		<official-title>To increase Federal Pell Grants for the children of
		  fallen police officers, firefighters, and other public safety
		  officers.</official-title>

		<section id="H9AD0C25FE8304F3C906B2E4C29B3461E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Children of Fallen Heroes Scholarship
			 Act of 2012</short-title></quote>.</text>
		</section><section id="H156ED789928343B2B04DA7C6434D56E7"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H80F45FBED30A4B3A8D566D57B3FE98A5"><enum>(1)</enum><text display-inline="yes-display-inline">2011 was a deadly year for law enforcement
			 officers, with 163 men and women killed in the line of duty, which is a 15
			 percent increase from the number of law enforcement officers killed in the line
			 of duty in 2010. In 2011, 80 firefighters lost their lives and 19 paramedics
			 suffered fatalities in the line of duty.</text>
			</paragraph><paragraph id="H1885E76884874F6DB5C4954009A9BA5C"><enum>(2)</enum><text display-inline="yes-display-inline">Congress recognizes the sacrifice of the
			 families of fallen public safety officers.</text>
			</paragraph><paragraph id="H1351666C9EC94851853C75B70BFC3210"><enum>(3)</enum><text display-inline="yes-display-inline">The financial loss for a family with
			 children could be detrimental for decades.</text>
			</paragraph><paragraph id="H15BFA1BA0BD441949D7875F37EEB9BAC"><enum>(4)</enum><text display-inline="yes-display-inline">Families who have given the ultimate
			 sacrifice deserve the support of the American people as their children pursue
			 higher education.</text>
			</paragraph></section><section id="H49E0DC30EC1B4D3A8F68EC1FE37E1C1E"><enum>3.</enum><header>Calculation of
			 Federal Pell Grant eligibility</header><text display-inline="no-display-inline">Section 401(f) of the Higher Education Act
			 of 1965 (20 U.S.C. 1070a(f)) is amended by adding at the end the following new
			 paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="HE027D9D1D6BC4DE982976E86AD84FE9D" style="OLC">
				<paragraph id="H1705E66477714A46841781129681A68D"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H71266E9C2545481D97D07CDE1FB3CB2E"><enum>(A)</enum><text>Notwithstanding
				paragraph (1) or any other provision of this section, the expected family
				contribution of each student described in subparagraph (B) shall be deemed to
				be zero for the period during which each such student is eligible to receive a
				Federal Pell Grant under subsection (c).</text>
					</subparagraph><subparagraph id="H48F960EBBFAB4CB1ADF958749CE1A79C" indent="up1"><enum>(B)</enum><text>Subparagraph (A) shall apply to any
				student at an institution of higher education—</text>
						<clause id="HA6DFAEC504484A26B39ABD9B97B6A042"><enum>(i)</enum><text>whose parent or guardian—</text>
							<subclause id="H90750B4A758E42C1A2712AC58C411D87"><enum>(I)</enum><text>was actively serving as a police officer,
				firefighter, or other public safety officer; and</text>
							</subclause><subclause id="HCBA60D59CC274FBBB72E52AA471B2D6F"><enum>(II)</enum><text>died as a result of performing a public
				safety service; and</text>
							</subclause></clause><clause id="HAF319CD779E94A3BAE3E61DFCF533DF8"><enum>(ii)</enum><text>who was 18 years or less, or was
				enrolled as a full-time or part-time student at an institution of higher
				education, as of the time of the parent or guardian’s death.</text>
						</clause></subparagraph><subparagraph id="H835134EC86BF44BE964DED2155EF3051" indent="up1"><enum>(C)</enum><text>For purposes of this paragraph—</text>
						<clause id="HD52017525BC44F4E900C630C850DFBA6"><enum>(i)</enum><text>the term <term>police officer,
				firefighter, or other public safety officer</term> means an individual
				who—</text>
							<subclause id="HC3673A7D970F4C33B491ECA0ACCECE38"><enum>(I)</enum><text display-inline="yes-display-inline">is a
				law enforcement officer or firefighter in a police department or fire
				department which is organized and operated by a State or political subdivision
				to provide police protection, firefighting services, or emergency medical
				services for any area within the jurisdiction of such State or political
				subdivision;</text>
							</subclause><subclause id="HA37E98226C9F4205AD5D49FC83886BEB"><enum>(II)</enum><text display-inline="yes-display-inline">is
				an emergency medical services provider who provides out-of-hospital emergency
				medical care, including an emergency medical technician or paramedic; or</text>
							</subclause><subclause id="HBB3E185490724953B7EE6A08F2777607"><enum>(III)</enum><text display-inline="yes-display-inline">is
				a member of a qualified volunteer emergency response organization who provides
				firefighting services or emergency medical services; and</text>
							</subclause></clause><clause id="H5C02E09F802A4DD38AB67C88C8F73EDD"><enum>(ii)</enum><text>the term <term>qualified volunteer
				emergency response organization</term> means any volunteer organization
				that—</text>
							<subclause id="H3D5AF4A96BB0491C813B057303129B13"><enum>(I)</enum><text>is organized and operated to provide
				firefighting or emergency medical services for persons in the State or
				political subdivision, as the case may be; and</text>
							</subclause><subclause id="HA15B292E0AF24E338F226783A042D978"><enum>(II)</enum><text>is required (by written agreement) by
				the State or political subdivision to furnish firefighting or emergency medical
				services in such State or political
				subdivision.</text>
							</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H1F06974FFFD34D4CA26A03268BB3435D"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendment made by
			 section 3 of this Act shall apply with respect to Federal Pell Grants awarded
			 for academic year 2013–2014, and each succeeding academic year.</text>
