			 trade relations for the Russian Federation</header>
			<section id="H870322335EDD4C2BA4B388F940897A32" section-type="subsequent-section"><enum>101.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
				<paragraph id="H98A67610AB244B828CFE89035FC7D20D"><enum>(1)</enum><text>The Russian
			 Federation allows its citizens the right and opportunity to emigrate, free of
			 any heavy tax on emigration or on the visas or other documents required for
			 emigration and free of any tax, levy, fine, fee, or other charge on any
			 citizens as a consequence of the desire of those citizens to emigrate to the
			 country of their choice.</text>
				</paragraph><paragraph id="HCA20858A2AD24990B4CDAE48D4E685F7"><enum>(2)</enum><text>The Russian
			 Federation has been found to be in full compliance with the freedom of
			 emigration requirements under title IV of the Trade Act of 1974 (19 U.S.C. 2431
			 et seq.) since 1994.</text>
				</paragraph><paragraph id="H469E9E026DCC4EA2BA731402CA037782"><enum>(3)</enum><text>The Russian
			 Federation has received normal trade relations treatment since concluding a
			 bilateral trade agreement with the United States that entered into force in
			 1992.</text>
				</paragraph><paragraph id="H9B925109786C4AC1AEA4D1A81404358E"><enum>(4)</enum><text>On December 16,
			 2011, the Ministerial Conference of the World Trade Organization invited the
			 Russian Federation to accede to the World Trade Organization.</text>
				</paragraph></section><section id="HAA2C2E844B944E9E9D8FE231B67084D4"><enum>102.</enum><header>Termination of
			 application of title IV of the Trade Act of 1974 to products of the Russian
			 Federation</header>
				<subsection id="HE6E218F308F445C8A253AAC013513380"><enum>(a)</enum><header>Presidential
			 determinations and extension of nondiscriminatory
			 treatment</header><text>Notwithstanding any provision of title IV of the Trade
			 Act of 1974 (19 U.S.C. 2431 et seq.), the President may—</text>
					<paragraph id="HED80FC910D5B425AA5B6542AFFD2A6DF"><enum>(1)</enum><text>determine that
			 such title should no longer apply to the Russian Federation; and</text>
					</paragraph><paragraph id="H9F60F54279A84DC2B1D7742BC49B1D80"><enum>(2)</enum><text>after making a
			 determination under paragraph (1) with respect to the Russian Federation,
			 proclaim the extension of nondiscriminatory treatment (normal trade relations
			 treatment) to the products of the Russian Federation.</text>
					</paragraph></subsection><subsection id="H7E95B1A011144D2D8B8F27FBB3D88FAF"><enum>(b)</enum><header>Effective date
			 of nondiscriminatory treatment</header><text>The extension of nondiscriminatory
			 treatment to the products of the Russian Federation pursuant to subsection (a)
			 shall be effective not sooner than the effective date of the accession of the
			 Russian Federation to the World Trade Organization.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HB153CF3B05CE489CBF0C2D990F4CF42B"><enum>(c)</enum><header>Termination of
			 applicability of title IV</header><text>On and after the effective date under
			 subsection (b) of the extension of nondiscriminatory treatment to the products
			 of the Russian Federation, title IV of the Trade Act of 1974 (19 U.S.C. 2431 et
			 seq.) shall cease to apply to the Russian Federation.</text>
				</subsection></section></title><title id="H1BBD629B07584BB3A206641D482D7424"><enum>II</enum><header>Trade enforcement
			 measures relating to the Russian Federation</header>
			<section id="H64850BF163494A47889BDE32315B85D4"><enum>201.</enum><header>Reports on
			 implementation by the Russian Federation of obligations as a member of the
			 World Trade Organization and enforcement actions by the United States Trade
			 Representative</header>
				<subsection id="HA676DE9E3CA24DF3A20D7E5AE1FA93BD"><enum>(a)</enum><header>Reports on
			 implementation</header>
					<paragraph id="H3A73B0EE77D74C068C4458A3A43A3259"><enum>(1)</enum><header>In
			 general</header><text>Not later than one year after the effective date under
			 section 102(b) of the extension of nondiscriminatory treatment to the products
			 of the Russian Federation, and annually thereafter, the United States Trade
			 Representative shall submit to the Committee on Finance of the Senate and the
			 Committee on Ways and Means of the House of Representatives a report assessing
			 the following:</text>
						<subparagraph id="HF2C48DDB1A4D4703BF37C00FA1DE1345"><enum>(A)</enum><text>The extent to
			 which the Russian Federation is implementing the WTO Agreement (as defined in
			 section 2 of the Uruguay Round Agreements Act (19 U.S.C. 3501)) and the
			 following agreements annexed to that Agreement:</text>
							<clause id="HDC2F950C690D40D9999AB43327279068"><enum>(i)</enum><text>The
			 Agreement on the Application of Sanitary and Phytosanitary Measures (referred
			 to in section 101(d)(3) of the Uruguay Round Agreements Act (19 U.S.C.
			 3511(d)(3))).</text>
							</clause><clause id="H54BB5EC6AC094194A4513E5A1E6E7753"><enum>(ii)</enum><text>The
			 Agreement on Trade-Related Aspects of Intellectual Property Rights (referred to
			 in section 101(d)(15) of the Uruguay Round Agreements Act (19 U.S.C.
			 3511(d)(15))).</text>
							</clause></subparagraph><subparagraph id="H7392E950FBFB45D48A3079B44CFEE866"><enum>(B)</enum><text>The progress made
			 by the Russian Federation in acceding to, and the extent to which the Russian
			 Federation is implementing, the following:</text>
							<clause id="HCA141AE3F49843C4A205DF1F2E5CDDCE"><enum>(i)</enum><text>The
			 Ministerial Declaration on Trade in Information Technology Products of the
			 World Trade Organization, agreed to at Singapore December 13, 1996 (commonly
			 referred to as the <term>Information Technology Agreement</term>) (or a
			 successor agreement).</text>
							</clause><clause id="HB5A94EAA463B413F94B930D12C8738EC"><enum>(ii)</enum><text>The
			 Agreement on Government Procurement (referred to in section 101(d)(17) of the
			 Uruguay Round Agreements Act (19 U.S.C. 3511(d)(17))).</text>
							</clause></subparagraph></paragraph><paragraph id="HFE356DB2170649CCAC6664E92365A54C"><enum>(2)</enum><header>Plan for action
			 by Trade Representative</header>
						<subparagraph id="H5BF2ED4139CB4038A4C48B9B9632B35B"><enum>(A)</enum><header>In
			 general</header><text>If, in preparing a report required by paragraph (1), the
			 Trade Representative believes that the Russian Federation is not fully
			 implementing an agreement specified in subparagraph (A) or (B) of that
			 paragraph or that the Russian Federation is not making adequate progress in
			 acceding to an agreement specified in subparagraph (B) of that paragraph, the
			 Trade Representative shall, except as provided in subparagraph (B) of this
			 paragraph, include in the report a description of the actions the Trade
			 Representative plans to take to encourage the Russian Federation to improve its
			 implementation of the agreement or increase its progress in acceding to the
			 agreement, as the case may be.</text>
						</subparagraph><subparagraph id="H19A91761ED254D72BC73F6C20A6B8566"><enum>(B)</enum><header>Classified
			 information</header><text>If any information regarding a planned action
			 referred to in subparagraph (A) is classifiable under Executive Order 13526 (75
			 Fed. Reg. 707; relating to classified national security information) or a
			 subsequent Executive order, the Trade Representative shall report that
			 information to the Committee on Finance of the Senate and the Committee on Ways
			 and Means of the House of Representatives by—</text>
							<clause id="H6E4647A83D804932B31F6F5449FB96C6"><enum>(i)</enum><text>including the
			 information in a classified annex to the report required by paragraph (1);
			 or</text>
							</clause><clause id="H0D0F5E18FCFC4C72B222B8F5B9E53E28"><enum>(ii)</enum><text>consulting with
			 the Committee on Finance and the Committee on Ways and Means with respect to
			 the information instead of including the information in the report or a
			 classified annex to the report.</text>
							</clause></subparagraph></paragraph><paragraph id="HC44A1BCDB05D4E6E9511B65F90F6BF81"><enum>(3)</enum><header>Public
			 comments</header>
						<subparagraph id="HCADEB92F6A144646B8F408C68052D3CC"><enum>(A)</enum><header>In
			 general</header><text>In developing the report required by paragraph (1), the
			 Trade Representative shall provide an opportunity for the public to comment,
			 including by holding a public hearing.</text>
						</subparagraph><subparagraph id="H63DF18F6E96D4126A49517EB38560AB7"><enum>(B)</enum><header>Publication in
			 Federal Register</header><text>The Trade Representative shall publish notice of
			 the opportunity to comment and hearing required by subparagraph (A) in the
			 Federal Register.</text>
						</subparagraph></paragraph></subsection><subsection id="H18BA2654EA6A4E199F97C1A58CA746F3"><enum>(b)</enum><header>Report on
			 enforcement actions taken by Trade Representative</header><text>Not later than
			 180 days after the effective date under section 102(b) of the extension of
			 nondiscriminatory treatment to the products of the Russian Federation, and
			 annually thereafter, the United States Trade Representative shall submit to the
			 Committee on Finance of the Senate and the Committee on Ways and Means of the
			 House of Representatives a report describing the enforcement actions taken by
			 the Trade Representative against the Russian Federation to ensure the full
			 compliance of the Russian Federation with its obligations as a member of the
			 World Trade Organization, including obligations under agreements with members
			 of the Working Party on the accession of the Russian Federation to the World
			 Trade Organization.</text>
				</subsection></section><section id="H0735C122E9AC47F6A5DBB37798A0CE62"><enum>202.</enum><header>Promotion of
			 the rule of law in the Russian Federation to support United States trade and
			 investment</header>
				<subsection id="HA3B98B8B8F414998A2C3ABE755CE820E"><enum>(a)</enum><header>Reports on
			 promotion of rule of law</header><text>Not later than one year after the
			 effective date under section 102(b) of the extension of nondiscriminatory
			 treatment to the products of the Russian Federation, and annually thereafter,
			 the United States Trade Representative and the Secretary of State shall jointly
			 submit to the Committee on Finance of the Senate and the Committee on Ways and
			 Means of the House of Representatives a report—</text>
					<paragraph id="H214B82C53D3D44CAA0F65E74E3F8EA36"><enum>(1)</enum><text>on the measures
			 taken by the Trade Representative and the Secretary and the results achieved
			 during the year preceding the submission of the report with respect to
			 promoting the rule of law in the Russian Federation, including with respect
			 to—</text>
						<subparagraph id="HD1280061CEE648DC8BA880A19363CB62"><enum>(A)</enum><text>strengthening
			 formal protections for United States investors in the Russian Federation,
			 including through the negotiation of a new bilateral investment treaty;</text>
						</subparagraph><subparagraph id="HD9081D4C14664F02A7FFC8EE34A4EEA9"><enum>(B)</enum><text>advocating for
			 United States investors in the Russian Federation, including by promoting the
			 claims of United States investors in Yukos Oil Company;</text>
						</subparagraph><subparagraph id="H98CC5F61E82643818948EBDDD64A79DA"><enum>(C)</enum><text>encouraging all
			 countries that are parties to the Convention on Combating Bribery of Foreign
			 Public Officials in International Business Transactions of the Organisation for
			 Economic Co-operation and Development, done at Paris December 17, 1997
			 (commonly referred to as the <quote>OECD Anti-Bribery Convention</quote>),
			 including the Russian Federation, to fully implement their commitments under
			 the Convention to prevent overseas business bribery by the nationals of those
			 countries;</text>
						</subparagraph><subparagraph id="HAD34EF2BC2924BCB9F0EB13AB7494C31"><enum>(D)</enum><text>promoting a
			 customs administration, tax administration, and judiciary in the Russia
			 Federation that are free of corruption; and</text>
						</subparagraph><subparagraph id="H2DBC32C259084F2AB9C62F6B5EBD06A0"><enum>(E)</enum><text>increasing
			 cooperation between the United States and the Russian Federation to expand the
			 capacity for civil society organizations to monitor, investigate, and report on
			 suspected instances of corruption; and</text>
						</subparagraph></paragraph><paragraph id="H1152F8D8A45C4910A35B3818D9D4D512"><enum>(2)</enum><text>that discloses the
			 status of any pending petition for espousal filed with the Secretary by a
			 United States investor in the Russian Federation.</text>
					</paragraph></subsection><subsection id="H427CEF1C2E6E4CCB8AA6F458F203F794"><enum>(b)</enum><header>Anti-Bribery
			 reporting and assistance</header>
					<paragraph id="HE6F673CD9FBF48C18A1C00F9211C8762"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Commerce shall establish and maintain a
			 dedicated phone hotline and secure website, accessible from within and outside
			 the Russian Federation, for the purpose of allowing United States
			 entities—</text>
						<subparagraph id="HA02ED419A0684910ACAD884BB7F3C1FE"><enum>(A)</enum><text>to report
			 instances of bribery, attempted bribery, or other forms of corruption in the
			 Russian Federation that impact or potentially impact their operations;
			 and</text>
						</subparagraph><subparagraph id="H231656C3BF2844DDB429F2EBF43D6A0C"><enum>(B)</enum><text>to request the
			 assistance of the United States with respect to issues relating to corruption
			 in the Russian Federation.</text>
						</subparagraph></paragraph><paragraph id="H6116895741B04A8A81E29729A4954370"><enum>(2)</enum><header>Report
			 required</header>
						<subparagraph id="H84689971C976443485ED5FCF1CEE737F"><enum>(A)</enum><header>In
			 general</header><text>Not later than one year after the effective date under
			 section 102(b) of the extension of nondiscriminatory treatment to the products
			 of the Russian Federation, and annually thereafter, the Secretary of Commerce
			 shall submit to the Committee on Finance of the Senate and the Committee on
			 Ways and Means of the House of Representatives a report that includes the
			 following:</text>
							<clause id="H58B1E51FA1E94B7B8501486139212A26"><enum>(i)</enum><text>The
			 number of instances in which bribery, attempted bribery, or other forms of
			 corruption have been reported using the hotline or website established pursuant
			 to paragraph (1).</text>
							</clause><clause id="HB5BADDF4B2EE4E7B9CD45809080173A0"><enum>(ii)</enum><text>A
			 description of the regions in the Russian Federation in which those instances
			 are alleged to have occurred.</text>
							</clause><clause id="H9B94F46EC03F47E4A48792630100CAFD"><enum>(iii)</enum><text>A
			 summary of actions taken by the United States to provide assistance to United
			 States entities pursuant to paragraph (1)(B).</text>
							</clause><clause id="H4267B8574F674DBF83C2B6CCCC51E1C8"><enum>(iv)</enum><text>A
			 description of the efforts taken by the Secretary to inform United States
			 entities conducting business in the Russian Federation or considering
			 conducting business in the Russian Federation of the availability of assistance
			 through the hotline and website.</text>
							</clause></subparagraph><subparagraph id="H010ACD1E9C454FF6B7FFD945F85185F3"><enum>(B)</enum><header>Confidentiality</header><text>The
			 Secretary shall not include in the report required by subparagraph (A) the
			 identity of a United States entity that reports instances of bribery, attempted
			 bribery, or other forms of corruption in the Russian Federation or requests
			 assistance pursuant to paragraph (1).</text>
						</subparagraph></paragraph></subsection></section><section id="HAC43EEE6D5A540AE866D45CB6D17D550"><enum>203.</enum><header>Reports on
			 laws, policies, and practices of the Russian Federation that discriminate
			 against United States digital trade</header><text display-inline="no-display-inline">Section 181(a) of the Trade Act of 1974 (19
			 U.S.C. 2241(a)) is amended—</text>
				<paragraph id="HA006FFA48CCE40948D1B4B56A7389EFD"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph
			 (4); and</text>
				</paragraph><paragraph id="H130A7E52A8E14268982D54774767F270"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HD98AE48DC8E746F197260778880A9EB6" style="OLC">
						<paragraph id="H6294E35A20BC4989878560EB9EEE4E1A"><enum>(3)</enum><header>Inclusion of
				certain discriminatory laws, policies, and practices of the Russian
				Federation</header><text display-inline="yes-display-inline">For calender year
				2012 and each succeeding calendar year, the Trade Representative shall include
				in the analyses and estimates under paragraph (1) an identification and
				analysis of any laws, policies, or practices of the Russian Federation that
				deny fair and equitable market access to United States digital
				trade.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HF9CD109EFC9146BB88B3F5E61614C546"><enum>204.</enum><header>Efforts to
			 reduce barriers to trade imposed by the Russian Federation</header><text display-inline="no-display-inline">The United States Trade Representative shall
			 continue to pursue the reduction of barriers to trade imposed by the Russian
			 Federation on articles exported from the United States to the Russian
			 Federation through efforts—</text>
				<paragraph id="H43C1CB057CD64641BB7096CE21F0C896"><enum>(1)</enum><text display-inline="yes-display-inline">to negotiate a bilateral agreement under
			 which the Russian Federation will accept the sanitary and phytosanitary
			 measures of the United States as equivalent to the sanitary and phytosanitary
			 measures of the Russian Federation; and</text>
				</paragraph><paragraph id="H9A6C1241AC154ED3BDF4DFE86EE90D15"><enum>(2)</enum><text>to obtain the
			 adoption by the Russian Federation of an action plan for providing greater
			 protections for intellectual property rights than the protections required by
			 the Agreement on Trade-Related Aspects of Intellectual Property Rights
			 (referred to in section 101(d)(15) of the Uruguay Round Agreements Act (19
			 U.S.C. 3511(d)(15))).</text>
				</paragraph></section></title><title id="HE3B945DDB13540C3A48FD6E6F47EBFFA"><enum>III</enum><header>Permanent normal
			 trade relations for Moldova</header>
			<section commented="no" id="H41F64350B38B4CCE88654452216A046E"><enum>301.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
				<paragraph id="HD45A7A78D0424246BB751256A9B65DCB"><enum>(1)</enum><text>Moldova allows its
			 citizens the right and opportunity to emigrate, free of any heavy tax on
			 emigration or on the visas or other documents required for emigration and free
			 of any tax, levy, fine, fee, or other charge on any citizens as a consequence
			 of the desire of those citizens to emigrate to the country of their
			 choice.</text>
				</paragraph><paragraph id="H09DB2AC24616465BAAAA45BE7DC8AD31"><enum>(2)</enum><text>Moldova has been
			 found to be in full compliance with the freedom of emigration requirements
			 under title IV of the Trade Act of 1974 (19 U.S.C. 2431 et seq.) since
			 1997.</text>
				</paragraph><paragraph id="HBE00A85CF22344F3BFF22A3C21D0C49B"><enum>(3)</enum><text>Moldova acceded to
			 the World Trade Organization on July 26, 2001.</text>
				</paragraph></section><section commented="no" id="H69C2ABBAF18443A68A3BA7D99365647C"><enum>302.</enum><header>Termination of
			 application of title IV of the Trade Act of 1974 to products of
			 Moldova</header>
				<subsection commented="no" id="H9B46D63D58014B0EA6834D028FF0E52B"><enum>(a)</enum><header>Presidential
			 determinations and extension of nondiscriminatory
			 treatment</header><text>Notwithstanding any provision of title IV of the Trade
			 Act of 1974 (19 U.S.C. 2431 et seq.), the President may—</text>
					<paragraph commented="no" id="H212E6EB80C4C4E9A98BB516B8DD82551"><enum>(1)</enum><text>determine that
			 such title should no longer apply to Moldova; and</text>
					</paragraph><paragraph commented="no" id="HA409543E0C774BD5B9F8075B3C3CD176"><enum>(2)</enum><text>after making a
			 determination under paragraph (1) with respect to Moldova, proclaim the
			 extension of nondiscriminatory treatment (normal trade relations treatment) to
			 the products of Moldova.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA07440B8141B4A759BD87B30E8C3426C"><enum>(b)</enum><header>Termination of
			 applicability of title IV</header><text>On and after the date on which the
			 President extends nondiscriminatory treatment to the products of Moldova
			 pursuant to subsection (a), title IV of the Trade Act of 1974 (19 U.S.C. 2431
			 et seq.) shall cease to apply to Moldova.</text>
