		<section id="H5E2EA64F82B24E1F8EE1F88F3CBB5451" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Air and Health Quality Empowerment
			 Zone Designation Act of 2012</short-title></quote>.</text>
		</section><section id="H0CC58893BA4944329372B52EB561860C"><enum>2.</enum><header>Air and health
			 quality empowerment zones</header>
			<subsection id="H9CD2E9A55BB7435FBF0A9D0375DA29EC"><enum>(a)</enum><header>Designation of
			 air and health quality empowerment zones</header>
				<paragraph id="HB964802A93C849F4BC2249467256798C"><enum>(1)</enum><header>In
			 general</header><text>The Administrator may designate an area as an air and
			 health quality empowerment zone if—</text>
					<subparagraph id="HDFD7284B48E1451183B3D953ABBE3B47"><enum>(A)</enum><text display-inline="yes-display-inline">the air pollution control district or other
			 local governmental entity authorized to regulate air quality for the area
			 submits an application under paragraph (2) nominating the area for such
			 designation; and</text>
					</subparagraph><subparagraph id="HB24252D5E7894686A0E515D580CFBC70"><enum>(B)</enum><text>the Administrator
			 determines that—</text>
						<clause id="H3E9441B784134460AACD4932BAD493B8"><enum>(i)</enum><text>the
			 information in the application is reasonably accurate; and</text>
						</clause><clause id="H7284627399E64D74AFE1499E6925FDDC"><enum>(ii)</enum><text>the
			 nominated area satisfies the eligibility criteria described in paragraph
			 (3).</text>
						</clause></subparagraph></paragraph><paragraph id="H23844A5B93DD4F558A3644E20EC58EED"><enum>(2)</enum><header>Nomination</header><text>To
			 nominate an area for designation under paragraph (1), the air pollution control
			 district or other local governmental entity authorized to regulate air quality
			 for the area shall submit to the Administrator an application that—</text>
					<subparagraph id="HB9FED9C8F8554C2583A129476CD513DB"><enum>(A)</enum><text>demonstrates that
			 the nominated area satisfies the eligibility criteria described in paragraph
			 (3); and</text>
					</subparagraph><subparagraph id="H0D7FED4C33F340938AD01B0A810F1130"><enum>(B)</enum><text display-inline="yes-display-inline">includes a strategic plan that—</text>
						<clause id="H9C4D7553313340808DDE32EBCE7503F0"><enum>(i)</enum><text>is
			 designed for—</text>
							<subclause display-inline="no-display-inline" id="H135E2AF950024C6B8F394E9013422EFA"><enum>(I)</enum><text>addressing air
			 quality challenges and achieving attainment of air quality standards in the
			 area; and</text>
							</subclause><subclause id="H3470271ED24048B5913A21ECB237B3FF"><enum>(II)</enum><text>improving the
			 health of the population in the area;</text>
							</subclause></clause><clause id="HB394171979D447C8919F718722EB84F2"><enum>(ii)</enum><text>describes—</text>
							<subclause id="HAB5B895CA4224AA8BD71300CD4E3CAA9"><enum>(I)</enum><text>the process by
			 which the district or local governmental entity is a full partner in the
			 process of developing and implementing the strategic plan; and</text>
							</subclause><subclause id="H5FF0945C217D4FEBB48A8C82163034FA"><enum>(II)</enum><text>the extent to
			 which local institutions and organizations have contributed to the planning
			 process;</text>
							</subclause></clause><clause id="H6014AE32C28B4012BCFDE5EC80AE1B7A"><enum>(iii)</enum><text>identifies—</text>
							<subclause id="H03BDBFB5E3FE483F9739333494DB3BB4"><enum>(I)</enum><text>the amount of
			 State, local, and private resources that will be available for carrying out the
			 strategic plan; and</text>
							</subclause><subclause id="H6CAB519C12BC4106AE8E5CAB73A724FC"><enum>(II)</enum><text>the private and
			 public partnerships to be used (which may include participation by, and
			 cooperation with, institutions of higher education, medical centers, and other
			 private and public entities) in carrying out the strategic plan;</text>
							</subclause></clause><clause id="H3F26A489EE224937A7A47D034C6B9195"><enum>(iv)</enum><text>identifies the
			 funding requested under any Federal program in support of the strategic
			 plan;</text>
						</clause><clause id="H8559BF3E873C454282F1E2FC7013C502"><enum>(v)</enum><text>identifies
			 baselines, methods, and benchmarks for measuring the success of the strategic
			 plan; and</text>
						</clause><clause id="H26E6091BC2904591BF8EE26437099198"><enum>(vi)</enum><text>includes such
			 other information as may be required by the Administrator; and</text>
						</clause></subparagraph><subparagraph id="H7653E76E6F2143F09C4A2FAB0B0D16FC"><enum>(C)</enum><text>provides written
			 assurances satisfactory to the Administrator that the strategic plan will be
			 implemented.</text>
					</subparagraph></paragraph><paragraph id="H9383B95913A74BE6BEB96C1E0808797E"><enum>(3)</enum><header>Eligibility
			 criteria</header><text>To be eligible for designation under paragraph (1), an
			 area must meet all of the following criteria:</text>
					<subparagraph id="H99E970A3EF0F467CAF6BBBB54BAFAB5B"><enum>(A)</enum><header>Nonattainment</header><text>The
			 area has been designated as being—</text>
						<clause id="H0BC1B07610644700960CBCEFE1745C41"><enum>(i)</enum><text>in
			 extreme nonattainment of the national ambient air quality standard for ozone;
			 and</text>
						</clause><clause id="H875A1386A84E4107AFFA72A2EB38A2DB"><enum>(ii)</enum><text display-inline="yes-display-inline">in nonattainment of the national ambient
			 air quality standard for PM<subscript>2.5</subscript>.</text>
						</clause></subparagraph><subparagraph id="H7C4EF723C9E340B3BDF362B4164FD207"><enum>(B)</enum><header>Agricultural
			 sources</header><text>The area had—</text>
						<clause id="H0C468C5C3B2B4120A8B5AA77906C4656"><enum>(i)</enum><text>emissions of
			 oxides of nitrogen from farm equipment of at least 30 tons per day in calendar
			 year 2011; or</text>
						</clause><clause id="HC124169E850744E9B65E5FA220216BE4"><enum>(ii)</enum><text>emissions of
			 volatile organic compounds from farming operations of at least 3 tons per day
			 in calendar year 2010.</text>
						</clause></subparagraph><subparagraph id="HFBF1C083C0E44E5CBFB03E97C8C53D82"><enum>(C)</enum><header>Air
			 quality-related health effects</header><text>As of the date of designation, the
			 area meets or exceeds the national average per capita incidence of
			 asthma.</text>
					</subparagraph><subparagraph id="HFDAF09B46781477FA5220D217E623B47"><enum>(D)</enum><header>Economic
			 impact</header><text>As of the date of designation, the area experiences
			 unemployment rates higher than the national average.</text>
					</subparagraph><subparagraph commented="no" id="H3CA1ACDE065245A188C774E14D109628"><enum>(E)</enum><header>Matching
			 funds</header><text display-inline="yes-display-inline">The air pollution
			 control district or other local governmental entity submitting the strategic
			 plan under paragraph (2) for the area agrees that it will make available
			 (directly or through contributions from the State or other public or private
			 entities) non-Federal contributions toward the activities to be carried out
			 under the strategic plan in an amount equal to $1 for each $1 of Federal funds
			 provided for such activities. Such non-Federal matching funds may be in cash or
			 in-kind, fairly evaluated, including plant, equipment, or services.</text>
					</subparagraph></paragraph><paragraph id="HAB6A428D3C6847ADAF3C8160C8EDB853"><enum>(4)</enum><header>Period of
			 designation</header><text>A designation under paragraph (1) shall remain in
			 effect during the period beginning on the date of the designation and ending on
			 the earlier of—</text>
					<subparagraph id="H37FCEA5D725848A78824CB2452E30A82"><enum>(A)</enum><text>the last day of
			 the tenth calendar year ending after the date of the designation; or</text>
					</subparagraph><subparagraph id="HE302AD3B011649308F88AA66C4D29041"><enum>(B)</enum><text>the date on which
			 the Administrator revokes the designation.</text>
					</subparagraph></paragraph><paragraph id="H62D40269CB734429B9CB5601A598A75E"><enum>(5)</enum><header>Revocation of
			 designation</header><text>The Administrator may revoke the designation under
			 paragraph (1) of an area if the Administrator determines that—</text>
					<subparagraph id="HEC414ECD7668409A808CB81464D57E0F"><enum>(A)</enum><text display-inline="yes-display-inline">the area is in attainment with the national
			 ambient air quality standards for PM<subscript>2.5</subscript> and ozone;
			 or</text>
					</subparagraph><subparagraph id="HF4167319CFF5457BBEC38426C044764C"><enum>(B)</enum><text display-inline="yes-display-inline">the air pollution control district or other
			 local governmental entity submitting the strategic plan under paragraph (2) for
			 the area is not complying substantially with, or fails to make progress in
			 achieving the goals of, such strategic plan.</text>
					</subparagraph></paragraph></subsection><subsection id="H49A2609E2A5D484DA2B2826E0E1CD638"><enum>(b)</enum><header>Grants for air
			 and health quality empowerment zones</header>
				<paragraph display-inline="no-display-inline" id="H65D95D8B8A324300B91A51924D8BAB4A"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">For the purpose
			 described in paragraph (2), the Administrator may award one or more grants to
			 the air pollution control district or local governmental entity submitting the
			 application under subsection (a)(2) on behalf of each air and health quality
			 empowerment zone designated under subsection (a)(1).</text>
				</paragraph><paragraph id="H276990A9D6D24AD188ADA128180B029D"><enum>(2)</enum><header>Use of
			 grants</header><text>A recipient of a grant under paragraph (1) shall use the
			 grant solely for the purpose of carrying out the strategic plan submitted by
			 the recipient under subsection (a)(2).</text>
				</paragraph><paragraph id="HE287F501C0764DB3B63337A7F183240B"><enum>(3)</enum><header>Amount of
			 grants</header><text>The amount awarded under this subsection with respect to a
			 designated air and health quality empowerment zone shall be determined by the
			 Administrator based upon a review of—</text>
					<subparagraph id="HD34D9100DADE4CCBB055949454C0DD8F"><enum>(A)</enum><text>the information
			 contained in the application for the zone under subsection (a)(2); and</text>
					</subparagraph><subparagraph id="H8A8E7B1BED8247E286DCBB1FD2908125"><enum>(B)</enum><text>the needs set
			 forth in the application for those anticipated to benefit from the strategic
			 plan submitted for the zone.</text>
					</subparagraph></paragraph><paragraph id="H957052E6F8374871B9502FDA89D4BD48"><enum>(4)</enum><header>Timing of
			 grants</header><text>To the extent and in the amount of appropriations made
			 available in advance, the Administrator shall—</text>
					<subparagraph id="H091B7CA3D11443599A70CB42BE2A98DB"><enum>(A)</enum><text>award a grant
			 under this subsection with respect to each air and health quality empowerment
			 zone on the date of designation of the zone under subsection (a)(1); and</text>
					</subparagraph><subparagraph id="H64E9AC8E2FE34A90AC28D093A14E32BF"><enum>(B)</enum><text>make the grant
			 funds available to the grantee on the first day of the first fiscal year that
			 begins after the date of such designation.</text>
					</subparagraph></paragraph><paragraph id="H66000DF9D7934EB9B7DD80F45BF2A55B"><enum>(5)</enum><header>Authorization of
			 appropriations</header><text>To carry out this subsection, there is authorized
			 to be appropriated $20,000,000 for each of fiscal years 2013 through
			 2017.</text>
				</paragraph></subsection><subsection id="HB27C5443071A421E8D7534807990A0FE"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H859617EC70654EB18CFCA23872327FD3"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
				</paragraph><paragraph id="HF10F7A04903140D09B48598608F06C10"><enum>(2)</enum><header>PM<subscript>2.5</subscript></header><text display-inline="yes-display-inline">The term
			 <term>PM<subscript>2.5</subscript></term> means particulate matter with a
			 diameter that does not exceed 2.5 micrometers.</text>
				</paragraph></subsection></section><section id="H170505F8C05C42578127F8DD1AADF19E"><enum>3.</enum><header>Report to
			 Congress</header><text display-inline="no-display-inline">Not later than 5
			 years after the date of the enactment of this Act, the Administrator of the
			 Environmental Protection Agency—</text>
			<paragraph id="HD53C60EB224943C1950B1681436D06A8"><enum>(1)</enum><text>shall submit a
			 report to the Congress on the impact of this Act; and</text>
			</paragraph><paragraph id="H7AAA13DC4DCF4D58A6EF8665BDB47B5E"><enum>(2)</enum><text>may include in
			 such report a description of the impact of this Act in regard to—</text>
				<subparagraph id="H726F8EB72100436F86B4A4EAB084CBF4"><enum>(A)</enum><text>the reduction of
			 particulate matter and nitrogen oxides emissions;</text>
				</subparagraph><subparagraph id="HBAC9ABACDE114380955F43646D589AD0"><enum>(B)</enum><text>the reduction of
			 asthma rates and other health indicators; and</text>
				</subparagraph><subparagraph id="HFFAF20D299A542739EEAA4FE67FEE831"><enum>(C)</enum><text>economic
			 indicators.</text>
				</subparagraph></paragraph></section></legis-body>
