		<section id="H0D28310466D5444ABAFE79FD3FEC4DCD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Vulnerable Veterans Housing Reform Act
			 of 2012</short-title></quote>.</text>
		</section><section id="HB6F655D5DAAF4DBEA4E0D54D85F70697" section-type="subsequent-section"><enum>2.</enum><header>Exclusion from
			 income</header><text display-inline="no-display-inline">Paragraph (4) of
			 section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)(4)</external-xref>) is
			 amended—</text>
			<paragraph id="HCB93905F5D364D28BB81493A2E3859B5"><enum>(1)</enum><text>by striking
			 <quote>and any amounts</quote> and inserting <quote>, any
			 amounts</quote>;</text>
			</paragraph><paragraph id="H77A4702AFBED42B7A0885FAB7EC645F4"><enum>(2)</enum><text>by striking
			 <quote>or any deferred</quote> and inserting <quote>, any deferred</quote>;
			 and</text>
			</paragraph><paragraph id="H32E3FFF934D24AD88B6F3AD0C1C94F72"><enum>(3)</enum><text>by inserting after
			 <quote>prospective monthly amounts</quote> the following: <quote>, and any
			 expenses related to aid and attendance as detailed under
			 <external-xref legal-doc="usc" parsable-cite="usc/38/1521">section
			 1521</external-xref> of title 38, United States Code</quote>.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H7A17355E2BAC4716B33DB2AC822ACB82" section-type="subsequent-section"><enum>3.</enum><header>Utility allowances and
			 data</header><text display-inline="no-display-inline">Section 8(o) of the
			 United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C.
			 1437f(o)</external-xref>) is amended—</text>
			<paragraph id="HD45DCA8FF05D494FB4BCBBD093B1E719"><enum>(1)</enum><text>in paragraph (2),
			 by adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HF96F3505F257459CB0CD77844B56914D" style="OLC">
					<subparagraph id="HC73E2143DD2D448D9FCC41C50A6E6284"><enum>(D)</enum><header>Utility
				allowance</header>
						<clause id="H3F7998936D31415DADFA3BC034B41A66"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">In determining the
				monthly assistance payment for a family under subparagraphs (A) and (B), the
				amount allowed for tenant-paid utilities shall not exceed the appropriate
				utility allowance for the family unit size as determined by the public housing
				agency regardless of the size of the dwelling unit leased by the family.</text>
						</clause><clause id="HAC3AAF329A714EA1AD8BE50DC3F526B6"><enum>(ii)</enum><header>Exception for
				certain families</header><text>Notwithstanding subparagraph (A), upon request
				by a family that includes a person with disabilities, an elderly family, or a
				family that includes any person who is less than 18 years of age, the public
				housing agency shall approve a utility allowance that is higher than the
				applicable amount on the utility allowance schedule, except that in the case of
				a family that includes a person with disabilities, the agency shall approve
				such higher amount only if a higher utility allowance is needed as a reasonable
				accommodation to make the program accessible to and usable by the family member
				with a disability.</text>
						</clause><clause id="HE4EAF33E07C34B1B859A99C1560741ED"><enum>(iii)</enum><header>Authority to
				increase allowance</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), in the
				case of any family not described in clause (ii), a public housing agency may,
				at the request of the family, approve a utility allowance that is higher than
				the applicable amount on the utility allowance schedule. In making such a
				determination, the agency shall consider (I) the amount of the increase in
				utility costs for the family, and (II) the difficulty for the family in
				relocating.</text>
						</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HF6AD70C3861D490981782057EBCDEAED"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HEF02BCDA21354569A8DC4A29971921BF" style="OLC">
					<paragraph id="H73D3C631F540478594D542CF36698F80"><enum>(21)</enum><header>Utility
				data</header>
						<subparagraph id="H25D6107C92884E9DB6D438699ABE272C"><enum>(A)</enum><header>Publication</header><text display-inline="yes-display-inline">The Secretary shall, to the extent that
				data can be collected cost effectively, regularly publish such data regarding
				utility consumption and costs in local areas as the Secretary determines will
				be useful for the establishment of allowances for tenant-paid utilities for
				families assisted under this subsection.</text>
						</subparagraph><subparagraph id="H7A2A0F8E58834A3EAC47AA6A88EBB604"><enum>(B)</enum><header>Use of
				data</header><text>The Secretary shall provide such data in a manner
				that—</text>
							<clause id="HFB2DAC7E974644CB8544A624DFC69BCE"><enum>(i)</enum><text>avoids unnecessary
				administrative burdens for public housing agencies and owners; and</text>
							</clause><clause id="H30685FB381974F52978072A1898F7F25"><enum>(ii)</enum><text>protects families
				in various unit sizes and building types, and using various utilities, from
				high rent and utility cost burdens relative to
				income.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H7FCA170EDBB44795AD9741F03641B0A2"><enum>4.</enum><header>Pilot program for
			 grants for rehabilitation and modification of homes of disabled and low-income
			 veterans</header>
			<subsection id="H38ADDAE35577499586571D0CA5819E39"><enum>(a)</enum><header>Grant</header>
				<paragraph id="H8D90804CB480441E8838B04A04E84B97"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 establish a pilot program to award grants to qualified organizations to
			 rehabilitate and modify the primary residence of eligible veterans.</text>
				</paragraph><paragraph id="H89B96618C706492E97662DFEF04AE700"><enum>(2)</enum><header>Coordination</header><text>The
			 Secretary shall work in conjunction with the Secretary of Veterans Affairs to
			 establish and oversee the pilot program and to ensure that such program meets
			 the needs of eligible veterans.</text>
				</paragraph><paragraph id="H996729BE5D834C1AA6BBC467F9607B83"><enum>(3)</enum><header>Maximum
			 grant</header><text>A grant award under the pilot program to any one qualified
			 organization shall not exceed $1,000,000 in any one fiscal year, and such an
			 award shall remain available until expended by such organization.</text>
				</paragraph></subsection><subsection id="H92456ED67C87451E88AD4E5F73B3CA50"><enum>(b)</enum><header>Application</header>
				<paragraph id="HF6129EE203294731BF5F63D330B2DEAD"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each qualified
			 organization that desires a grant under the pilot program shall submit an
			 application to the Secretary at such time, in such manner, and, in addition to
			 the information required under paragraph (2), accompanied by such information
			 as the Secretary may reasonably require.</text>
				</paragraph><paragraph id="H3D9EEE3C6C4249649A3595D80FED78B8"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each application submitted under paragraph
			 (1) shall include—</text>
					<subparagraph id="HA7D2C63532924FCD921966F31D228B2D"><enum>(A)</enum><text>a plan of action
			 detailing outreach initiatives;</text>
					</subparagraph><subparagraph id="HC3195D17A3C84D63A2E8ED4F59A2942C"><enum>(B)</enum><text>the approximate
			 number of veterans the qualified organization intends to serve using grant
			 funds;</text>
					</subparagraph><subparagraph id="H38132BB0622743BD9764AAFE19F69AE7"><enum>(C)</enum><text>a description of
			 the type of work that will be conducted, such as interior home modifications,
			 energy efficiency improvements, and other similar categories of work;
			 and</text>
					</subparagraph><subparagraph id="HB641589813C44668AFA80A82A1224834"><enum>(D)</enum><text>a plan for working
			 with the Department of Veterans Affairs and veterans service organizations to
			 identify veterans and serve their needs.</text>
					</subparagraph></paragraph><paragraph id="H1DC2FC607F59420596B7DF7BD6771CBA"><enum>(3)</enum><header>Preferences</header><text display-inline="yes-display-inline">In awarding grants under the pilot program,
			 the Secretary shall give preference to a qualified organization—</text>
					<subparagraph id="H167F107A3D7B4FE48CD850682549FB92"><enum>(A)</enum><text>with experience in
			 providing housing rehabilitation and modification services for disabled
			 veterans; or</text>
					</subparagraph><subparagraph id="H6D341BB599EB46F0A7AA29149766FD7C"><enum>(B)</enum><text display-inline="yes-display-inline">that proposes to provide housing
			 rehabilitation and modification services for eligible veterans who live in
			 rural areas (the Secretary, through regulations, shall define the term
			 <quote>rural areas</quote>).</text>
					</subparagraph></paragraph></subsection><subsection id="H06A02463C7074697AD50FD59A4D0A6E9"><enum>(c)</enum><header>Criteria</header><text display-inline="yes-display-inline">In order to receive a grant award under the
			 pilot program, a qualified organization shall meet the following
			 criteria:</text>
				<paragraph id="H411404CEAD78486186642E86CCB7741E"><enum>(1)</enum><text>Demonstrate
			 expertise in providing housing rehabilitation and modification services for
			 disabled or low-income individuals for the purpose of making the homes of such
			 individuals accessible, functional, and safe for such individuals.</text>
				</paragraph><paragraph id="H29F8DDC661E045599CF6E49529CEECBA"><enum>(2)</enum><text display-inline="yes-display-inline">Have established outreach initiatives
			 that—</text>
					<subparagraph id="H18492A9E11F04D8997D6516E4405CF3B"><enum>(A)</enum><text>would engage
			 eligible veterans and veterans service organizations in projects utilizing
			 grant funds under the pilot program; and</text>
					</subparagraph><subparagraph id="H1CEFED4985E94A32948DB21476A2DA67"><enum>(B)</enum><text>identify eligible
			 veterans and their families and enlist veterans involved in skilled trades,
			 such as carpentry, roofing, plumbing, or HVAC work.</text>
					</subparagraph></paragraph><paragraph id="HFD88316087A94F9B8A9E41FAD3101159"><enum>(3)</enum><text display-inline="yes-display-inline">Have an established nationwide or
			 State-wide network of affiliates that are—</text>
					<subparagraph id="HA94E08CF15B349159D9F007AD0313053"><enum>(A)</enum><text>nonprofit
			 organizations; and</text>
					</subparagraph><subparagraph id="HDAA082717F494284BCFD4AB343DEF59D"><enum>(B)</enum><text>able to provide
			 housing rehabilitation and modification services for eligible veterans.</text>
					</subparagraph></paragraph><paragraph id="H7EBFF212B09E4F5E800A1AB763015D8A"><enum>(4)</enum><text>Have experience in
			 successfully carrying out the accountability and reporting requirements
			 involved in the proper administration of grant funds, including funds provided
			 by private entities or Federal, State, or local government entities.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H769320FA96124BBAA2A47CCAF521741B"><enum>(d)</enum><header>Use of
			 funds</header><text display-inline="yes-display-inline">A grant award under the
			 pilot program shall be used—</text>
				<paragraph id="H09C0988132184BE2BCC5B8AB55B1DD9D"><enum>(1)</enum><text>to modify and
			 rehabilitate the primary residence of an eligible veteran, and may
			 include—</text>
					<subparagraph id="H54B093BCFDB64ABBB0C2A03AD6A779FD"><enum>(A)</enum><text display-inline="yes-display-inline">installing wheelchair ramps, widening
			 exterior and interior doors, reconfigurating and re-equipping bathrooms (which
			 includes installing new fixtures and grab bars), removing doorway thresholds,
			 installing special lighting, adding additional electrical outlets and
			 electrical service, and installing appropriate floor coverings to—</text>
						<clause id="H0FD4944FB6A2400E807B2928DC9B687E"><enum>(i)</enum><text>accommodate the
			 functional limitations that result from having a disability; or</text>
						</clause><clause id="H4B8718C5DA5544589137DBADBBFE2ADA"><enum>(ii)</enum><text display-inline="yes-display-inline">if such residence does not have
			 modifications necessary to reduce the chances that an elderly, but not disabled
			 person, will fall in their home, reduce the risks of such an elderly person
			 from falling;</text>
						</clause></subparagraph><subparagraph id="H9A912DD618F24D9CBD82CD91EB772185"><enum>(B)</enum><text>rehabilitating
			 such residence that is in a state of interior or exterior disrepair; and</text>
					</subparagraph><subparagraph id="HFF2D89EE631F43F8B6F1168D5A8CC9FD"><enum>(C)</enum><text display-inline="yes-display-inline">installing energy efficient features or
			 equipment if—</text>
						<clause id="H44FECE4BE107435E92FEEC6D6D1E8F9F"><enum>(i)</enum><text>an
			 eligible veteran’s monthly utility costs for such residence is more than 5
			 percent of such veteran’s monthly income; and</text>
						</clause><clause id="H6AF39E908ABB4108A6751285AF0DC59C"><enum>(ii)</enum><text>an
			 energy audit of such residence indicates that the installation of energy
			 efficient features or equipment will reduce such costs by 10 percent or
			 more;</text>
						</clause></subparagraph></paragraph><paragraph id="HCC327103317F470B81019EBEB93DA5CB"><enum>(2)</enum><text display-inline="yes-display-inline">in connection with modification and
			 rehabilitation services provided under the pilot program, to provide technical,
			 administrative, and training support to an affiliate of a qualified
			 organization receiving a grant under such pilot program; and</text>
				</paragraph><paragraph id="H6213682918B2440C891912978287B308"><enum>(3)</enum><text>for other purposes
			 as the Secretary may prescribe through regulations.</text>
				</paragraph></subsection><subsection id="H4964B29A8AA24C318C04783284D80BDA"><enum>(e)</enum><header>Oversight</header><text>The
			 Secretary shall direct the oversight of the grant funds for the pilot program
			 so that such funds are used efficiently until expended to fulfill the purpose
			 of addressing the adaptive housing needs of eligible veterans.</text>
			</subsection><subsection id="H8F69BAE5E08A4D4192F0668AC32CF026"><enum>(f)</enum><header>Matching
			 funds</header>
				<paragraph id="H9D2E66E8B34F40A79F25E5D543E6B26D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A qualified
			 organization receiving a grant under the pilot program shall contribute towards
			 the housing modification and rehabilitation services provided to eligible
			 veterans an amount equal to not less than 50 percent of the grant award
			 received by such organization.</text>
				</paragraph><paragraph id="H781AF16ECDC94212849EC16D28DD3992"><enum>(2)</enum><header>In-kind
			 contributions</header><text display-inline="yes-display-inline">In order to
			 meet the requirement under paragraph (1), such organization may arrange for
			 in-kind contributions.</text>
				</paragraph></subsection><subsection id="H0008F79D699847E6A07D6F600DA770C9"><enum>(g)</enum><header>Limitation cost
			 to the veterans</header><text display-inline="yes-display-inline">A qualified
			 organization receiving a grant under the pilot program shall modify or
			 rehabilitate the primary residence of an eligible veteran at no cost to such
			 veteran (including application fees) or at a cost such that such veteran pays
			 no more than 30 percent of his or her income in housing costs during any month.</text>
			</subsection><subsection id="HD17C88C685FC40809CED047114B442E4"><enum>(h)</enum><header>Reports</header>
				<paragraph id="H56726EBF5712426A8C6C967D91F49DD8"><enum>(1)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">The Secretary shall
			 submit to Congress, on an annual basis, a report that provides, with respect to
			 the year for which such report is written—</text>
					<subparagraph id="H94DC63712C254EFAA45FD0FBCDCC8D3B"><enum>(A)</enum><text>the number of
			 eligible veterans provided assistance under the pilot program;</text>
					</subparagraph><subparagraph id="H7159A8C8A1BE4FD49E08A6E32A95C58B"><enum>(B)</enum><text>the socioeconomic
			 characteristics of such veterans, including their gender, age, race, and
			 ethnicity;</text>
					</subparagraph><subparagraph id="H5993A3403D7048D5B7AAFB0047EAB025"><enum>(C)</enum><text>the total number,
			 types, and locations of entities contracted under such program to administer
			 the grant funding;</text>
					</subparagraph><subparagraph id="H285C5B525ACF45D4BB3CFDE3590596AE"><enum>(D)</enum><text>the amount of
			 matching funds and in-kind contributions raised with each grant;</text>
					</subparagraph><subparagraph id="H84271BCCEFFF40D1AB6F846151E103F0"><enum>(E)</enum><text>a description of
			 the housing rehabilitation and modification services provided, costs saved, and
			 actions taken under such program;</text>
					</subparagraph><subparagraph id="H78E78E2FD0794348B849CB3211DCC5A3"><enum>(F)</enum><text>a description of
			 the outreach initiatives implemented by the Secretary to educate the general
			 public and eligible entities about such program;</text>
					</subparagraph><subparagraph id="HEEA0DB9FD07A4682B65CD6BA0EEBD3E5"><enum>(G)</enum><text>a description of
			 the outreach initiatives instituted by grant recipients to engage eligible
			 veterans and veteran service organizations in projects utilizing grant funds
			 under such program;</text>
					</subparagraph><subparagraph id="H1070FC72C4414544A592523A46DEB6FC"><enum>(H)</enum><text>a description of
			 the outreach initiatives instituted by grant recipients to identify eligible
			 veterans and their families; and</text>
					</subparagraph><subparagraph id="H2F412AC825894EB995498508FB949277"><enum>(I)</enum><text>any other
			 information that the Secretary considers relevant in assessing such
			 program.</text>
					</subparagraph></paragraph><paragraph id="HC988D48B6E2640AB9BE1137D707CE2A1"><enum>(2)</enum><header>Final
			 report</header><text>Not later than 6 months after the completion of the pilot
			 program, the Secretary shall submit to Congress a report that provides such
			 information that the Secretary considers relevant in assessing the pilot
			 program.</text>
				</paragraph></subsection><subsection id="H0069395974B648BF885DCC01614D3534"><enum>(i)</enum><header>Definitions</header><text>In
			 this section, the following definitions shall apply:</text>
				<paragraph id="H4C9BA6342F324A04BBEBA1C2DE104E57"><enum>(1)</enum><header>Disabled</header><text>The
			 term <quote>disabled</quote> means an individual with a disability, as defined
			 by <external-xref legal-doc="usc" parsable-cite="usc/42/12102">section
			 12102</external-xref> of title 42, United States Code.</text>
				</paragraph><paragraph id="HC0DD5C03FD1348C9A021B4E1F1985EDD"><enum>(2)</enum><header>Eligible
			 veteran</header><text display-inline="yes-display-inline">The term
			 <quote>eligible veteran</quote> means a disabled or low-income veteran.</text>
				</paragraph><paragraph id="HD538EEBE60DB4122879337662F8C228A"><enum>(3)</enum><header>Energy efficient
			 features or equipment</header><text>The term <quote>energy efficient features
			 or equipment</quote> means features of, or equipment in, a primary residence
			 that help reduce the amount of electricity used to heat, cool, or ventilate
			 such residence, including insulation, weatherstripping, air sealing, heating
			 system repairs, duct sealing, or other measures.</text>
				</paragraph><paragraph id="H114420F8C4F04850B24F400F934FF152"><enum>(4)</enum><header>Low-income
			 veteran</header><text display-inline="yes-display-inline">The term
			 <quote>low-income veteran</quote> means a veteran whose income does not exceed
			 80 percent of the median income for an area, as determined by the
			 Secretary.</text>
				</paragraph><paragraph id="HBE401491352441BAAF02F2CCE6FF577A"><enum>(5)</enum><header>Nonprofit
			 organization</header><text display-inline="yes-display-inline">The term
			 <quote>nonprofit organization</quote> means an organization that is—</text>
					<subparagraph id="H2517A5C6CBD5491A8B8A3707AA4FBDD7"><enum>(A)</enum><text>described in
			 section 501(c)(3) or 501(c)(19) of the Internal Revenue Code of 1986;
			 and</text>
					</subparagraph><subparagraph id="H4C3EF9BA8C4142DA985A84B664476865"><enum>(B)</enum><text>exempt from tax
			 under section 501(a) of such Code.</text>
					</subparagraph></paragraph><paragraph id="HE768CD74EEC14369BB0CBCCA633BB405"><enum>(6)</enum><header>Primary
			 residence</header>
					<subparagraph id="HB014BCA989E345628B2C7BB3F2BB046B"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <quote>primary residence</quote> means a single family house, a duplex, or a
			 unit within a multiple-dwelling structure that is an eligible veteran’s
			 principal dwelling and is owned by such veteran or a family member of such
			 veteran.</text>
					</subparagraph><subparagraph id="HD549710137714D53BE9535BE8D24E8BE"><enum>(B)</enum><header>Family member
			 defined</header><text>For purposes of this paragraph, the term <quote>family
			 member</quote> includes—</text>
						<clause id="HBF2C6450F40D43D0AE8A197C79D7F833"><enum>(i)</enum><text>a
			 spouse, child, grandchild, parent, or sibling;</text>
						</clause><clause id="H3C80FA4640B64F24AC735384C5CCDC76"><enum>(ii)</enum><text>a
			 spouse of such a child, grandchild, parent, or sibling; or</text>
						</clause><clause id="H0E7C62432B254BAE9CB33476087AEB4B"><enum>(iii)</enum><text>any individual
			 related by blood or affinity whose close association with a veteran is the
			 equivalent of a family relationship.</text>
						</clause></subparagraph></paragraph><paragraph id="HF288C22FD3EE4B6BB3FA152D6F8F49D6"><enum>(7)</enum><header>Qualified
			 organization</header><text display-inline="yes-display-inline">The term
			 <quote>qualified organization</quote> means a nonprofit organization that
			 provides nationwide or State-wide programs that primarily serve veterans or
			 low-income individuals.</text>
				</paragraph><paragraph id="HF44EF895A9AC49268BEFC4DC0C6FE76B"><enum>(8)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of Housing and Urban Development.</text>
				</paragraph><paragraph id="H9E1D877459F345499225E5D0A92166F3"><enum>(9)</enum><header>Veteran</header><text display-inline="yes-display-inline">The term <quote>veteran</quote> has the
			 same meaning as given such term in
			 <external-xref legal-doc="usc" parsable-cite="usc/38/101">section
