		<official-title>To amend the Patient Protection and Affordable Care Act
		  so as to eliminate the authority of the Secretary of Health and Human Services
		  to limit the ability of medical providers to conduct lawful business, and for
		  other purposes.</official-title>

		<section id="H5691AF86B65C4AEBA3616D566B330F41" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safeguarding Care Of Patients
			 Everywhere Act</short-title></quote> or the <quote><short-title>SCOPE Act</short-title></quote>.</text>
		</section><section id="H25A076C3F9904770A2AC2E98D406733C"><enum>2.</enum><header>Findings and
			 Purpose</header>
			<subsection id="HDE4B4E957060460591807AB92808E389"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
				<paragraph id="H9990C3B0DC834EF8A38B50E998F7DE3E"><enum>(1)</enum><text>The practice of
			 medicine is guided by a set of principles contained in the Hippocratic oath,
			 which in part directs medical practitioners to “remember that I do not treat a
			 fever chart, a cancerous growth, but a sick human being”.</text>
				</paragraph><paragraph id="H6A4619D5FDA740118943B0C17994896D"><enum>(2)</enum><text>Historically, the
			 practice of medicine has been principally governed by the laws of each of the
			 50 States, not the Federal Government.</text>
				</paragraph><paragraph id="H702F51D592A045459EB49BC3C023416E"><enum>(3)</enum><text>State medical
			 licensing and disciplinary boards administer medical practice laws and have the
			 principal responsibility to protect the public from improper and unlawful
			 medical practices.</text>
				</paragraph><paragraph id="H6B32C06289BA4B25A542B1398F19C5B4"><enum>(4)</enum><text>Such boards define
			 activities that constitute the legitimate practice of medicine.</text>
				</paragraph><paragraph id="H25829BF4E5EA4412BE93BB4BDB49662F"><enum>(5)</enum><text display-inline="yes-display-inline">The actions of the Secretary of Health and
			 Human Services are not governed by the Hippocratic oath or a medical board of
			 any of the 50 States.</text>
				</paragraph><paragraph id="HA365546857EF43598E8D9F968D1C84BC"><enum>(6)</enum><text>The actions of the
			 Secretary are not determined solely by the needs of patients.</text>
				</paragraph><paragraph id="HF5958C6F080D434092ED6113DF99C371"><enum>(7)</enum><text display-inline="yes-display-inline">Individual and institutional financial
			 interests can influence the discretion and actions of the Secretary.</text>
				</paragraph><paragraph id="H54003ECDBDF54AB491D5E2E51EAF63D0"><enum>(8)</enum><text display-inline="yes-display-inline">The Patient Protection and Affordable Care
			 Act, in subsection (h) of section 1311 (42 U.S.C. 18031), grants the Secretary
			 the authority to—</text>
					<subparagraph id="HA0F8936A92EE4BD5BAE2EF0E2912F5E5"><enum>(A)</enum><text>make findings
			 regarding the quality of medical care and the activities that constitute the
			 legitimate practice of medicine; and</text>
					</subparagraph><subparagraph id="H149F0392EB3842C18E610BDF2D24748C"><enum>(B)</enum><text display-inline="yes-display-inline">on the basis of these findings, terminate
			 or limit the ability of medical providers to conduct lawful business, thus
			 restricting the practice of medicine by curtailing economic activity.</text>
					</subparagraph></paragraph></subsection><subsection id="H96C2C43943B0451CA8CE382635CFD65B"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to remove from
			 the Secretary such improper authority, which presents a threat to the health
			 and welfare of patients in the United States.</text>
			</subsection></section><section id="HBFC82B1A75794447A4B2DD135FA57ED4"><enum>3.</enum><header>Repeal of
			 restrictions on the professional practice of physicians and other health care
			 providers entering into contracts with health plans</header><text display-inline="no-display-inline">Section 1311 of the Patient Protection and
			 Affordable Care Act (42 U.S.C. 18031) is amended by striking subsection (h),
			 relating to the authority of the Secretary of Health and Human Services to
			 regulate contracts between qualified health plans and health care providers
			 based on findings of health care quality.</text>
