		<official-title>To amend part A of title IV of the Social Security Act to
		  temporarily reinstate, with certain adjustments, the Emergency Contingency Fund
		  for State Temporary Assistance for Needy Families Programs, and for other
		  purposes.</official-title>

		<section id="H1B98DACCEF5543EAAEA2D2E196F3CF9C" section-type="section-one"><enum>1.</enum><header>Temporary reinstatement of
			 the Emergency Contingency Fund for State Temporary Assistance for Needy
			 Families Programs</header>
			<subsection id="H955D06B9B4A04E71848DFD5ACBF8A911"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 403 of the
			 Social Security Act (42 U.S.C. 603) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H83AAEB82630F4C69BF1CAA851F9794CB" style="OLC">
					<subsection id="H730CA6D616F84BD4A3798C9BCD85C2C8"><enum>(c)</enum><header>Emergency
				Fund</header>
						<paragraph id="H76E6532C159F4E96A5DA6C15D0E67D82"><enum>(1)</enum><header>Establishment</header><text>There
				is established in the Treasury of the United States a fund which shall be known
				as the <quote>Emergency Contingency Fund for State Temporary Assistance for
				Needy Families Programs</quote> (in this subsection referred to as the
				<quote>Emergency Fund</quote>).</text>
						</paragraph><paragraph id="H3A6D3DB35A6A4CC48737592B1701ADF7"><enum>(2)</enum><header>Deposits into
				fund</header>
							<subparagraph id="HBB39FE5A24DC498498A8AC9D3B0F99DE"><enum>(A)</enum><header>In
				general</header><text>Out of any money in the Treasury of the United States not
				otherwise appropriated, there are appropriated for fiscal year 2011,
				$20,000,000,000 for payment to the Emergency Fund.</text>
							</subparagraph><subparagraph id="H4BC792BFA8274E2FB09D906061F78955"><enum>(B)</enum><header>Availability and
				use of funds</header><text>The amounts appropriated to the Emergency Fund under
				subparagraph (A) shall remain available through fiscal year 2018 and shall be
				used to make grants to States in each of fiscal years 2011 through 2018 in
				accordance with the requirements of paragraph (3).</text>
							</subparagraph><subparagraph id="H4AAA71A1466344A3861C8FD6F024E679"><enum>(C)</enum><header>Limitation</header><text>In
				no case may the Secretary make a grant from the Emergency Fund for a fiscal
				year after fiscal year 2018.</text>
							</subparagraph></paragraph><paragraph id="H0B869EFAAB8D4A74BE5E12BEF4FDEE29"><enum>(3)</enum><header>Grants</header>
							<subparagraph id="H3090B16828854DBCB3031E35A663B459"><enum>(A)</enum><header>Grant related to
				caseload increases</header>
								<clause id="H6A5E99BFD5CD4AD3AACB2FAE75B6FB24"><enum>(i)</enum><header>In
				general</header><text>For each calendar quarter in fiscal year 2011 through
				2018, the Secretary shall make a grant from the Emergency Fund to each State
				that—</text>
									<subclause id="H8EAE34186F6A4F57A0D449A22E6E1B32"><enum>(I)</enum><text>requests a grant
				under this subparagraph for the quarter; and</text>
									</subclause><subclause id="H47030085A6A34C829F7CEBD60F5A152E"><enum>(II)</enum><text>meets the
				requirement of clause (ii) for the quarter.</text>
									</subclause></clause><clause id="H24FD2E085C5A47C69F5AD6873B2E2C68"><enum>(ii)</enum><header>Caseload
				increase requirement</header><text>A State meets the requirement of this clause
				for a quarter in a fiscal year if the average monthly assistance caseload of
				the State for the quarter exceeds the average monthly assistance caseload of
				the State for the corresponding quarter in the preceding fiscal year.</text>
								</clause><clause id="HACB9786952BE43109CFC97877E3713C1"><enum>(iii)</enum><header>Amount of
				grant</header><text>Subject to paragraph (5), the amount of the grant to be
				made to a State under this subparagraph for a quarter in a fiscal year shall be
				an amount equal to 80 percent of the amount (if any) by which the total
				expenditures of the State for basic assistance (as defined by the Secretary) in
				the quarter, whether under the State program funded under this part or as
				qualified State expenditures, exceeds the total expenditures of the State for
				such assistance for the corresponding quarter in the preceding fiscal
				year.</text>
								</clause></subparagraph><subparagraph id="H45C1287E7D704A42A3215300C22AEB3B"><enum>(B)</enum><header>Grant related to
				increased expenditures for non-recurrent short term benefits</header>
								<clause id="H3190DEE9A4D44ECEB1E6061D978AABE3"><enum>(i)</enum><header>In
				general</header><text>For each calendar quarter in fiscal year 2011 through
				2018, the Secretary shall make a grant from the Emergency Fund to each State
				that—</text>
									<subclause id="HE83083DB641B4E9492CFEFBF3D0475CE"><enum>(I)</enum><text>requests a grant
				under this subparagraph for the quarter; and</text>
									</subclause><subclause id="H2F88BE802E42436FB1BD1BCAF1344128"><enum>(II)</enum><text>meets the
				requirement of clause (ii) for the quarter.</text>
									</subclause></clause><clause id="HE5B473E1222F42D1B34B603D448D53CC"><enum>(ii)</enum><header>Non-recurrent
				short term expenditure requirement</header><text>A State meets the requirement
				of this clause for a quarter in a fiscal year if the total expenditures of the
				State for non-recurrent short term benefits in the quarter, whether under the
				State program funded under this part or as qualified State expenditures,
				exceeds the total expenditures of the State for non-recurrent short term
				benefits in the corresponding quarter in the preceding fiscal year.</text>
								</clause><clause id="H61FF047A8C574902968BCBD02CC04CC0"><enum>(iii)</enum><header>Amount of
				grant</header><text>Subject to paragraph (5), the amount of the grant to be
				made to a State under this subparagraph for a quarter shall be an amount equal
				to 80 percent of the excess described in clause (ii).</text>
								</clause></subparagraph><subparagraph id="HE60303A06AEE4BA8910030A88843DB8A"><enum>(C)</enum><header>Grant related to
				increased expenditures for subsidized employment</header>
								<clause id="H2F1A0887B7F74DA4A7D8524254262B4B"><enum>(i)</enum><header>In
				general</header><text>For each calendar quarter in fiscal year 2011 through
				2018, the Secretary shall make a grant from the Emergency Fund to each State
				that—</text>
									<subclause id="HAE8A456D87864769B487EFE67B8743D5"><enum>(I)</enum><text>requests a grant
				under this subparagraph for the quarter; and</text>
									</subclause><subclause id="HDD97FAD4659147A79BA51427E8AC2F30"><enum>(II)</enum><text>meets the
				requirement of clause (ii) for the quarter.</text>
									</subclause></clause><clause id="HC11EF79F0E4B4641B63C0112F290B180"><enum>(ii)</enum><header>Subsidized
				employment expenditure requirement</header><text>A State meets the requirement
				of this clause for a quarter in a fiscal year if the total expenditures of the
				State for subsidized employment in the quarter, whether under the State program
				funded under this part or as qualified State expenditures, exceeds the total
				such expenditures of the State in the corresponding quarter in the preceding
				fiscal year.</text>
								</clause><clause id="H7AADE39E19484CC78C597E067CA082AF"><enum>(iii)</enum><header>Amount of
				grant</header><text>Subject to paragraph (5), the amount of the grant to be
				made to a State under this subparagraph for a quarter shall be an amount equal
				to 80 percent of the excess described in clause (ii).</text>
								</clause></subparagraph></paragraph><paragraph id="HDD8E08AAFC914DB6B9E65D8C0E01BF11"><enum>(4)</enum><header>Authority to
				make necessary adjustments to data and collect needed data</header><text>In
				determining the size of the caseload of a State and the expenditures of a State
				for basic assistance, non-recurrent short-term benefits, and subsidized
				employment, during any period for which the State requests funds under this
				subsection, the Secretary may make appropriate adjustments to the data, on a
				State-by-State basis, to ensure that the data are comparable with respect to
				the groups of families served and the types of aid provided. The Secretary may
				develop a mechanism for collecting expenditure data, including procedures which
				allow States to make reasonable estimates, and may set deadlines for making
				revisions to the data.</text>
						</paragraph><paragraph id="H4BAE0C89F09D44549FC68126C71F957E"><enum>(5)</enum><header>Limitation</header><text>The
				total amount payable to a single State under subsection (b) and this subsection
				for fiscal years 2011 through 2018 combined shall not exceed 50 percent of the
				annual State family assistance grant.</text>
						</paragraph><paragraph id="H57D34DE1EB87452689531DFF8716B277"><enum>(6)</enum><header>Limitations on
				use of funds</header><text>A State to which an amount is paid under this
				subsection may use the amount only as authorized by section 404.</text>
						</paragraph><paragraph id="H19577C0A3A2C4E1E82A5BCDD30F2D8C8"><enum>(7)</enum><header>Timing of
				implementation</header><text>The Secretary shall implement this subsection as
				quickly as reasonably possible, pursuant to appropriate guidance to
				States.</text>
						</paragraph><paragraph id="H06D774D3321749CAAED5E6F789D8E6ED"><enum>(8)</enum><header>Application to
				indian tribes</header><text>This subsection shall apply to an Indian tribe with
				an approved tribal family assistance plan under section 412 in the same manner
				as this subsection applies to a State.</text>
						</paragraph><paragraph id="H2535C448C3BE425BB0624885FE79373D"><enum>(9)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph id="H1F5D397FD8ED49E7BD1D9A59948BF528"><enum>(A)</enum><header>Average monthly
				assistance caseload defined</header><text>The term <term>average monthly
				assistance caseload</term> means, with respect to a State and a quarter, the
				number of families receiving assistance during the quarter under the State
				program funded under this part or as qualified State expenditures, subject to
				adjustment under paragraph (4).</text>
							</subparagraph><subparagraph id="H9F3377781E9F4309956C9E409F3CEE81"><enum>(B)</enum><header>Qualified state
				expenditures</header><text>The term <term>qualified State expenditures</term>
				has the meaning given the term in section
				409(a)(7).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H33BAA7E4C0504D6F866C0255F0007E9C"><enum>(b)</enum><header>Disregard from
			 limitation on total payments to territories</header><text display-inline="yes-display-inline">Section 1108(a)(2) of the Social Security
			 Act (42 U.S.C. 1308(a)(2)) is amended by inserting “403(c)(3),” after
			 “403(a)(5),”.</text>
			</subsection><subsection id="HF3F9BCADF3E44237979CFB25F3054327"><enum>(c)</enum><header>Elimination of
			 modification of caseload reduction credit</header>
				<paragraph id="HE397AE399D2B4613A0C263F6067E50D8"><enum>(1)</enum><header>In
			 general</header><text>Section 407(b)(3)(A)(i) of the Social Security Act (42
			 U.S.C. 607(b)(3)(A)(i)) is amended by striking “(or if the immediately
			 preceding fiscal year is fiscal year 2008, 2009, or 2010, then, at State
			 option, during the emergency fund base year of the State with respect to the
			 average monthly assistance caseload of the State (within the meaning of section
			 403(c)(9)), except that, if a State elects such option for fiscal year 2008,
			 the emergency fund base year of the State with respect to such caseload shall
			 be fiscal year 2007))”.</text>
				</paragraph><paragraph id="HFC9268F2C1F8460AACA3D44814ABC57F"><enum>(2)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Section 2101 of
			 the American Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat.
			 446–449) is amended—</text>
					<subparagraph id="HC9311661BC3B45AFB8B437BE02025D5A"><enum>(A)</enum><text>in subsection
			 (a)(2), by striking <quote>, except that paragraph (9) of such subsection shall
			 remain in effect until October 1, 2011, but only with respect to section
			 407(b)(3)(A)(i) of such Act</quote>; and</text>
					</subparagraph><subparagraph id="HCDF51D9DA78341EA8E3E88F9E172743C"><enum>(B)</enum><text>in subsection (d),
			 by striking paragraph (2).</text>
					</subparagraph></paragraph></subsection><subsection id="HF7AC3A3C148A47CE9E01A31A64D01333"><enum>(d)</enum><header>Sunset</header><text display-inline="yes-display-inline">Effective October 1, 2018:</text>
				<paragraph id="HBB9EB3E92014476A90CA5A404FA4B32D"><enum>(1)</enum><header>Emergency
			 fund</header><text>Section 403 of the Social Security Act (42 U.S.C. 603) (as
			 added by paragraph (1)) is amended by striking subsection (c) (as added by
			 subsection (a) of this section).</text>
				</paragraph><paragraph id="H5CD63DF6FFB5484B975685A4CA303F1A"><enum>(2)</enum><header>Disregard from
			 limitation on total payments to territories</header><text display-inline="yes-display-inline">Section 1108(a)(2) of such Act (42 U.S.C.
			 1308(a)(2)) is amended by striking “403(c)(3),” (as added by subsection (b) of
			 this section).</text>
