		<official-title>To prohibit an employer from inquiring whether an
		  applicant for employment has been convicted of a criminal offense, except in
		  certain circumstances.</official-title>

		<section id="H16F6649491474532A81FB3CB7F797051" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ban the Box
			 Act</short-title></quote>.</text>
		</section><section id="HF92B7FEBAFB14347A545BE0E5A608C58"><enum>2.</enum><header>Unlawful
			 employment practices related to criminal record of applicants</header>
			<subsection id="H3E9678D099734C16B2A337F66C84050C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 subsection (b), it shall be an unlawful employment practice for any employer to
			 make inquiries of an applicant for employment or otherwise seek information
			 about such an applicant (including through the use of any form or application)
			 relating to whether such applicant has ever been convicted of a criminal
			 offense.</text>
			</subsection><subsection commented="no" id="H89E2B7710C0F441A8D05C656CA356EE1"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), an employer
			 may make inquiries of an applicant or otherwise seek information about the
			 applicant relating to whether such applicant has ever been convicted of a
			 criminal offense—</text>
				<paragraph commented="no" id="H12B43660DD3042E58AE62492C1A0A230"><enum>(1)</enum><text>after a
			 conditional offer for employment has been extended to an applicant; or</text>
				</paragraph><paragraph commented="no" id="H60A5EB85E02A49E0B3874569690396CD"><enum>(2)</enum><text>where the granting
			 of employment may involve an unreasonable risk to the safety of specific
			 individuals or to the general public.</text>
				</paragraph></subsection></section><section commented="no" id="H984368007814464F84689956AB8E0341"><enum>3.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Commission shall issue rules—</text>
			<paragraph id="H4E018C38DC92403CB357AA655869FA82"><enum>(1)</enum><text>defining
			 categories of employment where an individual’s past criminal history may
			 involve an unreasonable risk to the safety of specific individuals or to the
			 general public; and</text>
			</paragraph><paragraph id="H41CCCC36000642CDAF339D0D6B9B2499"><enum>(2)</enum><text display-inline="yes-display-inline">factors to be considered by employers in
			 assessing whether an individual’s past criminal history poses such an
			 unreasonable risk.</text>
			</paragraph></section><section id="HC391A2EF901A4C6E99C4EA5037EFA471"><enum>4.</enum><header>Enforcement</header>
			<subsection id="H1FC52D30BC164E43ADD47669C5DB5DA3"><enum>(a)</enum><header>Employees
			 Covered by Title VII of the Civil Rights Act of 1964</header>
				<paragraph id="HFF31A3714B32477ABF919056C1F9795D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The powers,
			 procedures, and remedies provided in sections 705, 706, 707, 709, 710, and 711
			 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-4">42 U.S.C. 2000e–4 et seq.</external-xref>) to
			 the Commission, the Attorney General, or any person, alleging a violation of
			 title VII of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) shall be
			 the powers, procedures, and remedies this title provides to the Commission, the
			 Attorney General, or any person, respectively, alleging an unlawful employment
			 practice in violation of this title against an employee described in section
			 5(2)(A), except as provided in paragraphs (2) and (3).</text>
				</paragraph><paragraph id="H05112D7F7B98455D9230D26800429AA2"><enum>(2)</enum><header>Costs and
			 fees</header><text display-inline="yes-display-inline">The powers, remedies,
			 and procedures provided in subsections (b) and (c) of section 722 of the
			 Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1988">42 U.S.C. 1988</external-xref>), shall be the
			 powers, remedies, and procedures this title provides to the Commission, the
			 Attorney General, or any person, alleging such a practice.</text>
				</paragraph><paragraph id="H01DE20C60B8540AEABE6484C497BE0B6"><enum>(3)</enum><header>Damages</header><text>The
			 powers, remedies, and procedures provided in section 1977A of the Revised
			 Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a</external-xref>), including the
			 limitations contained in subsection (b)(3) of such section 1977A, shall be the
			 powers, remedies, and procedures this title provides to the Commission, the
			 Attorney General, or any person, alleging such a practice (not an employment
			 practice specifically excluded from coverage under section 1977A(a)(1) of the
			 Revised Statutes of the United States).</text>
				</paragraph></subsection><subsection id="H347C2E325F14431CBD4B8EE7D5647925"><enum>(b)</enum><header>Employees
			 Covered by Congressional Accountability Act of 1995</header>
				<paragraph id="H0A764CA7F41843DAB1AA49C8B759CA61"><enum>(1)</enum><header>In
			 general</header><text>The powers, remedies, and procedures provided in the
			 Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) to the Board
			 (as defined in section 101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>)), or any person,
			 alleging a violation of section 201(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311(a)(1)</external-xref>) shall be the
			 powers, remedies, and procedures this title provides to that Board, or any
			 person, alleging an unlawful employment practice in violation of this title
			 against an employee described in section 5(2)(B), except as provided in
			 paragraphs (2) and (3).</text>
				</paragraph><paragraph id="H10AB6D3293984961A3DD37CB82E787B3"><enum>(2)</enum><header>Costs and
			 fees</header><text>The powers, remedies, and procedures provided in subsections
			 (b) and (c) of section 722 of the Revised Statutes of the United States (42
			 U.S.C. 1988), shall be the powers, remedies, and procedures this title provides
			 to that Board, or any person, alleging such a practice.</text>
				</paragraph><paragraph id="HAB079FB52ECB48E0AF54F4A711037BF8"><enum>(3)</enum><header>Damages</header><text display-inline="yes-display-inline">The powers, remedies, and procedures
			 provided in section 1977A of the Revised Statutes of the United States (42
			 U.S.C. 1981a), including the limitations contained in subsection (b)(3) of such
			 section 1977A, shall be the powers, remedies, and procedures this title
			 provides to that Board, or any person, alleging such a practice (not an
			 employment practice specifically excluded from coverage under section
			 1977A(a)(1) of the Revised Statutes of the United States).</text>
				</paragraph><paragraph id="H3AFE0917C375428CB161129F3F62922B"><enum>(4)</enum><header>Other applicable
			 provisions</header><text>With respect to a claim alleging a practice described
			 in paragraph (1), title III of the Congressional Accountability Act of 1995 (2
			 U.S.C. 1381 et seq.) shall apply in the same manner as such title applies with
			 respect to a claim alleging a violation of section 201(a)(1) of such Act (2
			 U.S.C. 1311(a)(1)).</text>
				</paragraph></subsection><subsection id="H27A27816405F41DB8FAC286AD591091F"><enum>(c)</enum><header>Employees
			 covered by
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/3/5">chapter
			 5</external-xref> of title 3, United States Code</header>
				<paragraph id="HF7043990E2C2431E800CDDBAFA707044"><enum>(1)</enum><header>In
			 general</header><text>The powers, remedies, and procedures provided in chapter
			 5 of title 3, United States Code, to the President, the Commission, the Merit
			 Systems Protection Board, or any person, alleging a violation of section
			 411(a)(1) of that title, shall be the powers, remedies, and procedures this
			 title provides to the President, the Commission, such Board, or any person,
			 respectively, alleging an unlawful employment practice in violation of this
			 title against an employee described in section 5(2)(C), except as provided in
			 paragraphs (2) and (3).</text>
				</paragraph><paragraph id="HBE5E3CE901834C97A183EE52139C9B8F"><enum>(2)</enum><header>Costs and
			 fees</header><text>The powers, remedies, and procedures provided in subsections
			 (b) and (c) of section 722 of the Revised Statutes of the United States (42
			 U.S.C. 1988), shall be the powers, remedies, and procedures this title provides
			 to the President, the Commission, such Board, or any person, alleging such a
			 practice.</text>
				</paragraph><paragraph id="H77241D0F31FC400EA4F922A97B24F4F6"><enum>(3)</enum><header>Damages</header><text>The
			 powers, remedies, and procedures provided in section 1977A of the Revised
			 Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a</external-xref>), including the
			 limitations contained in subsection (b)(3) of such section 1977A, shall be the
			 powers, remedies, and procedures this title provides to the President, the
			 Commission, such Board, or any person, alleging such a practice (not an
			 employment practice specifically excluded from coverage under section
			 1977A(a)(1) of the Revised Statutes of the United States).</text>
				</paragraph></subsection><subsection commented="no" id="HABFF2DEBA8BC4E8D97932D1D9B124AD7"><enum>(d)</enum><header>Employees
			 Covered by Government Employee Rights Act of 1991</header>
				<paragraph commented="no" id="H28CD0C451DF74E45840AB6D71CC88F6B"><enum>(1)</enum><header>In
			 general</header><text>The powers, remedies, and procedures provided in sections
			 302 and 304 of the Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16b,
			 2000e–16c) to the Commission, or any person, alleging a violation of section
			 302(a)(1) of that Act (42 U.S.C. 2000e–16b(a)(1)) shall be the powers,
			 remedies, and procedures this title provides to the Commission, or any person,
			 respectively, alleging an unlawful employment practice in violation of this
			 title against an employee described in section 5(2)(D), except as provided in
			 paragraphs (2) and (3).</text>
				</paragraph><paragraph commented="no" id="H4AD8EC2E74AC439A843DED8E8D8D44A7"><enum>(2)</enum><header>Costs and
			 fees</header><text>The powers, remedies, and procedures provided in subsections
			 (b) and (c) of section 722 of the Revised Statutes of the United States (42
			 U.S.C. 1988), shall be the powers, remedies, and procedures this title provides
			 to the Commission, or any person, alleging such a practice.</text>
				</paragraph><paragraph commented="no" id="H7EAD9DE067904F58B5E5A38C9C1EAF74"><enum>(3)</enum><header>Damages</header><text>The
			 powers, remedies, and procedures provided in section 1977A of the Revised
			 Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a</external-xref>), including the
			 limitations contained in subsection (b)(3) of such section 1977A, shall be the
			 powers, remedies, and procedures this title provides to the Commission, or any
			 person, alleging such a practice (not an employment practice specifically
			 excluded from coverage under section 1977A(a)(1) of the Revised Statutes of the
			 United States).</text>
				</paragraph></subsection><subsection commented="no" id="H3EE253E21A1D4C00A23CB27175052CE8"><enum>(e)</enum><header>Employees
			 Covered by section 717 of the Civil Rights Act of 1964</header>
				<paragraph commented="no" id="HD182608302FF4812B945D29840B8DE2B"><enum>(1)</enum><header>In
			 general</header><text>The powers, remedies, and procedures provided in section
			 717 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16</external-xref>) to the
			 Commission, the Attorney General, the Librarian of Congress, or any person,
			 alleging a violation of that section shall be the powers, remedies, and
			 procedures this title provides to the Commission, the Attorney General, the
			 Librarian of Congress, or any person, respectively, alleging an unlawful
			 employment practice in violation of this title against an employee or applicant
			 described in section 2(2)(E), except as provided in paragraphs (2) and
			 (3).</text>
				</paragraph><paragraph commented="no" id="H20E6C769514D4936BB8A501B368B1FBE"><enum>(2)</enum><header>Costs and
			 fees</header><text>The powers, remedies, and procedures provided in subsections
			 (b) and (c) of section 722 of the Revised Statutes of the United States (42
			 U.S.C. 1988), shall be the powers, remedies, and procedures this title provides
			 to the Commission, the Attorney General, the Librarian of Congress, or any
			 person, alleging such a practice.</text>
				</paragraph><paragraph commented="no" id="HCD07FDAF53A9496C94E5A0BD3BDD9A82"><enum>(3)</enum><header>Damages</header><text>The
			 powers, remedies, and procedures provided in section 1977A of the Revised
			 Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a</external-xref>), including the
			 limitations contained in subsection (b)(3) of such section 1977A, shall be the
			 powers, remedies, and procedures this title provides to the Commission, the
			 Attorney General, the Librarian of Congress, or any person, alleging such a
			 practice (not an employment practice specifically excluded from coverage under
			 section 1977A(a)(1) of the Revised Statutes of the United States).</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H3507F6AF1D6B45F1888239661EDF208C" section-type="subsequent-section"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text>
			<paragraph commented="no" id="HB68C7AFB954A4E9CBCC54A85ABECF7DA"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Commission</term> means the
			 Equal Employment Opportunity Commission;</text>
			</paragraph><paragraph id="H73C7AA16B2F049E8B6B5293BA8755A85"><enum>(2)</enum><text>the term
			 <term>employer</term>—</text>
				<subparagraph id="H0C1979722C5C4E27B13484B676F1141B"><enum>(A)</enum><text>has the meaning
			 given such term in section 701(b) of the Civil Rights Act of 1964
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C.
			 2000e(b)</external-xref>); and</text>
				</subparagraph><subparagraph id="HC84308513CA5453E9CFB1082B0E9F73A"><enum>(B)</enum><text>includes—</text>
					<clause id="HC211B8C181334CF7960FB46FE3B44C8B"><enum>(i)</enum><text>an
			 employing office, as defined in section 101 of the Congressional Accountability
			 Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C.
			 1301</external-xref>) and
			 <external-xref legal-doc="usc" parsable-cite="usc/3/411">section
			 411(c)</external-xref> of title 3, United States Code;</text>
					</clause><clause id="H08D3D138884C4639B4934B5454AE2909"><enum>(ii)</enum><text display-inline="yes-display-inline">an entity employing a State employee
			 described in section 304(a) of the Government Employee Rights Act of 1991 (12
			 U.S.C. 1220(a)); and</text>
					</clause><clause id="HCEB265E6417748B08EE475F48F8347A2"><enum>(iii)</enum><text display-inline="yes-display-inline">an entity to which section 717(a) of the
			 Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16(a)</external-xref>) applies;</text>
					</clause></subparagraph></paragraph><paragraph id="H84356167FAC8470ABD37F6D0F9475182"><enum>(3)</enum><text>the term
			 <term>employee</term> means—</text>
				<subparagraph id="H7EB852CFF8BE415493A2063CAF637D1D"><enum>(A)</enum><text display-inline="yes-display-inline">an employee (including an applicant), as
			 defined in section 701(f) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C.
			 2000e(f)</external-xref>);</text>
				</subparagraph><subparagraph id="HE0D3585E2A1143D39E5C21762D62619A"><enum>(B)</enum><text>a covered employee
			 (including an applicant), as defined in section 101 of the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>);</text>
				</subparagraph><subparagraph id="H0616D3B31C6C42099AAB32FCEA349EC6"><enum>(C)</enum><text display-inline="yes-display-inline">a covered employee (including an
			 applicant), as defined in
			 <external-xref legal-doc="usc" parsable-cite="usc/3/411">section
			 411(c)</external-xref> of title 3, United States Code;</text>
				</subparagraph><subparagraph id="H9130A147842648669838263B9B6A23EE"><enum>(D)</enum><text display-inline="yes-display-inline">a State employee (including an applicant)
			 described in section 304(a) of the Government Employee Rights Act of 1991 (12
			 U.S.C. 1220(a)); or</text>
				</subparagraph><subparagraph id="H53E5F74F4AFE47108E7A2E008C125BD6"><enum>(E)</enum><text>an employee
			 (including an applicant) to which section 717(a) of the Civil Rights Act of
			 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C.
			 2000e–16(a)</external-xref>) applies; and</text>
				</subparagraph></paragraph><paragraph id="H31AF80CAD01F4E8D93F2C3B6DE966147"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>person</term> has the
			 meaning given such term in section 701(a) of the Civil Rights Act of 1964 (42
			 U.S.C. 2000e(a)).</text>
			</paragraph></section><section id="H2155AB07E70841938244491966A095A8"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect beginning 1 year after the date of the enactment of this Act.</text>
