		<official-title>To amend the Horse Protection Act to designate additional
		  unlawful acts under the Act, strengthen penalties for violations of the Act,
		  improve Department of Agriculture enforcement of the Act, and for other

		<section display-inline="no-display-inline" id="HB1D2905B2C0D4AB1AB95A9DD15BBCA7B" section-type="section-one"><enum>1.</enum><header>Increased enforcement under
			 Horse Protection Act</header>
			<subsection display-inline="no-display-inline" id="H2EB6C554102345E69EC6B2962970248C"><enum>(a)</enum><header>Definitions</header><text>Section
			 2 of the Horse Protection Act (15 U.S.C. 1821) is amended—</text>
				<paragraph id="HF31726C56B864DE39D231BADB5C861BD"><enum>(1)</enum><text>by redesignating
			 paragraphs (1), (2), (3), and (4) as paragraphs (2), (3), (4), and (5),
			 respectively;</text>
				</paragraph><paragraph id="H9870D38123E54143B240DC8A77B81ADD"><enum>(2)</enum><text>by inserting
			 before paragraph (2) (as so redesignated) the following new paragraph:</text>
					<quoted-block id="H78B074F962764F44B613D9BD95BC3CEF" style="OLC">
						<paragraph id="H36F390C75A3C4A9EA12ACF012374AD12"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>action device</term> means
				any boot, collar, chain, roller, or other device that encircles or is placed
				upon the lower extremity of the leg of a horse in such a manner that it
				can—</text>
							<subparagraph id="H8A97E8D0F925496988D5C72BE0F1E44F"><enum>(A)</enum><text>rotate around the
				leg or slide up and down the leg, so as to cause friction; or</text>
							</subparagraph><subparagraph id="HA0EBF4A39E0145BBA060154B13624B19"><enum>(B)</enum><text>strike the hoof,
				coronet band, fetlock joint, or pastern of the
				horse.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8AE02F3C5D2948659964CB7C03D2F32C"><enum>(3)</enum><text>in paragraph (2)
			 (as so redesignated) by inserting <quote>, including the sponsoring
			 organization and event manager</quote> before the period; and</text>
				</paragraph><paragraph id="H7F2ED26978CA4EF7B72D14D25C05A342"><enum>(4)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block id="H960550DE332D44EAB74FB2857695E30B" style="OLC">
						<paragraph id="H6393EA36558A4BCAB07A6BD6A72A4353"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H9C3F2BE7B00F4288B5F5D6610D7D3262"><enum>(A)</enum><text>The term
				<term>participate</term> means engaging in any activity with respect to a horse
				show, horse exhibition, or horse sale or auction, including—</text>
								<clause id="H28B4013C22A745FDB6C3C3A321571013"><enum>(i)</enum><text>transporting or
				arranging for the transportation of a horse to or from a horse show, horse
				exhibition, or horse sale or auction;</text>
								</clause><clause id="H2F2B500B6F6F48DABE2954E876BA0C80"><enum>(ii)</enum><text>personally giving
				instructions to an exhibitor;</text>
								</clause><clause id="H5569C0D79D9B43788323C8B6D0A87E51"><enum>(iii)</enum><text>being knowingly
				present in a warm-up area, inspection area, or other area at a horse show,
				horse exhibition, or horse sale or auction that spectators are not permitted to
				enter; or</text>
								</clause><clause id="H3E5CED66DBA74C21BA8B41C76EAEC546"><enum>(iv)</enum><text>financing the
				participation of other individuals in any horse show, horse exhibition, or
				horse sale or auction.</text>
								</clause></subparagraph><subparagraph id="H4B0878D486B34732ADB57AD26260BBB9" indent="up1"><enum>(B)</enum><text>Such term does not include
				spectating.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2805F7F131734F5E990067953C526AB9"><enum>(b)</enum><header>Findings</header><text>Section
			 3 of the Horse Protection Act (15 U.S.C. 1822) is amended—</text>
				<paragraph id="H39672C3EEA2E4E19B887CF78799A3857"><enum>(1)</enum><text>in paragraph
			 (3)—</text>
					<subparagraph id="HD0BF4CDB7BD3420CBE128A68CE3344B9"><enum>(A)</enum><text>by inserting
			 <quote>and soring horses for such purposes</quote> after <quote>horses in
			 intrastate commerce,</quote>; and</text>
					</subparagraph><subparagraph id="H6733948738E54397B5D59CD9E529D3F4"><enum>(B)</enum><text>by inserting
			 <quote>in many ways, including by creating unfair competition, by deceiving the
			 spectating public and horse buyers, and by negatively impacting horse
			 sales</quote> before the semicolon;</text>
					</subparagraph></paragraph><paragraph id="H382D2EFC2F334EEBA7D74341175FD7D6"><enum>(2)</enum><text>in paragraph (4),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H020E066256F447949CCB54D73A1694B6"><enum>(3)</enum><text>in paragraph (5),
			 by striking the period at the end and inserting a semicolon; and</text>
				</paragraph><paragraph id="H2A5814832F3241A09A0B3D8A2D841F72"><enum>(4)</enum><text>by adding at the
			 end the following new paragraphs:</text>
					<quoted-block id="H02CE0E8B538D4C7C8D7230C07C898A6B" style="OLC">
						<paragraph id="HB6055CBA996F46DA8EC840E9D0E8C5AE"><enum>(6)</enum><text display-inline="yes-display-inline">the Inspector General of the Department of
				Agriculture has determined that the program through which the Secretary
				inspects horses is inadequate for preventing the soring of show horses;
				and</text>
						</paragraph><paragraph id="H6512DDA3D5444F738A5FAD2D16048E8C"><enum>(7)</enum><text>despite
				regulations in effect related to inspection for purposes of ensuring that
				horses are not sore, violations of this Act continue to be
				prevalent.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HDBEE750C722745359B77094D6C4232AC"><enum>(c)</enum><header>Horse shows and
			 exhibitions</header><text>Section 4 of the Horse Protection Act (15 U.S.C.
			 1823) is amended—</text>
				<paragraph id="HF65F48056AB8444E93EB2A827CF026A6"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H2B62899426264E8F88617C76467B4D92"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>appointed</quote> and
			 inserting <quote>licensed</quote>; and</text>
					</subparagraph><subparagraph id="HD0CB5C9FCE7A4C1EAB1D4B680D732208"><enum>(B)</enum><text>by adding at the
			 end the following new sentences: <quote>On the first instance in which the
			 Secretary determines that a horse is sore, the Secretary shall disqualify the
			 horse from being shown or exhibited for a period of not less than 180 days. On
			 the second instance in which the Secretary determines that such horse is sore,
			 the Secretary shall disqualify the horse for a period of not less than one
			 year. On the third instance in which the Secretary determines that such horse
			 is sore, the Secretary shall disqualify the horse for a period of not less than
			 three years.</quote>;</text>
					</subparagraph></paragraph><paragraph id="HB14336FAE05341CB92755BF8281A9F1A"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking
			 <quote>appointed</quote> and inserting <quote>licensed</quote>;</text>
				</paragraph><paragraph id="HE75E556F93FA41D2840B0F6C5C53D4E9"><enum>(3)</enum><text>by striking
			 subsection (c) and inserting the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H192549A49F944DDF8B22B1E1EFEB8757" style="OLC">
						<subsection id="H457B879EFA7244E097A3506F9E7B9EDF"><enum>(c)</enum><header>Licensure,
				training, and assignment of inspectors; manner of inspection</header><paragraph commented="no" display-inline="yes-display-inline" id="H9F3B3CC60E8944C88BB74857A1B0453F"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H31B6B6451223423E95FE61ED6344B5DB"><enum>(A)</enum><text>Not later than 180 days
				after the date of enactment of this subsection, the Secretary shall prescribe
				by regulation requirements for the Department of Agriculture to license, train,
				assign, and oversee persons qualified to detect and diagnose a horse which is
				sore or to otherwise inspect horses at horse shows, horse exhibitions, or horse
				sales or auctions, to be hired by management of such events, for the purposes
				of enforcing this Act.</text>
								</subparagraph><subparagraph id="HFC125704965E44ACA434161784C8C858" indent="up2"><enum>(B)</enum><text>If the Secretary determines that the
				performance of a person licensed in accordance with subparagraph (A) is
				unsatisfactory, the Secretary may, after notice and an opportunity for a
				hearing, revoke the license issued to such person.</text>
								</subparagraph><subparagraph id="H3F4D9D3A2A334D4781B6066324DC0674" indent="up2"><enum>(C)</enum><text>Licensure of a person in accordance
				with the requirements prescribed under this subsection shall not be construed
				as authorizing such person to conduct inspections in a manner other than that
				prescribed for inspections by the Secretary (or the Secretary’s representative)
				under subsection (e) of this section.</text>
								</subparagraph></paragraph><paragraph id="HA09891E801004B13A21A3C00D047E276" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H76E561A08B954631B93EC35DDCA7443C"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than 30 days before the date on
				which a horse show, horse exhibition, or horse sale or auction begins, the
				management of such show, exhibition, or sale or auction may notify the
				Secretary of the intent of the management to hire a person or persons licensed
				under this subsection and selected by the Secretary to conduct inspections at
				such show, exhibition, or sale or auction.</text>
								</subparagraph><subparagraph id="HE9107277EBF34C4183597D3013CEC899" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">After such notification, the Secretary
				shall assign a person or persons licensed under this subsection to conduct
				inspections at the horse show, horse exhibition, or horse sale or
				auction.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H3F5D93B08F6C4C278A7235DC38984B4C" indent="up1"><enum>(3)</enum><text>A person licensed by the Secretary to
				conduct inspections under this subsection shall issue a citation with respect
				to any violation of this Act recorded during an inspection and notify the
				Secretary of each such violation not later than five days after the date on
				which a citation was issued with respect to such
				violation.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H70CD9EA2F36343F192794F3ECB2AADA3"><enum>(4)</enum><text>in the heading for
			 subsection (e), by striking <quote><header-in-text level="subsection" style="USC">Appointed</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="USC">Designated</header-in-text></quote>.</text>
				</paragraph></subsection><subsection id="HF55D4F88191F436794CB43E1CAEF9811"><enum>(d)</enum><header>Unlawful
			 acts</header><text>Section 5 of the Horse Protection Act (15 U.S.C. 1824) is
			 amended—</text>
				<paragraph id="HBDE3C5F7A23241339022F14BFA5F85FC"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="HDCF12A6FBBC54F91B89EA9EBE2DB909D"><enum>(A)</enum><text>by striking
			 <quote>or (C) respecting</quote> and inserting <quote>(C), or (D)
			 respecting</quote>; and</text>
					</subparagraph><subparagraph id="H308921FEB363441991009DE5FFAFBB81"><enum>(B)</enum><text>by striking
			 <quote>and (D)</quote> and inserting <quote>(D) causing a horse to become sore
			 or directing another person to cause a horse to become sore for the purpose of
			 showing, exhibiting, selling, auctioning, or offering for sale the horse in any
			 horse show, horse exhibition, or horse sale or auction, and (E)</quote>;</text>
					</subparagraph></paragraph><paragraph id="HEA2A27F8EF3D4C95BB2401ECC2CBCCAC"><enum>(2)</enum><text>in paragraph (3),
			 by striking <quote>appoint</quote> and inserting <quote>hire</quote>;</text>
				</paragraph><paragraph id="H4CB577455F2D4658859ADE55DFAA0B00"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (4)—</text>
					<subparagraph id="H14EFBDE7F57640CC9165D3E1FDF03D00"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>appoint</quote> and
			 inserting <quote>hire</quote>; and</text>
					</subparagraph><subparagraph id="H4DF4C126061B456B939A8373447F5BB0"><enum>(B)</enum><text>by striking
			 <quote>qualified</quote>;</text>
					</subparagraph></paragraph><paragraph id="H17944210F66B4EEF890EF9200C10FA7E"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking
			 <quote>appointed</quote> and insert <quote>hired</quote>;</text>
				</paragraph><paragraph id="H04CA18C2714C471DB1C2D21AD3B66255"><enum>(5)</enum><text>in paragraph
			 (6)—</text>
					<subparagraph id="H9E96C69CFBD14224BB64304BF05A556E"><enum>(A)</enum><text>by striking
			 <quote>appointed</quote> and inserting <quote>hired</quote>; and</text>
					</subparagraph><subparagraph id="H96E983D5791E41CA948CCB7E597AA18E"><enum>(B)</enum><text>by inserting
			 <quote>that the horse is sore</quote> after <quote>the Secretary</quote>;
			 and</text>
					</subparagraph></paragraph><paragraph id="H62E6EE7095FC4F22AD57861A741D2150"><enum>(6)</enum><text>by adding at the
			 end the following new paragraphs:</text>
					<quoted-block id="H0FF69057365A44F79E960E1C8A9DBDA4" style="OLC">
						<paragraph id="HA967FC1CD23E4313BD1589460B4A904B"><enum>(12)</enum><text display-inline="yes-display-inline">The use of an action device on any limb of
				a Tennessee Walking, a Racking, or a Spotted Saddle horse at a horse show,
				horse exhibition, or horse sale or auction.</text>
						</paragraph><paragraph id="HE3E3964EB7FD4249BAAE4A060480A635"><enum>(13)</enum><text display-inline="yes-display-inline">The use of a weighted shoe, pad, wedge,
				hoof band, or other device or material at a horse show, horse exhibition, or
				horse sale or auction that—</text>
							<subparagraph id="HF5412BC6BE2540BA993015730610793D"><enum>(A)</enum><text>is placed on,
				inserted in, or attached to any limb of a Tennessee Walking, a Racking, or a
				Spotted Saddle horse;</text>
							</subparagraph><subparagraph id="HF387F233B03F4777B7F63266B52E00BC"><enum>(B)</enum><text>is constructed to
				artificially alter the gait of such a horse; and</text>
							</subparagraph><subparagraph id="HF4E64FD455E64F6197E2A2A7692A348D"><enum>(C)</enum><text>is not strictly
				protective or therapeutic in
				nature.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H56D226AB56F24E34B4467D717D1F7F67"><enum>(e)</enum><header>Violations and
			 penalties</header><text>Section 6 of the Horse Protection Act (15 U.S.C. 1825)
			 is amended—</text>
				<paragraph id="H1A64EE48DF4C4DE0A8A481CA5D4B79A0"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H55F9EBC31ACD455F990B770C227DC419"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="HC7FEAB2B2D9649208B22D8F3BF65D2C3"><enum>(i)</enum><text>by
			 striking <quote>Except as provided in paragraph (2) of this subsection, any
			 person who knowingly violates section 5</quote> and inserting <quote>Any person
			 who knowingly violates section 5 or the regulations issued under such section,
			 including any violation recorded during an inspection conducted in accordance
			 with section 4(c) or 4(e)</quote>; and</text>
						</clause><clause id="H3772AD5E93D84A8AA078F8E3C9A9D381"><enum>(ii)</enum><text>by
			 striking <quote>more than $3,000, or imprisoned for not more than one year, or
			 both.</quote> and inserting <quote>more than $5,000, or imprisoned for not more
			 than three years, or both, for each such violation.</quote>;</text>
						</clause></subparagraph><subparagraph id="H89F3E740D4974A2CB815CCFA29508E98"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="H6720493D03454E3695EEF9DC0D99D842"><enum>(i)</enum><text>by
			 striking subparagraph (A);</text>
						</clause><clause id="HD8A19655FB6640B6B7FAAE013D4F02DB"><enum>(ii)</enum><text>by
			 striking <quote><header-in-text level="paragraph" style="OLC"><enum-in-header>(2)</enum-in-header></header-in-text></quote>;
			 and</text>
						</clause><clause id="HD1FEF4226D53430E8923CA135EAD7D93"><enum>(iii)</enum><text>by
			 redesignating subparagraphs (B) and (C) as paragraphs (2) and (3),
			 respectively, and moving the margins of such paragraphs (as so redesignated)
			 two ems to the left; and</text>
						</clause></subparagraph><subparagraph id="H1A13330A92164E0A92BBD15D2FB69968"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block id="HAC4FA7F7400443F8B39B1CBE3868C22A" style="OLC">
							<paragraph id="H325E26A49DD54E95A9E51BC1EE512327"><enum>(4)</enum><text>Any person who
				knowingly fails to obey an order of disqualification shall, upon conviction
				thereof, be fined not more than $5,000 for each failure to obey such an order,
				imprisoned for not more than three years, or
				both.</text>
							</paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HD0BD3E7272684166ADD29F3792593E6C"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H98321788987642B7A5D2463AB36A7123"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="HACCBAAA6A78B4ACB8CB8A323D55BC744"><enum>(i)</enum><text>by
			 striking <quote>section 5 of this Act</quote> and inserting <quote>section 5 or
			 the regulations issued under such section</quote>; and</text>
						</clause><clause id="H627A4866ECA14C1A8F8C02146BEB5F59"><enum>(ii)</enum><text>by
			 striking <quote>$2,000</quote> and inserting <quote>$4,000</quote>; and</text>
						</clause></subparagraph><subparagraph id="H65C4F44807454731BE2DFBEA7129064E"><enum>(B)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HB22B5AE9B1214F008B900370441734BA" style="OLC">
							<paragraph id="H86BB9FF87CCF49F3A9F462EFBBA4EAEC"><enum>(5)</enum><text display-inline="yes-display-inline">Any person who fails to pay a licensed
				inspector hired under section 4(c) shall, upon conviction thereof, be fined not
				more than $4,000 for each such
				violation.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HC3AFF4760FAB4225835FC6709853A764"><enum>(3)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="H752A984EAE22416D91274A7A959EDD6E"><enum>(A)</enum><text>in the first
			 sentence—</text>
						<clause id="H8D56BCE040CC4BEFAB7BA3A9AB439A4D"><enum>(i)</enum><text>by
			 inserting <quote>, or otherwise participating in any horse show, horse
			 exhibition, or horse sale or auction</quote> before <quote>for a period of not
			 less than one year</quote>; and</text>
						</clause><clause id="H18C39441D555467787742F32EB9F49C4"><enum>(ii)</enum><text>by
			 striking <quote>any subsequent</quote> and inserting <quote>the
			 second</quote>;</text>
						</clause></subparagraph><subparagraph id="H33B4111D75254A85B86E38409F8D9305"><enum>(B)</enum><text>by inserting
			 before <quote>Any person who knowingly fails</quote> the following: <quote>For
			 the third or any subsequent violation, a person may be permanently disqualified
			 by order of the Secretary, after notice and an opportunity for a hearing before
			 the Secretary, from showing or exhibiting any horse, judging or managing any
			 horse show, horse exhibition, or horse sale or auction, or otherwise
			 participating in any horse show, horse exhibition, or horse sale or
			 auction.</quote>; and</text>
					</subparagraph><subparagraph id="H8D010769409149E4A3E65EEFE3BDED52"><enum>(C)</enum><text>by striking
			 <quote>$3,000</quote> each place it appears and inserting
			 <quote>$5,000</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H18D8265CD4D54167A6E78204D90A5397"><enum>(f)</enum><header>Regulations</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Secretary
			 shall issue regulations to carry out the amendments made by this Act.</text>
			</subsection><subsection id="HC56EE1D59FA14F9480A3C342312EE35B"><enum>(g)</enum><header>Severability</header><text>If
			 any provision of this Act or any amendment made by this Act, or the application
			 of a provision to any person or circumstance, is held to be unconstitutional,
			 the remainder of this Act and the amendments made by this Act, and the
			 application of the provisions to any person or circumstance, shall not be
			 affected by the holding.</text>
