<enum>I</enum><header>Allocation and
assignment of public safety licenses</header>
<section id="id0112253BFB16433CB9EF590931AF6E28"><enum>101.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
<paragraph id="id94B363DBCCDB4024B8A5E7121113406A"><enum>(1)</enum><text>The
communications capabilities of first responders and other public safety
agencies directly affect the public safety of the people of the United States
and our national security.</text>
</paragraph><paragraph id="id7BE9D2210053493DA0F8488F598FD051"><enum>(2)</enum><text>As events such as
the terrorist attacks of September 11, 2001, and Hurricane Katrina revealed,
the inability of local, State, tribal, and Federal first responders to
communicate effectively during an emergency impairs operations to respond to
terrorist acts and natural disasters.</text>
</paragraph><paragraph id="id320628A8FE094BA49F439EDAC96443A2"><enum>(3)</enum><text>Many public
safety communications systems rely on commercially available systems that lack
broadband capabilities or otherwise fail to provide the level of service
necessary to meet the mission-critical needs of public safety agencies.</text>
</paragraph><paragraph id="id1AB1FCA1431C40F7B471775886560CDF"><enum>(4)</enum><text>A wireless public
safety broadband network is needed to guarantee priority access for public
safety use and first responder interoperability across the United
States.</text>
</paragraph><paragraph id="id4C44498628504CB9A42664FE319861EC"><enum>(5)</enum><text>Allocating the
paired electromagnetic spectrum bands of 758–763 megahertz and 788–793
megahertz, referred to as the D Block, to public safety agencies will fulfill
public safety agencies needs for sufficient spectrum and would help reduce the
complexity and future operating cost of public safety communications
systems.</text>
</paragraph><paragraph id="idD31CDAB23E3D49DDA55C01CB82461ABB"><enum>(6)</enum><text>Because the
communications needs of public safety agencies may differ by geographic region
(including whether they require a dedicated communications system or can rely
on a system shared with commercial users), each region requires flexibility to
develop a model that meets its local needs without sacrificing the
interoperability of the nationwide system.</text>
</paragraph><paragraph id="idFE758DCA739F43559F76D89A8BD760E4"><enum>(7)</enum><text>The most timely
and cost-effective way to achieve nationwide interoperability in public safety
communications will be to leverage commercial infrastructure without
compromising the mission-critical needs of public safety agencies.</text>
</paragraph><paragraph id="id5E7AA5D281DF42228DBC56AB11C34C22"><enum>(8)</enum><text>The use by public
safety agencies of standardized technologies commonly employed in the
commercial telecommunications sector will provide significant benefits,
including improved capabilities, greater economies of scale, and more rapid
adoption of technological innovations.</text>
</paragraph><paragraph id="id9FF68E4217E440BFA2E91C732DD699D3"><enum>(9)</enum><text>When it is in the
interest of public safety, the Federal Communications Commission should
encourage any public safety licensee or spectrum lessee to consider using
existing or planned commercial infrastructure.</text>
</paragraph></section><section id="id057FFFD188B64229A78890CA73EDB82F"><enum>102.</enum><header>Allocation and
assignment of public safety licenses</header>
<subsection id="id689C652A552B47E281562F2D1780FC7E"><enum>(a)</enum><header>Spectrum
Allocation</header><text>Section 337(a) of the Communications Act of 1934 (47
U.S.C. 337(a)) is amended—</text>
<paragraph id="id4C76C43BD71F433C931FEFB04C87DDFE"><enum>(1)</enum><text>in paragraph (1),
by striking <quote>24</quote> and inserting <quote>34</quote>; and</text>
</paragraph><paragraph id="id8551BB07E5AE4DC99BDD5B5BB7E7A576"><enum>(2)</enum><text>in paragraph (2),
by striking <quote>36</quote> and inserting <quote>26</quote>.</text>
</paragraph></subsection><subsection id="id2209B1FF5FB14911819EB355AF824A74"><enum>(b)</enum><header>Assignment</header><text>Section
337(b) of the Communications Act of 1934 (47 U.S.C. 337(b)) is amended to read
as follows:</text>

<subsection id="id9F627F2D1CAC46339388A3141CE7470E"><enum>(b)</enum><header>Assignment</header>
<paragraph id="id1C7C49090B8A4DABA65FE3C92820AB0B"><enum>(1)</enum><header>In
general</header><text>Not later than 60 days after the date of enactment of the
Broadband for First Responders Act of 2011, the Commission shall allocate the
paired electromagnetic spectrum bands of 758–763 megahertz and 788–793
megahertz for public safety broadband communications and shall license such
paired bands to the public safety broadband licensee.</text>
</paragraph><paragraph id="idCFBB74B5D9CC416DB89024A61750A155"><enum>(2)</enum><header>Establishment
of rules</header>
<subparagraph id="idD8114D024420415EADDCF2EAD365569A"><enum>(A)</enum><header>In
general</header><text>The Commission shall establish rules to permit the public
safety broadband licensee to authorize providers of public safety services to
construct and operate a wireless public safety broadband network in the
spectrum licensed to the public safety broadband licensee if the public safety
broadband licensee determines that such authorization would expedite the
deployment of public safety broadband communications.</text>
</subparagraph><subparagraph id="idF8AC3C37B2E6457B9A9D4AE73954F2AD"><enum>(B)</enum><header>Network
requirements</header><text>The Commission shall require that any such wireless
public safety broadband network shall—</text>
<clause id="idED5527846C704446B7C53D7C91D21FB0"><enum>(i)</enum><text>be fully
interoperable and remain interoperable with, and in conformance with the same
broadband technology standards as, all other public safety broadband systems
deployed or authorized;</text>
</clause><clause id="id9E4E5BA6D12444E48E396D135233C93B"><enum>(ii)</enum><text>provide for
roaming by local, State, tribal, and Federal governments and other authorized
users of the spectrum licensed to the public safety broadband licensee;</text>
</clause><clause id="id13AD0339FC7F4F6E8D214382F91C8152"><enum>(iii)</enum><text>provide
priority access to public safety agencies;</text>
</clause><clause id="id08E6725D9665401D877A2CF9FF792671"><enum>(iv)</enum><text>be built to
survive most large-scale disasters;</text>
</clause><clause id="idEBE00EC763134134881B4CC539C2F2C4"><enum>(v)</enum><text>ensure that
networks of such systems have the appropriate level of cyber security;</text>
</clause><clause id="id21242F2A27C546D19BD52B729047DBEE"><enum>(vi)</enum><text>ensure that
authorized users have control over all local network uses consistent with rules
established by the Commission; and</text>
</clause><clause id="idC7D5668D88B3418AA44372A486DFBE7B"><enum>(vii)</enum><text>be consistent
with the Statewide Interoperable Communications Plans adopted by each State and
the National Emergency Communications Plan, as adopted by the Department of
Homeland Security.</text>
</clause></subparagraph><subparagraph id="id9B8072435D8441EF88CF0078EA59EF5A"><enum>(C)</enum><header>Deadlines</header>
<clause id="id4DA649836327498D8ED866E2514F3C51"><enum>(i)</enum><header>Rules</header><text>The
Commission shall establish rules under this paragraph not later than 9 months
after the date of enactment of the Broadband for First Responders Act of
2011.</text>
</clause><clause id="idCF8A35254DAC4157A3739F93EE1CAE42"><enum>(ii)</enum><header>Report</header>
<subclause id="idFBF65FAF2196445BAE7893002A0DE119"><enum>(I)</enum><header>In
general</header><text>Not later than 60 days after the date of enactment of the
Broadband for First Responders Act of 2011, the public safety broadband
licensee shall submit a report to the appropriate committees of Congress on the
phased network deployment plan of such spectrum bands.</text>
</subclause><subclause id="id82B758DECE664AB1B8E7BA93D50973E7"><enum>(II)</enum><header>Definitions</header><text>For
purposes of subclause (I), the term <quote>appropriate committees of
Congress</quote> means—</text>

Homeland Security and Governmental Affairs of the Senate;</text>
</item><item id="id9D2608B0498248E983A6FC8465EBE546"><enum>(bb)</enum><text>the Committee on
Commerce, Science, and Transportation of the Senate;</text>
</item><item id="id80A65E5A33DA4288B0A54E67C9F1449A"><enum>(cc)</enum><text>the Committee on
Energy and Commerce of the House of Representatives; and</text>
</item><item id="id3237F8F8528244C2ABAF8E6530821CCB"><enum>(dd)</enum><text>the Committee on
Homeland Security of the House of
Representatives.</text>
</item></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="id04BD7E49F31341FA9CF45C14883FCA9C"><enum>(c)</enum><header>Network-Sharing
Agreements</header><text>Section 337 of the Communications Act of 1934 (47
U.S.C. 337) is amended—</text>
<paragraph id="id09897DEFE3EB4FD9AD5A56B59EAB6047"><enum>(1)</enum><text>by redesignating
subsection (f) as subsection (g); and</text>
</paragraph><paragraph id="id6574B6756FAF40BC8963FE5425B45AFB"><enum>(2)</enum><text>by inserting
after subsection (e) the following:</text>
<quoted-block display-inline="no-display-inline" id="id96CAA313DD4749EE8E66FC8A683C7BCB" style="OLC">
<subsection id="idE6FA88A7085940AC8CE4779E5C76EF64"><enum>(f)</enum><header>Rulemaking
Required</header><text>The Commission shall establish regulations to—</text>
<paragraph id="idBCB15ECA98C94ABE84CCF7FE2EB10296"><enum>(1)</enum><text>authorize the
shared use of the public safety broadband spectrum and network infrastructure
by entities that are not defined as public safety services in subsection
(g)(1), subject to the requirement that public safety services retain priority
access to the spectrum, pursuant to procedures adopted by the Commission, so
long as the needs of other governmental entities needs are considered before
commercial entities; and</text>
</paragraph><paragraph id="id50DEF629914B43D8B7C99E53852176BE"><enum>(2)</enum><text>allow use of the
public safety broadband spectrum by emergency response providers, as defined in
section 2 of the Homeland Security Act of 2002 (6 U.S.C.
101).</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection id="idD33F7DC734744CD39855350940F350FD"><enum>(d)</enum><header>Definition</header><text>Section
337(g) of the Communications Act of 1934 (as so redesignated) is
amended—</text>
<paragraph id="id6759866EABBA40A9AB373255778C29EF"><enum>(1)</enum><text>by redesignating
paragraphs (1) and (2) as paragraphs (3) and (4), respectively; and</text>
</paragraph><paragraph id="idFF644786BABE43F3A98A9190BA39DA77"><enum>(2)</enum><text>by inserting
before paragraph (3), as so redesignated, the following:</text>
<quoted-block display-inline="no-display-inline" id="idEF4456D4A8BE403187D15B9828CEBAB9" style="OLC">
<paragraph id="idB5718CF826154AD7A96C6E4A6D1D034F"><enum>(1)</enum><header>Public safety
broadband licensee</header><text>The term <quote>public safety broadband
licensee</quote> means a licensee as defined by the Commission in its Second
Report and Order adopted July 31, 2007 (FCC 07–132), and selected in the
Commission's Order adopted November 19, 2007 (FCC 07–199), by the Commission to
be the licensee for spectrum between 763–768 and 793–798 megahertz.</text>
</paragraph><paragraph id="id9B317B54E0E64549AFE43AD6020D2F66"><enum>(2)</enum><header>Public safety
broadband spectrum</header><text>The term <quote>public safety broadband
spectrum</quote> means the electromagnetic spectrum between 758 megahertz and
768 megahertz, inclusive, and 788 megahertz and 798 megahertz, inclusive, and
any additional electromagnetic frequencies allocated by the Commission for
public safety broadband
use.</text>
</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection></section><section id="id178F53128C6B408B824E761E22A191DC"><enum>103.</enum><header>Standards</header>
<subsection id="id6A668839B44F4604B685A64622A20AA3"><enum>(a)</enum><header>Interoperability
Requirements</header><text>Not later than 180 days after the date of enactment
of this Act, the Chairman of the Federal Communications Commission, in
consultation with the Director of the National Institute of Standards and
Technology, the Secretary of Homeland Security, the Attorney General, and
local, State, tribal, and Federal public safety agencies, shall develop a
public safety agency statement of requirements that enables nationwide
interoperability and roaming across any communications system using public
safety broadband spectrum, as defined in section 337(g) of the Communications
Act of 1934.</text>
</subsection><subsection id="idD57A79BBEBB54FB9A9BCAC7ADB4DC8B5"><enum>(b)</enum><header>Specifications</header><text>The
Secretary of Homeland Security, in coordination with the Director of the
National Institute of Standards and Technology, shall establish an appropriate
standard, or set of standards, for meeting the public safety agency statement
requirements developed under subsection (a), taking into consideration—</text>
<paragraph id="idFE82311F775142B3A08E316E5ECA8079"><enum>(1)</enum><text>the extent to
which particular technologies and user equipment are, or are likely to be,
available in the commercial marketplace;</text>
</paragraph><paragraph id="idA44B98161D2142BD82E0DFB144409B34"><enum>(2)</enum><text>the availability
of necessary technologies and equipment on reasonable and nondiscriminatory
licensing terms;</text>
</paragraph><paragraph id="id53944E4C0F9B49BBBE7279289CCA04F8"><enum>(3)</enum><text>the ability to
evolve with technological developments in the commercial marketplace;</text>
</paragraph><paragraph id="id7C191DE50D5346C9B0BBCA799B02F3BD"><enum>(4)</enum><text>the ability to
accommodate prioritization for public safety transmissions;</text>
</paragraph><paragraph id="id10F3F7A67A9F42439C7B2FE6FC8B3E6B"><enum>(5)</enum><text>the ability to
accommodate appropriate security measures for public safety transmissions;
and</text>
</paragraph><paragraph id="idD9FCD2E15D67406D9760F74A1D623E24"><enum>(6)</enum><text>any other
considerations the Federal Communications Commission deems appropriate.</text>
</paragraph></subsection></section><section id="id0E806409DDEA4DF3A85FDC0262541234"><enum>104.</enum><header>Rule of
construction</header><text display-inline="no-display-inline">Nothing in this
Act, or the amendments made by this Act, shall be construed to overturn,
supersede, or otherwise preempt the Federal Communication Commission's Order
adopted on November 19, 2007 (FCC 07–199), setting forth the roles and
responsibilities of the public safety broadband licensee (as such term is
defined in section 337(g) of the Communications Act of 1934) and the Federal
Communications Commission, except that the following may, by rule or order, be
modified by the Commission:</text>
<paragraph id="id8DC44005AA2D4AF5A755E62584BEE974"><enum>(1)</enum><text>Any organization
seeking membership to the board of directors of the public safety broadband
licensee may be voted in by a simple majority of the then serving members of
the Board of Directors.</text>
</paragraph><paragraph id="id856F2D4D354C41078BE46A57B5BE83D9"><enum>(2)</enum><text>The Board of
Directors of the Public Safety Broadband Licensee shall include the following
organizations:</text>

</paragraph><paragraph id="idC7B33AD4389D49A5BFC96D2C741E220E"><enum>(4)</enum><text>the term
<term>Maintenance and Operation Fund</term> means the Public Safety
Interoperable Broadband Network Maintenance and Operation Fund established
under section 202; and</text>
</paragraph><paragraph id="id754C773E080E471B87F7D105C3BEFB1E"><enum>(5)</enum><text>the term
<term>Secretary</term> means the Secretary of Homeland Security.</text>
</paragraph></section><section id="id58AFF97E197B417BADBDA2108A73C8CB"><enum>202.</enum><header>Funding</header>
<subsection id="idA2DE7211622A4D6DBC60C085DAFE2F6B"><enum>(a)</enum><header>Establishment
of Funds</header>
<paragraph id="id8BE5D123A81A4F4C9211DE7B9361022C"><enum>(1)</enum><header>Construction
fund</header>
<subparagraph id="idA8667EFDB9C14407A76431FCA4D6D1FC"><enum>(A)</enum><header>Establishment</header><text>There
is established in the Treasury of the United States a fund to be known as the
Public Safety Interoperable Broadband Network Construction Fund.</text>
</subparagraph><subparagraph id="id21B8767E9DF5478FA6BA19D71ED1E28B"><enum>(B)</enum><header>Purpose</header><text>The
Secretary shall establish and administer the grant program under section 203
using the funds deposited in the Construction Fund.</text>
</subparagraph><subparagraph id="id85F7AA17F93C4EB9B7A2DF0CF460A75E"><enum>(C)</enum><header>Credit</header>
<clause id="id6CB5E07AB5974083885FCF388D6D8515"><enum>(i)</enum><header>Borrowing
authority</header><text>The Secretary may borrow from the general fund of the
Treasury beginning October 1, 2011, such sums as may be necessary, but not to
exceed $2,000,000,000, to implement section 203.</text>
</clause><clause id="idE467A885A4254B07848745691EC92EE8"><enum>(ii)</enum><header>Reimbursement</header><text>The
Secretary of the Treasury shall reimburse the general fund of the Treasury,
without interest, for any amounts borrowed under clause (i) as funds are
deposited into the Construction Fund, but in no case later than December 31,
2014.</text>
</clause></subparagraph></paragraph><paragraph id="idB2E5273B6BA049E4859DBD06118B6A07"><enum>(2)</enum><header>Maintenance and
operation fund</header>
<subparagraph id="idCAA14D56AFBC43EE979210248C3F1857"><enum>(A)</enum><header>Establishment</header><text>There
is established in the Treasury of the United States a fund to be known as the
Public Safety Interoperable Broadband Network Maintenance and Operation
Fund.</text>
</subparagraph><subparagraph id="idC574C683CC604BB08D9ACE986D735FF6"><enum>(B)</enum><header>Purpose</header><text>The
Secretary shall use the funds deposited in the Maintenance and Operation Fund
to carry out section 204.</text>
</subparagraph></paragraph></subsection><subsection id="idFD9B76F690E94AC5AEB24758F2F6DF9D"><enum>(b)</enum><header>Initial
Distribution of Auction Proceeds in Funds</header><text>Notwithstanding
subparagraphs (A) and (D) of section 309(j)(8) of the Communications Act of
1934 (47 U.S.C. 309(j)(8)), the Secretary of the Treasury shall deposit the
proceeds (including deposits and upfront payments from successful bidders) from
the auction of the spectrum described in section 205 in the following
manner:</text>
<paragraph id="idDB91848E42F245EDB0574EE780AF9DC8"><enum>(1)</enum><text>All proceeds less
than or equal to $5,500,000,000 shall be deposited in the Construction Fund and
shall be made available to the Secretary without further appropriations.</text>
</paragraph><paragraph id="id085E89E85AB54FBF8463B6938906AD01"><enum>(2)</enum><text>Any proceeds
exceeding $5,500,000,000 shall be deposited in the Maintenance and Operation
Fund and shall be made available to the Secretary without further
appropriations.</text>
</paragraph></subsection><subsection id="idE174C613F7864A3683C67A1B331A77D1"><enum>(c)</enum><header>Transfer of
Funds at Completion of Construction</header><text>The Secretary of the Treasury
shall transfer to the Maintenance and Operation Fund any funds remaining in the
Construction Fund after the date of the completion of the construction phase,
as determined by the Secretary.</text>
</subsection><subsection id="id4B8B387875F64161A2120A509589D339"><enum>(d)</enum><header>Transfer of
Funds to Treasury</header><text>The Secretary of the Treasury shall transfer to
the general fund of the Treasury any funds remaining in the Maintenance and
Operation Fund after the end of the 10-year period following receipt of notice
by the Secretary of Homeland Security that construction of the nationwide
system has been completed.</text>
</subsection><subsection id="id2186BB0751EF431A86BA16BB5B628E79"><enum>(e)</enum><header>Authorization
of Appropriations</header>
<paragraph id="id3851C956C57949C487403F0291E54774"><enum>(1)</enum><header>Construction
fund</header><text>There are authorized to be appropriated to the Secretary for
deposit in the Construction Fund in and after fiscal year 2012 an amount not to
exceed the amount set forth in paragraph (3).</text>
</paragraph><paragraph id="id8129A024742C430584A5070EEE78C426"><enum>(2)</enum><header>Maintenance and
operation fund</header><text>There are authorized to be appropriated to the
Secretary for deposit in the Maintenance and Operation Fund in and after fiscal
year 2012 an amount not to exceed the amount set forth in paragraph (3).</text>
</paragraph><paragraph id="idCB95DB8C34554C468BA6AC56863B1E6F"><enum>(3)</enum><header>Limitation</header><text>The
authorization of appropriations under paragraphs (1) and (2) may not exceed a
total of $5,500,000,000.</text>
</paragraph></subsection></section><section id="id664FF78D1DB74AAEB346255BDA73ECD1"><enum>203.</enum><header>Public safety
interoperable broadband network construction</header>
<subsection id="idDE519D0711A846208FA86C2D333ABC5A"><enum>(a)</enum><header>Construction
Grant Program Establishment</header><text>The Secretary shall take such action
as is necessary to establish a grant program to assist public safety entities
to establish a nationwide public safety interoperable broadband network in the
700 megahertz band.</text>
</subsection><subsection id="id59E949259D97479FB4D8ED6E7C905B06"><enum>(b)</enum><header>Projects</header><text>The
projects for which construction grants may be made under this section are the
following:</text>
<paragraph id="id74B20BE2B91342ED8997DE226D341B7A"><enum>(1)</enum><text>Construction of a
new public safety interoperable broadband network using public safety
infrastructure or commercial infrastructure, or both, in the 700 megahertz
band.</text>
</paragraph><paragraph id="idA65C160A17174125857DACE3611BA6DF"><enum>(2)</enum><text>Improvement of
the existing public safety and commercial networks and construction of new
infrastructure to meet public safety requirements.</text>
</paragraph></subsection><subsection id="id6C1C325733934C9C9A0C5B9B267F1327"><enum>(c)</enum><header>Matching
Requirements</header>
<paragraph id="idC273849FF57949D7A81CB5BEC18E108D"><enum>(1)</enum><header>Federal
share</header><text>The Federal share of the cost of carrying out a project
under this section may not exceed 80 percent of the eligible costs of carrying
out a project, as determined by the Secretary in consultation with the Chairman
of the Federal Communications Commission.</text>
</paragraph><paragraph id="idE7AF7AE248574EACAB3548666273CFC6"><enum>(2)</enum><header>Non-federal
share</header><text>The non-Federal share of the cost of carrying out a project
under this section may be provided through an in-kind contribution.</text>
</paragraph></subsection><subsection id="id327CFFD6CAC9428499C2974A64A4530B"><enum>(d)</enum><header>Requirements</header><text>Not
later than 6 months after the date of enactment of this Act, the Secretary
shall establish grant program requirements including the following:</text>
<paragraph id="idC7BFA40958A6475B9D24E3B7D557DDC7"><enum>(1)</enum><text>Defining entities
that are eligible to receive a grant under this section.</text>
</paragraph><paragraph id="idECC1C5A4F7044401B71B9558869A9432"><enum>(2)</enum><text>Defining eligible
costs for purposes of subsection (c)(1).</text>
</paragraph><paragraph id="idE2C49B656BCC48BAA10D09AB20859992"><enum>(3)</enum><text>Determining the
scope of network infrastructure eligible for grant funding under this
section.</text>
</paragraph><paragraph id="id9DD9FF1F0B004E939A1B1452DEFC1CEA"><enum>(4)</enum><text>Conditioning
grant funding on compliance with the Federal Communications Commission's
license terms.</text>
</paragraph><paragraph id="id023DCBA320344CBD8F6ECB226E88EBF7"><enum>(5)</enum><text>Ensuring that all
grant funds are in compliance with and support the goals of the National
Emergency Communications Plan and the Statewide Communication Interoperability
Plans for each State and territory.</text>
</paragraph></subsection><subsection id="idCB93ED9D1C104ACCAEED4FB7E3EE68A7"><enum>(e)</enum><header>Technical
Assistance</header><text>The Secretary will enhance the Office of Emergency
Communications Technical Assistance Program to assist grantees with best
practices and guidance in implementing these projects.</text>
</subsection></section><section id="idBEF5A1FFF58B4D4C865E3786F8120A9F"><enum>204.</enum><header>Public safety
interoperable broadband maintenance and operation</header>
<subsection id="idA3E2128439024A77816AC27A336A1264"><enum>(a)</enum><header>Maintenance and
Operation Reimbursement Program</header><text>The Secretary shall administer a
program through which not more than 50 percent of maintenance and operational
expenses associated with the public safety interoperable broadband network may
be reimbursed from the Maintenance and Operation Fund for those expenses that
are attributable to the maintenance, operation, and improvement of the public
safety interoperable broadband network.</text>
</subsection><subsection id="id54E5578679A34A1C8271EA60DE0F34E4"><enum>(b)</enum><header>Report</header><text>Not
later than 7 years after the commencement of the reimbursement program
established under subsection (a), the Secretary shall submit to Congress a
report on whether to continue to provide funding for the Maintenance and
Operation Fund following completion of the period provided for under section
202(d).</text>
</subsection></section><section id="id1387FBAA606449B4A2F1E2249DCAFC28"><enum>205.</enum><header>Audits</header>
<subsection id="id3168CC6203EC4B69B963A1C483688BA2"><enum>(a)</enum><header>In
General</header><text>Not later than 3 years after the date of enactment of
this Act, and every 3 years thereafter, the Comptroller General of the United
States shall perform an audit of the financial statements, records, and
accounts of the—</text>
<paragraph id="id72FE914A1D764A708610D8D0168D3E37"><enum>(1)</enum><text>Public Safety
Interoperable Broadband Network Construction Fund established under section
202(a)(1);</text>
</paragraph><paragraph id="idFD54643E8619468E89A9B1FEBDB7A7CB"><enum>(2)</enum><text>Public Safety
Interoperable Broadband Network Maintenance and Operation Fund established
under section 202(a)(2);</text>
</paragraph><paragraph id="id76D6434101CB4CA4A10E4E05B65811B8"><enum>(3)</enum><text>construction
grant program established under section 203; and</text>
</paragraph><paragraph id="idF7C7F55D72C34CB5A0C5A6FF5ECC6C6C"><enum>(4)</enum><text>maintenance and
operation grant program established under section 204.</text>
</paragraph></subsection><subsection id="idA7BB34C5BA534379A4653DFA8D3930DB"><enum>(b)</enum><header>GAAP</header><text>Each
audit required under subsection (a) shall be conducted in accordance with
generally accepted accounting procedures.</text>
</subsection><subsection id="idF13C4D14685F4B6DA69AB76E8FA71EC7"><enum>(c)</enum><header>Report to
Congress</header><text>A copy of each audit required under subsection (a) shall
be submitted to the appropriate committees of Congress.</text>
</subsection></section><section id="id5D0B337DEFFF450A9DF5E7E5EE3D6497"><enum>206.</enum><header>Auction of
spectrum to fund the interoperable broadband network construction fund, and the
operation and maintenance fund</header>
<subsection id="idF129BA3746BA4460B52B6EE206E71156"><enum>(a)</enum><header>In
General</header>
<paragraph id="idE13454888CB84F0F8393236504409DB0"><enum>(1)</enum><header>Reallocation of
spectrum</header><text>Not later than 1 year after the date of enactment of
this Act, the Assistant Secretary shall reallocate for commercial use
electromagnetic spectrum at 1755–1780 megahertz.</text>
</paragraph><paragraph id="id94C0606CC1C14CD992CA424AE9A97556"><enum>(2)</enum><header>Auction</header><text>Not
later than 18 months after the date of enactment of this Act, the Federal
Communications Commission shall establish rules for pairing electromagnetic
spectrum bands at 1755–1780 megahertz and 2155–2180 megahertz, inclusive, and
auction the licenses for such paired spectrum in accordance of section
309(j).</text>
</paragraph></subsection></section><section id="idF5D9806849A44830A40C6382CAA18BAF"><enum>207.</enum><header>Achieving
long-term interoperability by consolidating band use by public safety
agencies</header>
<subsection id="idAD71A6B84993467CAA79CB1F3827EF36"><enum>(a)</enum><header>Mandating
Migration of Public Safety Entities and Federal Law Enforcement</header>
<paragraph id="id0422D1E1CBB24D78A25F92DC199B372C"><enum>(1)</enum><header>Require
migration by public safety entities</header><text>Not later than 8 years after
the date of enactment of the Act, each public safety entities shall end their
use of radio spectrum above 420 megahertz and below 512 megahertz and begin to
use alternative radio spectrum licensed to public safety services in the 700
megahertz and 800 megahertz bands.</text>
</paragraph><paragraph id="idB3E47E26C47F48DFAAD0B60829D86EF2"><enum>(2)</enum><header>Require use by
federal law enforcement</header><text>Not later than 10 years after the date of
enactment of this Act, each Federal law enforcement agency shall move all of
their communications, not being carried on commercial networks, to spectrum
located in the 700 megahertz and 800 megahertz bands.</text>
</paragraph></subsection><subsection id="id8AE02BC6BED04CE187C81300CF16CBF7"><enum>(b)</enum><header>GAO
Study</header><text>Not later than 3 years after the date of enactment of this
Act, the Comptroller General of the United States shall conduct a study and
submit a report to the appropriate committees of Congress that identifies those
parts of the radio spectrum above 174 megahertz and below 512 megahertz used by
public safety entities that should be returned to the Federal Communications
Commission for auction in accordance with subsection (d).</text>
</subsection><subsection id="idD985EC02D0EA4C069AD0199F70A68D10"><enum>(c)</enum><header>Migration Plan
Developed by FCC and DHS</header>
<paragraph id="idB4D7F29F89D64078BE1427D4CF8093C4"><enum>(1)</enum><header>In
general</header><text>Not later than 6 years after the date of enactment of
this Act, the Federal Communications Commission, in consultation with the
Secretary, the Assistant Secretary, and Federal, State and local public safety
agencies, shall issue a report, detailing the plan for public safety entities
to end their use of radio spectrum above 170 megahertz and below 512 megahertz
and move all use to the radio spectrum licensed to public safety services, in
the 700 megahertz and 800 megahertz bands.</text>
</paragraph><paragraph id="idAE74BB7B847646E3BE8168C7176A5FE9"><enum>(2)</enum><header>Facilitation of
migration</header><text>The Secretary shall make amounts available out of the
maintenance and operation grant program established under section 204 to
facilitate the migration of public safety entity use of the radio spectrum
licensed to public safety services in the 700 megahertz and 800 megahertz bands
in accordance with the plan developed under paragraph (1).</text>
</paragraph></subsection><subsection id="idF3FECD7F00AD4F80BE7AA1C3C8FD1E21"><enum>(d)</enum><header>Recovered
Public Safety Spectrum</header>
<paragraph id="id903E4368706A46EA950652F3F79C3C4D"><enum>(1)</enum><header>Auction</header><text>Not
later than 10 years after the date of enactment of this Act, the paired
electromagnetic spectrum bands of 420–440 megahertz and 450–470 megahertz
recovered as a result of the report and order required under subsection (c)
shall be auctioned off by the Federal Communications Commission through a
system of competitive bidding meeting the requirements of section 309 of the
Communications Act of 1934.</text>
</paragraph><paragraph id="id9DBAE4855678403FB1AC25BC46A18940"><enum>(2)</enum><header>Encouraged use
of certain authority</header><text>In making the recovered spectrum identified
under paragraph (1) available through auction, the Commission is encouraged to
use its authority under sections 303 and 316 of the Act to configure the
spectrum in a manner that increases the value of the recovered spectrum for
commercial use.</text>
</paragraph><paragraph id="idED18F54EB69B4257A9589BAC16FFF888"><enum>(3)</enum><header>Proceeds</header><text>Notwithstanding
any other provision of law, all proceeds (including deposits and upfront
payments from successful bidders) from the auction required under this
subsection shall be deposited in the Treasury in accordance with chapter 33 of
title 31, United States Code.</text>
</paragraph></subsection></section><section id="id6BDD870C7E844DCBA88B8BCA69D00055"><enum>208.</enum><header>Extension of
auction authority and assurance of open auctions</header>
<subsection id="id83A5FD47ED3F49E5AAC1AB9F882B7A47"><enum>(a)</enum><header>Extension of
auction authority</header><text>Section 309(j)(11) of the Communications Act of
1934 (47 U.S.C. 309(j)(11)) is amended by striking <quote>2012</quote> and
inserting <quote>2020</quote>.</text>
</subsection><subsection id="idCF30AFFE927441DAA0FF2B20C6C23B74"><enum>(b)</enum><header>Eligibility</header><text>The
Commission shall ensure that no bidder is deemed ineligible for or otherwise
excluded from an auction specified in this Act, or any other competitive
bidding process under section 309(j) of the Communications Act, on account of
its size or amount of its other spectrum holdings.</text>
</subsection></section><section id="id2F85C86AA22A42BFBF936501E6B9E460"><enum>209.</enum><header>Report on
efficient use of public safety spectrum</header><text display-inline="no-display-inline">Not later than 3 years after the date of
enactment of this Act and every 3 years thereafter, the Federal Communications
Commission shall conduct a study and submit to the appropriate committees of
Congress a report—</text>
<paragraph id="id7CB41FD0975E4D3CA0B374589E4CCEA1"><enum>(1)</enum><text>on the spectrum
held by the public safety broadband licensee;</text>
</paragraph><paragraph id="idAFEF3E2C56A441B480239FB7BE4628E3"><enum>(2)</enum><text>on how
efficiently such spectrum is being used; and</text>
</paragraph><paragraph id="id7C56A704A5F640948807CB0E292AC987"><enum>(3)</enum><text>that provide a
recommendation for whether more spectrum needs to be made available to meet the
needs of public safety entities.</text>
</paragraph></section><section id="id6A4F54339CBC4CA8B11C8E2D6A71607B"><enum>210.</enum><header>Report on
long-term interoperability using IP-based solutions</header><text display-inline="no-display-inline">Not later than 2 years after the date of
enactment of this Act, the Federal Communications Commission, in consultation
with the Secretary of Homeland Security and the Assistant Secretary, shall
issue a report and order, after allowing time for notice and comment, including
comment from public safety users, and submit such report the appropriate
committees of Congress, on whether Internet Protocol-enabled solutions could
aid interoperability.</text>
