		  high-risk areas identified by such States, to make permanent Forest Service and
		  Bureau of Land Management authority to conduct good-neighbor cooperation with

			 title</header><text>This Act may be cited as the <quote><short-title>Healthy Forest Management Act of
			 2012</short-title></quote>.</text>

			</subsection></section><section id="HB94EC4D7D8A540598775E439247D2E15"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HE0C23CFD822548F488D5DDE172EEDFEF"><enum>(1)</enum><header>Emergency
			 hazardous fuels reduction project</header><text>The term <quote>emergency
			 hazardous fuels reduction project</quote> means a project or activity carried
			 out in a high-risk area to address the bark beetle epidemic, drought, or
			 deteriorating forest health conditions and the resulting imminent risk of
			 devastating wildfires.</text>
			</paragraph><paragraph id="H4472114417224310A177C2099F7C7A7E"><enum>(2)</enum><header>High-risk
			 area</header><text>The term <quote>high-risk area</quote> means an area of
			 National Forest System land or public lands identified under section 4 as an
			 area suffering from the bark beetle epidemic, drought, or deteriorating forest
			 health conditions, with the resulting imminent risk of devastating wildfires,
			 or otherwise at high risk for bark beetle infestation, drought, or
			 wildfire.</text>
			</paragraph><paragraph id="H3FADC9807651417388F187827E8C9E31"><enum>(3)</enum><header>National forest
			 system</header><text>The term <quote>National Forest System</quote> has the
			 meaning given that term in section 11(a) of the Forest and Rangeland Renewable
			 Resources Planning Act of 1974 (16 U.S.C. 1609(a)).</text>
			</paragraph><paragraph id="H9EFA7FB1D3914A1CA4AEC8ED0393BC11"><enum>(4)</enum><header>Public
			 lands</header><text>The term <quote>public lands</quote> has the meaning given
			 that term in section 103(e) of the Federal Land Policy and Management Act of
			 1976 (43 U.S.C. 1702(e)).</text>
			</paragraph><paragraph id="H670F8FE23EDB490BBEA18CC622D50BC4"><enum>(5)</enum><header>Secretary
			 concerned</header><text>The term <quote>Secretary concerned</quote>
			 means—</text>
				<subparagraph id="HA277891A3597478EA1D2E921F991EFDC"><enum>(A)</enum><text>the Secretary of
			 Agriculture, with respect to the National Forest System; and</text>
				</subparagraph><subparagraph id="HD523ABB5A5464A98AC2E5A4FA9C67639"><enum>(B)</enum><text>the Secretary of
			 the Interior, with respect to public lands.</text>
				</subparagraph></paragraph><paragraph id="H5B246B92F5ED42E1BAFE583E3CF98FE2"><enum>(6)</enum><text>The term
			 <quote>State</quote> means any of the several States containing National Forest
			 System land or public lands. The term includes the Commonwealth of Puerto
			 Rico.</text>
			</paragraph></section><section id="H5492446BA14D476B8A1056B372D9052C"><enum>3.</enum><header>Congressional
			 declaration of bark beetle epidemic, drought, deteriorating forest health
			 conditions, and high risk of wildfires in States as imminent
			 threat</header><text display-inline="no-display-inline">Congress hereby
			 declares that the bark beetle epidemic, drought, and deteriorating forest
			 health conditions on National Forest System land and public lands in the
			 States, with the resulting imminent risk of devastating wildfires that pose a
			 significant threat to the economic stability of communities in the affected
			 areas and the health, safety, and well-being of residents, firefighters, and
			 visitors to the areas, is an <quote>imminent threat</quote> within the meaning
			 of section 294.12(b)(1) of title 36, Code of Federal Regulations (2002 Edition)
			 and any existing or pending roadless area management rule applicable to a
			 State.</text>
		</section><section id="H0F4F1ED23E7B49F2A533B5CFBC9BC7D9"><enum>4.</enum><header>State designation
			 of high-risk areas of National Forest System and public lands</header>
			<subsection id="HAD14F6DAAAA6408CA0AB48C3E5E7A3FD"><enum>(a)</enum><header>Designation
			 authority</header><text>The Governor of a State may designate high-risk areas
			 of the National Forest System and public lands in the State for the purposes of
			 addressing—</text>
				<paragraph id="H08667AD1ED9C4D76A24FF314F103F630"><enum>(1)</enum><text>deteriorating
			 forest health conditions in existence as of the date of the enactment of this
			 Act due to the bark beetle epidemic or drought, with the resulting imminent
			 risk of devastating wildfires; and</text>
				</paragraph><paragraph id="HBA0AB949B46F4FDE825763F37F0449CE"><enum>(2)</enum><text>the future risk of
			 insect infestations or disease outbreaks through preventative treatments to
			 improve forest health conditions.</text>
				</paragraph></subsection><subsection id="H5DEB40C647E94DAA936B2ED1468F192E"><enum>(b)</enum><header>Consultation</header><text>In
			 designating high-risk areas, the Governor of a State shall consult with county
			 government from affected counties and with affected Indian tribes.</text>
			</subsection><subsection id="HB593D87A50B24C5189DAA1602E33601F"><enum>(c)</enum><header>Exclusion of
			 certain areas</header><text>The following National Forest System land or public
			 lands may not be designated as a high-risk area:</text>
				<paragraph id="HA1673F5F8DBF41739D629F9824F63852"><enum>(1)</enum><text>A
			 component of the National Wilderness Preservation System.</text>
				</paragraph><paragraph id="HB7D69148EE1640FA9CE9E0B385DD0767"><enum>(2)</enum><text>A
			 National Monument.</text>
				</paragraph></subsection><subsection id="H069D73FE33B04B1991DAB76F95CFD02D"><enum>(d)</enum><header>Standards for
			 designation</header><text display-inline="yes-display-inline">Designation of
			 high-risk areas shall be consistent with standards and guidelines contained in
			 the land and resource management plan or land use plan for the unit of the
			 National Forest System or public lands for which the designation is being made,
			 except that the Secretary concerned may modify such standards and guidelines to
			 correspond with a specific high-risk area designation.</text>
			</subsection><subsection id="H3A0739E00C9043CFA7D7A8AB0B909329"><enum>(e)</enum><header>Time for initial
			 designations</header><text>The first high-risk areas should be designated not
			 later than 60 days after the date of the enactment of this Act but may be
			 designated at any time consistent with subsection (a).</text>
			</subsection><subsection id="H3B7E1C13431C438198D37F33A7D5B094"><enum>(f)</enum><header>Duration of
			 designation</header><text>The designation of a high-risk area in a State shall
			 expire 20 years after the date of the designation, unless earlier terminated by
			 the Governor of the State.</text>
			</subsection><subsection id="H2A483A4802694629A007F0ECA5C11276"><enum>(g)</enum><header>Redesignation</header><text>The
			 expiration of the 20-year period specified in subsection (f) does not prohibit
			 the Governor from redesignating an area of the National Forest System land or
			 public lands as a high-risk area under this section if the Governor determines
			 that the area of National Forest System land or public lands continues to be
			 subject to the terms of this section</text>
			</subsection><subsection id="H5C533BAE1A1E476DB09076616F22F05B"><enum>(h)</enum><header>Recognition of
			 valid and existing rights</header><text>The designation of a high-risk area
			 shall not be construed to limit or restrict—</text>
				<paragraph id="H43C533A133BE491D88D9D330E7FB0BEF"><enum>(1)</enum><text>access to National
			 Forest System land or public lands included in the area for hunting, fishing,
			 and other related purposes; or</text>
				</paragraph><paragraph id="H386989AA709D4F429C5AAD3FDFAF6EDF"><enum>(2)</enum><text>valid and existing
			 rights regarding the National Forest System land or public lands.</text>
				</paragraph></subsection></section><section id="HFC8F998EBBF144568DB07DD9D1C784F7"><enum>5.</enum><header>Designation of
			 high-risk areas by the Secretary concerned</header>
			<subsection id="H1D10A8F90F974E618017CCF8B2664AF3"><enum>(a)</enum><header>Designation
			 authority</header><text>The Secretary concerned may designate high-risk areas
			 of the National Forest System and the public lands for the purposes of
			 addressing—</text>
				<paragraph id="H9CE28FD7B8C3465F847FF9ABCB28C711"><enum>(1)</enum><text>deteriorating
			 forest health conditions in existence as of the date of the enactment of this
			 Act due to the bark beetle epidemic or drought, with the resulting imminent
			 risk of devastating wildfires; and</text>
				</paragraph><paragraph id="H76A7403043B7417FBF90D78516635D80"><enum>(2)</enum><text>the future risk of
			 insect infestations or disease outbreaks through preventative treatments to
			 improve forest health conditions.</text>
				</paragraph></subsection><subsection id="H7FF7EA9C90024D77B8FA16C53F4B1363"><enum>(b)</enum><header>Consultation</header><text>In
			 designating high-risk areas, the Secretary concerned shall consult with
			 Governors of affected States, county government from affected counties, and
			 with affected Indian tribes.</text>
			</subsection><subsection id="HDF9FE2391303489D83FB68CF7795CB55"><enum>(c)</enum><header>Exclusion of
			 certain areas</header><text>The following National Forest System land or public
			 lands may not be designated as a high-risk area:</text>
				<paragraph id="HCC476AA4BD324D24AE9D86D608550DA6"><enum>(1)</enum><text>A
			 component of the National Wilderness Preservation System.</text>
				</paragraph><paragraph id="H456FBE9F11244A0F97CA90F9695C1F43"><enum>(2)</enum><text>A
			 National Monument.</text>
				</paragraph></subsection><subsection id="H978EAA785788436193D0E883A07B21F1"><enum>(d)</enum><header>Standards for
			 designation</header><text display-inline="yes-display-inline">Designation of
			 high risk areas shall be consistent with standards and guidelines contained in
			 the land and resource management plan or land use plan for the unit of the
			 National Forest System or public lands for which the designation is being made,
			 except that the Secretary concerned may modify such standards and guidelines to
			 correspond with a specific high-risk area designation.</text>
			</subsection><subsection id="H6A22ACF7FB2B4CD4BC1281EF6A158C76"><enum>(e)</enum><header>Time for initial
			 designations</header><text>The first high-risk areas should be designated not
			 later than 60 days after the date of the enactment of this Act but may be
			 designated at any time consistent with subsection (a).</text>
			</subsection><subsection id="HD05BC336DADD4552AC29162BC34CB14B"><enum>(f)</enum><header>Duration of
			 designation</header><text>The designation of a high-risk area in a State shall
			 expire 20 years after the date of the designation, unless earlier terminated by
			 the Secretary concerned.</text>
			</subsection><subsection id="H1266B0FBB8AA4B9DB7AEE3E9517FE6F4"><enum>(g)</enum><header>Redesignation</header><text>The
			 expiration of the 20-year period specified in subsection (f) does not prohibit
			 the Secretary concerned from redesignating an area of the National Forest
			 System or public lands as a high-risk area if the Secretary determines that the
			 National Forest System land or public lands continues to be subject to the
			 terms of this section, except that such redesignation is subject to
			 consultation with Governors from affected States, county government from
			 affected counties, and affected Indian tribes.</text>
			</subsection><subsection id="H55C97FDB818C4D608CCD9BC3F453D93D"><enum>(h)</enum><header>Recognition of
			 valid and existing rights</header><text>The designation of a high-risk area
			 shall not be construed to limit or restrict—</text>
				<paragraph id="H09CD29C53C4D43DB83F0303E83B125F3"><enum>(1)</enum><text>access to National
			 Forest System land or public lands included in the area for hunting, fishing,
			 and other related purposes; or</text>
				</paragraph><paragraph id="H26A39B18FA36446EAACCCE4E18124F9D"><enum>(2)</enum><text>valid and existing
			 rights regarding the National Forest System land or public lands.</text>
				</paragraph></subsection></section><section id="H530A853E32D4463086A00D90D6022B6F"><enum>6.</enum><header>Use of emergency
			 hazardous fuels reduction projects for high-risk areas</header>
			<subsection id="H56A29ACA410B4EF58DACA0C14F5DC0AE"><enum>(a)</enum><header>Project
			 proposals</header>
				<paragraph id="H6D662E355FFF4712A10C6CEC9ED376D5"><enum>(1)</enum><header>Proposals
			 authorized</header><text>Upon designation of a high-risk area in a State, the
			 Governor of the State may provide for the development of proposed emergency
			 hazardous fuels reduction projects for the high-risk area. The Secretary
			 concerned also may develop emergency hazardous fuels reduction projects.</text>
				</paragraph><paragraph id="HAC9590B057BB4C91BB00A3DA64A21598"><enum>(2)</enum><header>Project
			 criteria</header><text>In preparing proposed emergency hazardous fuels
			 reduction projects, the Governor of a State and the Secretary concerned
			 shall—</text>
					<subparagraph id="H90F126A41CD84386B958E388540E49AF"><enum>(A)</enum><text>take into account
			 managing for rights of way, protection of watersheds, protection of wildlife
			 and endangered species habitat, safe-guarding water resources, and protecting
			 local communities from wildfires; and</text>
					</subparagraph><subparagraph id="H14E9A3559B1D4143AC3D7125C9597DAE"><enum>(B)</enum><text>emphasize
			 activities that thin the forest to provide the greatest health and longevity of
			 the forest.</text>
					</subparagraph></paragraph></subsection><subsection id="H27B3C4B68D6E435AA1032D6EB901934D"><enum>(b)</enum><header>Prohibition on
			 certain activities</header><text>An emergency hazardous fuels reduction project
			 may not include clear cutting of timber.</text>
			</subsection><subsection id="HF31F8DF19B834CA6ABBE7D31666D1FAA"><enum>(c)</enum><header>Consultation</header><text>In
			 preparing proposed emergency hazardous fuels reduction projects, the Governor
			 of a State shall consult with county government from affected counties, and
			 with affected Indian tribes. If the Secretary concerned develops a proposal,
			 the Secretary concerned shall consult with the Governor of the affected State,
			 county government from affected counties, and affected Indian tribes.</text>
			</subsection><subsection id="HA87351A851DE42A09E50669C7715A259"><enum>(d)</enum><header>Submission and
			 implementation</header><text>The Governor of a State shall submit proposed
			 emergency hazardous fuels reduction projects to the Secretary concerned for
			 implementation.</text>
			</subsection><subsection id="H912BBBC2B54D4F06A09F3354EA28463C"><enum>(e)</enum><header>Implementation
			 of projects</header>
				<paragraph id="HF9D3046D5E9E42BE974081F06064C929"><enum>(1)</enum><header>State proposed
			 projects</header><text display-inline="yes-display-inline">The Secretary
			 concerned shall implement hazardous fuels reduction projects proposed by
			 Governors within 60 days of the date on which the Secretary receives the
			 proposal.</text>
				</paragraph><paragraph id="H023335E2C81C453795B969343FC58D60"><enum>(2)</enum><header>Secretary
			 proposed projects</header><text display-inline="yes-display-inline">The
			 Secretary concerned shall implement hazardous fuels reduction projects proposed
			 by the Secretary concerned within 60 days of the date on which the proposal is
			 finalized.</text>
				</paragraph></subsection></section><section id="HC13E60B6642540CF8E96364565B1595D"><enum>7.</enum><header>Applicability of
			 expedited procedures and authorities of Healthy Forests Restoration Act of 2003
			 to emergency hazardous fuels reduction projects</header>
			<subsection id="H2C0AAA0A69FA4DAD95DAA87F50940926"><enum>(a)</enum><header>Applicability</header><text>Subject
			 to subsections (b) through (e), title I of the Healthy Forests Restoration Act
			 of 2003 (16 U.S.C. 6511 et seq.) (including the environmental analysis
			 requirements of section 104 of that Act (16 U.S.C. 6514), the special
			 administrative review process under section 105 of that Act (16 U.S.C. 6515),
			 and the judicial review process under section 106 of that Act (16 U.S.C.
			 6516)), shall apply to all emergency hazardous fuels reduction projects
			 developed under section 6.</text>
			</subsection><subsection id="HA85619DDDCBC46DFA7251914A9C63FA6"><enum>(b)</enum><header>Application of
			 other law</header><text>Section 322 of Public Law 102–381 (16 U.S.C. 1612 note;
			 106 Stat. 1419) shall not apply to Forest Service emergency hazardous fuels
			 reduction projects.</text>
			</subsection><subsection id="H635F2982FFB54B8E80789A34B57B34A6"><enum>(c)</enum><header>Required
			 modifications</header><text>In applying title I of the Healthy Forests
			 Restoration Act of 2003 (16 U.S.C. 6511 et seq.) to emergency hazardous fuels
			 reduction projects, the Secretary concerned shall make the following
			 modifications:</text>
				<paragraph id="HCCB85ADAF5DD4C59BA765749E0C265A1"><enum>(1)</enum><text>The authority
			 shall apply to the entire high-risk area, including land that is outside of a
			 wildland-urban interface area or that does not satisfy any of the other
			 eligibility criteria specified in section 102(a) of that Act (16 U.S.C.
			 6512(a)).</text>
				</paragraph><paragraph id="HFF1F371B1BC543F9A043547441A1AB35"><enum>(2)</enum><text>All projects and
			 activities of the Secretary concerned, including necessary connected actions
			 (as described in section 1508.25(a)(1) of title 40, Code of Federal
			 Regulations), of the emergency hazardous fuels reduction project shall be
			 deemed to be an authorized hazardous fuel reduction project for purposes of
			 applying the title.</text>
				</paragraph></subsection><subsection id="HB53FADB15BBD446BA9BB0F9392A1DD5B"><enum>(d)</enum><header>Forest
			 management plans</header><text display-inline="yes-display-inline">All projects
			 and activities carried out as part of an emergency hazardous fuels reduction
			 project in a designated high-risk area shall be consistent with standards and
			 guidelines contained in the land and resource management plan or land use plan
			 for the unit of the National Forest System or public lands for which the
			 designation is made, except that the Secretary concerned may modify such
			 standards and guidelines to correspond with a specific high-risk area
			 designation.</text>
			</subsection><subsection id="H8CE7ADC028304F269A35C2A890A066ED"><enum>(e)</enum><header>Retention of
			 NEPA responsibilities</header><text display-inline="yes-display-inline">Any
			 decision required to be made under the National Environmental Policy Act of
			 1969 (42 U.S.C. 4321 et seq.) with respect to any project or activity to be
			 carried out as part of an emergency hazardous fuels reduction project in a
			 high-risk area shall not be delegated to a State forester or any other officer
			 or employee of the State in which the emergency hazardous fuels reduction
			 project will be carried out.</text>
			</subsection><subsection id="H8D9C9EF215B94A8F9015E0FFB419FBC0"><enum>(f)</enum><header>Categorical
			 exclusion</header><text display-inline="yes-display-inline">If a project or
			 activity to be carried out as part of an emergency hazardous fuels reduction
			 project in a high-risk area involves the removal of insect-infected trees or
			 other hazardous fuels within 500 feet of utility or telephone infrastructure,
			 campgrounds, roadsides, heritage sites, recreation sites, schools, or other
			 infrastructure, the project or activity is categorically excluded from the
			 requirement to prepare an environmental assessment or an environmental impact
			 statement under the National Environmental Policy Act of 1969 (42 U.S.C. 4321
			 et seq.) so long as the project or activity is otherwise conducted consistently
			 with agency and departmental procedures and the applicable land and resource
			 management plan or land use plan.</text>
			</subsection></section><section id="HE101EF81ECC847D1A2741B54547E7F26"><enum>8.</enum><header>Forest Service
			 and Bureau of Land Management good-neighbor cooperation with States to reduce
			 wildfire risks</header>
			<subsection id="H8E04B2FA32F242B0AED80C7EEB955BE3"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H7EBF7F4A95FB4D6CA6D47AEEAC1C0A89"><enum>(1)</enum><header>Eligible
			 state</header><text>The term <quote>eligible State</quote> means a State that
			 contains National Forest System land.</text>
				</paragraph><paragraph id="H6367BF5053F24C869A2D72E4EAD56B75"><enum>(2)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Agriculture.</text>
				</paragraph><paragraph id="H6C258A824CCC411D83655A735238427B"><enum>(3)</enum><header>State
			 forester</header><text>The term <quote>State forester</quote> means the head of
			 a State agency with jurisdiction over State forestry programs in an eligible
			 State.</text>
				</paragraph></subsection><subsection id="HD661E5F512F941D9A7FC95EA2CD7B042"><enum>(b)</enum><header>Cooperative
			 agreements and contracts</header>
				<paragraph id="HFB095180AECC4811AE0F22A56845F51D"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may enter into a cooperative agreement or
			 contract (including a sole source contract) with a State forester to authorize
			 the State forester to provide the forest, rangeland, and watershed restoration
			 and protection services described in paragraph (2) on National Forest System
			 land in the eligible State.</text>
				</paragraph><paragraph id="H7A2892C393D24A79ABA47DDAD4EB38B1"><enum>(2)</enum><header>Authorized
			 services</header><text>The forest, rangeland, and watershed restoration and
			 protection services referred to in paragraph (1) include the conduct of—</text>
					<subparagraph id="H99FB15E3C551459FB755291BFB50B638"><enum>(A)</enum><text>activities to
			 treat insect infected trees;</text>
					</subparagraph><subparagraph id="H580F3A43CE1E4036A1C65B5C54E98260"><enum>(B)</enum><text>activities to
			 reduce hazardous fuels; and</text>
					</subparagraph><subparagraph id="H4A3D4E1F7C334FE59E2660B4E5070B55"><enum>(C)</enum><text>any other
			 activities to restore or improve forest, rangeland, and watershed health,
			 including fish and wildlife habitat.</text>
					</subparagraph></paragraph><paragraph id="H869B28F6AC3D4EC1B89676F6E65CAB96"><enum>(3)</enum><header>State as
			 agent</header><text>Except as provided in paragraph (6), a cooperative
			 agreement or contract entered into under paragraph (1) may authorize the State
			 forester to serve as the agent for the Secretary in providing the restoration
			 and protection services authorized under that paragraph.</text>
				</paragraph><paragraph id="HDE35273AECE340D181EE0AE68BCBBDE4"><enum>(4)</enum><header>Subcontracts</header><text>In
			 accordance with applicable contract procedures for the eligible State, a State
			 forester may enter into subcontracts to provide the restoration and protection
			 services authorized under a cooperative agreement or contract entered into
			 under paragraph (1).</text>
				</paragraph><paragraph id="HBD1C803ACA0447688ADDE80D6DAB24E1"><enum>(5)</enum><header>Timber
			 sales</header><text>Subsections (d) and (g) of section 14 of the National
			 Forest Management Act of 1976 (16 U.S.C. 472a) shall not apply to services
			 performed under a cooperative agreement or contract entered into under
			 paragraph (1).</text>
				</paragraph><paragraph id="HED5F53323F484DA197E89ADBCBF3C461"><enum>(6)</enum><header>Retention of
			 nepa responsibilities</header><text>Any decision required to be made under the
			 National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) with respect
			 to any restoration and protection services to be provided under this section by
			 a State forester on National Forest System land shall not be delegated to a
			 State forester or any other officer or employee of the eligible State.</text>
				</paragraph><paragraph id="H4F56890A360E434980C7DE46F8EE48F4"><enum>(7)</enum><header>Applicable
			 law</header><text>The restoration and protection services to be provided under
			 this section shall be carried out on a project-to-project basis under existing
			 authorities of the Forest Service.</text>
				</paragraph></subsection></section><section id="HAC1833AF858441C8BA9A14AB808C3D38"><enum>9.</enum><header>Stewardship end
			 result contracting project authority</header>
			<subsection id="H4D7A921E417C4CCAAC50D8F390799D6C"><enum>(a)</enum><header>Extension of
			 authority</header><text>Section 347(a) of the Department of the Interior and
			 Related Agencies Appropriations Act, 1999 (as contained in section 101(e) of
			 division A of Public Law 105–277; 16 U.S.C. 2104 note) is amended by striking
			 <quote>2013</quote> and inserting <quote>2017</quote>.</text>
			</subsection><subsection id="H0A7F6DE43D7B4A40BB9FF1B0CCF854E0"><enum>(b)</enum><header>Duration of
			 contracts</header><text>Section 347(c)(2) of the Department of the Interior and
			 Related Agencies Appropriations Act, 1999 (as contained in section 101(e) of
			 division A of Public Law 105–277; 16 U.S.C. 2104 note) is amended by striking
			 <quote>10 years</quote> and inserting <quote>20 years</quote>.</text>
