		<section id="H060AE70F5EF944619DF43CF94C66FB09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Reducing Barriers to Veterans’
			 Benefits Act</short-title></quote>.</text>
		</section><section id="H5A3EAB9FEC824DB5A044E4D6A05F930F" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H8B818CBE759D41E7A3B9E6E8D5857340"><enum>(1)</enum><text display-inline="yes-display-inline">Tinnitus is the most common
			 service-connected disability for veterans from all periods of service,
			 accounting for almost 841,000 individuals.</text>
			</paragraph><paragraph id="H60DFA6EEFDC34905A56045DC2A1EEB70"><enum>(2)</enum><text display-inline="yes-display-inline">Hearing loss is the second leading
			 service-connected disability for veterans from all periods of service,
			 accounting for almost 702,000 individuals.</text>
			</paragraph><paragraph id="H005278E4163E4EDA953423C3E9820DD6"><enum>(3)</enum><text display-inline="yes-display-inline">Since fiscal year 1999, the number of
			 veterans with service-connected disability for tinnitus has increased by an
			 average rate of 17 percent each year.</text>
			</paragraph><paragraph id="HC429CCB5014E49EB97BAFF7AD6E3E678"><enum>(4)</enum><text display-inline="yes-display-inline">The number of tinnitus disabilities has
			 grown from 128,600 in fiscal year 1999 to 840,900 in fiscal year 2011, an
			 increase of more than 500 percent.</text>
			</paragraph></section><section id="HDCF266E17D6F467482CB7084FE8D1EF6"><enum>3.</enum><header>Presumption of
			 service-connection for hearing loss and tinnitus</header>
			<subsection id="H61540461E2D14A25832D10763A235FC2"><enum>(a)</enum><header>Presumption</header>
				<paragraph display-inline="no-display-inline" id="HA9118E83286B43CA9916421325671050"><enum>(1)</enum><header>In
			 general</header><text>Subchapter II of chapter 11 of title 38, United States
			 Code, is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="HB69BEBA7D2554C1AA6F0068D6E136C19" style="USC">
						<section id="H7F04B6E1DBE146F29CC1962BB4483EFF"><enum>1119.</enum><header>Presumption of
				service connection for hearing loss associated with particular military
				occupational specialties or combat service</header>
							<subsection display-inline="no-display-inline" id="H01666D87AFC64A2E95C0E86337FAE3A5"><enum>(a)</enum><header>In
				general</header><paragraph commented="no" display-inline="yes-display-inline" id="H05DC7F8E66EB416891FEA0D6B86F92B1"><enum>(1)</enum><text>For purposes of section
				1110 of this title, and subject to section 1113 of this title, diagnosed
				hearing loss, tinnitus, or both of a veteran described in paragraph (2) shall
				be considered to have been incurred in or aggravated by the service of the
				veteran, notwithstanding that there is no record of evidence of such hearing
				loss or tinnitus, as the case may be, during the period of such service.</text>
								</paragraph><paragraph id="H6866254B2EB64E88A97545479AF2126B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A
				veteran described in this paragraph is a veteran who while on active military,
				naval, or air service—</text>
									<subparagraph id="HCCF97B86EF084B8DA9880F4FD94FF9AD"><enum>(A)</enum><text>was assigned to a military
				occupational specialty or equivalent described in subsection (b); or</text>
									</subparagraph><subparagraph id="H64690A516C044B88B02679C6727495E4"><enum>(B)</enum><text>served in combat against a hostile
				force during a period of hostilities (as defined in section 1712A(a)(2)(B) of
				this title).</text>
									</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H690BF7660E224F208E52FCD7EDE38DB4"><enum>(b)</enum><header>Military
				occupational specialty</header><text>A military occupational specialty or
				equivalent referred to in subsection (a)(2)(A) is a military occupational
				specialty or equivalent, if any, that the Secretary determines in regulations
				prescribed under this section in which individuals assigned to such military
				occupational specialty or equivalent in the active military, naval, or air
				service are or were likely to be exposed to a sufficiently high level of
				acoustic trauma as to result in permanent hearing loss, tinnitus, or
				both.</text>
							</subsection><subsection id="HB0244FC402314482B055839B451D467D"><enum>(c)</enum><header>Determination</header><paragraph commented="no" display-inline="yes-display-inline" id="H5396EFC13C4B487682B42F9033FFBDD6"><enum>(1)</enum><text display-inline="yes-display-inline">If the Secretary determines under
				subsection (b) that a presumption of service connection is warranted for a
				military occupational specialty or equivalent, the Secretary shall, not later
				than 60 days after the date of the determination, issue proposed regulations
				setting forth the Secretary’s determination.</text>
								</paragraph><paragraph id="HCD2F6C159E5D4B9484758E3957FDA845" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary determines under
				subsection (b) that a presumption of service connection is not warranted for a
				military occupational specialty or equivalent, the Secretary shall, not later
				than 60 days after the date of the determination—</text>
									<subparagraph id="H6BE63471CBC44AB7900ACFBB5178AB5E"><enum>(A)</enum><text>publish the determination in the
				Federal Register; and</text>
									</subparagraph><subparagraph id="HBD6AE12001AA4F1A97EB2F819BE4F244"><enum>(B)</enum><text>submit to the Committees on Veterans’
				Affairs of the Senate and the House of Representatives a report on the
				determination, including a justification for the
				determination.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H2C925DCE971642B7A997A07DAAB14BF8"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 11 of
			 such title is amended by inserting after the item relating to section 1118 the
			 following new item:</text>

						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8BCFFF0F28D242A6B6E9952AA2EA868A"><enum>(b)</enum><header>Presumption
			 rebuttable</header><text>Section 1113 of title 38, United States Code, is
			 amended by striking <quote>or 1118</quote> each place it appears and inserting
			 <quote>1118, or 1119</quote>.</text>
			</subsection><subsection id="HFC9987C9137448EC89F69E6620BBA2B3"><enum>(c)</enum><header>Presumption
			 during peacetime service</header><text>Section 1137 of title 38, United States
			 Code, is amended by striking <quote>and 1113</quote> and inserting <quote>1113,
			 and 1119</quote>.</text>
			</subsection><subsection id="H2D023205475E405B9A09298D0EF14718"><enum>(d)</enum><header>Effective
			 date</header><text>Section 1119 of title 38, United States Code, as added by
			 subsection (a)(1), shall apply with respect to a claim for compensation made on
			 or after the date that is 60 days after the date on which the Secretary
			 prescribes regulations pursuant to subsection (c)(1) of such section.</text>
			</subsection></section><section id="HE81D9B9E2B0145B18B6CCFB3381FC86E"><enum>4.</enum><header>Audiometric test
			 required before separation of members of the Armed Forces</header>
			<subsection id="HBF0F16C154D54E0B9896CAD318BC5B1F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 59 of title
			 10, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H8E2036B371434E62AFD8C66A72A6898A" style="USC">
					<section id="HA2510A20696744B589AAC2E80D8D92CE"><enum>1179.</enum><header>Audiometric
				test required</header><text display-inline="no-display-inline">Under
				regulations prescribed by the Secretary of Defense, the Secretary of a military
				department shall ensure that a member of the armed forces under the
				jurisdiction of the Secretary receives an audiometric test at the 8000 Hz
				frequency (or other test that the Secretary of Defense determines has the
				ability to discover potential future hearing loss) to evaluate the hearing of
				the member during the 90-day period before the date on which the member is
				discharged, separated, or
				retired.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5D89377B450848438F3CC1EA35FB1BBF"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding after the item relating to section 1178 the following new
			 item:</text>

			</subsection><subsection id="H2C1BFA52F3E44680ADD5EC6D3EA03E07"><enum>(c)</enum><header>Effective
			 date</header><text>Section 1179 of title 10, United States Code, as added by
			 subsection (a), shall apply with respect to a member being discharged,
			 separated, or retired from the Armed Forces on or after the date that is 60
			 days after the date of the enactment of this Act.</text>
