		<legis-type>A BILL</legis-type>
		<official-title>To amend the Internal Revenue Code of 1986 to permit
		  health plans without a deductible for prenatal, labor and delivery, and
		  postpartum care to be treated as high deductible plans with respect to health
		  savings accounts.</official-title>

		<section id="HB087B16508214A0F8A8F887699DF222B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ensuring Women’s Access to Free-Market Healthcare Act of
			 2012</short-title></quote>.</text>
		</section><section id="H7F105ADAB59D471F8857DD1EE7B08295"><enum>2.</enum><header>HSA high
			 deductible plan safe harbor for absence of prenatal, labor and delivery, and
			 postpartum care deductible</header>
			<subsection id="H2334A7CC736D45C58563174DFC0BD756"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (2) of
			 section 223(c) of the Internal Revenue Code of 1986 is amended by redesignating
			 subparagraph (D) as subparagraph (E) and by inserting after subparagraph (C)
			 the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H71189E3A9F074D71BD6A3E054CB3BD95" style="OLC">
					<subparagraph id="HF8D21BCD6FEE4382A54717E2648BB856"><enum>(D)</enum><header>Safe harbor for
				absence of prenatal, labor and delivery, and postpartum care
				deductible</header>
						<clause id="HB0E5673E7425445A87AAEC7CE888C18C"><enum>(i)</enum><header>In
				general</header><text>A plan shall not fail to be treated as a high deductible
				health plan by reason of failing to have a deductible for prenatal, labor and
				delivery, and postpartum care.</text>
						</clause><clause id="H7A0B80B1EA83400DAE28AD196FD21423"><enum>(ii)</enum><header>Prenatal, labor
				and delivery, and postpartum</header><text display-inline="yes-display-inline">The Secretary, in consultation with the
				American Academy of Pediatrics and American College of Obstetricians and
				Gynecologists, shall by regulation define prenatal, labor and delivery, and
				postpartum care for purposes of this
				subparagraph.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB3A2D94C5C2A4432AEB412DAD736A008"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to taxable
			 years beginning after December 31, 2012.</text>
