		<section id="H32CCC5BAE56A416B8CBB73C8AC2BFDBF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Affordable Housing Regulation
			 Simplification Act of 2012</short-title></quote>.</text>
		</section><section id="H7A9CE234FAE648D4B480A6AC05664C7E"><enum>2.</enum><header>Inapplicability
			 of certain Fannie Mae and Freddie Mac guidelines to affordable workforce
			 housing mortgages</header>
			<subsection id="HB1BFC1E6F1714DAA8FE59ADF9766C43D"><enum>(a)</enum><header>Fannie
			 Mae</header><text display-inline="yes-display-inline">Subsection (b) of section
			 302 of the Federal National Mortgage Association Charter Act (12 U.S.C.
			 1717(b)) is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H2DF9E1536DAD48A49912FB553C32BCDB" style="OLC">
					<paragraph id="HCD24A84F438C446D82B4A72697CF2FFA" indent="up1"><enum>(7)</enum><header>Mortgages for affordable workforce
				housing</header>
						<subparagraph id="H950C195753974D68BAA329E0F6597079"><enum>(A)</enum><header>Exemptions from
				guidelines</header><text display-inline="yes-display-inline">Notwithstanding
				any other provision of law—</text>
							<clause id="H3A191A07D3DE4D2E86714842BDBB02C3"><enum>(i)</enum><text>the corporation may purchase,
				service, sell, lend on the security of, and otherwise deal in any affordable
				workforce housing mortgage; and</text>
							</clause><clause id="H36A3DFCD2EB94FA58EC1335F71152D4B"><enum>(ii)</enum><text>any requirements and guidelines of
				the corporation that are inconsistent with the authority under clause (i) shall
				not apply to any affordable workforce housing mortgage.</text>
							</clause></subparagraph><subparagraph id="H4B54D3C84B904ECA90A8A66C323ED889"><enum>(B)</enum><header>Affordable workforce housing
				mortgages</header><text>For purposes of this paragraph, the term
				<term>affordable workforce housing mortgage</term> means a mortgage that meets
				the following requirements:</text>
							<clause id="H84477ED7D8B44EDDA7707A9C8F38486E"><enum>(i)</enum><header>Property</header><text>The
				mortgage shall be made for the purchase of, and secured by, a one-family
				residence that—</text>
								<subclause id="H254800F6C50B4640A9E77090C578BF2F"><enum>(I)</enum><text display-inline="yes-display-inline">shall
				be used as the residence of the mortgagor for not less than 8 of any 12 months
				and 240 days of any 365 days;</text>
								</subclause><subclause id="HBFAD8D37067041379DAF85A96B689776"><enum>(II)</enum><text display-inline="yes-display-inline">is
				located within or is part of a multifamily housing development—</text>
									<item id="HB3A4054EC85D4A01B382430D6B49D4F7"><enum>(aa)</enum><text>that consists of 5 or more dwelling
				units or a mixed-use development that is not less than 50 percent residential,
				as defined in the legal description of the property in the purchase contract or
				mortgage or title documents relating to such purchase;</text>
									</item><item id="H7562A28519DF414C9102C1A51DA62C7A"><enum>(bb)</enum><text display-inline="yes-display-inline">of which not less than 25 percent of the
				dwelling units in the development are owner-occupied; except that the
				requirement under this item shall be considered to be complied with, with
				respect to a development, unless verifiable public records indicate an
				owner-occupancy rate for the development of less than 25 percent;</text>
									</item><item id="H0FD416B1F26E4B24941B16E5A8845EC9"><enum>(cc)</enum><text>that provides individual,
				centralized, or any other method of metering for energy use of the constituent
				dwelling units; and</text>
									</item><item id="H99F83391C33C4D6C8A41BFC68DE9CC4F"><enum>(dd)</enum><text display-inline="yes-display-inline">that may include dwelling units that are
				used for the sole purpose of short-term rentals and may provide such services
				as a staffed front desk, a concierge, or other amenities consistent with
				providing customer service for non-owner occupied or short-term rental units in
				the development, including marketing that describes the property as a lodge,
				resort, or other similar facility;</text>
									</item><continuation-text continuation-text-level="subclause">and any
				multifamily housing development that otherwise complies with the requirements
				under this subclause may not be considered ineligible because the development
				or any portion of the development is called or referred to as a
				<term>condotel</term>, <term>condo-hotel</term>, <term>lodge</term>, or any
				other title;</continuation-text></subclause><subclause id="H82B08D0921724D3E922223FB8868B880"><enum>(III)</enum><text display-inline="yes-display-inline">is
				subject to resale restrictions that—</text>
									<item id="H7F27DB3151FB46EE9011E652EE9AF810"><enum>(aa)</enum><text>are recorded with the appropriate
				public registry for recording of titles and interests in real estate;
				and</text>
									</item><item id="H603BD3505B4F4008B006B0CC1D9DC9E3"><enum>(bb)</enum><text>terminate upon foreclosure or
				execution of any deed-in-lieu-of-foreclosure; and</text>
									</item></subclause><subclause id="H93F9074E31934C698F4A49C39D7CFB9E"><enum>(IV)</enum><text display-inline="yes-display-inline">is
				located in an area that, at the time of the origination of the mortgage, is a
				high tourism area.</text>
								</subclause></clause><clause id="H30CB6DA9DCB4457294CE68E3BA9AD864"><enum>(ii)</enum><header>Mortgagor
				income</header><text>The household of the mortgagor shall have a gross
				household income—</text>
								<subclause id="H7C204D42B3D24F168C93D14819370E25"><enum>(I)</enum><text display-inline="yes-display-inline">that
				does not exceed 160 percent of the area median income, as determined and
				updated by the Secretary of Housing and Urban Development or the Director of
				the Federal Housing Finance Agency on an annual basis; and</text>
								</subclause><subclause id="HB72631266ED949058E787AEA14958D07"><enum>(II)</enum><text>not less than 75 percent of which is
				earned from positions the discharge of whose duties involved physical presence
				in one or more high tourism areas.</text>
								</subclause></clause><clause id="H3DE3584C87064935A36FA122E67C2169"><enum>(iii)</enum><header>Employment</header><text>The
				mortgagor or another member of the mortgagor’s household—</text>
								<subclause id="HA34947BE659048509BFF18AE3C1C9C62"><enum>(I)</enum><text display-inline="yes-display-inline">has
				been employed, during the 6-month period ending upon execution of the mortgage,
				in a position or multiple positions the discharge of whose duties involved
				physical presence in one or more high tourism areas, in the aggregate, for an
				average of not less than 30 hours per week;</text>
								</subclause><subclause id="H455ED11182BD41D58E36CFA0F7CD7FFA"><enum>(II)</enum><text display-inline="yes-display-inline">is
				employed at the time of the execution of the mortgage in a position or multiple
				positions the discharge of whose duties involve physical presence in one or
				more high tourism areas, in the aggregate, for an average of not less than 30
				hours per week and the duration of such employment in such position is expected
				to last at least 6 months;</text>
								</subclause><subclause id="H08429CEE85174C8CB1777649C2F25F42"><enum>(III)</enum><text display-inline="yes-display-inline">is
				60 years of age or older and, during the 5-year period ending up the
				mortgagor’s retirement from employment was employed in a position or positions
				the discharge of whose duties involved physical presence in one or more high
				tourism areas for—</text>
									<item id="H0FE64C5DF275450FBF92EC9218241F07"><enum>(aa)</enum><text>an average of not less than 30 hours
				per week; and</text>
									</item><item id="H210D631FEFA14859A06A058243A70F1C"><enum>(bb)</enum><text>for not less than 8 months per
				year;</text>
									</item></subclause><subclause id="H47AC7779BD654B529C9CCFB595FDF002"><enum>(IV)</enum><text>is a person with disabilities (as such
				term is defined in section 811(k) of the Cranston-Gonzalez National Affordable
				Housing Act (42 U.S.C. 8013)) who—</text>
									<item id="H0CAA53C52B144C0E9746A7EE12B78F6A"><enum>(aa)</enum><text>was employed, during the 2-year
				period ending upon becoming disabled, in a position or positions described in
				subclause (I) or (II); or</text>
									</item><item id="HCFD7D56E9B44427BBCA658F0C1913CAA"><enum>(bb)</enum><text>is employed in a position or
				positions described in subclause (I) or (II), except that the 30-hour
				requirement under such subclauses shall not apply to such person if—</text>
										<subitem id="H0C0CC0E9399E4E94A37F75CCB335C305"><enum>(AA)</enum><text>compliance with such requirement would
				make such person ineligible for benefits made available for persons with
				disabilities through a program of any State agency for developmental
				disabilities or through the supplemental security income program under title
				XVI of the Social Security Act; and</text>
										</subitem><subitem id="HFFA298A002EA4DD6B45D7C854F38CBE2"><enum>(BB)</enum><text>such person works the maximum number of
				hours per week allowable for eligibility for benefits under such program;
				or</text>
										</subitem></item></subclause><subclause id="HCEDCC064A7C04E7F9FD5F7689524D2CD"><enum>(V)</enum><text>is the head of household in a household
				that includes one or more dependents, at least one of whom is at the time of
				the execution of the mortgage 5 years of age or younger or is enrolled
				full-time in a school in a high tourism area.</text>
								</subclause></clause><clause id="HC3451C061DF241758AB927277E2D3EA6"><enum>(iv)</enum><header>Conforming
				loan</header><text>The original principal obligation of the mortgage shall
				comply with the applicable dollar amount limitations established pursuant to
				paragraph (2).</text>
							</clause></subparagraph><subparagraph id="H37FFEB899A344ECB98A734854E984528"><enum>(C)</enum><header>High tourism area</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<term>high tourism area</term> means a county that is designated as a high
				tourism county pursuant to section 5 of the <short-title>Affordable Housing Regulation Simplification Act of
				2012</short-title>.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8B7CB20140364694BA49D9E8C98D3223"><enum>(b)</enum><header>Freddie
			 Mac</header><text>Subsection (a) of section 305 of the Federal Home Loan
			 Mortgage Corporation Act (12 U.S.C. 1454(a)) is amended by adding at the end
			 the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H82DB8E2BAB97436BBA5B2007C3E6F967" style="OLC">
					<paragraph id="H6FF4A474F6D54E3180C8A23645F09620" indent="up1"><enum>(6)</enum><header>Mortgages for affordable workforce
				housing</header>
						<subparagraph id="HF55CCC2F326F420493A2FA8A48EA1F0A"><enum>(A)</enum><header>Exemptions from
				guidelines</header><text display-inline="yes-display-inline">Notwithstanding
				any other provision of law—</text>
							<clause id="HF7F203FD16994FBC883C167446047A89"><enum>(i)</enum><text>the Corporation may purchase,
				service, sell, lend on the security of, and otherwise deal in any affordable
				workforce housing mortgage; and</text>
							</clause><clause id="HB06F575EA43848098A261542C6FE0636"><enum>(ii)</enum><text>any requirements and guidelines of
				the Corporation that are inconsistent with the authority under clause (i) shall
				not apply to any affordable workforce housing mortgage.</text>
							</clause></subparagraph><subparagraph id="H581E4E36DB0B4E4DBFE764074959C98A"><enum>(B)</enum><header>Affordable workforce housing
				mortgages</header><text>For purposes of this paragraph, the term
				<term>affordable workforce housing mortgage</term> means a mortgage that meets
				the following requirements:</text>
							<clause id="HA54F9EC5CCE047FC853BC648A669E9F5"><enum>(i)</enum><header>Property</header><text>The
				mortgage shall be made for the purchase of, and secured by, a one-family
				residence that—</text>
								<subclause id="H02EB7971FB8E4885B3BB064E5E782D94"><enum>(I)</enum><text display-inline="yes-display-inline">shall
				be used as the residence of the mortgagor for not less than 8 of any 12 months
				and 240 days of any 365 days;</text>
								</subclause><subclause id="H1B3A198706794CDBB7A4D7ECF0635C5F"><enum>(II)</enum><text display-inline="yes-display-inline">is
				located within or is part of a multifamily housing development—</text>
									<item id="H3BEC16507D374CF2A49F76ECCAB5F69D"><enum>(aa)</enum><text>that consists of 5 or more dwelling
				units or a mixed-use development that is not less than 50 percent residential,
				as defined in the legal description of the property in the purchase contract or
				mortgage or title documents relating to such purchase;</text>
									</item><item id="H3DD5460ACA1947B099AFC484BDF66363"><enum>(bb)</enum><text display-inline="yes-display-inline">of which not less than 25 percent of the
				dwelling units in the development are owner-occupied; except that the
				requirement under this item shall be considered to be complied with, with
				respect to a development, unless verifiable public records indicate an
				owner-occupancy rate for the development of less than 25 percent;</text>
									</item><item id="H817967A055EC4E429064DAA085A2A874"><enum>(cc)</enum><text>that provides individual,
				centralized, or any other method of metering for energy use of the constituent
				dwelling units; and</text>
									</item><item id="HC12F380CA6CE40EE96288518CE993C3E"><enum>(dd)</enum><text display-inline="yes-display-inline">that may include dwelling units that are
				used for the sole purpose of short-term rentals and may provide such services
				as a staffed front desk, a concierge, or other amenities consistent with
				providing customer service for non-owner occupied or short-term rental units in
				the development, including marketing that describes the property as a lodge,
				resort, or other similar facility;</text>
									</item><continuation-text continuation-text-level="subclause">and any
				multifamily housing development that otherwise complies with the requirements
				under this subclause may not be considered ineligible because the development
				or any portion of the development is called or referred to as a
				<term>condotel</term>, <term>condo-hotel</term>, <term>lodge</term>, or any
				other title;</continuation-text></subclause><subclause id="H0AB8C687D4EB4C21922AA35ECEB50D4A"><enum>(III)</enum><text display-inline="yes-display-inline">is
				subject to resale restrictions that—</text>
									<item id="H847783B16B7142959DAE037395F74ECD"><enum>(aa)</enum><text>are recorded with the appropriate
				public registry for recording of titles and interests in real estate;
				and</text>
									</item><item id="H477B29AD58B64121870B2B1943DF6411"><enum>(bb)</enum><text>terminate upon foreclosure or
				execution of any deed-in-lieu-of-foreclosure; and</text>
									</item></subclause><subclause id="HE25516428F544DC28C233C9652C9C356"><enum>(IV)</enum><text display-inline="yes-display-inline">is
				located in an area that, at the time of the origination of the mortgage, is a
				high tourism area.</text>
								</subclause></clause><clause id="HFB751F21320A49958CB4363B61A3F551"><enum>(ii)</enum><header>Mortgagor
				income</header><text>The household of the mortgagor shall have a gross
				household income—</text>
								<subclause id="HE7A1F4FBE4C64A6DA47D7EB49DA4AA01"><enum>(I)</enum><text display-inline="yes-display-inline">that
				does not exceed 160 percent of the area median income, as determined and
				updated by the Secretary of Housing and Urban Development or the Director of
				the Federal Housing Finance Agency on an annual basis; and</text>
								</subclause><subclause id="H81E8AA557E6043D486C3FF51D7EDDB34"><enum>(II)</enum><text display-inline="yes-display-inline">not
				less than 75 percent of which is earned from positions the discharge of whose
				duties involved physical presence in one or more high tourism areas.</text>
								</subclause></clause><clause id="HA884BADDCC154264895E9B94BE302FEF"><enum>(iii)</enum><header>Employment</header><text>The
				mortgagor or another member of the mortgagor’s household—</text>
								<subclause id="H8421A091E8D84A5D8E7DDDEB658CD4D6"><enum>(I)</enum><text display-inline="yes-display-inline">has
				been employed, during the 6-month period ending upon execution of the mortgage,
				in a position or multiple positions the discharge of whose duties involved
				physical presence in one or more high tourism areas, in the aggregate, for an
				average of not less than 30 hours per week;</text>
								</subclause><subclause id="H032F8DD5B2344FF79D9AC12E77BD65D0"><enum>(II)</enum><text display-inline="yes-display-inline">is
				employed at the time of the execution of the mortgage in a position or multiple
				positions the discharge of whose duties involve physical presence in one or
				more high tourism areas, in the aggregate, for an average of not less than 30
				hours per week and the duration of such employment in such position is expected
				to last at least 6 months;</text>
								</subclause><subclause id="H403EA5DA8D5F4257AFF09A995142B916"><enum>(III)</enum><text display-inline="yes-display-inline">is
				60 years of age or older and, during the 5-year period ending up the
				mortgagor’s retirement from employment was employed in a position or positions
				the discharge of whose duties involved physical presence in one or more high
				tourism areas for—</text>
									<item id="HE78E4E9413B84948B4230AF541E9BDA8"><enum>(aa)</enum><text>an average of not less than 30 hours
				per week; and</text>
									</item><item id="HCB4332B30C5C48EC99AEFA9D474B1B94"><enum>(bb)</enum><text>for not less than 8 months per
				year;</text>
									</item></subclause><subclause id="HAE3BC836B67E4DC8A05103F035872B75"><enum>(IV)</enum><text>is a person with disabilities (as such
				term is defined in section 811(k) of the Cranston-Gonzalez National Affordable
				Housing Act (42 U.S.C. 8013)) who—</text>
									<item id="H14EF2C6B35E74F20BBB46964040DAF07"><enum>(aa)</enum><text>was employed, during the 2-year
				period ending upon becoming disabled, in a position or positions described in
				subclause (I) or (II); or</text>
									</item><item id="HA9A8AF920DA24E2094CEF35E12A339AE"><enum>(bb)</enum><text>is employed in a position or
				positions described in subclause (I) or (II), except that the 30-hour
				requirement under such subclauses shall not apply to such person if—</text>
										<subitem id="HE812DCF91B7E4155AA779E60D4826CA3"><enum>(AA)</enum><text>compliance with such requirement would
				make such person ineligible for benefits made available for persons with
				disabilities through a program of any State agency for developmental
				disabilities or through the supplemental security income program under title
				XVI of the Social Security Act; and</text>
										</subitem><subitem id="H5139245FA6C543B9B9615107AB05D0E8"><enum>(BB)</enum><text>such person works the maximum number of
				hours per week allowable for eligibility for benefits under such program;
				or</text>
										</subitem></item></subclause><subclause id="H8EA1CB5684494984B4AA72DD34B346F8"><enum>(V)</enum><text display-inline="yes-display-inline">is
				the head of household in a household that includes one or more dependents, at
				least one of whom is at the time of the execution of the mortgage 5 years of
				age or younger or is enrolled full-time in a school in a high tourism
				area.</text>
								</subclause></clause><clause id="H81CB493CA574452DAF4A14E6D287FB6D"><enum>(iv)</enum><header>Conforming
				loan</header><text>The original principal obligation of the mortgage shall
				comply with the applicable dollar amount limitations established pursuant to
				paragraph (2).</text>
							</clause></subparagraph><subparagraph id="H0DCD196E789E493AB146CA65AD92F954"><enum>(C)</enum><header>High tourism area</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<term>high tourism area</term> means any county that is designated as a high
				tourism county pursuant to section 5 of the <short-title>Affordable Housing Regulation Simplification Act of
				2012</short-title>.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H7210F042F4664E9689FADED433D1C8E2"><enum>3.</enum><header>Insurance of
			 affordable workforce housing mortgages by FHA</header><text display-inline="no-display-inline">Section 203 of the National Housing Act (12
			 U.S.C. 1709) is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HCA515F3BD3FC4D66854BB5CCFB351680" style="OLC">
				<subsection id="H50334712737140C4B32068B708B2AECF"><enum>(y)</enum><header>Mortgages for
				affordable workforce housing</header>
					<paragraph id="H57D00154EDD44B12871D1F99B4560ED0"><enum>(1)</enum><header>Insurance
				authority</header><text display-inline="yes-display-inline">The Secretary may
				insure under this section any affordable workforce housing mortgage meeting the
				requirements of subsection (b) of this section, except as modified by this
				subsection.</text>
					</paragraph><paragraph id="HD1F1026B9AD2433D9046006BE3454663"><enum>(2)</enum><header>Exemptions</header><text>Notwithstanding
				any other provision of law, any requirements and guidelines of the Secretary
				that are inconsistent with the authority under paragraph (1) shall not apply to
				any affordable workforce housing mortgage.</text>
					</paragraph><paragraph id="H85A0A03713B14254A35595A9B6D6A42B"><enum>(3)</enum><header>Affordable
				workforce housing mortgages</header><text>For purposes of this subsection, the
				term <term>affordable workforce housing mortgage</term> means a mortgage that
				meets the following requirements:</text>
						<subparagraph id="HF3A5057E42B5428E809B470A95B29442"><enum>(A)</enum><header>Property</header><text>The
				mortgage shall be made for the purchase of, and secured by, a one-family
				residence that—</text>
							<clause id="HEB3A90628AAE46889ADF131BF848F6E2"><enum>(i)</enum><text display-inline="yes-display-inline">shall be used as the residence of the
				mortgagor for not less than 8 of any 12 months and 240 days of any 365
				days;</text>
							</clause><clause id="H08B1F1E0BDDD4F1DA0085EB50E882833"><enum>(ii)</enum><text display-inline="yes-display-inline">is located within or is part of a
				multifamily housing development—</text>
								<subclause id="HACCE07EC7A7641D992AF8FF889CD0634"><enum>(I)</enum><text>that consists of 5
				or more dwelling units or a mixed-use development that is not less than 50
				percent residential, as defined in the legal description of the property in the
				purchase contract or mortgage or title documents relating to such
				purchase;</text>
								</subclause><subclause id="HAA8B185BBBA0409B82B45147743F7153"><enum>(II)</enum><text>of which not less
				than 25 percent of the dwelling units in the development are owner-occupied;
				except that the requirement under this item shall be considered to be complied
				with, with respect to a development, unless verifiable public records indicate
				an owner-occupancy rate for the development of less than 25 percent;</text>
								</subclause><subclause id="H73AB301B614A4DBCABD01ADFF8C37345"><enum>(III)</enum><text>that provides
				individual, centralized, or any other method of metering for energy use of the
				constituent dwelling units; and</text>
								</subclause><subclause id="HBCF79B45AA564AC88710774AD5AEE5A4"><enum>(IV)</enum><text>that may include
				dwelling units that are used for the sole purpose of short-term rentals and may
				provide such services as a staffed front desk, a concierge, or other amenities
				consistent with providing customer service for non-owner occupied or short-term
				rental units in the development, including marketing that describes the
				property as a lodge, resort, or other similar facility;</text>
								</subclause><continuation-text continuation-text-level="clause">and any
				multifamily housing development that otherwise complies with the requirements
				under this clause may not be considered ineligible because the development or
				any portion of the development is called or referred to as a
				<term>condotel</term>, <term>condo-hotel</term>, <term>lodge</term>, or any
				other title;</continuation-text></clause><clause id="H407D4F8720E843DEB266B7A1E4AACF83"><enum>(iii)</enum><text display-inline="yes-display-inline">is subject to resale restrictions
				that—</text>
								<subclause id="H94D66AB89A124A399EDD8B12FCEFD3F4"><enum>(I)</enum><text>are recorded with
				the appropriate public registry for recording of titles and interests in real
				estate; and</text>
								</subclause><subclause id="H52CFEC3B91A143A6A81F236698093835"><enum>(II)</enum><text>terminate upon
				foreclosure or execution of any deed-in-lieu-of-foreclosure; and</text>
								</subclause></clause><clause id="HDF3492CB62ED4A5992CC03406676BCED"><enum>(iv)</enum><text display-inline="yes-display-inline">is located in an area that, at the time of
				the origination of the mortgage, is a high tourism area.</text>
							</clause></subparagraph><subparagraph id="HA2F96D73BF324B5D9EE454CA3CB5A238"><enum>(B)</enum><header>Mortgagor
				income</header><text>The household of the mortgagor shall have a gross
				household income—</text>
							<clause id="HEF37950C68254FCFB963C38AFFEA639E"><enum>(i)</enum><text display-inline="yes-display-inline">that does not exceed 160 percent of the
				area median income, as determined and updated by the Secretary on an annual
				basis; and</text>
							</clause><clause id="H02C69998A6A04E6BAE4BB454A1EE6BBE"><enum>(ii)</enum><text>not less than 75
				percent of which is earned from positions the discharge of whose duties
				involved physical presence in one or more high tourism areas.</text>
							</clause></subparagraph><subparagraph id="H3335EF24AA4B4DB78D486FBAAE8D82BD"><enum>(C)</enum><header>Employment</header><text>The
				mortgagor or another member of the mortgagor’s household—</text>
							<clause id="H211C72BD4B9C4FCF9C27D6CF151B038B"><enum>(i)</enum><text display-inline="yes-display-inline">has been employed, during the 6-month
				period ending upon execution of the mortgage, in a position or multiple
				positions the discharge of whose duties involved physical presence in one or
				more high tourism areas, in the aggregate, for an average of not less than 30
				hours per week;</text>
							</clause><clause id="H5BA257BB78134C14AD352C562933EA42"><enum>(ii)</enum><text display-inline="yes-display-inline">is employed at the time of the execution of
				the mortgage in a position or multiple positions the discharge of whose duties
				involve physical presence in one or more high tourism areas, in the aggregate,
				for an average of not less than 30 hours per week and the duration of such
				employment in such position is expected to last at least 6 months;</text>
							</clause><clause id="HF69DB14DFCBF4346B089FDCB8584E90F"><enum>(iii)</enum><text display-inline="yes-display-inline">is 60 years of age or older and, during the
				5-year period ending up the mortgagor’s retirement from employment was employed
				in a position or positions the discharge of whose duties involved physical
				presence in one or more high tourism areas for—</text>
								<subclause id="H1F4F6D48181842C3970CF7C58ED4E5A2"><enum>(I)</enum><text>an average of not
				less than 30 hours per week; and</text>
								</subclause><subclause id="H09A7CA9E8B8043ADB266FD9EA725A28E"><enum>(II)</enum><text>for not less than
				8 months per year;</text>
								</subclause></clause><clause id="H8790214ECB424DA99C870952F601A88C"><enum>(iv)</enum><text>is a person with
				disabilities (as such term is defined in section 811(k) of the
				Cranston-Gonzalez National Affordable Housing Act (42 U.S.C. 8013)) who—</text>
								<subclause id="HB7BC4557A6844000A2858C1A44C48418"><enum>(I)</enum><text>was employed,
				during the 2-year period ending upon becoming disabled, in a position or
				positions described in clause (i) or (ii); or</text>
								</subclause><subclause id="HF2E99BC6666748A08EBC215207B7D80A"><enum>(II)</enum><text>is employed in a
				position or positions described in clause (i) or (ii), except that the 30-hour
				requirement under such clauses shall not apply to such person if—</text>
									<item id="H2124C3681F1346CDA219C98AD0E5B7E7"><enum>(aa)</enum><text>compliance with
				such requirement would make such person ineligible for benefits made available
				for persons with disabilities through a program of any State agency for
				developmental disabilities or through the supplemental security income program
				under title XVI of the Social Security Act; and</text>
									</item><item id="HE3DE0F5FA3BD450583EAFC7ECA9AA561"><enum>(bb)</enum><text>such person works
				the maximum number of hours per week allowable for eligibility for benefits
				under such program; or</text>
									</item></subclause></clause><clause id="H07B9C96EF2974B72909D5468E95D52E3"><enum>(v)</enum><text>is
				the head of household in a household that includes one or more dependents, at
				least one of whom is at the time of the execution of the mortgage 5 years of
				age or younger or is enrolled full-time in a school in a high tourism
				area.</text>
							</clause></subparagraph><subparagraph id="HCF8D137288E340A89BC9BD6F2A641C71"><enum>(D)</enum><header>Loan
				limit</header><text>The original principal obligation of the mortgage shall
				comply with the applicable dollar amount limitations under subsection
				(b)(2).</text>
						</subparagraph></paragraph><paragraph id="HD67DF9FF19BF4EC99330BCE67B166E8F"><enum>(4)</enum><header>High tourism
				area</header><text display-inline="yes-display-inline">For purposes of this
				paragraph, the term <term>high tourism area</term> means any a county that is
				designated as a high tourism county pursuant to section 5 of the
				<short-title>Affordable Housing Regulation Simplification
				Act of
				2012</short-title>.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H0A07019BCABC4416B307E47891EE96AD"><enum>4.</enum><header>FHA authority for
			 spot approval of mortgages for condominium units</header><text display-inline="no-display-inline">Section 234 of the National Housing Act (12
			 U.S.C. 1715y) is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H3F6BFF47307E4F4CA83EA1BA23C2BDD5" style="OLC">
				<subsection id="HF826E1E88A1944508007A4E10C677B5D"><enum>(l)</enum><header>Authority for
				spot approvals</header><text display-inline="yes-display-inline">In the case of
				individual mortgages for one-family units in a multifamily project and an
				undivided interest in the common areas and facilities that serve the project
				and affordable workforce housing mortgages (as such term is defined in section
				203(y)), the Secretary shall provide an approval process for insurance of such
				mortgages that does not require prior approval of the entire project or of the
				homeowners association for the entire
				project.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HA037A46753D948038F7EE242C71D505F"><enum>5.</enum><header>Determination of
			 high tourism areas</header><text display-inline="no-display-inline">The
			 Secretary of Commerce shall, by notice issued not later than December 31,
			 2013—</text>
			<paragraph id="HC4C91390830644E7AE00D18C2244787A"><enum>(1)</enum><text>establish a
			 procedure and metric for assessing, for counties in all States throughout the
			 United States, the economic impact of tourism on such counties;</text>
			</paragraph><paragraph id="H8124D663BCB94080A082B5E425D1FCE3"><enum>(2)</enum><text>establish a
			 minimum threshold for such economic activity for use for designating counties
			 as high tourism counties; and</text>
			</paragraph><paragraph id="H85D56A2468FD455B890C500D55A5FFA6"><enum>(3)</enum><text>pursuant to such
			 procedure, metric, and threshold, designate the counties in the United States
			 that are high tourism counties at the time of such designation.</text>
				<continuation-text continuation-text-level="paragraph" indent="subsection">The Secretary of Commerce shall reassess and update
			 such designations on a biennial basis.</continuation-text></paragraph></section></legis-body>
