services may not
				construct, repair, alter, or acquire by lease, purchase or otherwise, a public
				building or space for which a prospectus is required pursuant to section 3307,
				unless the particular project or space acquisition is specifically authorized
				by Congress, including through incorporation by reference into the relevant
				legislation.</text>
							</subsection><subsection id="H393D2881DCD04C59980C6D88D6CD4F66"><enum>(b)</enum><header>Exception</header><text>Notwithstanding
				subsection (a), the Administrator may enter into an extension lease, if
				necessary, not to exceed 5
				years.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H09CEEC267FF94EC8B25130BEDEB23620"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is further amended by

			 vacant buildings</header><text display-inline="yes-display-inline">Chapter 33
			 of title 40, United States Code, is further amended by adding at the end the
			 following:</text>

				Infrastructure of the House of Representatives and the Committee on Environment
				and Public Works of the Senate a report on public buildings in the inventory of
				the Administrator that have been vacant, based on actual utilization, for 2 or
				more years before the respective report. The report shall include—</text>
							<paragraph id="H2CE96B6FCECE451DA024DEDEFEF9DD01"><enum>(1)</enum><text>a list of vacant
				public buildings based on actual utilization;</text>
							</paragraph><paragraph id="H9E71B5FC8C2D4235A07D7AA03B6A032A"><enum>(2)</enum><text>the square footage
				of each building;</text>
							</paragraph><paragraph id="H23B1863986F04DDAA5D5EC475ABFAD03"><enum>(3)</enum><text>the location of
				each building;</text>
							</paragraph><paragraph id="H916526F182524712B8F85A1D3D9C214E"><enum>(4)</enum><text>the annual
				operating costs for each building; and</text>
							</paragraph><paragraph id="H28CD574AA2364397BD2959ECCD23E71B"><enum>(5)</enum><text>any plans
				associated with each
				building.</text>
							</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 Committee on Transportation and Infrastructure of the House of Representatives
			 and the Committee on Environment and Public Works of the Senate of an increase
			 more than 5 percent of the estimated maximum cost or of any increase or
			 decrease in scope or size of 5 or more percent. Such notification shall include
			 an explanation regarding any such increase or decrease.</quote>.</text>
