		<section id="H1FA63F142BE74E9F847879F1CC71E489" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>STEM Education Opportunity
			 Act</short-title></quote>.</text>
		</section><section id="H2B388442073B47D88DED7A7B3C0659EF"><enum>2.</enum><header>STEM qualified
			 higher education expenses</header>
			<subsection id="H014EF906DC364B519333082E147E9CBF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part VII of
			 subchapter B of chapter 1 of the Internal Revenue Code of 1986 is amended by
			 inserting after section 222 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H82E93C77E1134709AE88841E36B2CBCA" style="OLC">
					<section id="HF61098303B0E497D88AA39045DC2A19A"><enum>222A.</enum><header>STEM qualified
				higher education expenses</header>
						<subsection id="H85F3675C52B749F4BA30AAEBB6B6E75E"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				individual, there shall be allowed as a deduction an amount equal to the STEM
				higher education expenses paid by the taxpayer during the taxable year.</text>
						</subsection><subsection id="H92120C54086744AB90674DCF7119F996"><enum>(b)</enum><header>STEM higher
				education expenses</header><text display-inline="yes-display-inline">For
				purposes of this section, the term <term>STEM higher education expense</term>
				means any expense of a type which is taken into account in determining the cost
				of attendance (as defined in section 472 of the Higher Education Act of 1965
				(20 U.S.C. 1087ll)) at an eligible educational institution with respect to the
				attendance of an individual—</text>
							<paragraph id="HD7EA5DAC315C4F9F967DED29912994DF"><enum>(1)</enum><text>at such
				institution for the academic period for which the deduction under this section
				is being determined,</text>
							</paragraph><paragraph id="H6EE31C1522B4423090619E6CEA307E9C"><enum>(2)</enum><text display-inline="yes-display-inline">majoring in a course of study at such
				institution leading to an associate degree or higher in—</text>
								<subparagraph id="H26F4ED083160411D88559602658D2A78"><enum>(A)</enum><text>science,
				technology, engineering, or mathematics (within the meaning of section
				131(g)(4) of the Higher Education Act of 1965 (20 U.S.C. 1015(g)(4)), or</text>
								</subparagraph><subparagraph id="HF3F3C39EA86143A99B07FDEB5F87191B"><enum>(B)</enum><text>education with a
				focus on any area described in subparagraph (A), and</text>
								</subparagraph></paragraph><paragraph id="H17EAECEB035D4FA6ADAFBB539FE1344D"><enum>(3)</enum><text display-inline="yes-display-inline">who at all times during such period is
				making satisfactory academic progress (as defined in section 668.34 of title
				34, Code of Federal Regulations, or any successor regulation) in the pursuit of
				such degree.</text>
							</paragraph></subsection><subsection id="HF5281CF9D4464B3BAF70858F035428D6"><enum>(c)</enum><header>Definition and
				special rules</header><text display-inline="yes-display-inline">For purposes of
				this section—</text>
							<paragraph id="H6C69C716DE09457E8368A69B171C172E"><enum>(1)</enum><header>Eligible
				educational institution</header><text>The term <term>eligible educational
				institution</term> has the meaning given the term <term>institution of higher
				education</term> in section 102 of the Higher Education Act of 1965 (20 U.S.C.
				1002).</text>
							</paragraph><paragraph id="HD3AC25698A204F17906EBFFA73970D39"><enum>(2)</enum><header>Room and board
				included for students who are at least half-time</header><text>Subsection (a)
				shall not apply to any costs of an individual for room and board while
				attending an eligible educational institution, unless such individual is an
				eligible individual (as defined in section 25A(b)(3)).</text>
							</paragraph><paragraph id="H38C2F309AC534565AF64754E9F1A61D6"><enum>(3)</enum><header>Carryforward of
				unused deduction</header><text>If for any taxable year the deduction allowable
				under subsection (a) exceeds the taxpayer’s taxable income (determined without
				regard to this section), the amount of STEM higher education expenses of the
				taxpayer attributable to such excess shall be treated as STEM higher education
				expenses paid by the taxpayer in the succeeding taxable year.</text>
							</paragraph><paragraph id="H35FD8F3FACAB474CB6095D2F2E62BDAE"><enum>(4)</enum><header>Identification
				requirement</header><text>No deduction shall be allowed under subsection (a) to
				a taxpayer with respect to STEM higher education expenses of an individual
				unless the taxpayer includes the name and taxpayer identification number of the
				individual on the return of tax for the taxable year.</text>
							</paragraph><paragraph id="HCD944BEC820D496F89507E13FC41CA5B"><enum>(5)</enum><header>Certain
				prepayments allowed</header><text>If STEM higher education expenses are paid by
				the taxpayer during a taxable year for an academic period which begins during
				the first 3 months following such taxable year, such academic period shall be
				treated for purposes of this section as beginning during such taxable
				year.</text>
							</paragraph><paragraph id="H2FE0172FC805407AB99F5AFDA421B73F"><enum>(6)</enum><header>Coordination
				with other education incentives</header>
								<subparagraph id="HB2B53320A4414CBBB73AA6877476C207"><enum>(A)</enum><header>Denial of
				deduction if other credit elected</header><text display-inline="yes-display-inline">No deduction shall be allowed under
				subsection (a) for any taxable year with respect to the STEM higher education
				expenses with respect to an individual if the taxpayer or any other person
				elects to have section 25A apply with respect to such individual for such year
				or if a credit is allowed under section 36D with respect to such individual for
				such taxable year.</text>
								</subparagraph><subparagraph id="HAF4F2D547AAD4DB7AC11146EBDD1B726"><enum>(B)</enum><header>Coordination
				with exclusions</header><text>The total amount of STEM higher education
				expenses shall be reduced by the amount of such expenses taken into account in
				determining any amount excluded under section 135, 529(c), or 530(d)(2). For
				purposes of the preceding sentence, the amount taken into account in
				determining the amount excluded under section 529(c)(1) shall not include that
				portion of the distribution which represents a return of any contributions to
				the plan.</text>
								</subparagraph></paragraph><paragraph id="HD44DFAF2742F486DA77B36A9A61D6299"><enum>(7)</enum><header>Adjustment for
				certain scholarships</header><text>Rules similar to the rules of 25A(g)(2)
				shall apply for purposes of this section.</text>
							</paragraph><paragraph id="H8DA4AEC500664C91AFBF19171254473F"><enum>(8)</enum><header>Dependents</header><text>No
				deduction shall be allowed under subsection (a) to any individual with respect
				to whom a deduction under section 151 is allowable to another taxpayer for a
				taxable year beginning in the calendar year in which such individual’s taxable
				year begins.</text>
							</paragraph><paragraph id="HF3246E7339BC4832BE938EE26D82A40D"><enum>(9)</enum><header>Nonresident
				aliens</header><text>If the taxpayer is a nonresident alien individual for any
				portion of the taxable year, this section shall only apply if such individual
				is treated as a resident alien of the United States for purposes of this
				chapter by reason of an election under subsection (g) or (h) of section
				6013.</text>
							</paragraph></subsection><subsection id="H07C260159D5C4A2A8C68EE8E3FB50F28"><enum>(d)</enum><header>Termination</header><text display-inline="yes-display-inline">This section shall not apply to taxable
				years beginning more than 10 years after the date of the enactment of the STEM
				Education Opportunity
				Act.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDC935A31843442A2B996375F0372C46C"><enum>(b)</enum><header>Deduction
			 allowed whether or not taxpayer itemizes other
			 deductions</header><text>Subsection (a) of section 62 of such Code is amended
			 by inserting after paragraph (21) the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HDD7DCDFF32DB4CD19C63966F897807AE" style="OLC">
					<paragraph id="H24E161C554044E228142F0F2CB8269E5"><enum>(22)</enum><header>STEM qualified
				higher education expenses</header><text display-inline="yes-display-inline">The
				deduction allowed by section
				222A.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4552E42A4C224E4F9A53A2AEDC1324AA"><enum>(c)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for part VII of subchapter B of chapter 1 of such Code is amended by
			 inserting after the item relating to section 222 the following new item:</text>

						<toc-entry level="section">Sec. 222A. STEM qualified higher education
				expenses.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC6C6AAF9F70440279D7FED4E4B7508E0"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to payments
			 made in taxable years beginning after the date of the enactment of this
			 Act.</text>
			</subsection></section><section id="H2879B518A0234BF99232FC9D4EEC26ED"><enum>3.</enum><header>Credits for
			 certain contributions benefitting science, technology, engineering, and
			 mathematics education at the elementary and secondary school level</header>
			<subsection id="HE54642C815A84EB0BFBE3C8C24A2D94B"><enum>(a)</enum><header>In
			 general</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to business related credits) is amended
			 by adding at the end the following new section:</text>
				<quoted-block id="HC4FFE3EEA68E4CF6A752FE7EC9058697" style="OLC">
					<section id="HB6D6CAA1DE1D41ABA8E58572574CE879"><enum>45S.</enum><header>Contributions
				benefitting science, technology, engineering, and mathematics education at the
				elementary and secondary school level</header>
						<subsection id="H0F80F367DB33410DA81FD742335EB718"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of
				section 38, the elementary and secondary school STEM contributions credit
				determined under this section for the taxable year is an amount equal to the
				qualified STEM contributions made by the taxpayer during the taxable year to
				one or more elementary or secondary schools.</text>
						</subsection><subsection id="H8D027DE6D9CF44E1BC0C2FC3C4AA75C8"><enum>(b)</enum><header>Maximum
				credit</header>
							<paragraph id="H79F52A4B3B7D4E3F8D02EBE26CC1996F"><enum>(1)</enum><header>Per
				taxpayer</header><text display-inline="yes-display-inline">The amount of
				qualified STEM contributions made to any school which may be taken into account
				under this section by the taxpayer for the taxable year shall not exceed the
				portion of the limitation under paragraph (2) which is allocated by such school
				to the taxpayer for such year.</text>
							</paragraph><paragraph id="HB401B9470B2E41B98249E45FDC78171E"><enum>(2)</enum><header>Per
				school</header><text>The amount of qualified STEM contributions made to any
				school which may be allocated under this section by the school to all taxpayers
				for all taxable years shall not exceed $100,000.</text>
							</paragraph></subsection><subsection id="H990F33CAFA234CFC85BE47426B82B788"><enum>(c)</enum><header>Qualified STEM
				contributions</header><text>For purposes of this section—</text>
							<paragraph id="HB64484F9DB2C4C3DAE62C01C3BE23063"><enum>(1)</enum><header>In
				general</header><text>The term <term>qualified STEM contributions</term>
				means—</text>
								<subparagraph id="HF890556C119141ADB571746623E45C9B"><enum>(A)</enum><text>STEM property
				contributions,</text>
								</subparagraph><subparagraph id="H72C386564C93468A80D8E2180A7C16A1"><enum>(B)</enum><text>STEM service
				contributions, and</text>
								</subparagraph><subparagraph id="HD027CDEF9AA9416DB4DCCB3190F3358D"><enum>(C)</enum><text>STEM student and
				educator training contributions.</text>
								</subparagraph></paragraph><paragraph id="HA6A1F972E225459DB19143A5AE2ACE13"><enum>(2)</enum><header>STEM property
				contributions</header>
								<subparagraph id="H70621A11F4C74802B0C9571A98C14D03"><enum>(A)</enum><header>In
				general</header><text>The term <term>STEM property contribution</term> means
				the amount which would (but for subsection (d)) be allowed as a deduction under
				section 170 for a charitable contribution of STEM property if—</text>
									<clause id="HD37E03B7684440EBBA63CBC710A187FA"><enum>(i)</enum><text>the donee is an
				elementary or secondary school,</text>
									</clause><clause id="HBC746C1182574B6C9B28C8BF46D7C494"><enum>(ii)</enum><text display-inline="yes-display-inline">substantially all of the use of the
				property by the donee is within the United States for STEM education in any of
				the grades K–12 for use during the school day or in after-school
				programs,</text>
									</clause><clause id="HCE9B4DB0E89345198A8BDDF9230F3924"><enum>(iii)</enum><text>the original use
				of the property begins with the donee,</text>
									</clause><clause id="HA7377F070BBF4B768AD6ADAFDF11BA34"><enum>(iv)</enum><text>the property will
				fit productively into the donee’s education plan,</text>
									</clause><clause id="H2C1B2E448FE147EC917713504C055186"><enum>(v)</enum><text>the property is
				not transferred by the donee in exchange for money, other property, or
				services, except for shipping, installation and transfer costs, and</text>
									</clause><clause id="H435C79B1B3C64909824731829215252D"><enum>(vi)</enum><text>the donee’s use
				and disposition of the property will be in accordance with the provisions of
				clauses (ii) through (v).</text>
									</clause></subparagraph><subparagraph id="H03B8333D28EA443DA9AB73981A2E2CC0"><enum>(B)</enum><header>STEM
				property</header><text>The term <term>STEM property</term> means—</text>
									<clause id="H5C1607A7CCF44305A305BE799D993918"><enum>(i)</enum><text display-inline="yes-display-inline">computer equipment and software,</text>
									</clause><clause id="HA30CFC79A5C84D30987662465540D8DF"><enum>(ii)</enum><text>microscopes,</text>
									</clause><clause id="H8F9CCA263FF04F1B9317D12ABEB79BE2"><enum>(iii)</enum><text>lab equipment,
				including glassware, digital scales, and temperature measuring devices,</text>
									</clause><clause id="H8972A9BB297B4A45A578194E678372CF"><enum>(iv)</enum><text>property used to
				maintain, renovate, or improve laboratory facilities,</text>
									</clause><clause id="H470EBABE90F449F6989E824AAD248013"><enum>(v)</enum><text display-inline="yes-display-inline">STEM education curricula, and</text>
									</clause><clause id="HC6AF189A9B0B45A3A47561A77FBCF7DC"><enum>(vi)</enum><text>whiteboards,
				smartboards, cameras, and other relevant STEM education materials.</text>
									</clause></subparagraph></paragraph><paragraph id="H0DEFC4B1A65D4D59B54378EEC92885E1"><enum>(3)</enum><header>STEM service
				contributions</header>
								<subparagraph id="HD9091939CC854F02B5229C3578E9C4EE"><enum>(A)</enum><header>In
				general</header><text>The term <term>STEM service contributions</term> means
				the amount paid or incurred during the taxable year to provide STEM services in
				the United States for the exclusive benefit of students at an elementary or
				secondary school but only if no charge is imposed for providing such
				services.</text>
								</subparagraph><subparagraph id="H7ED51672F61742BFAB8B53C23171CBA0"><enum>(B)</enum><header>STEM
				services</header><text display-inline="yes-display-inline">The term <quote>STEM
				services</quote> means—</text>
									<clause id="H6D2E5692845F44A3B2F8443D2D5289AD"><enum>(i)</enum><text display-inline="yes-display-inline">providing students the opportunity to
				engage in hands-on technical equipment training in a STEM education field,
				and</text>
									</clause><clause id="HCB2F40C5B20D4C10BB878C9A3EE01573"><enum>(ii)</enum><text display-inline="yes-display-inline">bringing experts in a STEM education field
				into the classroom or after school programs for demonstrations, talks, or
				mentoring exercises.</text>
									</clause></subparagraph></paragraph><paragraph id="HD7FF5792ADEC4D9FB672C45708298C94"><enum>(4)</enum><header>STEM student and
				educator training contributions</header>
								<subparagraph id="H39C5E6A8A7C44BC8A5F778F393D513DB"><enum>(A)</enum><header>In
				general</header><text>The term <term>STEM student and educator training
				contributions</term> means the amount paid or incurred during the taxable year
				to provide STEM student and educator training services in the United States for
				the exclusive benefit of students at an elementary or secondary school but only
				if no charge is imposed for providing such services.</text>
								</subparagraph><subparagraph id="HDA8F64CB95674E1AAC306B93571C9C0F"><enum>(B)</enum><header>STEM student and
				educator training services</header><text>The term <term>STEM student and
				educator training services</term> means—</text>
									<clause id="H5BBABA2414BD4648A0D678A6FD93F084"><enum>(i)</enum><text display-inline="yes-display-inline">on-site technical equipment training in a
				STEM education field,</text>
									</clause><clause id="H2B231814C3D74784816146516EBA3D33"><enum>(ii)</enum><text>field trips to
				research or related facilities in a STEM education field,</text>
									</clause><clause id="H69EF2B3ACDE64FFFBF30AC601DD1FBE6"><enum>(iii)</enum><text>student
				internships or long term on-site training in a STEM education field, and</text>
									</clause><clause id="H43218DB072D24AF090F2EF72A1793761"><enum>(iv)</enum><text>educator training
				exercises in a STEM education field.</text>
									</clause></subparagraph></paragraph><paragraph id="H19966B339F614AD9863D6AAB874BFC49"><enum>(5)</enum><header>STEM
				education</header><text display-inline="yes-display-inline">The term <term>STEM
				education</term> means education in the biological sciences, mathematics, earth
				and physical sciences, computer and information science, engineering,
				geosciences, and social and behavioral sciences.</text>
							</paragraph><paragraph id="H0EB1B36551664C338902A92FE5952BBC"><enum>(6)</enum><header>Elementary or
				secondary school</header>
								<subparagraph id="H111F1902FE3F4A67B37E361F1A4A7CD4"><enum>(A)</enum><header>In
				general</header><text>The term <term>elementary or secondary school</term>
				means any school which provides elementary education or secondary education
				(kindergarten through grade 12), as determined under State law.</text>
								</subparagraph><subparagraph id="H73D137BE60054B828DE81DE4210D8D9B"><enum>(B)</enum><header>Groupings of
				schools</header><text>Such term includes consortia or other groupings of such
				schools if all such schools in the consortia or grouping are located within the
				same State.</text>
								</subparagraph></paragraph></subsection><subsection id="H7FEBBB8AF47C4DCDADC058AC98A53252"><enum>(d)</enum><header>Denial of double
				benefit</header><text>No deduction shall be allowed under this chapter for any
				amount allowed as a credit under this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4ABD6B213E774D01AE829199E186F150"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HEF717F31C5084C3FADE043E030A12EEB"><enum>(1)</enum><text>Section 38(b) of
			 such Code is amended by striking <quote>plus</quote> at the end of paragraph
			 (35), by striking the period at the end of paragraph (36), and inserting
			 <quote>, plus</quote>, and by adding at the end the following new
			 paragraph:</text>
					<quoted-block id="H46627C334E9E4025AE1D7532F5D6FBE8" style="OLC">
						<paragraph id="HD8D5FBBE3BA140FFA6EB279BF28B8E5C"><enum>(37)</enum><text>the elementary
				and secondary school STEM contributions credit determined under section
				45S.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H9E8FBF22679C49938874E7EC29114650"><enum>(2)</enum><text>The table of
			 sections for subpart D of part IV of subchapter A of chapter 1 of such Code is
			 amended by adding at the end the following new item:</text>

							<toc-entry level="section">Sec. 45S. Contributions benefitting
				science, technology, engineering, and mathematics education at the elementary
				and secondary school

						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H619364B3FDD14F51A7EF554FA8703799"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
			</subsection></section><section id="H829EB36602984D6EAED762BFBF5F5A85"><enum>4.</enum><header>GAO
			 Study</header><text display-inline="no-display-inline">Not later than 5 years
			 after the date of the enactment of this Act, the Government Accountability
			 Office, in consultation with the Secretary of the Treasury, shall submit to
			 Congress a report detailing—</text>
			<paragraph id="H9E18629303B24FA7B868B244E041D04E"><enum>(1)</enum><text>the efficacy of
			 the STEM Education Opportunity Act in increasing higher education enrollment in
			 the fields of math, science, engineering, and technology, and</text>
			</paragraph><paragraph id="H2BB54A61BE63401698091AFE349C37AE"><enum>(2)</enum><text>any effect such
			 Act has had on the price of higher education tuition in such fields.</text>
			</paragraph></section></legis-body>
