		<official-title>To amend the Omnibus Crime Control and Safe Streets Act
		  of 1968 to prohibit funding under the Edward Byrne Memorial Justice Assistance
		  grant program and the Public Safety and Community Policing grant program to be
		  provided to law enforcement agencies that use license plate readers unless
		  certain conditions are met.</official-title>

		<section id="H92EE074644B84CAAA19C2939D772A4AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Reasonable Policies on Automated
			 License Plate Readers Act</short-title></quote>.</text>
		</section><section id="HE358F25C4C25475B84EC91567B85F217"><enum>2.</enum><header>Funding under
			 Edward Byrne Memorial Justice Assistance grant program and Public Safety and
			 Community Policing grant program prohibited for use by law enforcement agencies
			 that use license plate readers unless certain conditions met</header>
			<subsection id="HCBB02C3102AC4AC98D244F87E21944CD"><enum>(a)</enum><header>Restriction
			 under Edward Byrne Memorial Justice Assistance Grant Program</header><text display-inline="yes-display-inline">Section 501(d) of the Omnibus Crime Control
			 and Safe Streets Act of 1968 is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HA108CDC2EA8448E4800F48796750B952" style="OLC">
					<paragraph id="H5D1EFB523A784A35A85ABF1356981AD0"><enum>(3)</enum><text display-inline="yes-display-inline">Any funds or other assistance to a law
				enforcement agency that uses an automated license plate reader, unless such law
				enforcement agency has developed written and binding policies for the use of
				the reader that ensure data collected by the reader—</text>
						<subparagraph id="H29EF572A28474A1C974886DFCE1929B9"><enum>(A)</enum><text>is not stored for
				a period exceeding 30 days unless the data is being used in an active law
				enforcement investigation;</text>
						</subparagraph><subparagraph id="H1BADA6E9DC9D4B9085D4F0CF69F3A0A9"><enum>(B)</enum><text>is not stored in a
				statewide database or other database that consolidates data from such readers;
				and</text>
						</subparagraph><subparagraph id="HACC2474AE3974B2A85202835CE65F327"><enum>(C)</enum><text>is shared with an
				entity other than the law enforcement agency that operates the reader only
				if—</text>
							<clause id="H1D39ED3D23874DD691C75AFE7DDE67D9"><enum>(i)</enum><text>the entity is
				another law enforcement agency;</text>
							</clause><clause id="H7541FA6E75C14AC69429E74454948D99"><enum>(ii)</enum><text>the data is to be
				used in an active law enforcement investigation; and</text>
							</clause><clause id="H6465E504FC694562BEF79C7725D654A1"><enum>(iii)</enum><text>the data is
				provided in response to a specific request for the
				data.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3054F24C533747F29D449C84818B1B47"><enum>(b)</enum><header>Restriction
			 under Public Safety and Community Policing grant program</header><text>Section
			 1701 of the Omnibus Crime Control and Safe Streets Act of 1968 is
			 amended—</text>
				<paragraph id="H2E082F0B05754EDD81BEC72878A1345C"><enum>(1)</enum><text>in subsection (b),
			 by striking <quote>The purposes</quote> and inserting <quote>Subject to
			 subsection (l), the purposes</quote>; and</text>
				</paragraph><paragraph id="H592CB8AD265E4C03B6CB13CECF7AA46C"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H20637D9EA2B34BFA884D645BC8509C1B" style="OLC">
						<subsection id="H9FA616C234844DC7BCA196D21DB3473E"><enum>(l)</enum><header>Prohibited
				use</header><text display-inline="yes-display-inline">Notwithstanding any other
				provision of this Act, no funds provided under this part may be provided to or
				used, directly or indirectly, by a law enforcement agency that uses an
				automated license plate reader, unless such law enforcement agency has
				developed written and binding policies for the use of the reader that ensure
				data collected by the reader—</text>
							<paragraph id="HC6E64C799A78493C91A1C78271360B56"><enum>(1)</enum><text>is not stored for
				a period exceeding 30 days unless the data is being used in an active law
				enforcement investigation;</text>
							</paragraph><paragraph id="HA9427813028D44DB85CBCDFA987A6DAC"><enum>(2)</enum><text>is not stored in a
				statewide database or other database that consolidates data from such readers;
				and</text>
							</paragraph><paragraph id="HFEC6C7B334D24817B542101B89C25377"><enum>(3)</enum><text>is shared with an
				entity other than the law enforcement agency that operates the reader only
				if—</text>
								<subparagraph id="H194937FA22E8470AA2BBD7BE8EF608BB"><enum>(A)</enum><text>the entity is
				another law enforcement agency;</text>
								</subparagraph><subparagraph id="H6CED83DD8B5D465F9F7BA972F19F848D"><enum>(B)</enum><text>the data is to be
				used in an active law enforcement investigation; and</text>
								</subparagraph><subparagraph id="H2366513DE35D45CB9B140C12946C8E6F"><enum>(C)</enum><text>the data is
				provided in response to a specific request for the
				data.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H2F34251D6195479BA15B426601C0D8E5"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to funds provided for grant periods beginning on or after the date that is 90
			 days after the date of the enactment of this Act.</text>
