		<official-title>To amend the Indian Arts and Crafts Act to clarify the
		  definition of Indian and Indian organization for the purposes of that
		  Act.</official-title>

		<section id="HAABC917CD7D74BBCAF49D6CF77D5B78C" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 6(a) of the Act entitled <quote>An
			 Act to promote the development of Indian arts and crafts and to create a board
			 to assist therein, and for other purposes</quote> (25 U.S.C. 305e(a)) is
			 amended as follows:</text>
			<paragraph id="HC8B8D94A82154ECBB8A3850B66E50EE6"><enum>(1)</enum><text>By striking
			 paragraph (1) and inserting the following:</text>
				<quoted-block id="H4C1076F3FA784E5D9D92B4F033810B8A" style="OLC">
					<paragraph id="H6C922661655E4AD19DD93811636B0674"><enum>(1)</enum><header>Indian</header><text>The
				term <term>Indian</term> means an individual that—</text>
						<subparagraph id="H1B829E793ABC43469CE95B6B561F758F"><enum>(A)</enum><text>is a member of an
				Indian tribe;</text>
						</subparagraph><subparagraph id="HA9562E04BC934BED9514A3F1355F73CA"><enum>(B)</enum><text>is certified as an
				Indian artisan by an Indian tribe;</text>
						</subparagraph><subparagraph id="H41A782ACD25542FF9AE15B62F1D6D894"><enum>(C)</enum><text>is a member of an
				Indian organization and who—</text>
							<clause id="H03DBECB29F54436A851DD6B0AA67B583"><enum>(i)</enum><text>resides in the
				State in which the Indian organization is chartered and head­quar­tered;
				and</text>
							</clause><clause id="H5A6598E954AE41D9965F284F52400962"><enum>(ii)</enum><text>is a direct
				lineal descendant of a person listed on the base roll of an Indian tribe,
				whether or not such individual qualifies for membership in the Indian tribe;
				or</text>
							</clause></subparagraph><subparagraph id="HB7711682F6B14B919E7675A89B65672F"><enum>(D)</enum><text>is a member of an
				Indian organization and who—</text>
							<clause id="H9227654F013E4585A41BA41989530250"><enum>(i)</enum><text>resides in the
				State in which the Indian organization is chartered and head­quar­tered;
				and</text>
							</clause><clause id="H3FEB5EECA9944B068C7D2E93E7252F32"><enum>(ii)</enum><text>is a direct
				lineal descendant of a person listed on a judgment fund distribution list,
				roll, or census of Indians or other document prepared and approved by the
				Secretary of the Interior or the Secretary’s authorized representative, whether
				or not such judgment fund distribution list, roll, census or document is used
				by an Indian tribe to determine
				membership.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HFDC9B42EA65B44F1A8C881A161F150FF"><enum>(2)</enum><text>By adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H99E0CF1F68DC46F5AF684C40B02C132B" style="OLC">
					<paragraph id="H314347EDA4E24C7CA13BA34822FF22A8"><enum>(5)</enum><header>Indian
				organization</header><text>The term <term>Indian organization</term> means a
				nonprofit organization that—</text>
						<subparagraph id="H87497A023F114D8A8D63899C37A03B3E"><enum>(A)</enum><text>is chartered as a
				section 501(c)(3) organization with the State in which the organization is
				headquartered;</text>
						</subparagraph><subparagraph id="H9DC508ED65BD47B8AD1663D397C02358"><enum>(B)</enum><text>is recognized by a
				State legislative body as an Indian organization or group, in which a majority
				of its members are recognized as Indians, whether or not such organization is
				recognized as a State or federally recognized tribe;</text>
						</subparagraph><subparagraph id="H0B1D85E8E4EF4EC39A7E3251D30DD63E"><enum>(C)</enum><text>is dedicated to
				preserving Native American principles, traditions, culture, history, language,
				and arts;</text>
						</subparagraph><subparagraph id="H99CAE4CA21704583A109444AD7F6418D"><enum>(D)</enum><text>performs free
				genealogical information on its members to verify that an individual meets the
				definition of <term>Indian</term> as defined in this Act; and</text>
						</subparagraph><subparagraph id="H034756B4531E4E9A93637D7F41CED9F8"><enum>(E)</enum><text>retains
				genealogical information collected on its members for
				verification.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
