		  sentencing enhancements for certain identity theft offenses victimizing the

		<section id="H68F1ADD178C74F6C9D6BFD14A65DD431" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protect Seniors Against Identity Theft
			 and Fraud Act of 2012</short-title></quote>.</text>
		</section><section id="H67F77945C08D4547802A88DC80A46A27"><enum>2.</enum><header>Sentencing
			 enhancements for certain identity theft offenses victimizing the
			 elderly</header>
			<subsection id="H0B52D2C380524B49BC705CD209118009"><enum>(a)</enum><header>Fraud and
			 related activity in connection with identification documents, authentication
			 features, and information</header><text display-inline="yes-display-inline">Section 1028 of title 18, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD270E592B48949059F06088EE1A62801" style="USC">
					<subsection id="H9ECF82F321E2416383CC0C9A3A839517"><enum>(j)</enum><header>Enhancement for
				certain offenses</header><text display-inline="yes-display-inline">If the
				offense under subsection (a) results in harm to any person 65 years of age or
				older, the punishment under subsection (b) may be increased by an additional
				term of imprisonment of not more than 10
				years.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H38306F4C2B6B489883EBD1F5261662CD"><enum>(b)</enum><header>Fraud and
			 related activity in connection with access devices</header><text display-inline="yes-display-inline">Section
			 1029(c) of such title is amended by adding at the end the following:</text>

				older, the punishment under this subsection may be increased by an additional
				term of imprisonment of not more than 10
				years.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC6EE90095B1F4F81AFC662641D5B1526"><enum>(c)</enum><header>Fraud and
			 related activity in connection with computers</header><text display-inline="yes-display-inline">Section 1030(c) of such title is amended by
			 adding at the end the following:</text>

				older, the punishment under subsection (c) may be increased by an additional
				term of imprisonment of not more than 10
				years.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H549E5C256B3B4856AEFDDA473A8C4602"><enum>(d)</enum><header>Fraud and
			 related activity in connection with electronic mail</header><text display-inline="yes-display-inline">Section 1037 of such title is amended by
			 adding at the end the following:</text>

					<subsection id="H25F04B6FB86A4CAF9D4C8E872CD17375"><enum>(e)</enum><header>Enhancement for
				certain offenses</header><text display-inline="yes-display-inline">If the
				offense under subsection (a) results in harm to any person 65 years of age or
				older, the punishment under subsection (b) may be increased by an additional
				term of imprisonment of not more than 10
				years.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6F925B5EFFF14133984A579F060CED94"><enum>(e)</enum><header>Frauds and
			 swindles</header><text>Section 1341 of such title is amended by adding at the
			 end the following: <quote>If an offense under this section results in harm to
			 any person 65 years of age or older, the punishment for that offense may be
			 increased by an additional term of imprisonment of not more than 10
			 years.</quote>.</text>
			</subsection><subsection id="H14793017F26E44A5B0D2B6421EB9212B"><enum>(f)</enum><header>Fictitious name
			 or address</header><text display-inline="yes-display-inline">Section 1342 of
			 such title is amended by adding at the end the following: <quote>If an offense
			 under this section results in harm to any person 65 years of age or older, the
			 punishment for that offense may be increased by an additional term of
			 imprisonment of not more than 10 years.</quote>.</text>
			</subsection><subsection id="H2A96B7B85C134F69B8DC04F6D1F5ABE0"><enum>(g)</enum><header>Fraud by wire,
			 radio, or television</header><text display-inline="yes-display-inline">Section
			 1343 of such title is amended by adding at the end the following: <quote>If an
			 offense under this section results in harm to any person 65 years of age or
			 older, the punishment for that offense may be increased by an additional term
			 of imprisonment of not more than 10 years.</quote>.</text>
			</subsection><subsection id="HF29E43C105CD4F9EB46257E1761B771E"><enum>(h)</enum><header>Bank
			 fraud</header><text>Section 1344 of such title is amended by adding at the end
			 the following: <quote>If an offense under this section results in harm to any
			 person 65 years of age or older, the punishment for that offense may be
			 increased by an additional term of imprisonment of not more than 10
			 years.</quote>.</text>
			</subsection><subsection id="H6895300C6BB54239BFDC628B8E8C8044"><enum>(i)</enum><header>Health care
			 fraud</header><text display-inline="yes-display-inline">Section 1347 of such
			 title is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDD2E71DDB713453C9FA265E00FC92B01" style="USC">
					<subsection id="HB8760B8EFA9143938ABF96AD3BC17A58"><enum>(c)</enum><header>Enhancement for
				certain offenses</header><text display-inline="yes-display-inline">If the
				offense under subsection (a) results in harm to any person 65 years of age or
				older, the punishment under that subsection may be increased by an additional
				term of imprisonment of not more than 10
				years.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H23A74EFF182649DCA8389DD0684D9D3C"><enum>3.</enum><header>Limitation on
			 consumer liability for unauthorized transfers</header><text display-inline="no-display-inline">Section 909(a) of the Electronic Fund
			 Transfer Act (15 U.S.C. 1693g(a)) is amended in the matter preceding paragraph
			 (2)—</text>
			<paragraph id="H4F65283820854E8FB80B5F8176C8E83C"><enum>(1)</enum><text>by striking
			 <quote>In addition, reimbursement need not be made to the consumer</quote> and
			 inserting <quote>In addition, except as otherwise provided in this section,
			 reimbursement need not be made to the consumer</quote>; and</text>
			</paragraph><paragraph id="H90D81008ACE54B0690FCEC9784133F18"><enum>(2)</enum><text>by adding at the
			 end the following: <quote>If the consumer is 65 years of age or older, the
			 consumer’s liability shall be no more than $50 if the consumer notifies the
			 financial institution within 7 business days or no more than $250 if the
			 consumer notifies the financial institution within 8 to 60
			 days.</quote>.</text>
