		<section id="H64B973A97D8C42D6B0684DE28D457DF3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Student Veteran Academic Counseling
			 Enhancement Act</short-title></quote> or the <quote><short-title>Student Veteran ACE Act</short-title></quote>.</text>
		</section><section id="HE8E19C12BC91417AAE752A2DBD693D19" section-type="subsequent-section"><enum>2.</enum><header>Educational counseling
			 for veterans</header>
			<subsection id="HB9F42E699160465EAFB86A03B908C484"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 36 of title
			 38, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H9941D767656B41738739D1FEE11AF4EE" style="USC">
					<section id="H8044164825A74EE8BECD0E496474CBA8"><enum>3698.</enum><header>Educational
				counseling</header>
						<subsection id="H414754D43EB84722A585DE89E6283EF8"><enum>(a)</enum><header>Provision of
				counseling</header><paragraph commented="no" display-inline="yes-display-inline" id="H53700165DBDA4ACE9E5921A7D5B2370F"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall make available
				educational counseling under this section to covered students in accordance
				with paragraph (4).</text>
							</paragraph><paragraph commented="no" id="HE3B1EB5595A14911889AD7564FACF796" indent="up1"><enum>(2)</enum><text>An institution offering a program of
				education may only be approved for purposes of this chapter if such institution
				transmits to the Secretary information necessary for the Secretary to provide
				educational counseling under this section, including information relating to
				matriculation requirements, degree information, and enrollment requirements and
				deadlines.</text>
							</paragraph><paragraph id="HB5B70B9DF7474086AC64F8020A851972" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In carrying out paragraph (1), the
				Secretary shall—</text>
								<subparagraph id="H7D08B85B6C3548838E250D3FCD71C335"><enum>(A)</enum><text>assign one educational counselor per
				each 100 covered students in a geographical area as determined by the
				Secretary; and</text>
								</subparagraph><subparagraph id="HA4CEE3F45C1C4F2AA639EDC76EEC0959"><enum>(B)</enum><text>provide covered students who are
				located in remote areas that are not within a geographical area determined
				under subparagraph (A) with adequate opportunities to receive counseling under
				this section.</text>
								</subparagraph></paragraph><paragraph commented="no" id="HE3198DB13BA14945A7C3F4A10365EB28" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB120AE6CA32E4E07BC85F39732302DF2"><enum>(A)</enum><text display-inline="yes-display-inline">A covered student who is a veteran shall
				automatically receive educational counseling under this section unless the
				student declines to receive such counseling pursuant to subparagraph
				(C).</text>
								</subparagraph><subparagraph commented="no" id="H4F371048A00C443AB59F9E56B951A9B2" indent="up1"><enum>(B)</enum><text>A covered student who is not a
				veteran may elect to receive educational counseling under this section.</text>
								</subparagraph><subparagraph commented="no" id="HF24090D6DBE9481AAC8F1A4525FE353B" indent="up1"><enum>(C)</enum><text>The Secretary shall ensure that a
				covered student may decline or elect to receive educational counseling under
				this section pursuant to subparagraph (A) or (B), as the case may be, through a
				streamlined process on the Internet Web site of the Department.</text>
								</subparagraph></paragraph></subsection><subsection id="HA2F5B3E968F942909B26FC506243678D"><enum>(b)</enum><header>Scope of
				counseling</header><text display-inline="yes-display-inline">In providing
				educational counseling under this section to covered students enrolled in an
				institution, an educational counselor shall—</text>
							<paragraph id="H1D897364FE1B40CA93B796A6FD81FE04"><enum>(1)</enum><text display-inline="yes-display-inline">answer inquiries by such students regarding
				educational assistance provided by the Department;</text>
							</paragraph><paragraph id="H07B86190256E4932B0747F21934E8A90"><enum>(2)</enum><text>coordinate with
				the institution to resolve inquiries described by paragraph (1), including
				inquiries regarding the payment of such assistance;</text>
							</paragraph><paragraph id="HB0CBAA87DF7449318288EEF264BBF271"><enum>(3)</enum><text>assist such
				students with applications for such assistance;</text>
							</paragraph><paragraph id="H4C3D31E62B754232A427757562EC814E"><enum>(4)</enum><text>act as a liaison
				between the Department and the institution;</text>
							</paragraph><paragraph id="HAB11A92BF563457FA464750DFA7A2F00"><enum>(5)</enum><text>provide academic
				counseling and transition assistance, including—</text>
								<subparagraph id="HB133BC5320E04E8CBC78A9D2E179A08A"><enum>(A)</enum><text>discussing course
				work, academic goals, degree progress, workload, and other relevant topics;
				and</text>
								</subparagraph><subparagraph id="H5BB5F3C061A946AAB0DF2AEF3494E429"><enum>(B)</enum><text display-inline="yes-display-inline">providing guidance on—</text>
									<clause id="HBF2713BC96F44EBA90516146B24D6E46"><enum>(i)</enum><text>selecting
				courses;</text>
									</clause><clause id="H83D3C531BFF04F34A833A90E51E05556"><enum>(ii)</enum><text>seeking—</text>
										<subclause id="HF0007B3EAD87412FB66E9D75B92681A9"><enum>(I)</enum><text>additional
				financial resources;</text>
										</subclause><subclause id="H248B596DDEF74EFFA7B4362C7AB4C6C5"><enum>(II)</enum><text>student support
				services;</text>
										</subclause><subclause id="HEC85E7B4420543F790E183D7ABD08B4E"><enum>(III)</enum><text>tutoring;
				and</text>
										</subclause><subclause id="H92A4FF6853AB47F1B373EB69B5ED4949"><enum>(IV)</enum><text>job placement
				counseling; and</text>
										</subclause></clause><clause id="H864D5034FE5040639FD35C9FBFEA2107"><enum>(iii)</enum><text>understanding
				benefits provided by the Department and the requirements for receiving
				educational assistance provided by the Department; and</text>
									</clause></subparagraph></paragraph><paragraph id="H4594F93016E64C9E8828C5F3ACCE4F9B"><enum>(6)</enum><text>carry out relevant
				outreach activities.</text>
							</paragraph></subsection><subsection id="HFBBE34E071A546B08F7551CB09399872"><enum>(c)</enum><header>Location of
				counselors</header><paragraph commented="no" display-inline="yes-display-inline" id="HA58253BCF2734DB38024615FFF4A40ED"><enum>(1)</enum><text display-inline="yes-display-inline">An educational counselor may be
				located—</text>
								<subparagraph id="HB818A606ADE94D0BB9A4CABCF1E5B147" indent="up1"><enum>(A)</enum><text>on the campus or facility of an
				institution that elects to allow such counselor to be located at the
				institution; or</text>
								</subparagraph><subparagraph id="H610B7C206D364C31836C19CF876BE2B1" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">at
				a facility of the Department, including a Vet Center established under section
				1712A of this title or a mobile Vet Center.</text>
								</subparagraph></paragraph><paragraph id="HCCECC6FFA2A642A383B9A67ABEB050A0" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that an
				educational counselor is able to provide counseling to covered students through
				the use of interactive technology, including video conferencing using common
				Internet applications.</text>
							</paragraph></subsection><subsection id="HB1124F22745F4FB289762FCCF2D5017E"><enum>(d)</enum><header>Preference</header><text display-inline="yes-display-inline">In hiring educational counselors under this
				section, the Secretary shall apply the principles of preference for the hiring
				of veterans established in subchapter I of chapter 33 of title 5.</text>
						</subsection><subsection commented="no" id="H751E5DF9BD1B4242840FC01398EB2030"><enum>(e)</enum><header>Periodic
				counseling sessions</header><paragraph commented="no" display-inline="yes-display-inline" id="H43AD169F14AF4CB6839FEE91FF5AAF04"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided by paragraph (3), each
				covered student assigned an educational counselor under this section shall
				attend at least one counseling session per quarter, semester, or term, as the
				case may be, with such counselor.</text>
							</paragraph><paragraph commented="no" id="HBBD0DDA996244AA287C25AD786D3A099" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Except as provided by paragraph (3), an
				educational counselor shall notify the Secretary and the relevant institution
				of any covered student who does not attend a counseling session under paragraph
				(1).</text>
							</paragraph><paragraph commented="no" id="H6E99171A7A884B4E87500607A72CDC21" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0DA68F99C9C94ACBBD6CEAB8EB3DB550"><enum>(A)</enum><text>The Secretary may waive
				the periodic counseling sessions under paragraph (1) for a covered student if
				the Secretary determines that such sessions would place an undue hardship on
				the student.</text>
								</subparagraph><subparagraph commented="no" id="H1D8093B9953347A0B6A7FA56DFE1B998" indent="up1"><enum>(B)</enum><text>Paragraph (1) and (2) shall not apply
				to a covered student who declines to receive educational counseling under this
				section pursuant to subsection (a)(4)(A).</text>
								</subparagraph></paragraph></subsection><subsection id="H1C5470AC41CB4D0C9A393125B56910FB"><enum>(f)</enum><header>Annual
				report</header><text display-inline="yes-display-inline">The Secretary shall
				submit to the Committees on Veterans’ Affairs of the Senate and the House of
				Representatives an annual report on the educational counseling provided under
				this section, including the following information listed by each
				institution:</text>
							<paragraph id="H7B210AD2B069496D9152179FA767B2E0"><enum>(1)</enum><text>The number of
				covered students who received such counseling during the year covered by the
				report.</text>
							</paragraph><paragraph id="H0A075A83863F4D209A4B452FE5E4F4EF"><enum>(2)</enum><text>The number of
				covered students who declined such counseling under subsection (a)(4) during
				such year.</text>
							</paragraph><paragraph id="HD933A6A2687F461F879CA45E7A037A0E"><enum>(3)</enum><text>The number of
				covered students issued a waiver under subsection (e)(3) during such
				year.</text>
							</paragraph><paragraph id="HE0D1F0B53D2B467F9584188E326AA5FB"><enum>(4)</enum><text display-inline="yes-display-inline">For each quarter, semester, or term of the
				institution covered by the report, the number of failing grades earned by
				covered students receiving such counseling.</text>
							</paragraph><paragraph id="H5EEB0DDB8D694FF9A2858C725A753520"><enum>(5)</enum><text display-inline="yes-display-inline">The graduation rate of covered students who
				received such counseling as compared to the overall graduation rate of students
				during such year.</text>
							</paragraph></subsection><subsection id="HB335A67292D2422FB384015F7108C3EC"><enum>(g)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H63600B26476A4971B021862093B973E9"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered student</term> means
				an individual pursuing an approved program of education using educational
				assistance under chapter 30, 32, 33, or 35 of this title or chapter 1606 or
				1607 of title 10.</text>
							</paragraph><paragraph id="H1C1DADE0541B4C1EAD1FAF632A83B0CF"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>educational counselor</term>
				means an employee of the Department who provides educational counseling under
				this section.</text>
							</paragraph><paragraph id="H60ABFFC3F6434A1F87F63CF1D1A2B5EB"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>institution</term> means an
				institution that offers an approved program of education.</text>
							</paragraph><paragraph id="H8C04D50538C84ED28566506A7B220F4F"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>approved program of
				education</term> means a program of education that may be pursued using
				educational assistance under chapter 30, 32, 33, or 35 of this title or chapter
				1606 or 1607 of title
				10.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H487E62E112E74559972C2ECDA38CFC59"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of such chapter is amended by adding after the item
			 relating to section 3697A the following new item:</text>

						<toc-entry level="section">3698. Educational
				counseling.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H33D006166B6040C6AA6490537E3235CF"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date that is 180 days after the date of the enactment of this Act.</text>
			</subsection><subsection id="HE509F4B2B3B14B0DA9FE0D686A38D952"><enum>(d)</enum><header>Use of current
			 programs</header><text>The Secretary of Veterans Affairs may—</text>
				<paragraph id="H1893574E601649FE96A54B1FED4D345E"><enum>(1)</enum><text display-inline="yes-display-inline">use a current program of the Department of
			 Veterans Affairs as of the date of the enactment of this Act, including the
			 VetSuccess on Campus program, to carry out section 3698 of title 38, United
			 States Code, as added by subsection (a), if the Secretary determines such
			 program meets the requirements of such section; or</text>
				</paragraph><paragraph id="H09EA4594D9864BF68695538F7D69DFE7"><enum>(2)</enum><text>expand such a
			 current program to carry out such section 3698.</text>
				</paragraph></subsection><subsection commented="no" id="H31240506271B41279C01B3EBFB956AFA"><enum>(e)</enum><header>Cooperation and
			 consultation</header><text>The Secretary of Veterans Affairs shall consult and
			 cooperate with the Secretary of Defense, the Secretary of Education, and any
			 other appropriate head of a Federal department or agency in carrying out the
			 amendments made by this Act.</text>
			</subsection></section><section id="H201947731DF0450AA2F75B2486216878"><enum>3.</enum><header>Training and
			 counseling so veterans and members of the Armed Forces can make informed
			 decisions about education</header>
			<subsection id="H352C18FE9CCD4F999D8FD71502642FC5"><enum>(a)</enum><header>In
			 general</header><text>Chapter 36 of title 38, United States Code, is further
			 amended by adding after section 3698, as added by section 2(a), the following
			 new section:</text>
				<quoted-block display-inline="no-display-inline" id="H2DA9915241DA409C9004FFC61F49A606" style="USC">
					<section id="H0A8A4F0694E4401CABC8D6679DB3A040"><enum>3699.</enum><header>Required
				one-on-one educational counseling</header>
						<subsection id="H8FB89CC2FB564AEEBA89B35EF31AC0BC"><enum>(a)</enum><header>Provision of
				counseling required</header><paragraph commented="no" display-inline="yes-display-inline" id="H1528D43BA7424ADFBB61FE3369C3B93F"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
				provide individualized, one-on-one educational counseling to an individual
				considering pursuing a program of education with assistance furnished under
				this chapter or any of chapters 30 through 35 of this title unless the
				individual declines to receive such counseling. The Secretary shall ensure that
				an individual may decline to receive such counseling through a streamlined
				process on the Internet Web site of the Department of Veterans Affairs.</text>
							</paragraph><paragraph id="HF20DD485648744C1B22CBD9945E5F5A8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall provide
				individualized, one-on-one educational counseling to an individual considering
				pursuing a program of education with assistance furnished under chapter 106A or
				1606 of title 10 unless the individual declines to receive such counseling. The
				Secretary shall ensure that an individual may decline to receive such
				counseling through a streamlined process on the Internet Web site of the
				Department of Defense.</text>
							</paragraph></subsection><subsection id="HDC73E75B78224A23BFAC15B773D7E404"><enum>(b)</enum><header>Time and manner
				of counseling</header><paragraph commented="no" display-inline="yes-display-inline" id="H5D5119D5CD0642F18D6FE83C31B1251D"><enum>(1)</enum><text>Counseling provided
				under subsection (a) to an individual described in such subsection considering
				a program of education shall be provided at or before the individual enrolls in
				such program as follows:</text>
								<subparagraph id="HFA07063E3EE143449EC1FEB9CE3C68A7" indent="up1"><enum>(A)</enum><text>To such individuals who have received
				fewer than <fraction>1/3</fraction> of the credits necessary to complete the
				program of education, a complete version of such counseling.</text>
								</subparagraph><subparagraph id="H5A9221FA38DC4E79A860F4754F4A181C" indent="up1"><enum>(B)</enum><text>To such individuals who have received
				<fraction>1/3</fraction> or more of the credits necessary to complete the
				program of education, a condensed version of such counseling as the Secretary
				of Veterans Affairs or the Secretary of Defense, as the case may be, considers
				appropriate.</text>
								</subparagraph></paragraph><paragraph id="H4D540D9E74BC4FDD95CE3900416F12DA" indent="up1"><enum>(2)</enum><text>To the extent practicable, counseling
				provided under subsection (a) to an individual described in paragraph (1)(A) of
				this subsection shall be provided in person.</text>
							</paragraph><paragraph id="H6117573910CB4C37B68E19A3F4238149" indent="up1"><enum>(3)</enum><text>The Secretary of Veterans Affairs and
				the Secretary of Defense shall each establish, by regulation, procedures by
				which individuals may receive counseling provided under subsection (a) when
				receipt of such counseling in person is not practicable.</text>
							</paragraph></subsection><subsection id="HB25CA9F753454BD18427BDCD1454B00F"><enum>(c)</enum><header>Elements</header><text>A
				complete version of counseling provided under subsection (b)(1) for an
				individual shall include the following:</text>
							<paragraph id="HD4F8CC79B28B4F6BADEE0A222777B19F"><enum>(1)</enum><text>An overview of
				educational assistance available to the individual under this chapter and
				chapters 30 through 35 of this title or under chapters 106A and 1606 of title
				10, as the case may be.</text>
							</paragraph><paragraph id="H2B35E3AAC6F54195916E261D10C544CA"><enum>(2)</enum><text>Development of a
				personalized academic and career plan.</text>
							</paragraph><paragraph id="H3779A911E4B049EEAB93150982B93CA9"><enum>(3)</enum><text>An overview of the
				information disclosed and made readily available under section 3672(f)(1) of
				this title relevant to the academic and career plan developed under paragraph
				(2).</text>
							</paragraph><paragraph id="HFAA3E2D6E8D84B8082585E82452AA0B3"><enum>(4)</enum><text>A discussion of
				how enrollment in the program of education at the educational institution will
				affect the individual's academic and career plan and the financial implications
				for such individual of such enrollment.</text>
							</paragraph><paragraph id="H20E8DE10550D4D8FB571F47B7C1C569C"><enum>(5)</enum><text>An introduction to
				the College Navigator Internet Web site of the Department of Education.</text>
							</paragraph></subsection><subsection id="H69356B9743714566A46986F26F9700D7"><enum>(d)</enum><header>Qualified
				counselors</header><text>Counseling provided under subsection (a) may only be
				provided by properly trained counselors, as determined by the Secretary of
				Veterans Affairs and the Secretary of Defense.</text>
						</subsection><subsection id="HAC555CAA6E694D8CBF3935B4088478C7"><enum>(e)</enum><header>Use of
				information disclosed by educational institutions</header><text>In providing
				educational assistance under this section, the Secretary of Veterans Affairs
				and the Secretary of Defense shall, to the degree practicable, use the
				information disclosed and made readily available under section 3672(f)(1) of
				this title.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HCE760123DCBC40199A92F41ED2F8BA32"><enum>(f)</enum><header>Links to College
				Navigator Internet Web Site of Department of Education</header><text>The
				Secretary of Veterans Affairs and the Secretary of Defense shall provide links
				on the Internet Web sites of the Department of Veterans Affairs of the
				Department of Defense, respectively, to the College Navigator Internet Web site
				of the Department of Education in such a manner as the Secretary of Veterans
				Affairs and the Secretary of Defense consider appropriate to inform veterans
				and members of the Armed Forces of the availability of and the benefits of
				using the College Navigator Internet Web
				site.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4C58408D3B9A490A9E11B3D01F436192"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for chapter 36 of such title, as
			 amended by section 2(b), is amended by adding at the end the following new
			 item:</text>

			 shall take effect on August 1, 2013, and shall apply with respect to
			 individuals considering pursuing programs of education as described in
			 subsection (a) of such section after such date.</text>
			</subsection></section><section id="H13050C196EF64846AD3F0C42682E602E"><enum>4.</enum><header>Repeal of
			 limitation on payments for contract educational and vocational counseling
			 provided by Secretary of Veterans Affairs</header><text display-inline="no-display-inline">Section 3697 of title 38, United States
			 Code, is amended—</text>
			<paragraph id="H06D75077C443426EA168F79E086C312F"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (b);</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B0BB1D117DA4AEABC60A0C7A26DD75B"><enum>(2)</enum><text>in subsection (a),
			 by striking <quote>(a) Subject to subsection (b) of this section,
			 educational</quote> and inserting <quote>Educational</quote>; and</text>
			</paragraph><paragraph commented="no" id="HB14A68097FFD478DA422FF663A6552D2"><enum>(3)</enum><text>by striking
			 <quote>section 3697A</quote> and inserting <quote>sections 3697A, 3698, or
			 3699</quote>.</text>
			</paragraph></section><section id="H5638472BA7B141288E834FFAAF4DDEA6" section-type="subsequent-section"><enum>5.</enum><header>Veterans' education
			 consumer complaint tracking system</header>
			<subsection id="H717CC58A4D3F4A29BF5D4C42F06BA20A"><enum>(a)</enum><header>In
			 general</header><text>Chapter 36 of title 38, United States Code, is further
			 amended by inserting after section 3693 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HE53247BE93E34AD5AC617A0765A94677" style="USC">
					<section id="H82E1E4C345AB43818FFD4FC408D750F2"><enum>3693A.</enum><header>Complaint
				tracking system</header>
						<subsection id="H3BB94E619A7440F99008E25CA23805AD"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				the enactment of this section, the Secretary shall establish a system to
				collect, process, and track complaints submitted to the Secretary by
				individuals who are enrolled in programs of education at educational
				institutions to report instances of fraud, waste, and abuse by such
				institutions with respect to the benefits and services provided by such
				institutions to such individuals.</text>
						</subsection><subsection id="HECF8201EB9424B2AA540FF45C4220345"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">This system established under subsection
				(a) shall meet the following requirements:</text>
							<paragraph id="H0F3C37797AC14B52B14E0459CAF6A779"><enum>(1)</enum><text>The system shall
				create an individual case number for each complaint processed and tracked in
				the system.</text>
							</paragraph><paragraph id="H305C933DA2D542CBAF657205C31DC5BF"><enum>(2)</enum><text>The system shall
				allow for the reporting of complaints, disaggregated by educational
				institution.</text>
							</paragraph><paragraph id="H9129ECB46F1B42B8992B8E23A35DF60F"><enum>(3)</enum><text>The system shall
				allow for the reporting of complaints, disaggregated by topic or subject
				matter.</text>
							</paragraph><paragraph id="HA390E304333F40769D7A8AD5F92B094B"><enum>(4)</enum><text>The system shall
				allow for the submittal of complaints by—</text>
								<subparagraph id="H1F47D16D9D8F4384BCC5AE8A471AF7BA"><enum>(A)</enum><text>Internet Web site;
				and</text>
								</subparagraph><subparagraph id="H56516F0A361647B8B65031A7C34285FA"><enum>(B)</enum><text>telephone via a
				toll-free number that is available every day at all hours.</text>
								</subparagraph></paragraph><paragraph id="H2B0E08C6C3D5426892BFB2FA0A41E0EC"><enum>(5)</enum><text>The system shall
				allow for the sharing of complaints with the following:</text>
								<subparagraph id="H9F72B8CB496C49E6A2B61CE6E1ABAF22"><enum>(A)</enum><text>The educational
				institutions that are the subjects of the complaints.</text>
								</subparagraph><subparagraph id="H941BEEE37F524E35AAAE7D9B4124D40D"><enum>(B)</enum><text>The Secretary of
				Education.</text>
								</subparagraph><subparagraph id="H971FD85BA656490E82430606CEBF1983"><enum>(C)</enum><text>The Secretary of
				Defense.</text>
								</subparagraph><subparagraph id="H9DC673E63EFE4744AE4D3F7C76229D91"><enum>(D)</enum><text>State approving
				agencies.</text>
								</subparagraph><subparagraph id="H9C53E00A14C74896A848E19016685CFA"><enum>(E)</enum><text>Nationally or
				regionally recognized accrediting agencies and associations.</text>
								</subparagraph><subparagraph id="H9004F48836454858983FCBBEFB1604F2"><enum>(F)</enum><text>Such other Federal
				agencies as the Secretary of Veterans Affairs considers appropriate.</text>
								</subparagraph></paragraph></subsection><subsection id="H0AF4ABFFAFDF440F9FA7DAB8746D2CAA"><enum>(c)</enum><header>Outreach</header><text>The
				Secretary shall conduct such outreach as may be necessary to inform individuals
				described in subsection (a) of the system and process established under such
				subsection.</text>
						</subsection><subsection id="H0E48495A04904D99AEEAD016C65A5F26"><enum>(d)</enum><header>Consideration by
				State approving agencies</header><text>Whenever a State approving agency
				considers whether to approve a course of education of an educational
				institution under this chapter, the State approving agency shall review and
				take into consideration the complaints processed and tracked by the system
				established under subsection (a) regarding the educational institution.</text>
						</subsection><subsection id="HD394A17667EB48229C69594D59F8DF52"><enum>(e)</enum><header>Privacy</header><paragraph commented="no" display-inline="yes-display-inline" id="HCF5886F5D8B54624B5BDF6F093451425"><enum>(1)</enum><text>Whenever a complaint is
				shared under subsection (b)(5), the complaint shall be anonymized, unless the
				complainant gives permission to the Secretary to share the complainant's
				identity.</text>
							</paragraph><paragraph id="HD47C8867AB2E4C1D9D6EDE2E11AFD474" indent="up1"><enum>(2)</enum><text>The Secretary may not share a
				complaint under subsection (b)(5) with an educational institution if the
				complainant requests that such complaint not be shared with an educational
				institution.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H95A84782779E411E97233413FEBA351B"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 36 of
			 such title is amended by inserting after the item relating to section 3693 the
			 following new item:</text>
