		<official-title>To amend the Trademark Act of 1946 to correct an error in
		  the provisions relating to remedies for dilution.</official-title>

		<section id="H9E691099272C48A28F5F5BE7535A3109" section-type="section-one"><enum>1.</enum><header>Remedies for
			 dilution</header>
			<subsection id="H3FDAFC45D7744274A4B9A81E150D5D7B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 43(c)(6) of
			 the Act entitled <quote>An Act to provide for the registration and protection
			 of trademarks used in commerce, to carry out the provisions of certain
			 international conventions, and for other purposes</quote>, approved July 6,
			 1946 (commonly referred to as the <quote>Trademark Act of 1946</quote>; 15
			 U.S.C. 1125(c)(6)), is amended by striking subparagraphs (A) and (B) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HACE04026FA9F459ABEFCCF023EAEBF12" style="OLC">
					<subparagraph id="HA783B657F5984C8CABD9B0B25283FFBF"><enum>(A)</enum><text display-inline="yes-display-inline">is brought by another person under the
				common law or a statute of a State; and</text>
					</subparagraph><subparagraph id="HEA221CAACE8B4538AC738661B70DDE3B"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HC7637C5D6C1C46EBA90E5C8C7EA5B40D"><enum>(i)</enum><text>seeks to prevent
				dilution by blurring or dilution by tarnishment; or</text>
						</clause><clause id="HC2D0B04D25894E03B80F2A9D5F956F0A" indent="up1"><enum>(ii)</enum><text>asserts any claim of actual or
				likely damage or harm to the distinctiveness or reputation of a mark, label, or
				form of
				advertisement.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HACB0F48269A94B47A612B2E05D35CC98"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to any
			 action commenced on or after the date of the enactment of this Act.</text>
