		<official-title>To amend the Internal Revenue Code of 1986 to make
		  qualified biogas property eligible for the energy credit and to permit new
		  clean renewable energy bonds to finance qualified biogas

		<section id="H97EA5F4DAC3845F3A091CCECF93695D5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Biogas Investment Tax Credit Act of
			 2012</short-title></quote>.</text>
		</section><section id="H8659D422B1C94AD497E7664733079A7B" section-type="subsequent-section"><enum>2.</enum><header>Incentives for
			 qualified biogas property</header>
			<subsection id="H24B40B94D40745B48A1193C800C2BAA0"><enum>(a)</enum><header>Incentives for
			 qualified biogas property made eligible for the energy credit</header>
				<paragraph id="H7B222C3D981E4AC894CF36EF2F167645"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (A) of
			 section 48(a)(3) of the Internal Revenue Code of 1986 is amended by striking
			 <quote>or</quote> at the end of clause (vi), by inserting <quote>or</quote> at
			 the end of clause (vii), and by adding at the end the following new
			 clause:</text>

						<clause id="HD01B0038FC374344895E743CA5521899"><enum>(viii)</enum><text display-inline="yes-display-inline">qualified biogas
				property,</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H10207AD49440402E9B201D2FAFCD840A"><enum>(2)</enum><header>Qualified biogas
			 property</header><text>Subsection (c) of section 48 of such Code is amended by
			 adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H129CCC9FEC56433983F2785CD7C676F9" style="OLC">
						<paragraph id="H9B45F937875D4312A1D34787CC1862F9"><enum>(5)</enum><header>Qualified biogas
				property</header>
							<subparagraph id="HD147082D77F0477A9613FCAE702EC060"><enum>(A)</enum><header>In
				general</header><text>The term <term>qualified biogas property</term> means
				property comprising a system which—</text>
								<clause id="H25863D24C482401C92223D5D99EED075"><enum>(i)</enum><text display-inline="yes-display-inline">uses anaerobic digesters or other
				biological, chemical, thermal, or mechanical processes (alone or in
				combination) to convert biomass (as defined in section 45K(c)(3)) into a gas
				which consists of not less than 52 percent methane, and</text>
								</clause><clause id="HCDEC98801C4F453B991B06873D7D3F7F"><enum>(ii)</enum><text>captures such gas
				for use as a fuel.</text>
								</clause></subparagraph><subparagraph id="HF5600937F2264100A6119EBB9EC0BDAF"><enum>(B)</enum><header>Inclusion of
				certain cleaning and conditioning equipment</header><text>Such term shall
				include any property which cleans and conditions the gas referred to in
				subparagraph (A) for use as a fuel.</text>
							</subparagraph><subparagraph id="H436C0A18D5CC41FAB378C620779A8D88"><enum>(C)</enum><header>Termination</header><text>No
				credit shall be determined under this section with respect to any qualified
				biogas property for any period after December 31,
				2018.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H08030327CCD242BBBE699A5E9B5F214F"><enum>(3)</enum><header>Qualified biogas
			 property made eligible for 30 percent credit</header><text>Clause (i) of
			 section 48(a)(2)(A) of such Code is amended by striking <quote>and</quote> at
			 the end of subclause (III) and by adding at the end the following new
			 subclause:</text>
					<quoted-block display-inline="no-display-inline" id="H88F1BE5C38B94531AFC35E8C2072DD51" style="OLC">
						<subclause id="H3D4E5318BD7F4E91998568CF5C361983"><enum>(V)</enum><text display-inline="yes-display-inline">qualified biogas property,
				and</text>
						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5207B16A52D543DFB551DA16BC0DDE13"><enum>(4)</enum><header>Denial of double
			 benefit</header><text>Subsection (e) of section 45 of such Code is amended by
			 adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H976FD5A00CFC4DBEB493ACAEB71A0239" style="OLC">
						<paragraph id="H0C9E719498634345BDDBCBC2CABB7D62"><enum>(12)</enum><header>Coordination
				with energy credit for qualified biogas property</header><text display-inline="yes-display-inline">The term <term>qualified facility</term>
				shall not include any facility which produces electricity from gas produced by
				qualified biogas property (as defined in section 48(c)(5)) if a credit is
				determined under section 48 with respect to such property for the taxable year
				or any prior taxable
				year.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF40B6EBED9754757BEB8978737AD5567"><enum>(5)</enum><header>Effective
			 date</header><text>The amendments made by this subsection shall apply to
			 periods after December 31, 2012, in taxable years ending after such date, under
			 rules similar to the rules of section 48(m) of the Internal Revenue Code of
			 1986 (as in effect on the day before the date of the enactment of the Revenue
			 Reconciliation Act of 1990).</text>
				</paragraph></subsection><subsection id="HB1583D502B634DAFBFFF8A75BC6E0E35"><enum>(b)</enum><header>Qualified biogas
			 property made eligible for financing with new clean renewable energy
			 bonds</header>
				<paragraph id="HF173A4CE51CC406C92C3A1257798381B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (1) of
			 section 54C(d) of the Internal Revenue Code of 1986 is amended by inserting
			 <quote>, or a qualified biogas property (as defined in section
			 48(c)(5)),</quote> before <quote>owned by</quote>.</text>
				</paragraph><paragraph id="HC2C25AB81FC5418E906561598A0FEFDD"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by this subsection shall apply to
			 obligations issued after the date of the enactment of this Act.</text>
				</paragraph></subsection><subsection id="HFC253B134D3548A1998C772990554E3D"><enum>(c)</enum><header>Study of
			 biogas</header><text>The Secretary of the Treasury shall enter into an
			 agreement with the National Renewable Energy Laboratory to undertake a study of
			 biogas. Such agreement shall provide for a written report to be submitted to
			 Congress not later than 2 years after the date of the enactment of this Act.
			 Such report shall address the following issues:</text>
				<paragraph id="H7C68FAE01A3B48CF988DD963853D8724"><enum>(1)</enum><text>The quality of
			 biogas, including a comparison of biogas to natural gas and the identification
			 of any components of biogas which make it unsuitable for injection into
			 existing natural gas pipelines.</text>
				</paragraph><paragraph id="H1F2B5998B88F4CB19C719C2DB3A35363"><enum>(2)</enum><text>Methods for
			 obtaining the highest energy content in biogas, including the use of
			 co-digestion and identifying the optimal feed mixture.</text>
				</paragraph><paragraph id="H67D0C5A8E0B4427E84D83D5E5259F88E"><enum>(3)</enum><text>Recommendations
			 for the expansion of biogas production, including an analysis of the extent to
			 which increasing the methane content of biogas would result in its greater use
			 and an analysis of how the expanded use of biogas could help meet the growing
			 energy needs of the United States.</text>
				</paragraph></subsection></section></legis-body>
