		<official-title>To limit the number and pay of individuals serving as
		  special consultants, fellows, or other employees pursuant to subsection (f) or
		  (g) of section 207 of the Public Health Service Act, and for other
		  purposes.</official-title>

		<section id="HA67891A11863491E8F3B5A34796834B8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>HHS Employee Compensation Reform Act of
			 2012</short-title></quote>.</text>
		</section><section id="H949390750D99432EA84D1C88D83EA63E"><enum>2.</enum><header>Employment of
			 special consultants and fellows for the Public Health Service</header>
			<subsection id="H484D30A2CAF147BCB18F7612F44AE87E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 207 of the
			 Public Health Service Act (42 U.S.C. 209) is amended—</text>
				<paragraph id="H4FFA68270EF1464D91B9B557CAC3838A"><enum>(1)</enum><text>by redesignating
			 subsections (h) and (i) as subsections (i) and (j); and</text>
				</paragraph><paragraph id="HF28B7E91028242B2A1C8AB080CD09E5A"><enum>(2)</enum><text>by inserting after
			 subsection (h) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC34D50B21DE74000A27EF02CB57D90DB" style="OLC">
						<subsection id="H4E5A745FB6BB479083DFEF5BC9B46532"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H00706164FEEF46559E381E963A380705"><enum>(1)</enum><text display-inline="yes-display-inline">Subsections (f) and (g) do not authorize
				the designation, appointment, or employment of any special consultant, fellow,
				or other employee by an agency outside of the Department of Health and Human
				Services.</text>
							</paragraph><paragraph id="H3C5DCF94753A4C2AAF965B613752CD81" indent="up1"><enum>(2)</enum><text>Not more than 5 percent of the total
				number of employees of the Department of Health and Human Services may be
				individuals serving pursuant to subsection (f) or (g).</text>
							</paragraph><paragraph id="H281DCA9B8BD1471AA84961B96C1D19AB" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC99CF5315D794B44BEBD48079BDB09C3"><enum>(A)</enum><text display-inline="yes-display-inline">Subject to subparagraph (B), the total
				Federal compensation payable to a covered individual may not, for any 12-month
				period, exceed—</text>
									<clause commented="no" id="H6EA0F6A5DFA1468D8D3F43A8C097BC28" indent="up1"><enum>(i)</enum><text>if such individual is a covered
				individual for the entirety of such period, the dollar amount equal to 150
				percent of the annual rate of pay which, as of the last day of such period, is
				payable for level I of the Executive Schedule under section 5312 of title 5,
				United States Code; or</text>
									</clause><clause commented="no" id="H6BF2F0C718FA4A5FB6CC6D9FC8C4D2EB" indent="up1"><enum>(ii)</enum><text>if such individual is a covered
				individual for less than the entirety of such period, the pro rata equivalent
				of the dollar amount which would apply under clause (i) if such individual were
				a covered individual for the entirety of such period.</text>
									</clause></subparagraph><subparagraph commented="no" id="H6A83FF62F71A4D4DAC0691D94583E27A" indent="up1"><enum>(B)</enum><text>At any time, up to 50 individuals
				serving pursuant to subsection (f) or (g) may be paid without regard to the
				limitation on compensation established by subparagraph (A) if the Secretary
				finds that each such individual’s service is vital to support the activities of
				the Department of Health and Human Services.</text>
								</subparagraph><subparagraph id="H78046450E89A40F78A7B7FFA15CA13D7" indent="up1"><enum>(C)</enum><text>For purposes of subparagraph
				(A)—</text>
									<clause id="H48433C26AD874F3B82C263396B1B8571"><enum>(i)</enum><text>the term <term>compensation</term>
				means basic pay and any allowance, differential, bonus, award, or other similar
				cash payment;</text>
									</clause><clause id="H01406439825B41F5A0DACE3374282022"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>covered individual</term>
				means an individual serving pursuant to subsection (f) or (g); and</text>
									</clause><clause id="HE8BF80C7C9DE4F368379B751159F1CF7"><enum>(iii)</enum><text display-inline="yes-display-inline">the term <term>Federal compensation</term>
				means compensation for service performed pursuant to subsection (f) or (g) or
				both; and</text>
									</clause></subparagraph></paragraph><paragraph id="HB573D3388F244A2E81BF7BA183778F5F" indent="up1"><enum>(4)</enum><text>Not later than 6 months after the
				date of the enactment of this Act, and not later than each December 31
				thereafter, the Secretary shall submit to the Congress a report—</text>
								<subparagraph id="HEDF7833EF44B46D7B319AF1027918513"><enum>(A)</enum><text>specifying the number of individuals
				serving during the preceding 12-month period pursuant to subsection (f) or
				(g);</text>
								</subparagraph><subparagraph id="H2D819DA0808848788E8A6B7A57FB0FFD"><enum>(B)</enum><text>specifying the number of such
				individuals at each agency of the Department of Health and Human Services;
				and</text>
								</subparagraph><subparagraph id="H2E65A269008F474EB9D14D9CC198566A"><enum>(C)</enum><text>including each finding made by the
				Secretary under paragraph (3)(B) to authorize, with respect to service during
				such 12-month period, the payment of an individual without regard to the
				limitation on compensation established by paragraph
				(3)(A).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HFA4D1F2338574BA3A82DF15C3FB09153"><enum>(b)</enum><header>Technical
			 corrections</header><text>Subsection (i) of section 207 of the Public Health
			 Service Act (42 U.S.C. 209), as redesignated by subsection (a), is
			 amended—</text>
				<paragraph id="H75D56B85D382434CB84E2A73FC8BDB01"><enum>(1)</enum><text>by striking
			 <quote>subsection (f)</quote> and inserting <quote>subsection (g)</quote>;
			 and</text>
				</paragraph><paragraph id="HBC96BE2748154108B053F35F1E0BA953"><enum>(2)</enum><text>by striking
			 <quote>subsection (e)</quote> and inserting <quote>subsection (f)</quote>.</text>
				</paragraph></subsection><subsection id="H46CE63BA7CB843CE980573860011C57B"><enum>(c)</enum><header>Applicability</header>
				<paragraph id="HCD1A9876B58145308D368B1DD1FB4C06"><enum>(1)</enum><text>Paragraphs (1) and
			 (3) of section 207(i) of the Public Health Service Act, as added by subsection
			 (a), apply—</text>
					<subparagraph id="HAD395914164D47388DF6D62C408DCF10"><enum>(A)</enum><text>beginning on the
			 date of the enactment of this Act with respect to special consultants, fellows,
			 and other employees appointed on or after the date of the enactment of this
			 Act; and</text>
					</subparagraph><subparagraph id="HAF7B25213DE9403EB5FE7E1BB6BB2E3C"><enum>(B)</enum><text>beginning on the
			 date that is 5 years after the date of the enactment of this Act with respect
			 to special consultants, fellows, and other employees appointed before the date
			 of the enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="HA8C38D7EE1144CB4B3C028DF6CDDF45B"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (2) of section 207(i) of the
			 Public Health Service Act, as added by subsection (a), applies beginning on the
			 date that is 5 years after the date of the enactment of this Act.</text>
