<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend section 1059(e) of the National Defense Authorization Act for Fiscal Year 2006 to clarify that a period of employment abroad by the Chief of Mission or United States Armed Forces as a translator, interpreter, or in a security-related position in an executive or managerial capacity is to be counted as a period of residence and physical presence in the United States for purposes of qualifying for naturalization, and for other purposes.</official-title>

<section id="H12FF7CB0B2224A41B7004526594FC83B" section-type="section-one"><enum>1.</enum><header>Clarification with respect to absence from the United States due to certain employment by Chief of Mission or Armed Forces</header> 
<subsection id="HD4640411DA8544E19DBA25AB74675554"><enum>(a)</enum><header>In general</header><text>Section 1059(e) of the National Defense Authorization Act for Fiscal Year 2006 (8 U.S.C. 1101 note) is amended to read as follows:</text>

<subsection id="H3EFF48B5113C42538BC3677E76FC3D3A"><enum>(e)</enum><header>Naturalization</header> 
<paragraph id="H6603C8CF12DC4F9E892DFAC918423E91"><enum>(1)</enum><header>In general</header><text>A period of absence from the United States described in paragraph (2)—</text> 
<subparagraph id="HC81520FB99FF455098DC08FA857D0485"><enum>(A)</enum><text>shall not be considered to break any period for which continuous residence or physical presence in the United States is required for naturalization under title III of the Immigration and Nationality Act (8 U.S.C. 1401 et seq.); and</text></subparagraph> 
<subparagraph id="HCF5EA3232AC141CD8F07DFC2A2E018DB"><enum>(B)</enum><text>shall be treated as a period of residence and physical presence in the United States for purposes of satisfying the requirements for naturalization under such title.</text></subparagraph></paragraph> 
<paragraph id="HE10AD08CD65E4F44A56466675AC51A8A"><enum>(2)</enum><header>Period of absence described</header><text>A period of absence described in this paragraph is a period of absence from the United States due to a person’s employment by the Chief of Mission or United States Armed Forces, under contract with the Chief of Mission or United States Armed Forces, or by a firm or corporation under contract with the Chief of Mission or United States Armed Forces, if—</text> 
<subparagraph id="HFD63164A02CE43DC812A9BEACFE05FBE"><enum>(A)</enum><text>such employment involved supporting the Chief of Mission or United States Armed Forces as a translator, interpreter, or in a security-related position in an executive or managerial capacity; and</text></subparagraph> 
<subparagraph id="H86BE4213192B41A48F6032224024FA90"><enum>(B)</enum><text>the person spent at least a portion of the time outside the United States working directly with the Chief of Mission or United States Armed Forces as a translator, interpreter, or in a security-related position in an executive or managerial capacity.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDA013D7814964112B44F0CED3D5FAAD1"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect as if included in the enactment of section 1059(e) of the National Defense Authorization Act for Fiscal Year 2006 (8 U.S.C. 1101 note).</text></subsection></section>
