		<official-title>To protect the civil rights of victims of
		  gender-motivated violence and to promote public safety, health, and regulate
		  activities affecting interstate commerce by creating employer liability for
		  negligent conduct that results in an individual’s committing a gender-motivated
		  crime of violence against another individual on premises controlled by the
		  employer, and for other purposes.</official-title>

		<section id="H26B26F1FD42A4D41ACFC1B3AF7CFE564" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Give Workplace Gender Violence Victims
			 Their Day in Court Act of 2012</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H047CB4EE7F2541428CEC3E2547EF71D4" section-type="subsequent-section"><enum>2.</enum><header>Negligently allowing
			 gender-motivated violence</header><text display-inline="no-display-inline">An
			 employer—</text>
			<paragraph id="HAD13AE53E96E433EB5706E4AB59C95C5"><enum>(1)</enum><text>whose business is
			 in or affects interstate or foreign commerce; and</text>
			</paragraph><paragraph id="HB1C88653F94F44828F9D84A291F5D73A"><enum>(2)</enum><text>whose negligent
			 conduct results in a person’s (including a person who acts under color of
			 statute, ordinance, regulation, custom, or usage of any State) committing a
			 crime of violence motivated by gender against another person on premises under
			 the control of the employer;</text>
			</paragraph><continuation-text continuation-text-level="section">shall be
			 liable to the party injured, in an action for the recovery of compensatory and
			 punitive damages, injunctive and declaratory relief, and such other relief as a
			 court may deem appropriate.</continuation-text></section><section id="HE29FC45A69EA4EDBBFC18BE1517591FB"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text>
			<paragraph id="H66ED2197C78E4A7FA2DFD26DBDE1F2C6"><enum>(1)</enum><text>the term
			 <term>crime of violence motivated by gender</term> means a crime of violence
			 committed because of gender or on the basis of gender; and</text>
			</paragraph><paragraph id="H6A19D7035CDF40A08F22E29AA64BBB71"><enum>(2)</enum><text>the term
			 <term>crime of violence</term>—</text>
				<subparagraph id="H41967017E01B44F98C9C100F007704A8"><enum>(A)</enum><text>means an act or
			 series of acts that would constitute a crime, for which imprisonment of more
			 than one year may be imposed, against the person of another if that crime is a
			 crime of violence as defined in section 16 of title 18, United States Code;
			 and</text>
				</subparagraph><subparagraph id="H31183FA94F6D4BF68E73A35B73968B3C"><enum>(B)</enum><text>includes any
			 conduct that would constitute a crime described in subparagraph (A) but for the
			 relationship between the person engaging in that conduct and the individual
			 against whom such conduct is directed.</text>
				</subparagraph></paragraph></section><section id="HAE14A86D83EC483F857E1B3A68347661"><enum>4.</enum><header>Limitation and
			 procedure</header>
			<subsection id="H21C74B9034774E96B9F15D42B838B994"><enum>(a)</enum><header>Limitation</header><text>Nothing
			 in this Act entitles a person to a cause of action under section 1 for random
			 acts of violence unrelated to gender or for acts that cannot be demonstrated,
			 by a preponderance of the evidence, to be motivated by gender.</text>
			</subsection><subsection id="HD2D89D7D8F474FA9A77A8F79703CC5AC"><enum>(b)</enum><header>No prior
			 criminal action</header><text>Nothing in this section requires a prior criminal
			 complaint, prosecution, or conviction to establish the elements of a cause of
			 action under section 1.</text>
			</subsection><subsection id="H1F89536255BD45C3A3330A4242574627"><enum>(c)</enum><header>Concurrent
			 jurisdiction</header><text>The Federal and State courts shall have concurrent
			 jurisdiction over actions brought pursuant to this Act.</text>
			</subsection></section><section id="HB9DC903D3D164233A9EC26F7114917F7"><enum>5.</enum><header>Materials to
			 assist employers</header><text display-inline="no-display-inline">The Equal
			 Employment Opportunity Commission shall create and provide materials to
			 employers regarding personnel policies and safety standards to assist employers
			 in avoiding liability under this Act.</text>
