		<official-title>To require Federal contractors and other recipients of
		  Federal funds to participate in the E-Verify Program for employment eligibility
		  verification, to permanently reauthorize the E-Verify Program, and for other
		  purposes.</official-title>

		<section id="H206C3D2F212D4135AD091BAD8D7D37DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Employee Verification
			 Act</short-title></quote>.</text>
		</section><section id="HCB5CA8ACDD614882A6A46FD0688B637C" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H2C1BF57DA12B417B90DE6D1489C006B4"><enum>(1)</enum><text display-inline="yes-display-inline">The Department of Homeland Security
			 estimates that there were 11.5 million illegal immigrants in the United States
			 in 2011, a population with a traditionally high rate of labor force
			 participation. During this time, 13.7 million Americans were unemployed.</text>
			</paragraph><paragraph id="H85F9D19DF80641328B1FFA4991E5E864"><enum>(2)</enum><text>Pursuant to
			 Executive Order 12989, as amended by Executive Order 13465, contractors and
			 subcontractors that do business with the Federal Government must use the
			 E-Verify Program to verify that their employees are authorized to work in the
			 United States. Additionally, all Federal employees must be screened through the
			 E-Verify Program.</text>
			</paragraph><paragraph id="H80EDD2EC92634E36AC6BA9437701642E"><enum>(3)</enum><text>The E-Verify
			 Program is accurate, effective, and currently in use by more than 350,000
			 employers. Ninety-eight and three-tenths percent of employees are automatically
			 confirmed as work-authorized either instantly or within 24 hours, requiring no
			 employee or employer action.</text>
			</paragraph><paragraph id="HF26B0E24099849FC8490877227B71E46"><enum>(4)</enum><text>The United States
			 Court of Appeals for the Fourth Circuit decided in Chamber of Commerce v. Janet
			 Napolitano that entities that solicit and voluntarily enter into contracts or
			 agreements with the Federal Government can be subject to a requirement for
			 electronic verification of employment eligibility.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H9E5D8AF1DA1646738F86CD1D31CAE3B2" section-type="subsequent-section"><enum>3.</enum><header>Requirement for
			 Federal contractors and other recipients of Federal funds to participate in
			 E-Verify Program</header>
			<subsection id="HF6B485858BF6465598C75331BA142D7B"><enum>(a)</enum><header>In
			 general</header><text>Section 402(e)(1) of the Illegal Immigration Reform and
			 Immigrant Responsibility Act of 1996 (8 U.S.C. 1324a note) is amended by adding
			 at the end the following new subparagraphs:</text>
				<quoted-block display-inline="no-display-inline" id="HA84F1A779A16408EB5055D918F3B1034" style="OLC">
					<subparagraph id="H18038872AB4C4F3AAC95199F4A9F9289"><enum>(C)</enum><header>Federal
				contractors and subcontractors</header>
						<clause id="H23A35ADB14484F109AEF1C74E428E035"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Any Federal
				contractor described in clause (ii), and any subcontractor described in clause
				(iii), shall elect, prior to receipt of any payment under the contract or
				subcontract, to participate in the E-Verify Program described in section 403(a)
				and shall comply with the terms and conditions of such election.</text>
						</clause><clause id="H28CDD7C7B6464520BE73B395915A0103"><enum>(ii)</enum><header>Federal
				contractors described</header><text display-inline="yes-display-inline">A
				Federal contractor is described in this clause if the contractor—</text>
							<subclause id="HA4FAB98D5A88425AAA8D1481469337FD"><enum>(I)</enum><text>employs
				individuals; and</text>
							</subclause><subclause id="H4AF9844FBAA14B7897A0DF5BBFDE60B7"><enum>(II)</enum><text>has been awarded
				(and has not completed performance of) a contract by the Federal Government for
				the procurement of goods or services.</text>
							</subclause></clause><clause id="H525730D9273541E0A702311E9E7C36C3"><enum>(iii)</enum><header>Subcontractors
				described</header><text>A subcontractor is described in this clause if the
				subcontractor—</text>
							<subclause id="HD152EA470BE94E568088C86F7B6611C8"><enum>(I)</enum><text>employs
				individuals; and</text>
							</subclause><subclause id="HDCD7197D882A4AB2BD917050E321E742"><enum>(II)</enum><text>has been awarded
				(and has not completed performance of) a subcontract by a Federal contractor
				described in clause (ii).</text>
							</subclause></clause><clause id="HDEF12BF77C76444C8424BA18EBAF327D"><enum>(iv)</enum><header>Coverage of
				workforce</header><text>In implementing this subparagraph, the Secretary of
				Homeland Security shall ensure that the E-Verify Program is applied to—</text>
							<subclause id="HC4BC6BAA6A0946E98C89660AAE7A2CDF"><enum>(I)</enum><text>all persons hired
				during the contract term by the contractor to perform employment duties within
				the United States;</text>
							</subclause><subclause id="H2F23DC67C61645C289099A323B4E1BA9"><enum>(II)</enum><text>all employees
				assigned by the contractor to perform work within the United States on the
				contract; and</text>
							</subclause><subclause id="HB0E7721845B344F78EA1904D5FD85AE0"><enum>(III)</enum><text>in the case of a
				subcontractor, all employees of the subcontractor who are directly engaged in
				performing work under the contract.</text>
							</subclause></clause><clause id="HC2109B9B3EA945FF92E6DBBD7A378C95"><enum>(v)</enum><header>Exceptions to
				contracts covered</header><text>For purposes of clause (ii)(II), a contract by
				the Federal Government for the procurement of goods or services does not
				include any of the following contracts:</text>
							<subclause id="H67248F7362214E909CE27774F35D3293"><enum>(I)</enum><text>A contract in an
				amount less than the simplified acquisition threshold.</text>
							</subclause><subclause id="H9205BD50587B44598E1FE45D25029A10"><enum>(II)</enum><text>A contract that
				is for the procurement of only commercially available off-the-shelf items (or
				minor modifications to such items) and related services.</text>
							</subclause><subclause id="H3737B290CA4D49A6A4F55C8F3450680C"><enum>(III)</enum><text>A contract with
				a term of less than 120 days.</text>
							</subclause><subclause id="H5E1EC8AC8804408285AD134F2FD16C2E"><enum>(IV)</enum><text>A contract under
				which all work is performed outside the United States.</text>
							</subclause></clause></subparagraph><subparagraph id="HD154D8E2C7E34F2A9D1C2DCE08633A75"><enum>(D)</enum><header>Recipients of
				grants, loans, and other Federal benefits</header>
						<clause id="H1BCD35736F35453DA36125AE30115DBD"><enum>(i)</enum><header>In
				general</header><text>Any recipient of a Federal benefit described in clause
				(ii) shall elect, prior to receipt of the benefit, to participate in the
				E-Verify Program described in section 403(a) and shall comply with the terms
				and conditions of such election.</text>
						</clause><clause id="H046341440726487682D4ECC407CB0ED5"><enum>(ii)</enum><header>Recipient of
				Federal funds described</header><text>A recipient of a Federal benefit is
				described in this clause if the recipient—</text>
							<subclause id="H2F8A83F23E304844AD5B60DC24B83BA9"><enum>(I)</enum><text>employs
				individuals; and</text>
							</subclause><subclause id="HDCFD29EC42A1400480D72F6B938DBFB2"><enum>(II)</enum><text>has received (and
				not completed the term of) a grant, loan, loan guarantee, or cooperative
				agreement from the Federal Government.</text>
							</subclause></clause><clause id="HA3FF25559FCA41A6A8453E4665E913D7"><enum>(iii)</enum><header>Coverage of
				workforce</header><text>In implementing this subparagraph, the Secretary of
				Homeland Security shall ensure that the E-Verify Program is applied to—</text>
							<subclause id="HAB901AF07AA04A0F9BF313A81AFB38A4"><enum>(I)</enum><text>all persons hired
				during the term of the grant, loan, loan guarantee, or cooperative agreement by
				the recipient of the Federal benefit to perform employment duties within the
				United States; and</text>
							</subclause><subclause id="H1E8F77B06F9B4A4FBE61FC7785499A21"><enum>(II)</enum><text>all employees
				assigned by the recipient of the Federal benefit to perform work within the
				United States under the project or activity funded by the grant, loan, loan
				guarantee, or cooperative
				agreement.</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7E3620805CFA45CCA0D2C91AA92DEAFE"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to
			 contracts, grants, loans, loan guarantees, or cooperative agreements entered
			 into, awarded, renewed, or extended, as the case may be, on or after the
			 expiration of the 60-day period beginning on the date of the enactment of this
			 Act.</text>
			</subsection></section><section id="H549BDCC0212540AB89B3FDD80EEA90F7"><enum>4.</enum><header>Permanent
			 reauthorization of E-Verify</header>
			<subsection id="HDAD669E0B5104915850ACD1D8E900E11"><enum>(a)</enum><header>In
			 general</header><text>Section 401 of the Illegal Immigration Reform and
			 Immigrant Responsibility Act of 1996 (8 U.S.C. 1324a note) is amended—</text>
				<paragraph id="HFB5FE82A1A334862ACA0D2E0052D017A"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>pilot</quote>;</text>
				</paragraph><paragraph id="HC59698045621481AA0025EFBE42FF19D"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H211607390E6142C99A2DE4AC27FAB033"><enum>(A)</enum><text>by striking
			 <quote>the pilot programs</quote> and inserting <quote>the programs required
			 under this subtitle</quote>; and</text>
					</subparagraph><subparagraph id="HFCA4D6643EBA4084BBEE8B4A8DDF2602"><enum>(B)</enum><text>by striking
			 <quote>Unless the Congress otherwise provides, the Secretary of Homeland
			 Security shall terminate a pilot program on September 30, 2012.</quote>;
			 and</text>
					</subparagraph></paragraph><paragraph id="H908BEBA6ADDD4A3EB2E3EAB2528F4A30"><enum>(3)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="H91B4DF4F5C3A433A8350849015011843"><enum>(A)</enum><text>by redesignating
			 paragraphs (1), (2), (3), (4), (5), (6), and (7) as paragraphs (4), (1), (5),
			 (2), (3), (7), and (6), respectively; and</text>
					</subparagraph><subparagraph id="H975D678AF6E34BB695BB1CF5BDDA36B4"><enum>(B)</enum><text>by amending
			 paragraph (4), as redesignated, to read as follows:</text>
						<quoted-block id="H882211B894AE46A0A8A754CA2202EE88" style="OLC">
							<paragraph id="HEBDC6687CEF14B339409A513CDB99A5C"><enum>(4)</enum><header>Program</header><text>The
				term <term>program</term> means any of the 3 programs provided for under this
				subtitle.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H78702019D1C549109E3BEE74B0F80C1B"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Subtitle A of title IV of division C of the Illegal
			 Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1324a
			 note) is amended—</text>
				<paragraph id="H50EB7DF01C734F7787F74E0F09048567"><enum>(1)</enum><text>in section 402, by
			 striking <quote>pilot</quote> each place such term appears; and</text>
				</paragraph><paragraph id="H0D3A3D9DC5074F7799E66E0AC52FBFBE"><enum>(2)</enum><text>in section
			 403(a)(2)—</text>
					<subparagraph id="HB57F584555B04AA0AFC1D6A55156D46B"><enum>(A)</enum><text>in subparagraph
			 (A), by amending clause (i) to read as follows:</text>
						<quoted-block id="HAA03D9BCE6514F36882E372947845CAA" style="OLC">
							<clause id="HCDC8FD0D852D4AA2A08EA2315D695F9E"><enum>(i)</enum><text>A
				document referred to in section 274A(b)(1)(B)(ii) of the Immigration and
				Nationality Act (8 U.S.C. 1324a(b)(1)(B)(ii)) shall be designated by the
				Secretary of Homeland Security as suitable for the purpose of identification in
				a program provided for under this
				subtitle.</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HE8D44C14B1734B36ABD47F70688DC903"><enum>(B)</enum><text>in subparagraph
			 (B), by striking <quote>pilot</quote>.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
