		  well stimulation on Federal and Indian lands until such date the Secretary of
		  the Interior submits a report examining certain effects of such

		<section id="HEF35FD8579E54703A094C8DDC41B7CCF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Lands Energy Regulatory
			 Certainty Act of 2012</short-title></quote>.</text>
		</section><section id="HD08BD36A32194855837056CC62AB09DB"><enum>2.</enum><header>Delay of further
			 action on proposed rule regarding well stimulation on Federal and Indian lands
			 until report submitted</header>
			<subsection id="H75150D30653D4B0FB4779344974B063B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, the Secretary of the Interior may not, before the date
			 of the submission of the report under subsection (b)(2)(C), take any action to
			 finalize or otherwise implement provisions contained in the proposed rule
			 entitled <quote>Oil and Gas; Well Stimulation, Including Hydraulic Fracturing,
			 on Federal and Indian Lands</quote> (77 Fed. Reg. 27691 (May 11, 2012)).</text>
			</subsection><subsection id="H580EE9C525444E9C8D9C23FB4C32707B"><enum>(b)</enum><header>Study and
			 report</header>
				<paragraph id="H0F21171532C94362ABC6B7ED27A89712"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of the Interior may conduct a
			 study, with respect to each year of the 10-year period immediately following
			 the date of the enactment of this Act, on each of the following:</text>
					<subparagraph id="H26912C4F66E24BE986AA8021B6B37220"><enum>(A)</enum><text display-inline="yes-display-inline">The anticipated expenditure of resources by
			 the Bureau of Land Management for such year if the rule described in subsection
			 (a) is applied, as compared to the anticipated expenditure of such resources
			 for such year if such rule is not applied.</text>
					</subparagraph><subparagraph id="H2E086E29019147EBACEF17EDCD50AEA9"><enum>(B)</enum><text display-inline="yes-display-inline">The anticipated rates of development and
			 production of oil and natural gas resources in the United States for such year
			 if the rule described in subsection (a) is applied, as compared to such
			 anticipated rates for such year if such rule is not applied.</text>
					</subparagraph><subparagraph id="HF1114F51F8D54456B8CDAD0047027EA2"><enum>(C)</enum><text display-inline="yes-display-inline">The anticipated revenue to the Treasury
			 resulting from the development and production of oil and natural gas resources
			 for such year if the rule described in subsection (a) is applied, as compared
			 to such anticipated revenue for such year if such rule is not applied.</text>
					</subparagraph><subparagraph id="H051B409A63EE4CC782CCC26920A13F56"><enum>(D)</enum><text>Any potential
			 conflicts that may exist between the rule described in subsection (a) and State
			 and Federal regulations that are in existence as of the date of enactment of
			 this Act.</text>
					</subparagraph></paragraph><paragraph id="H4EF0EE0689134D46960068856D495BC4"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">If the Secretary of the Interior completes
			 the study described in paragraph (1), the Secretary shall—</text>
					<subparagraph id="HB978DC009C90414189B2B4BB88C65A5F"><enum>(A)</enum><text display-inline="yes-display-inline">not later than October 31, 2012, submit to
			 the Committee on Natural Resources of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate (and make publicly
			 available) a preliminary report containing the results of the study conducted
			 under paragraph (1);</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H451ABE2B57D643D9BF2BA98C9C964B29"><enum>(B)</enum><text display-inline="yes-display-inline">solicit public comments regarding the
			 preliminary report submitted under subparagraph (A) for a period of 120 days
			 after the submission of such preliminary report to both such Committees; and</text>
					</subparagraph><subparagraph id="HEF742C0E9BE84EE8B8F0F4E71A651286"><enum>(C)</enum><text display-inline="yes-display-inline">not later than May 1, 2013, submit to
			 Congress a final report containing the results of the study conducted under
			 paragraph (1), including any revisions to the preliminary report made as a
			 result of public comments submitted pursuant to subparagraph (B), and a
			 response to such comments.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
