		<official-title>To provide for the transfer of excess Department of
		  Defense aircraft to the Forest Service for wildfire suppression activities, and
		  for other purposes.</official-title>

		<section id="HF8023712ED3549F185F7FC84530B07EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Wildfire Suppression Aircraft Transfer
			 Act of 2012</short-title></quote>.</text>
		</section><section id="H580004767C7A48BDA61361EA581E006D"><enum>2.</enum><header>Transfer of
			 excess aircraft for wildfire suppression purposes</header>
			<subsection id="H6D17BA5075334C168BF4C413CA9E8877"><enum>(a)</enum><header>In
			 general</header><text>Not later than 90 days after the aircraft specified in
			 subsection (b) are declared excess to the needs of the Department of Defense,
			 the Secretary of Defense shall transfer such aircraft to the Secretary of
			 Agriculture for use by the Forest Service for wildfire suppression purposes.
			 The transfer of any excess aircraft under this subsection shall be without
			 reimbursement.</text>
			</subsection><subsection id="H8687CAE833024D6AB233FD2DB91F3034"><enum>(b)</enum><header>Aircraft</header><text>The
			 aircraft transferred under subsection (a) are 14 C–27J aircraft that
			 are—</text>
				<paragraph id="HCD4F437BED754542A1FFB4F73F36FBAA"><enum>(1)</enum><text>excess to the
			 needs of the Department of Defense, as determined by the Secretary of Defense;
			 and</text>
				</paragraph><paragraph id="H0FE87B9888D040FA80EFA6C219EA70EF"><enum>(2)</enum><text>acceptable for use
			 by the Forest Service, as determined by the Secretary of Agriculture.</text>
				</paragraph></subsection><subsection id="H3B12283E1B784A6FA3C11FF3224A4C1E"><enum>(c)</enum><header>Priority in
			 transfer</header><text>The Secretary of Agriculture shall be afforded a
			 priority in the transfer under subsection (a) of excess aircraft of the
			 Department of Defense described in subsection (b) before any other department
			 or agency of the Federal Government.</text>
			</subsection><subsection id="H8BBFC79C802540FB8BCD90ADDE6632B1"><enum>(d)</enum><header>Conditions of
			 transfer</header><text>Excess aircraft transferred under subsection (a)—</text>
				<paragraph id="H1A3A4D7C57894512BD66A8D899511D19"><enum>(1)</enum><text>may be used only
			 for wildfire suppression purposes; and</text>
				</paragraph><paragraph id="H4666CEC413DF417A962BB5F359C56214"><enum>(2)</enum><text>may not be flown
			 or otherwise removed from the United States unless dispatched by the National
			 Interagency Fire Center in support of an international agreement to assist in
			 wildfire suppression efforts or for other purposes approved by the Secretary of
			 Agriculture in writing in advance.</text>
				</paragraph></subsection><subsection id="HB9E7EC5B17C247E3B4D21F83A9CEEAA4"><enum>(e)</enum><header>Expiration of
			 authority</header><text>The authority to transfer excess aircraft under
			 subsection (a) shall expire upon the completion of the transfer of all the
			 excess aircraft specified in subsection (b).</text>
			</subsection></section><section id="HB499DB3265B044A5B8D2B0E1E9501D2B"><enum>3.</enum><header>Reauthorization
			 of sale of aircraft and parts for wildfire suppression purposes</header><text display-inline="no-display-inline">Section 2 of the Wildfire Suppression
			 Aircraft Transfer Act of 1996 (10 U.S.C. 2576 note) is amended—</text>
			<paragraph id="H5DBAC252A30A417EA31499BDED03DD15"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking
			 <quote>during the period beginning on October 1, 1996, and ending on September
			 30, 2005</quote> and inserting <quote>during a period specified in subsection
			 (g)</quote>;</text>
			</paragraph><paragraph id="HBAEBE46BF31D456B97B630759D662D3B"><enum>(2)</enum><text>by redesignating
			 subsection (g) as subsection (h); and</text>
			</paragraph><paragraph id="H1384326FA9774C75B06108418A758C5E"><enum>(3)</enum><text>by inserting after
			 subsection (f) the following new subsection (g):</text>
				<quoted-block display-inline="no-display-inline" id="HDE06C2EB117B417BAF94C0676B8BA463" style="OLC">
					<subsection id="H2BD50BA4E48241D1A99B4299EE6F0B07"><enum>(g)</enum><header>Periods for
				exercise of authority</header><text>The periods specified in this subsection
				are the following:</text>
						<paragraph id="H7F2E457FE17A4EADA75364EB999AE564"><enum>(1)</enum><text>The period
				beginning on October 1, 1996, and ending on September 30, 2005.</text>
						</paragraph><paragraph id="H57AC3CF2242244A5A64AC167D4BC7870"><enum>(2)</enum><text>The period
				beginning on October 1, 2012, and ending on September 30,
				2017.</text>
